To Whom It May Concern: We are proposing the development of the property listed above in the Nelson area into an Agricultural Fertilizer Storage and Distribution Facility. The project is to be located on the 26.49 acre McKnight Ranch parcel at the northeast corner of Nelson Road and the Union Pacific Railroad. The proposed structures on the site would be a 130' x 360' bulk dry fertilizer warehouse with two (2) each attached 34' x 48' load- out enclosures and accessory office with truck scale. Two (2) each free-standing 300,000-gallon liquid fertilizer tanks within a spill containment area are also proposed. Future plans call for a 30,000 square foot chemical warehouse for storage of 1-55 gallon containers of product. The warehouse will have an integral spill containment system designed into its construction. Site improvements will consist of placement of asphalt and concrete paving that will direct drainage to a storm water detention basin that will be monitored for water quality prior to being discharged at a pre- development rate. The Union Pacific Railroad is proposing installation of a branched spur line coming off of the existing rail on the westerly boundary of the parcel. This spur will allow loaded rail cars from the south to be pulled off of the active rail to be unloaded by a conveyor system to the warehouse. Once unloaded by Helena Chemical, Union Pacific will then be scheduled to pickup the empty rail car. Assumed schedule is eight (8) rail cars at two (2) times per week during seasonal application. Fertilizer will then be loaded into Helena owned trailers where they will then be transported to the customers site for application. The parcel is zoned A-40 with a general plan designation of OFC (Orchard and Field Crop) and we understand that both may need to be amended. Originally used as a dairy and livestock production facility, the land was converted in 1976 to rice cultivation where it remains today. Additional rice fields adjoin the property to the northern and southerly directions. Directly to the south across Nelson Road there are a couple of single family residences. The community of Nelson consisting of multiple small residential parcels is separated to the west by the Union Pacific Railroad, drainage ditches and Midway. Butte County Development Services including but not limited to Environmental Health and Public Works, Air Quality Board, Regional Water Quality Board and others. Helena will continue to work closely with many of these agencies and others for their many facilities across the country. The railroad has already been contacted and preparations are in place for the spur line should the project move forward. A phase I environmental study was completed in February by Hanover Environmental Services and determined that there was no cause to proceed with a phase II study. We discussed a future proposal from Helena Chemical Company to locate a fertilizer production company (both liquid and solid) adjacent to the community of Nelson. Representatives from this company has bought land at this location but current GP/Zoning does not support the use (neither does the PLUA). There was also concern that they may be in the 200 year floodplain but I checked this and that does not appear to be the case. We encouraged them to participate in the next Meeting Series, and to request the designation of"Agricultural Services". There are compatibility issues with the residential uses in Nelson, but the reps don't believe they are insurmountable. They are on a tight schedule due to pressure from a parent company and Union Pacific Railroad (who they have negotiated the development of a spur of the UPRR main line). We would like to receive direction on weather a use such as this can be developed without a Use Permit (which, even if they received the Agricultural Services designation would require additional time to process). Also, there are ramifications for the EIR in that this proposal would eliminate a minimum of 10 and possibly up to 26.5 acres of prime ag land. Please let us know your thoughts on the Use Permit as well as accommodating this change later in the process (possibly January) in light of the Draft EIR. Once unloaded by Helena Chemical, Union Pacific will then be scheduled to..pickup the empty rail car. Assumed schedule is eight (8) rail cars at two (2) times per week during seasonal application. Fertilizer will then be loaded into Helena owned trailers where they will then be transported to the customers site for application. The parcel is zoned A-40 with a general plan designation of OFC (Orchard and Field Crop) and we understand that both may need to be amended. Originally used as a dairy and livestock production facility, the land was converted in 1976 to rice cultivation where it remains today. Additional rice fields adjoin the property to the northern and southerly directions. Directly to the south across Nelson Road there are a couple of single family residences.
