Butte County Archaeological Resources Project Review By
The Northeast Information Center(NEIC)
The California Environmental Quality Act (CEQA) is the California State statute that requires the Butte County Department of
Development Services to perform an environmental review on all discretionary land use projects, to identify the significant
environmental impacts of the project and to avoid or mitigate those impacts,if feasible.
Every development project which requires a discretionary governmental approval will require at least some environmental review
pursuant to CEQA, unless an exemption applies. The environmental review required imposes both procedural and substantive
requirements. At a minimum,an initial review of the project and its environmental effects must be conducted. Depending upon the
potential effects, a further and more substantial review may be conducted in the form of an environmental impact report(EIR). A
project may not be approved if feasible alternatives or mitigation measures cannot substantially lessen the significant environmental
effects of the project. At the state level, CEQA requires that public agencies consider the effects of their actions on
historical resources eligible for listing on the California Register of Historical Resources. "Historical resource" refers to
buildings, structures, sites (prehistoric and historic), objects, districts, and all manner of properties containing material
remains of past human life or activity.
The Department of Development Services utilizes the Northeast Information Center (NEIC) of the California Historical
Resources Information System (CHRIS) to identify projects that may have archaeological significance. The CHRIS is a
statewide system for managing information on the full range of historical resources identified in California. This system is
under the authority and direction of the Office of Historic Preservation (OHP), the State Historic Preservation Officer
(SHPO), and the State Historical Resources Commission (SHRC). The Northeast Center of the CHRIS system, located at
California State University, Chico, manages the historical resource records for 11 counties, including Butte County.
The Northeast Information Center will fumi'th a Record Search to Development Services indicating the
archaeological/historical significance and sensitivity of the applicants project area and additionally providing a
recommendation as to whether further archaeologic-al survey is warranted. If further archaeological.survey is required,
the application would be considered incomplete untii the appropriate archaeological survey is completed and reviewed.
The Department of Development Services will forward applicants payment (by check) of $60.00 and relevant project
application information required for the Records Search to NEIC. NEIC will provide the results of the Records Search to
Development Services. Development Services will notify the applicant if further archaeological survey is warranted. The
$60.00 fee does not cover the cost of further archaeological survey work.
If further archaeological survey work is required, Development Services will work with the applicant to see that it is
accomplished, according to set standards, by a qualified archaeologist The applicant shall bear all costs associated with
further archaeological survey work required to continue processing of the planning project application.
THIS FORM MUST BE ACCOMPANIED BY A COPY OF A 7.5' TOPO MAP, WITH THE PROJECT AREA OUTLINED. THIS IS USED
DURING THE REVIEW TO RESEARCH CULTURAL SITES.
The undersigned applicant for the project as identified below has read and understood the Butte County Archaeological
Resources Project Review process and agrees to fund the required Record Search to be provided by NEIC.
Attached is a check for $60.00 made payable to ;he Northeast Information Center for NEIC to perform the Records
Search. Failure of payment to NEIC for this Records Search would result in the planning project application to be

15. This project is projected to have 1765 units. The sizes of the units will vary from roughly 1200
s.f. to 3500 s.f. Sale prices will be adjusted to meet the current market at the time of construction.
Household size is projected to reflect the areas average household size through construction.
19. The project is currently designated as Low Density Residential and will need a General Plan
Amendment to support the mixed use design. The project is currently zoned AR and will be
changed to PUD. It may or may not need a Use Permit to support the time shares and the age
restricted living.
22. The project area will change from generally open space to a residential subdivision.
24. Fugitive dust will be mitigated and Butte County Air Quality Management District's standards
will be adhered to.
26. Currently the land and most of the vicinity is open space. The addition of the project will add
noise and change the current vibration level.

not directly associated with the facility.

33. The surrounding properties consist of custom homes scattered to the north, south, east-and
the Feather Falls Casino to the northwest. There is housing planned on the far side of the Casino
and additional facilities being built by them as well.
We are proposing a residential development that's design will integrate the existing
features of the site. The project will be designed to add to the quality of the Casino facility while
also standing alone as a prestigious age restrictive community. We feel that this area is a good
market to include a condo/timeshare type product, which along with the overall development
would be able to fully use the recreational opportunities available in the area. This project will
prove utility access/capacities for the overall basin/area. Our intention is for this project to act as a
destination point that Butte County can offer to this overall region.of California. See attached
Master Plan for information on land use types, intensity of development and densities.

Re: Pre-Development Review (FRED 06-13) for a mixed-use subdivision (single-family,
multi-family, commercial and open space. Project area is located north of Lower
Wyandotte Road and west of Foothill Boulevard, southeast of Oroville. (APN 079-
230-002, 079-230-003, 079-230-004, 079-230-005 and 079-260-001)
Dear Hampton Development Group, Inc.,
This letter is intended to provide a summary of the information provided in the meeting held
on May 10, 2006, regarding your Tentative Subdivision Map for a mixed-use development
(757 —6,500 square foot Single Family lots; 595 — 3,000 square foot Single Family lots; 360
Multi-family units; 10 acre neighborhood commercial parcel.; and up to 83 acres of open
space).
The following agencies written comments are included with this letter:
1. Butte County Public Works
2. Butte County Fire (CDF) Department
3. Butte County Department of Environmental Health
4. Butte County Agricultural Commissioner
5. City of Oroville
6. Department of Transportation
7. California Regional Water Quality Control Board
8. Butte Local Agency Formation Commission (will be sending)
9. - Pacific Gas and Electric Company
The following is a summary of the comments from the meeting.
1. Planning Division:
A. Discussed the concerns of the proposed lot sizes (less than 6,500 square feet).
The Planning Division will be reviewing the conflict between the zoning and
General Plan regarding minimum lot sizes.

B. There was discussion regarding the possibility of doing a Specific Plan for the
project (and possibly surrounding) area. This determination will need to be
worked out with the Butte County Department of Development Services Planning
Division.
C. Discussed the issue of parklands (Quimby Act).
D. Anticipating based on the size of the project and the growth inducing impacts,
that the project will most likely require and EIR.
E. The parcels are located with the Oroville Urban Reserve Area that restricts
minimum parcel sizes to 10 acres until the area is served by water and sewer.
F. The County will require a minimum of two points of legal access that meet the
Butte County Department of Public Works standards.
G. The parcels will need to be in the districts for both Lake Oroville Area Public
Utility District and South Feather Water and Power Agency. The County has a
Cooperative Agreement procedure that has to be completed for projects that need
to annexation into the service districts. It appears that annexation of the project
parcels will include other parcels.
H. Single-Family Residential lots shall be accessed from the interior streets, not
from the arterial or collector streets.
2. Public Works (commented that they had insufficient information to comment on the
specific proposed project. Their attached draft conditions are general and what would be
required for any subdivision with urban improvements):
A. Arterial and access roads will need to be designed to RS-2A standard (curb,
gutter and sidewalk).
B. Discussed the possibility of rolled curbs for interio residential streets.
C. Prior to submission of application, provide 60-foot wide rights-of-way (minimum
of 2) from property to a publicly maintained road.
D. Drainage:
1. Proposed project peak storm run-off can not exceed current peak storm
run-off.
2. Cannot discharge to different drainage basins.
Note that draft conditions submitted are based on preliminary review and based on plans
submitted for the Pre-Development Meeting. The project will be re-evaluated at time of
project application submittal.
3. Butte County California Department of Forestry:
A. Submitted requirement for community pressurized water systems for the three
types of residential development(attached).
B. The project area is in the State Responsibility Area (SRA)for fire protection and
access to the project will be required during construction.
C. The requiring of fire sprinklers will be determined during project review.
Note that draft conditions submitted are based on preliminary review and based on plans
submitted for the Pre-Development Meeting. The project will be re-evaluated at time of
project application submittal.

4. The Departmental of Environmental Health:
A. Will require a willing and able to serve letter from LOAPUD and SFWPA.
B. Any existing septic systems are to be abandoned ur_der permit and any unused
well must be properly marked or abandoned under permit.
5. The Agricultural Commissioner identified adjacent parcels to the north are under a
Williamson Act Contract and a possible orchard located on a parcel to the northeast. A
300-foot residential dwelling setback may be required along those parcels (Butte County
General Plan, Agricultural Element, Program 2.2).
6. City of Oroville (Information provided was too vague and conceptual to support the
project—see City's attached letter):
A. Issues with density and had environmental concerns.
B. If project moves forward, a Specific Plan, PUD and EIR be required.
C. Concerned about growth inducing impacts.
D. Project will need sufficient recreation areas, inclu&ng neighborhood and pocket
parks, and open space trails.
E. Had concerns with consistency with surrounding d--velopment.
Note that these issues are not exhaustive. During the processing of the actual application,
other issues may arise that could place significant conditions on your project.

recordation of the Final Map. The formation of a CSA or other approved entity will require the
developer to fund the service until the beginning of the first fiscal year in which service charges can
be collected and to agree to an annual maximum service charge to ensure continued operation of the
facilities.

® 18. Provide a traffic study and comply with recommended mitigations.
B. DRAINAGE
® 1. Prior to recordation of the Final Map,a plan for a permanent solution for drainage shall be submitted
to and approved by the Department of Public Works. The drainage plans shall detail existing
drainage conditions and shall specify how drainage waters shall be detained or retained on-site and/
or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall

• provide that there shall be no increase in the peak flow runoff to said channel or facility. If storm

Final Map. The CSA formation process will require the Developer to fund the service until the
beginning of the first fiscal year in which service charges can be collected for the CSA,and agree to
an annual maximum service charge to ensure continued op?ration of the facilities.
® 2. Prior to final improvement inspection by the Department of Public Works, all new drain inlets shall.
be labeled with the county approved drain marker per County Standard S-40. Improvement plans
shall show and/or note the requirements for labeling inlets pursuant to Butte County Standard S-40.
❑ 3. Prior to recordation of the Final Map, establish 100 year flood plain elevations and the lowest floor
elevations for any structures, in accordance with Butte County Code §26-25. Show on the additional
map sheet the elevations(by contours) and the location of an accepted NGVD29(National Geodetic
Vertical Datum of 1929)benchmark and a temporary benchmark on-site.
❑ 4. Prior to, or concurrently with the recordation of the Final Map, pay the applicable drainage fees in
effect at the time of recordation of the Final Map for the L drainage area. (The current fee is now $
/acre.)
® 5. Prior to grading, a Construction Storm Water Permit will be required by the State Water Resources
Control Board if the project results in a disturbance (including clearing, excavation, filling, and
grading)of one or more acres. The Permit must be obtained from the State Water Resources Control
Board prior to construction. If a Construction Storm Water Permit is required, place a note on an
additional map sheet that states: "The development of this Final Map required a construction storm
water permit.Construction activities that result in a land disturbance of less than one acre,but which
are part of a larger common plan of development, also require a permit. Development of individual
lots may require an additional permit(s)."
C. FINAL MAP
® 1. Show all easements of record on the Final Map.
® 2. Prior to or concurrently with the recordation of the Final Map, pay in full any and all delinquent,
current and estimated taxes and assessments as specified in Article 8 of Chapter 4 of Division 2 of
Title 7,of the California Government Code commencing with Section 66492.

I called the developer and asked about the multi residential stuff described in their application.
Gab told me it would be one story condo type units. The fire flows shown in the conditions are
for condos. The residential housing would require less fire flow and the hydrants could be
spaced further apart.
The 595 3000 SF lots would require the following:

Pred 06-13:
1. The general position of the City is the information provided at thistimeis too vague and conceptual to
support the project, and given the substantial environmental constraints of the property it is questionable
whether the densities proposed can be obtained. These constraints include but are not necessarily limited
to traffic, steepness of terrain, wetlands, riparian zones, oak woodlands, and Swainson Hawk habitat. The
City has discussed the possibility of pulling back the sphere of influence in this area, although no official
action has been taken yet.
2. The City is also concerned with making the compatibility findings with surrounding land uses. It may be
required to rezone a much larger area, specifically to the north and west in order to not create an island of
urban development. This will generate a large growth inducing impact on surrounding properties,
specifically with respect to traffic.
3. If however the project moves forward, the city recommends it be filed with a Specific Pan, PD overlay, and
EIR so the above constraints can be evaluated.
4. The EIR is important not only to study traffic and other environmental impacts, but to address growth
inducing impacts created by the general plan change, sewer and water extensions, and roadway
improvements.
5. The project needs to be developed with sufficient active recreation areas, which will likely include several
neighborhood parks and several additional pocket parks. Passive recreation areas can be counted
towards the overall maximum park space required to meet the Quimby Act.
6. As with all projects the City is concerned with quality, so as part of the specific plan it will be imperative that
the applicant provide conceptual elevations, and detailed and thorough design guidelines to control
architecture.
Pred 06-14:
1. The general position of the City is this is likely a good area for urban development. There are

environmental and traffic constraints, although with the proper design these could likely be mitigated.
2. Given the size of the project, the City's recommendation would be to have this project filed with a PD
overlay and EIR. A specific plan would also be a plus.
3. The City's general plan calls for a 40 acre park somewhere on the property. Given the County's open
space requirements for a PD, this area could be split between passive and active recreation areas; 20-25
acres of useable active recreation area which would include at least one sizeable park with ballfields, and
several pocket or neighborhood parks. The remainder of the open space should be developed with
passive recreation trails that should interconnect the parks and ballfields.
4. The City's general plan calls for a new east-west arterial to connect Lincoln Blvd. with Olive Highway. The
City would ask that sufficient right-of-way be preserved for this roadway, and some portion of the roadway
be constructed to serve the development.
5. Again, the City is concerned with quality, so as part of the specific plan or PD overlay it will be imperative
that the applicant provide conceptual elevations, and detailed and thorough design guidelines to control
architecture.

Thank you for the opportunity to review and provide comments on the preapplication for
a proposed subdivision, general plan amendment, and rezone that would include 1,352
single family dwellings, 360 multi-family dwellings, 10.6 acres of commercial
development, and open space on 338.6 acres of property located adjacent to the
Mooretown Rancheria, east of State Route (SR) 70, north of Lower Wyandotte Road,
west of Foothill Boulevard, and south of the City of Oroville. Our comments are as
follows:
Potential transportation/traffic impacts; mitigation requested:
The proposed project will generate a total of approximately 23,289 average daily trip
ends and 2,280 peak hour trip ends (ITE Trip Generation). These average daily and
peak hour trip ends will be lower if a portion of the project's housing includes time-
share and age restricted units. Based on the anticipated traffic volumes, the proposed
project may generate potentially significant traffic impacts to SR 70 and 162.
• Therefore, a Traffic Impact Study (TIS), which contains appropriate mitigation
measures should be provided for in the environmental document prepared for the
project in accordance with the Guide for the Preparation of Traffic Impact Studies
updated December 2002 and the 2000 update to the Highway Capacity Manual with
refinements for District 3 that are identified below. A copy of the guide can be

• Before the TIS is prepared, trip distribution and background traffic assumptions
should be discussed with the County of Butte, the City of Oroville, BCAG, Caltrans,
and the consultant performing the analysis. Therefore, we request that an informal
scoping meeting be conducted prior to preparation of the TIS.
• Because this project entails a general plan amendment, we recommend that the TIS
analyze the following scenarios:
■ Existing Conditions: current year based on recent traffic counts.
■ Proposed Project Only With Select Zone Analysis.
■ General Plan Build-out: City of Oroville and Butte County.
■ General Plan Build-out (City and County) Plus Proposed Project.
• Along with the four scenarios, we also recommend that an Interim Analysis for the
year of project completion be conducted. This analysis should include a discussion of
the proposed schedule for project phasing. The phasing schedule should estimate the
number and type of units to be constructed per year and the total time required to
complete the project. This analysis will help determine when improvements will need
to be constructed.
• The TIS should include the following:
■ Trip generation rates, distribution, and assignment for both AM and PM peak-
hour.
■ Level of Service (LOS) analysis for the interchange ramps and ramp intersections
of SR 70/SR 162, and the intersections of SR 70/Ophir Road, SR 162/Washington
Avenue/Olive Highway, and SR 162/Lower Wyandotte Road. In addition, if there
will be a direct connection from the proposed project to Foothill Boulevard, then
the intersection of SR 162/Foothill Boulevard should also be analyzed. The
analysis should include the individual, not averaged, LOS and traffic volumes
applicable to all intersection road approaches and turn movements.
• Traffic signal warrants analysis: Traffic signals and stop sign warrants should be
analyzed using the 2003 MUTCD and the 2003 MUTCD California Supplement.
Intersection lighting is still analyzed based on Chapter 9 of the Traffic Manual.
The minimum signal design life should be assumed to be five years. Therefore, if
warrants are met or projected to meet, the LOS provided by the traffic signal five
years after it had been in operation would still need to be at an acceptable level.

■ Traffic volumes: Traffic volume data from other TISs prepared for other projects
that are located in the vicinity of this project and currently being processed by both
Butte County and the City of Oroville may be able to provide traffic volume data.
Since there are no school sites proposed with this project, a summary of expected
trips to and from local schools should be identified and traffic counts should be
taken while school is in session.
■ Trip Distribution: Prior to preparation of the TIS, the traffic consultant should
present Caltrans and Butte County staff with the proposed trip distribution for
review and confirmation. Based on our preliminary review, we recommend that
daily and peak hour trip distribution scenarios be developed. We would expect to
see higher volumes distributed to the north towards Chico, Butte College, and
Paradise as well as to the south towards Gridley, Marysville, and Yuba City during
the peak hour than for the daily trip distribution.
■ Growth rate assumptions: Growth rate assumptions from the 2004 Transportation
Concept Report (TCR) State Route 162 (TCR), the 2000 Transportation Concept
Report State Route 70, Butte County, the City of Oroville, and BCAG should be
examined before assigning growth rates. The SR 162 TCR for Segment 6 east of
SR 70 identifies an average annual daily trip (AADT) growth rate of traffic at 5
percent and identifies the percent of trucks using the facility at 3.6 percent, while
the SR 70 TCR for Segments 6 and 7 identifies an AADT growth rate of traffic
from 4 to 8 percent and identifies the percent of trucks using the facility at 6 to 7
percent. The growth rate assumptions should be included in the TIS.
■ Future analysis: Future transportation systems assumed for cumulative or build-
out conditions should include those improvements, which are in the most current
BCAG Regional Transportation Plan.
■ Intersection LOS and measures of effectiveness: Caltrans District 3 permits a LOS
"E" at signalized, urban, low speed intersections provided that this LOS does not
exceed 15 minutes in duration and that the delay at the ramp intersections does not
result in queuing on the mainline. We also permit a LOS "D" at high-speed rural
intersections provided this LOS does not exceed 15 minutes in duration.
■ Mitigation measures should be identified where the project would have a
significant impact. Caltrans considers the following to be significant impacts:
• Off-ramps with vehicle queues that extend into the ramp's deceleration area or
onto the freeway.
• Vehicle queues at intersections that exceed existing turn lane storage.
• Project traffic impacts that cause any ramp's merge/diverge LOS to be worse
than LOS "D".

• Project impacts that cause the freeway or intersection LOS to deteriorate
beyond LOS "D" for freeways and intersections. If LOS is already "E" or "F",
then a quantitative measure of increased queue lengths and delay should be
used to determine appropriate mitigation measures.
■ Mitigation measures: Specific improvements or in-lieu fees that can be collected
as a proportional fair-share towards the cost of the specific improvements to
reduce both project specific and cumulative traffic impacts to the State Highway
System to a less than significant level should be identified in the TIS and included
in the environmental document that will be prepared for the project. If impact fees
will be required for mitigation, then the pro-rata share of the estimated
improvements cost and estimated construction dates should be identified. Possible
mitigation measures to consider include:
• Widening interchange ramps to increase capacity.
• Modifying ramp terminal intersections.
• Adding auxiliary lanes between interchanges.
• Increasing the ramp acceleration or deceleration lane length to improve
merge/diverge operations.
• Adding signalization and ramp intersection geometric improvements at
impacted interchanges.
Mitigation Monitoring Submittals to Caltrans may be required:
• The California Environmental Quality Act (CEQA) and Public Resources Code
Sections 21081.4, 21081.6 and 21081.7 mandate that lead agencies provide the
California Department of Transportation with information on transportation related
mitigation monitoring measures for projects that are of statewide, regional, or area
wide significance. If a formal application is submitted for this preapplication, then the
project will have impacts that are of regional or area wide significance. The enclosed
"Guidelines for Submitting Transportation Information from a Reporting or
Monitoring Program to the Department of Transportation" discuss the scope,
purpose and legal requirements for mitigation monitoring reporting and submittal,
specify the generic content for reports, and explain procedures for the timing,
certification and submittal of the required reports. Therefore, if the project
application is submitted and approved, then the enclosed Mitigation Monitoring
Certification Checklist form must be completed and submitted to our office when the
mitigation measures are approved, and again when they are completed.
Site Plan Review:
• Assembly Bill 857 (2002) requires the State of California to promote specific planning and
development objectives including infill development, protection of valuable natural and

agricultural resources, and the incorporation of efficient development patterns to the extent
infill development is not possible. This preapplication meets very few of these objectives.
• We suggest that Butte County require the potential project to be redesigned to include the
following "sustainable development" concepts:
■ Placement of housing closer to employment centers or vise versa, so as to promote a jobs
and housingbalance. The result of such a balance will be a decrease in over hi
all vehicle
miles of travel and less traffic congestion.
■ Placement of sidewalks on both sides of the internal roadways, a transit stop, and a
bicycle route, lane or path within the project. Providing travel choices can often reduce
traffic volumes of motorized vehicles.
■ Placement of a community center that combines commercial, civic, cultural and
recreational uses. Public places should be designed to encourage the attention and
presence of people at all hours of the day and night.

INFORMATION FROM A REPORTING OR MONITORING
PROGRAM TO THE CALIFORNIA DEPARTMENT OF
TRANSPORTATION (DEPARTMENT)
INTRODUCTION The California Environmental Quality Act(CEQA)as amended on
January 1, 2001, by Assembly Bill (AB) 1807, added a new
provision to Section 21080.4 of the Public Resources Code
(PRC).
The provision requires lead agencies to submit Notices of
Preparation (NOPs) to the Governor's Office of Planning and
Research when they determine that an environmental impact report
will be required to approve a project.
The new law also amended PRC Section 21081.7, which now
requires that "transportation information resulting from a reporting
or monitoring program adopted by a public agency" be submitted
to the Department when a project has impacts that are of statewide,
regional, or area-wide significance.
Mitigation reporting or monitoring programs are required under
PRC Section 21081.6 when public agencies include environmental
impact mitigation as a condition of project approval. Reporting or
monitoring takes place after approval to ensure implementation of
the project in accordance with mitigation imposed during the
CEQA review process.
In addition to the requirements listed above, Ab 1807 obligates the
Department to provide guidance for public agencies to submit their
reporting or monitoring programs. Subject to these requirements,
the following guidelines have been adopted by the Department.

PROCEDURES The following procedures are intended for use by District IGR
Program Managers and Coordinators in directing local lead
agencies to comply with PRC Section 21081.7.
A. The District IGR Coordinator will notify the CEQA lead
agency in writing about transportation reporting or monitoring
submittal requirements in PRC Section 21081.7 during either
"early consultation", the Notice of Preparation (NOP) stage,
or the Initial Study (IS)phase of the CEQA review process.
B. Detailed procedures for the CEQA lead agency to submit
transportation reporting or monitoring information to the
district should be attached to the district's notification letter.
The submittal shall contain the following information:
1. The name, address, and telephone number of the CEQA
lead agency contact who is responsible for the mitigation
reporting or monitoring program (see PRC Section
21081.6[a][1]).
2. The location and custodian of the documents or other
material, which constitute the record of proceedings upon
which the lead agency's decision is based (see PRC
Section 21081.6[x][21).
3. Assurances from the CEQA lead agency that the
Department can obtain copies of the aforementioned
documents and materials, if needed, to clarify details or
resolve issues related to the mitigation adopted (see PRC
Section 21081.7).
4: Detailed information on impact assessment methodologies;
the type of mitigation, specific location, and
implementation schedule for each transportation impact
mitigation measure included in the reporting or monitoring
program (see PRC Section 21081.6[b]). The CEQA lead
agency, at its discretion, may submit the complete
reporting or monitoring program with the required
transportation information highlighted.
5. A certification section which will be signed and dated by
the CEQA lead agency and the Department certifying that
the mitigation measures agreed upon and identified in the
above checklist have been implemented, and all other
reporting requirements have been adhered to, in
accordance with PRC Sections 21081.6 and 21081.7.

C. When the project involves encroachment onto a state
highway, the certification section will be signed by the
District Permit Engineer. The District Permit Engineer will
retain one copy of the mitigation reporting or monitoring
information for the district permit files, and forward the

District IGR Coordinator will forward a copy to the
Department's IGR Program Manager.
D. When the project does not involve encroachment onto a state

Hi Mark:
We are completing our comments for the two subject preapplications and will submit formal
comment letters tomorrow.
In a nutshell, both projects may create significant adverse impacts to the State Highway
System (SHS) that are of regional and area-wide significance.
Therefore, if formal applications are submitted for these projects, traffic impact
studies, which contain project specific and cumulative mitigation measures to the SHS
should be required. The project applications should not be considered complete until
acceptable traffic impact studies are included into the project..
Details on the needed traffic studies as well as additional site design comments will be
included in the letter that will be faxed and mailed to you tomorrow.

We have reviewed the request for comments on PRED 06-13 Lincoln III Subdivision submitted
to our office on 19 April 2006. The applicant, Hampton Development Group, Inc,, proposes to
subdivide 338.6 acres for 1,352�residential dwellings. Please consider the.following .
comments. Al
Construction Stormwater Permit,
Based on the project description, it appears that grading or other soil disturbing activities may
occur. In order to protect water quality during development activities, appropriate stormwater
pollution controls should be implemented when construction activities occur. If construction
activities result in a land disturbance of one or more acres, the project will need to be covered
under the General Construction Stormwater Permit (Order No. 99-08-DWQ). The permit
requires that a Stormwater Pollution Prevention Plan (SWPPP) be prepared prior to
construction activities. The SWPPP is used to identify potential pollutants (such as sediment
and earthen materials, chemicals, building materials, etc.) and to describe best management
practices that will be employed at the site to eliminate or reduce those pollutants from entering
surface waters. The Construction Stormwater Permit is administered by the
State Water Resources Control Board (State Board) and the Regional Water Quality Control
Boards (Regional Boards).
Army Corps of Engineers and State Water Quality Certification
The proposed project may require a §404 permit from the U.S. Army Corps of Engineers and
§401 Water Quality Certification from the State Board. The Federal §404 Permit is required
for activities involving a discharge (such as fill or dredged material) to waters of the United
States. "Waters" include wetlands, riparian zones, streambeds, rivers, lakes, and oceans.
Typical activities include any modifications to these waters, such as stream.,crossings, stream
bank modifications, filling of wetlands, etc. These projects also require a water quality
certification (per Section §401 of the Clean Water Act) verifying that the project does not
violate State water quality standards. If required, the §404 permit and water quality

certification must be obtained prior to site disturbance. The Army Corps of Engineers contact
for Butte County is Mr. Tom Cavanaugh (530) 557-5250. An application for the §401 Water
Quality Certification from the State Board is available from our office.
Isolated wetlands not covered by the federal Clean Water Act
Wetlands not covered by the Clean Water Act are known as "isolated wetlands." Should the
U.S. Army Corps of Engineers determine that isolated wetlands exist at the project site and
should the project impact or have potential to impact the isolated wetlands, a Report of Waste
Discharge and filing fee must be submitted prior to commencing the construction activity. The
Regional Board will consider the provided information and either issue or waive Waste
Discharge Requirements. Failure to obtain waste discharge requirements or a waiver thereof,
when required, may result in enforcement action. Report of Waste Discharge application
forms are available by calling our office at (530) 224-4845.

SUBDIVISION OF PREMISES: When PG&E's Electric or Gas Service Facilities are located on
private property and such private property is subsequently subdivided into separate Premises with
ownership divested to other than Applicant or customer,the subdivider is required to provide PG&E
with adequate rights-of-way satisfactory to PG&E for its existing facilities and to notify property
owners of the subdivided Premises of the existence of the rights-of-way.
When adequate rights-of-way are not granted as a result of the property subdivision,PG&E shall
have the right,upon written notice to Applicant,to discontinue service without obligation or .
liability. The existing owner,Applicant,or customer shall pay to PG&E the total estimated cost of
any required relocation or removal of PG&E's facilities. A new service will be re-established in
accordance with the provisions for new service and the provisions of any other applicable PG&E
rules.
Any relocation or rearrangement of any existing PG&E facilities to accommodate this project will be
at the developers/applicants expense. There shall be no building of structures, or the storage of any
materials allowed over or under any existing PG&E facilities, or inside any easements that exist
which infringe on PG&E's easement rights.

WITH THE FOLLOWING CHECKED CONDITIONS:
A. STREETS
❑ 1. Prior to or concurrently with the recordation of the Parcel/Final Map, provide a
fully executed road maintenance agreement for all non-publicly maintained access
roads on the County approved form. A note shall be placed on a separate
document which is to be recorded concurrently with the map or on an additional
map sheet of the Parcel/Final Map stating: "In accordance with Civil Code
Section 845, maintenance of the road as shown hereon shall be shared by those
properties with a legal interest in it."
❑ 2. All access rights shall be reserved by deed per County Ordinance, offered for
dedication, and depicted on the Parcel/Final Map. For each private access within
the map boundary, place the following note on the Parcel/Final Map: "approved
road name is a non-exclusive easement for ingress, egress, road and public
services purposes, to be reserved in deeds and is hereby offered for dedication to
the County of Butte."
❑ 3. Prior to the recordation of the Parcel/Final Map, demonstrate to the Department of
Public Works that there is approved access conforming to County Code to each
parcel from a publicly maintained road.
❑ 4. Prior to or concurrently with the recordation of the Parcel/Final Map, Deed to
Butte County in fee simple feet of right-of-way from the centerline of
along the entire property frontage. The right-of-way shall be sufficient for the
installation of Improvement Standard No. S-5 at all street intersections.
❑ 5. Prior to or concurrently with the recordation of the Parcel/Final Map, relinquish
abutter's rights of access to Bette County, along the
frontage of parcels , except at approved access points.
❑ 6. Prior to recordation of the Parcel/Final Map, provide street name signs per
requirements of the Department of Public Works. Street names shall be reviewed
by the County Address Coordinator and one name for each new street shall be
recommended to the Board of Supervisors for approval prior to recordation of the
Parcel/Final Map. A minimum of fivelternate names for each new street shall
be submitted.
❑ 7. Prior to final road inspection, install all necessary traffic safety signs including
stop signs. A note shall be placed on a separate document which is to be recorded
concurrently with the map or on an additional map sheet of the Parcel/Final Map
stating: "No public entity shall be responsible for the maintenance of the traffic
safety signs including stop signs. In accordance with Civil Code Section 845,
maintenance of the traffic safety signs shall be shared by those properties with a
legal interest in them."
❑ 8. Prior to recordation of the Parcel/Final Map, obtain an encroachment permit and
improve all new and existing driveway approaches to publicly maintained roads
as specified in the County Improvement Standards and the terms of the
encroachment permit.
❑ 9. Prior to the recordation of the Parcel/Final Map, obtain an encroachment permit
and construct a standard S-18 road approach in accordance with County
Improvement Standards. Adequate sight distance at the intersection of access
road and shall be provided.
❑ 10. Provide a cul-de-sac designed and constructed as specified in the County
Improvement Standards. The Parcel/Final Map shall show the cul-de-sac.
❑ 11. Prior to the recordation of the Final map, construct, or provide a performance
bond and labor and material bond for the construction of, a %z+ 12' / full street
section on to an RS-_geometric standard. Minimum
structural section to be_" AC, and_" AB, prime coat, fog seal and 95 % relative
compaction. Submit design to Land Development Division for approval. "R"
value determination and other data may be required to support the section design
❑ 12. Prior to the recordation of the Final map, construct, or provide a performance

section on to an RS- road standard with curb,

be required to support the section design.
❑ 13. Prior to recordation of the Parcel Map, provide approved access to each parcel
from a County maintained road or from a state highway. Improve parcel
frontage to RS-_ LD-_ and access road to parcel being divided
to RS-_ LD-_. . (If the parcels being created are 5 acres or less in gross area,
submit road and drainage plans to the Department of Public Works for plan
checking and approval prior to construction).
❑ 14. Prior to recordation of the Parcel Map, submit road and drainage improvement
plans for the installation and construction of the street frontage improvements on
to County Improvement Standards. Improve parcel
frontage on to a t/z + 12' / full street section to an RS-
road standard including, but not limited to curb, gutter and sidewalk for parcels
with gross acreage of one acre or less.
❑ 15. Show on the additional map sheet of the ParceLTinal Map a_ ft. building setback

❑ 16. Street lighting shall be provided in accordance with Butte County requirements,
accepted design criteria, and recommendations of Pacific Gas & Electric
Company. If the developer chooses to install the streetlights and pay energy costs
through a County Service Area (CSA), he/she must complete the formation of the
CSA prior to recordation of the Final Map. The CSA formation process will
require the Developer to fund the service until the beginning of the first fiscal year
in which service charges can be collected for the CSA, and agree to an annual
maximum service charge to ensure continued operation of the facilities.
B. DRAINAGE
❑ 1. Prior to recordation of the Parcel/Final Map, a plan for a permanent solution for
drainage shall be submitted to and approved by the Department of Public Works.
The drainage plans shall detail existing drainage conditions and shall specify how
drainage waters shall be detained or retained on- site and/ or conveyed to the

nearest natural or publicly maintained drainage channel or facility and shall
provide that there.shall be no increase in the peak flow runoff to.said channel or
facility.
❑ 2. Prior to final improvement inspection by the Department of Public Works, all new
drain inlets shall be labeled with the county approved drain marker per County
Standard S-40. Improvement plans shall show and/or note the requirements for
labeling inlets pursuant to Butte County Standard S-40.
❑ 3. Prior to recordation of the Parcel/Final Map, establish 100 year flood plain
elevations and the lowest floor elevations for any structures, in accordance with
Butte County Code §26-25. Show on the additional map sheet the elevations (by
contours) and the location of an accepted NGVD29 (National Geodetic Vertical
Datum of 1929)benchmark and a temporary benchmark on-site.
❑ 4. Prior to, or concurrently with the recordation of the Parcel/Final Map, pay the
applicable drainage fees in effect at the time of recordation of the Parcel/Final
Map for the drainage area. (The current fee is now $
/acre.)
❑ 5. Prior to grading, a Construction Storm Water Permit will be required by the State
Water Resources Control Board if the project results in a disturbance (including
clearing, excavation, filling, and grading) of one or more acres. The Permit must

C. PARCEL/FINAL MAP

for facility operations, repair and maintenance.
C. Provide adequate resources to comply with all monitoring

❑ 4. Locate wastewater ponds separate, as required, from areas of residential
development. Meet design requirements for control of mosquitoes and nuisance
insects in the wastewater ponds to the satisfaction of the appropriate Mosquito
and Vector Control District.
❑ 5. If a homeowners association is provided, obtain approval of the By-laws and CC
& Rs by Butte County Environmental Health, and, if required, by the California
State Regional Water Quality Control Board. Approval shall be obtained prior to
recordation of the Final Map.
J. COMMUNITY SEWER SPECIAL NITRATE AREA
❑ 1. In accordance with the Chico Area Nitrate Action Plan, provide for a connection
to the public sewer, if practical and feasible. A determination that connection is
not practical and feasible shall be made with the concurrence of the Central
Valley Regional Water Quality Control Board and the Environmental Health
Division. NOTE: Board staff is currently requiring a density of no greater than
one equivalent residential unit per acre for development on septic tanks where
sewer is not available.
❑ . 2. If connection to a public sewer is not feasible prior to recordation of the Final
Map:
a. Provide the minimum required sewage disposal area as
required by the Butte County Subdivision Ordinance and
the Nitrate Action Plan.
b. In conformance with the City of Chico Sanitary Sewer
Master Plan, dated December 20, 1985, construct dry line
sewer mains to serve the project and ,stubbed out to the
property line to for future public sewer connection.
C. Provide a community services district or other legal
(government) entity adequate to ensure the maintenance of
the dry sewer main and, when necessary, the activated
sewer main.
d. Sign and record sewer and storm drainage agreements for
compliance with the Nitrate Action Plan.
e. Place the following notes on the additional map sheet or
document to be recorded concurrently with the Final Map:
"Butte County permit for the installation of individual
septic systems shall require the construction of sewer
laterals for future public sewer connection." "Lots within
this subdivision are subject to sewage flow restrictions that

f. Provide CC & Rs for the project that specify maximum

Valley Region. Within the CC & Rs, provide for changes

K. SOLID WASTE DISPOSAL PLANS

N. SITE DEVELOPMENT
❑ 1. Prior to the issuance of building permits, the plans, incorporating all applicable
conditions of approval shall be submitted to the Planning Division to verify
compliance with said conditions of approval.
❑ 2. Where a proposed development will have 5 or more mailing addresses, the site
plan shall show the location of centralized marl delivery units. Concrete bases
and the centralized mail delivery units, shall be installed by the developer.
Specifications of the concrete bases and mail delivery units shall be in accordance
with the requirements of Postal Service and the Butte County Department of
Public Works.
O. LANDSCAPING
❑ 1. A Landscape and Lighting Maintenance District, Community Service District,
Homeowners Association, or other alternative entity acceptable to the Planning
Manger, shall be established to maintain landscaping.
❑ 2. A plan of the existing on-site mature trees, located in any area proposed for
buildings and vehicular access, shall be provided to and approved by the Planning
Division prior to the issuance of building permits and/or prior to grading or
vegetation removal. The applicant shall minimize the removal of mature trees,
where possible. A mature tree shall be defined as a tree with a trunk measuring 4
inches in diameter, 4 feet from ground level. Mature trees removed shall be
replaced by planting replacement trees of equal number and not less than
gallon size.
❑ 3. For division of land, where lots of 1 acre or less are created, street trees of not less
than 15-gallon size shall be installed in accordance with Butte County standards
as specified in The street trees shall be planted at an average of one every
30 feet on streets inside the land division and at an average of one every 20 feet
on Circulation Element roads.
❑ 4: All graded slopes, over 5 feet in height, or on slopes greater than %, shall be
seeded, planted, mulched or hydroseeded or otherwise protected to prevent
erosion. A permanent irrigation system shall be installed for non-native
vegetation. A one year Faithful Performance bond shall be posted to guarantee
installation and established growth.
❑ 5. Prior to the commencement of grading and/or construction activity, all individual
or groups of oak trees which are to be retained as part of the project, shall be fully
protected through the use of root protection zones (RPZ). During construction,
RPZs shall be established using protective fencing enclosing an area with a radius
1.5 times the distance from the trunk to the dripline. Within this protective buffer,
no grading, trenching, fill, or vegetation alteration of any kind shall be allowed.
The RPZs shall be maintained after the completion of construction in order to
continue to protect the oak trees, but the fencing shall be removed..
P. FINAL MAPS
❑ 1. Place a note on a separate document which is to be recorded concurrently with the
map or on an additional map sheet which states, "Structures, dumping, fill
material, vegetation removal and/or excavation shall not be allowed within the 50
foot No Disturbance Setback as depicted." The 50 foot "No Disturbance Setback"
shall be measured from the top of bank or outer edge of the riparian vegetation
along Creek, whichever is greater. Limited vegetation
removal necessary for flood control and normal orchard operations is permissible
within the "No Disturbance Setback;" however, all living and thriving native trees
shall be retained and all vegetation removal shall be approved by the Department
of Fish and Game prior to removal.
❑ 2. Place a note on a separate document which is to be recorded concurrently with the
map or on an additional map sheet which states, "Residences constructed on lots
and shall be constructed in a manner to bring the sound levels from
dBA exterior source to 45 dBA interior."
❑ 3. Place a note on a separate document which is to be recorded concurrently with the
map or on an additional map sheet which states, "At the time of building permit
application, if a Deer Herd Impact fee(s) is currently in effect, it shall be paid
prior to the issuance of the building permit."
❑ 4. Place a note on a separate document which is to be recorded concurrently with the
map or on an additional map sheet which states, "Fencing for areas other than
residential areas shall be limited to a maximum of 5 wire strands. The lower
strand shall be at least 16" above the ground and the upper strand shall be no
higher than 48" above the ground."
❑ 5. Prior to the recordation of the Final Map, the applicant shall pay all overdue or
outstanding County fees.
Q. GRADING
❑ 1. Place a note on a separate document which is to be recorded concurrently with the
Final Map or on an additional map sheet stating "During construction, should any
archaeological artifacts be discovered, the Planning Division shall be notified
immediately, and all work shall cease until a qualified archaeologist has examined
the artifacts and the site and submitted his or her findings to the Planning
Division, and recommended clearance to continue. Recommencement of
construction shall be upon the approval of the Planning Division. "Archaeological
artifacts" are defined as follows:
❑ 2. Prior to any clearing, grading and/or construction in a Federal or State identified
100 year floodplain and/or streambed the following entitlements must be
obtained: a California Fish and Game 1604 Streambed Alteration permit and an
Army Corps 404 permit or exemption certificate.
R. ADDITIONAL APPROVALS
❑ 1. This application is approved subject to the conditions contained herein. The
tentative subdivision map on file in the Planning Division identified as Exhibit
"B" and dated —, 20 is incorporated by reference.
❑ 2. All lots are subject to the payment of the North Oroville/Thermalito Traffic
Impact Fees.
❑ 3. The applicant/owner shall sign the CSA 87 Traffic and Drainage Mitigation
Agreement and/or pay the required fee(s) prior to the issuance of building
permits. If the agreement is used it shall be recorded by the applicant prior to the
recordation of the Final Map.
❑ 4. The applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement
prior to the recordation of the Final Map and place a note on the Final Map or

mitigation fee of$750 shall be paid prior to the issuance of a building permit for
each new or additional living unit."
❑ 5. To insure the maintenance and continuance of the orchard or other agricultural
use of the property, all lot owners shall enter into the County approved Orchard
Management Agreement. The agreement shall terminate in 10 years or upon a
rezoning of the parcel/lot to a zone other than A-5 through A-160..The agreement
shall be recorded and recording fees paid by the applicant.
❑ 6. The developer shall display a current County Zoning and County Land Use Map
in the sales office at all times, and/or suitable alternatives.
❑ 7. All sales maps that are distributed or made available to the public shall include
but not be limited to showing future and existing schools, parks, and streets.
❑ 8. The Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of
Chapter 3, Article II of the Butte County Code, prior to the issuance of a building
permit or prior to the issuance of a Use Permit for a Mobile Home Park. The fee
amount shall be determined and calculated as of the date of application for
building permit.
❑ 9. Prior to recordation of the Final Map or application for a building permit, the
applicant shall pay the then-current established fee for the West Chico Fire
Station Fund.
❑ 10. Approval of this request shall not waive the requirement to comply with all
applicable Federal, State, and County laws, ordinances, and regulations in effect

S. FIRE CLEARANCE

Regulations—Public Resources Code 4290, 4291 and current Butte County
Improvement Standards, whichever is stricter.
❑ 2. Prior to construction, a pressurized community water system for fire protection is
required. Bonding may be allowed with the approval of the County Fire Chief.
Average required'hydrant spacing is feet, hydrant size inches, and
residual fire flow of GPM. Fire hydrant identification, road reflectors

Butte County Archaeological Resources Project Review By
The Northe-st Information Center(NEIC)
The California Environmental Quality Act (CEQA) is 'he California State stattr..e that requires the Butte County Department of
Development Services to perform an environmental review on all discretionary land use projects, to identify the significant
environmental impacts of the project and to avoid or mitigate those impacts,if feasible.
Every development project which requires a discretionary governmental approval will require at least some environmental review
pursuant to CEQA, unless an exemption applies. The environmental review required imposes both procedural and substantive
requirements. At a minimum, an initial review of the project and its environmental effects must be conducted. Depending upon the
potential effects, a further and more substantial review may be conducted in the form of an environmental impact report(EIR). A
project may not be approved if feasible alternatives or mitigation measures cannot substantially lessen the significant environmental
effects of the project. At the state level, CEQA requires that public agencies consider the effects of their actions on
historical.resources eligible for listing on the California Register of Historical Resources. 'Historical resource" refers to
buildings, structures, sites (prehistoric and historic), objects, districts, and all manner of properties containing material
remains of past human life or activity.
The .Department of Development Services utilizes the Northeast Information Center (NEIC) of the California Historical
Resources Information System (CHRIS) to identify projects that may have archaeological significance. The CHRIS is a
statewide system for managing information on the full range of historical resources identified in California. This system is
under the authority and direction of the Office of :Historic Preservation (OHP), the State Historic Preservation Officer
(SHPO), and the State Historical Resources Commission(SHRC). The Northeast Center of the CHRIS system, located at
California State University, Chico, manages the historical resource records for 11 counties, including Butte County.
The Northeast Information Center will furnish a Record Search to Development Services indicating the
archaeological/historical significance and sensitivity of the applicants project area and additionally providing a
recommendation as to whether further archaeological survey is warranted. If further archaeological survey is required,
the application would be considered incomplete until the appropriate archaeological survey is completed and reviewed.
The Department of Development Services will forward applicants payment (by check) of $60.00 and relevant project
application information.required for the Records Search to NEIC. NEIC will provide the results of the Records Search to
Development Services. Development Services will notify the applicant if further archaeological survey is warranted. The
$60.00 fee does not cover the cost of further archaeological survey work.
If further archaeological survey work is required, Development Services will work with the applicant to see that it is
accomplished, according to set standards, by a qualified archaeologist The applicant shall bear all costs associated with
further archaeological survey work required to continue processing of the planning project application.
THIS FORM MUST BE ACCOMPANIED BY A COPY OF A 7.5' TOPO MAP, WITH THE PROJECT AREA OUTLINED. THIS IS USED
DURING THE REVIEW TO RESEARCH CULTURAL SITES.

15. This project is projected to have 1765 units. The sizes of the units will vary from roughly 1200
s.f. to 3500 s.f. Sale prices will be adjusted to meet the current market at the time of construction.
Household size is projected to reflect the areas average household size through construction.
19. The project is currently designated as Low Density Residential and will need a General Plan
Amendment to support the mixed use design. The project is currently zoned AR and will be
changed to PUD. It may or may not need a Use Permit to support the time shares and the age
restricted living.
22. The project area will change from generally open space to a residential subdivision.
24. Fugitive dust.will be mitigated and Butte County Air Quality Management District's standards
will be adhered to.
26. Currently the land and most of the vicinity is open space. The addition of the project will add
noise and change the current vibration level.

29. Because the land use is changing from open space to a development of considerable size,
there will be a change in demand for municipal services in the area.

not directly associated with the facility.

33: The surrounding properties consist of custom homes scattered to the north, south, east and
the Feather Falls Casino to the northwest. There is housing planred on the far side of the Casino
and additional facilities being built by them as well.
We are proposing a residential development that's design will integrate the existing
features of the site. The project will be designed to add to the quality of the Casino facility while
also standing alone as a prestigious age restrictive community. We feel that this area is a good
market to include a condo/timeshare type product, which along with the overall development.
would be able to fully use the recreational opportunities available in the area. This project will
prove utility access/capacities for the overall basin/area. Our intention is for this project to act as a
destination point that Butte County can offer to this overall region of California. See attached
Master Plan for information on land use types, intensity.of development and densities.
