In a nutshell, both projects may create significant adverse impacts to. the State Highway System (SHS) that are of regional and area-wide significance. Therefore, if formal applications are submitted for these projects, traffic impact studies, which contain project specific and cumulative mitigation measures to the SHS should be required. The project applications should not be considered complete until acceptable traffic impact studies are included into the project. Our comments are as follows: Potential transportation/traffic impacts; mitigation requested: • The proposed project will generate a total of approximately 6,230 average daily trips ends and 658 peak hour trip ends (ITE Trip Generation). Based on the anticipated traffic volumes, the proposed project may generate potentially significant traffic impacts to SR 70 and 162. • Therefore, a Traffic Impact Study (TIS), which contains appropriate mitigation measures should be provided for in the environmental document prepared for the project in accordance with the Guide for the Preparation of Traffic Impact Studies updated December 2002 and the 2000 update to the Highway Capacity Manual with refinements for District 3 that are identified below. A copy of the guide can be downloaded at: http://www.dot.ca.gov/hq/traffops/developsery/operationalsystems/reports/tis uide.pdf. • Before the TIS is prepared, trip distribution and background traffic assumptions should be discussed with the County of Butte, the City of Oroville, BCAG, Caltrans, and the consultant performing the analysis. Therefore, we request that an informal scoping meeting be conducted prior to preparation of the TIS. "Caltrans improves mobility across California" 13 Mr. Mark Michelena May 8, 2006 Page 2 1I • The TIS should include the following: ■ Trip generation, distribution, and assignment for both AM and PM peak-hour volume data, and Level of Service analysis for the intersections of SR 70/Ophir Road, SR 162/Lincoln Boulevard, SR 162/Myers Street, and SR 162/Lower Wyandotte Road for the following scenarios: • Existing Conditions: current year based on recent traffic counts. • Existing Conditions Plus Proposed Project. • Cumulative Conditions Without the Proposed Project. • Cumulative Conditions Plus Proposed Project at the various project phases. ■ Traffic signal warrants analysis: Traffic signals and stop sign warrants should be analyzed using the 2003 MUTCD and the 2003 MUTCD California Supplement. Intersection lighting is still analyzed based on Chapter 9 of the Traffic Manual. The minimum signal design life should be assumed to be five years. Therefore, if warrants are met or projected to meet, the LOS provided by the traffic signal five years after it had been in operation would still need;to be at an acceptable level. ■ Traffic volumes: Traffic volume data from other TISs prepared for other projects that are located in the vicinity of this project and currently being processed by both Butte County and the City of Oroville may be able to provide traffic volume data. Traffic counts should be taken while school is in session. ■ Trip Distribution: Prior to preparation of the TIS, the traffic consultant should present Caltrans.and Butte County staff with the proposed trip distribution for review and confirmation. Based on our preliminary review, we recommend that daily and peak hour trip distribution scenarios be developed. We would expect to see higher volumes distributed to the north towards Chico, Butte College, and Paradise as well as to the south towards Gridley, Marysville, and Yuba City during the peak hour than for the daily trip distribution. ■ Growth rate assumptions: Growth rate assumptions from the 2004 Transportation Concept Report (TCR) State Route 162 (TCR), the 2000 Transportation Concept Report State Route 70, Butte County, the City of Oroville, and BCAG should be examined before assigning growth rates. The SR 162 TCR for Segment 6 east of SR 70 identifies an average annual daily trip (AADT) growth rate of traffic at 5 percent and identifies the percent of trucks using the facility at 3.6 percent, while the SR 70 TCR for Segments 6 and 7 identifies an AADT growth rate of traffic from 4 to 8 percent and identifies the percent of trucks using the facility at 6 to 7 percent. The growth rate assumptions should be included in the TIS. "Caltrans improves mobility across California" i Mr. Mark Michelena May 8, 2006 Page 3 ■ Future analysis: Future transportation systems assumed for cumulative or build- out conditions should include those improvements, which are in the most current BCAG Regional Transportation Plan. • Intersection LOS and measures of effectiveness: Caltrans District 3 permits a LOS "E" at signalized, urban, low speed intersections provided that this LOS does not: exceed 15 minutes in duration and that the delay at the ramp intersections does not result in queuing on the mainline. We also permit a LOS "D" at high-speed rural intersections provided that this LOS does not exceed 15 minutes in duration. Mitigation measures should be identified where the project would have a significant impact. Caltrans considers the following to be significant impacts: • Off-ramps with vehicle queues that extend into rhe ramp's deceleration area or onto the freeway. • Vehicle queues at intersections that exceed existing turn lane storage. • Project traffic impacts that cause any ramp's merge/diverge LOS to be worse than LOS "D". • Project impacts that cause the freeway or intersection LOS to deteriorate beyond LOS "D" for freeways and intersections. If LOS is already "E" or "F"; then a quantitative measure of increased queue lengths and delay should be used to determine appropriate mitigation measures. ■ Mitigation measures: Specific improvements or in-lieu fees that can be collected as a proportional fair-share towards the cost of the specific improvements to reduce both project specific and cumulative traffic impacts to the State Highway System to a less than significant level should be identified in the TIS and included in the environmental document that will be prepared for the project. If impact fees will be required for mitigation, then the pro-rata share of the estimated improvements cost and estimated construction dates should be identified. Possible mitigation measures to consider include: • Widening interchange ramps to increase capacity. • Modifying ramp terminal intersections. • Adding auxiliary lanes between interchanges. • Increasing the ramp acceleration or deceleration lane length to improve merge/diverge operations. • Adding signalization and ramp intersection geometric improvements at impacted interchanges. ■ Due to funding constraints for the highway widening interchange project at the SR 70/Ophir Road intersection, it should be assumed that the recent placement of a traffic signal at the SR 70/Georgia Pacific Way intersection would likely be in place for five to ten years. This placement will improve the safety for children who walk to the school facilities in greater Oroville area. Mitigation Monitoring Submittals to Caltrans may be required: • The California Environmental Quality Act (CEQA) and Public Resources Code Sections 21081.4, 21081.6 and 21081.7 mandate that lead agencies provide the California Department of Transportation with information on transportation related mitigation monitoring measures for projects that are of statewide, regional, or area wide significance. If a formal application is submitted for this preapplication; then the project will have impacts that are of regional or area wide significance. The enclosed "Guidelines for Submitting Transportation Information from a Reporting or Monitoring Program to the Department of Transportation" discuss the scope, purpose and legal requirements for mitigation monitoring reporting and submittal, specify the generic content for reports, and explain procedures for the timing, certification and submittal of the required reports. Site Plan Review: • Assembly Bill 857 (2002) requires the State of California to promote specific planning and development objectives including infill development, protection of valuable natural and agricultural resources, and the incorporation of efficient development patterns to the extent infill development is not possible. This preapplication meets very few of these objectives. • We suggest that Butte County require the potential project to be redesigned to include the following "sustainable development" concepts: ■ Placement of housing closer to employment centers or visa versa, so as to promote a jobs and housing balance. The result of such a balance will be a decrease in overall vehicle miles of travel and less traffic congestion. ■ Placement of sidewalks on both sides of the internal roadways, a transit stop, and a bicycle route, lane or path within the project. Providing travel choices can often reduce traffic volumes of motorized vehicles. ■ Placement of a neighborhood center within a portion of the proposed designated open space that combines the appropriate balance of commercial, civic, cultural and recreational uses. The provision requires lead agencies to submit Notices of Preparation (NOPs) to the Governor's Office of Planning and Research when they determine that an environmental impact report will be required to approve a project. The new law also amended PRC Section 21081.7, which now requires that "transportation information resulting from a reporting or monitoring program adopted by a public agency" be submitted to the Department when a project has impacts that are of statewide, regional, or area-wide significance. Mitigation reporting or monitoring programs are required under PRC Section 21081.6 when public agencies include environmental impact mitigation as a condition of project approval. Reporting or monitoring takes place after approval to ensure implementation of the project in accordance with mitigation imposed during the CEQA review process. In addition to the requirements listed above, AB 1807 obligates the Department to provide guidance for public agencies to submit their reporting or monitoring programs. Subject to these requirements, the following guidelines have been adopted by the Department. The District IGR Coordinator will notify the CEQA lead agency in writing about transportation reporting or monitoring submittal requirements in PRC Section 21081.7 during either "early consultation", the Notice of Preparation (NOP) stage, or the Initial Study(IS)phase of the CEQA review process. B. Detailed procedures for the CEQA lead agency to submit transportation reporting or monitoring information to the district should be attached to the district's notification letter. According to the Butte County Local Agency Formation Commission (LAFCO), the El Medio Fire Protection District does not have the resources to provide an acceptable level of fire service to either existing or new residents within the District. A proposed solution to this lack of resources will be required prior to accepting the application. If a proposed solution is accepted, it will be a condition of project approval. Page 1 of 3 cr B. Discussed the concerns of the proposed lot sizes (less than 6,500 square feet). The Planning Division will be reviewing the conflict between the zoning and General Plan regarding minimum lot sizes. C. There was discussion regarding the possibility of doing a Specific Plan for the project area. This determination will need to be worked out with the Butte County Department of Development Services Planning Division. D. Discussed the issue of parklands (Quimby Act). E. Anticipating based on the size of the project and the growth inducing impacts, that the project will most likely require and EIR. F. The County will require a minimum of two points of legal access that meet the Butte County Department of Public Works standards. G. The parcels will need to be in the districts for both Lake Oroville Area Public Utility District and South Feather Water and Power Agency. The County has a Cooperative Agreement procedure that has to be completed for projects that need to annexation into the service districts. (If already in both service districts, see the Department of Environmental Health section Below.) H. Single-Family Residential lots shall be accessed from the interior streets, not from the arterial or collector streets. 2. Public Works (commented that they had insufficient information to comment on.the specific proposed project. Their attached draft conditions are general and what would be required for any subdivision with urban improvements): A. Arterial and access roads will need to be designed to RS-2A standard (curb, gutter and sidewalk)with an 80-foot right-of-way. B. Discussed the possibility of rolled curbs for interior residential streets. C. Substation may impede Oroville's General Plan Arterial designated for the project site. D. Proposed project peak storm run-off can not exceed current peak storm run-off. E. Traffic Study identified a potential pro rata share for a signal light. Note that draft conditions submitted are based on preliminary review and based on plans submitted for the Pre-Development Meeting. The project will be re-evaluated at time of project application submittal. 3. The Departmental of Environmental Health: A. Will require a willing and able to serve letter from LOAPUD and SFWPA. B. Any existing septic systems are to be abandoned under permit and any unused well must be properly marked or abandoned under permit. 4. City of Oroville (Information provided was too vague and conceptual to support the project—see City's attached letter): A. General Plan (City of Oroville) identifies a 40-acre community park on the project site. (see attachment with City comments) B. If project moves forward, a Specific Plan/PUD and EIR are recommended. Thanks. Pred 06-13: 1. The general position of the City is the information provided at this time is too vague and conceptual to support the project, and given the substantial environmental constraints of the property it is questionable whether the densities proposed can be obtained. These constraints include but are not necessarily limited to traffic, steepness of terrain, wetlands, riparian zones, oak woodlands, and Swainson Hawk habitat. The City has discussed the possibility of pulling back the sphere of influence in this area, although no official action has been taken yet. 2. The City is also concerned with making the compatibility findings with surrounding land uses. It may be required to rezone a much larger area, specifically to the north and west in order to not create an island of urban development. This will generate a large growth inducing impact on surrounding properties, specifically with respect to traffic. 3. If however the project moves forward, the city recommends it be filed with a Specific Pan, PD overlay, and EIR so the above constraints can be evaluated. 4. The EIR is important not only to study traffic and other environmental impacts, but to address growth inducing impacts created by the general plan change, sewer and water extensions, and roadway improvements. 5. The project needs to be developed with sufficient active recreation areas, which will likely include several neighborhood parks and several additional pocket parks. Passive recreation areas can be counted towards the overall maximum park space required to meet the Quimby Act. 6. As with all projects the City is concerned with quality, so as part of the specific plan it will be imperative that the applicant provide conceptual elevations, and detailed and thorough design guidelines to control architecture. Pred 06-14: 1. The general position of the City is this is likely a good area for urban development. There are 5/11/2006 Page 2 of 2 environmental and traffic constraints, although with the proper design these could likely be mitigated. 2. Given the size of the project, the City's recommendation would be to have this project filed with a PD overlay and EIR. A specific plan would also be a plus. 3. The City's general plan calls for a 40 acre park somewhere on the property. Given the County's open space requirements for a PD, this area could be split between passive and active recreation areas; 20-25 acres of useable active recreation area which would include at least one sizeable park with ballfields, and several pocket or neighborhood parks. The remainder of the open space should be developed with passive recreation trails that should interconnect the parks and ballfields. 4. The City's general plan calls for a new east-west arterial to connect Lincoln Blvd. with Olive Highway. The City would ask that sufficient right-of-way be preserved for this roadway, and some portion of the roadway be constructed to serve the development. 5. The Oroville Wildlife Area Management Plan (1978) inventoried opportunities and specified general objectives for the area, including plans for construction of recreation-enhancing facilities. According to the DFG, this plan was most recently updated in 1992. Future plans for the Fish Hatchery may include modifications in the operation of the facility which would not be anticipated to affect its recreational uses. PARK TYPES There are seven types of parks in the Planning Area: neighborhood, community, special, regional, and school-related facilities; linear "parks" such as those appropriate for traversing corridors (adjacent to waterways, utility rights-of-way, along ridges or the base of bluffs); and mini-parks. Table 7.10-A identifies and describes the existing and future park and recreation facilities within the Planning Area. (The.category of"future" encompasses sites ranging across a broad spectrum, from those that are owned, to those for which sites are leased, to those which are desired for lease or acquisition.) Table 7.10- A also shows those areas to be preserved as open space that are not planned for development as parks. Neighborhood and community. Neighborhood and community parks are primarily local- serving. Eleven new neighborhood parks, three communi parks, and significant expansion of one community park are proposed as a part of the 1994 General Plan update as described in Table 7.10-A. As their name implies., neighborhood parks, of which there are six in the Planning Area(1994)ranging in size from about two to eight acres, serve their immediate surroundings. Community parks typically serve a population of 10,000 or more and have facilities for all age groups. The two community-sized parks within the Planning Area are Nelson Park (29.6 acres) and Mitchell Park (15.27 acres), which is adjoined by 8.6-acre Harrison Stadium. Many residents are attracted to Nelson and Mitchell parks solely for their sports fields. Because of the heavy use of their sports facilities, these facilities might be functionally considered to be in both the "community parks" and "special facilities" categories. The General Plan Diagram shows expansion of Nelson Park to the west, adding about 54 acres. Special. "Special facilities" is a catch-all category that includes park sites comprised solely of buildings or artifacts of historic interest, specialized sports facilities (stadiums, tennis courts, golf courses), and the municipal auditorium. These facilities are of both local and regional interest. Some of these facilities serve a function similar to neighborhood or community parks. No new "special facilities" are.proposed as part of the 1994 General Plan Update, although the 60-acre River Bend site might be developed in the future as a special facility. Construction Stormwater Permit Based on the project description, it appears that grading or other soil disturbing activities may occur. In order to protect water quality during development activities, appropriate.stormwater pollution controls should be implemented when construction activities occur. If construction activities result in a land disturbance of one or more acres, the project will need to be covered under the General Construction Stormwater Permit (Order No. 99-08-DWQ). The permit requires that a Stormwater Pollution Prevention Plan (SWPPP) be prepared prior to construction activities. The SWPPP is used to identify potential pollutants (such as sediment and earthen materials, chemicals, building materials, etc.) and to describe best management practices that will be employed at the site to eliminate or reduce those pollutants from entering surface waters. The Construction Stormwater Permit is administered by the State Water Resources Control Board (State Board) and the Regional Water Quality Control Boards (Regional Boards). Army Corps of Engineers and State Water Quality Certification The proposed project may require a §404 permit from the U.S. Army Corps of Engineers and §401 Water Quality Certification from the State Board. The Federal §404 Permit is required for activities involving a discharge (such as fill or dredged material) to waters of the United States. "Waters" include wetlands, riparian zones, streambeds, rivers, lakes, and oceans. Typical activities include any modifications to these waters, such as stream crossings, stream bank modifications, filling of wetlands, etc. These projects also require a water quality certification (per Section §401 of the Clean Water Act) verifying that the project does not violate State water quality standards. If required, the §404 permit and water quality certification must be obtained prior to site disturbance. Locate wastewater ponds separate, as required, from areas of residential development.
