Dear Mr. Bashiran:
This letter has been prepared as a follow up to the Pre-Development Meeting held on April 14,
2010. The letter contains information discussed during the meeting.
Discussion Items
Planning Division
1. The future tentative subdivision map will need to be deemed complete prior to the adoption
of the General Plan 2030 update. The future land use designation will require at least 20-acre
size parcels. In order to apply the current zoning (A-10), the project will need to be deemed
complete.
2. If the project is deemed complete prior to the adoption of the General Plan, staff will need to
make the necessary findings of the current Orchard and Field Crops land use designation to
approve 10-acre size parcels.
Environmental Health (Tom Loushine - 538-7281)
1. The first requirement of applying for a tentative subdivision map is to complete a pre-
application process with Environmental Health. This process is prior to submitting the
application to the Planning Division.
2. The Environmental Health representative (Tom Loushine) discussed the initial requirement
of doing profile holes. He suggested doing one profile hole on each proposed lot where the
home sites will be. Home site locations have narrowed down due to comments from the
Agricultural Commissioner(see below).
3. They also discussed the possibility of the need to groundwater monitoring.
4. Discussion of completing the Disclosure Statement of Concurrent Land Project Review
Public Works (Eric Schroth- 538-7266)
1. Discussed the requirements of road standards:
A. Esquon Road— '/2 street+ 12 feet(RS-313)
B. Interior cul-de-sac (RS-3C)
2. When the cul-de-sac was required was discussed. The requirement is that the cul-de-sac will
be either required prior to the map recording, or being bonded and constructed within one-
year after recording the map. If the applicant would like to modify that requirement
(condition), an exception will need to be requested as part of the application. One idea that
was discussed for the exception was requiring at the time of the first building permit for a
residential dwelling served by the cul-de-sac, that the cul-de-sac be built. In order for the
Planning Commission to grant the exception, special justification/support will be required .to
be submitted by the applicant.
3. Need to provide preliminary drainage plans to Public Works.
4. The parcel is located in a flood zone (Flood Zone AE — Map No 06007C0520 C, June 8,
1998).
CalFire/Butte Count
1. No pressurized water required.
2. Road access needs to be in place prior to residential development.
Agricultural Commissioner
The Agricultural Commissioner's office was represented at the meeting, but they did submit a
letter dated March 15, 2010, to Development Services. The letter is attached. In the letter they
discussed the surrounding agricultural and residential surrounding uses. Their recommendation.
included residential building locations and an exhibit that identified agricultural buffer areas.

COMMENTS:
1. Submission of a title report will allow more comprehensive review.
2. Project is located within the Durham-Dayton urban reserve area,which requires installation of curb,
gutter and sidewalk.
A. STREETS
❑ 1. Prior to or concurrently with the recordation of the final map, provide a fully executed road
maintenance agreement for all non-publicly maintained access roads on the county approved form.
A note shall be placed on a separate document which is to be recorded concurrently with the map or
on an additional map sheet of the final map stating: "In accordance with Civil Code Section 845,
maintenance of the road as shown hereon shall be shared by those properties with a legal interest in
it."
® 2. All access rights shall be reserved by deed per county ordinance,offered for dedication,and depicted
on the final map. Place the following note on the final map: "approved road name is a non-
exclusive easement for ingress, egress, road and public services purposes, to be reserved in deeds
and is hereby offered for dedication to the County of Butte."
❑ 3. Prior to the recordation of the final map,provide approved access conforming to county code to each
parcel from a publicly maintained road.
® 4. Prior to or concurrently with the recordation of the final map, deed to Butte County in fee simple 30
feet of right-of-way from the physical centerline of Esqucn Road along the entire property frontage.
The right-of-way shall be sufficient for the installation of county improvement standard S-5 at all
street intersections.
❑ 5. Prior to or concurrently with the recordation of the final reap, relinquish abutter's rights of access to
Butte County along the I frontage of parcels I except at approved access points.
® 6. Prior to recordation of the final map, provide street name signs per requirements of the Department
of Public Works. Street names shall be reviewed by the county address coordinator and one name
for each new street shall be recommended to the Board of Supervisors for approval prior to
recordation of the final map. A minimum of five alte-nate names for each new street shall be
submitted.
® 7. Prior to final road inspection,install all necessary traffic safety signs including stop signs.
® 8. Prior to recordation of the final map, obtain an encroachment permit and improve all new and
existing driveway approaches to publicly maintained roads as specified in the county improvement
standards and the terms of the encroachment permit.
❑ 9. Prior to the recordation of the final map, submit road and drainage improvement plans to the Land
Development Division for the installation of a standard S-181 road approach in accordance with
county improvement standards. Obtain an encroachment permit and construct the road approach
prior to recordation of the final map. Adequate sight distance at the intersection of access road and
shall be provided. Right-of-way required for construction of road approach and roadside drainage
shall be provided.
® 10. Provide a cul-de-sac designed and constructed as specified in the county improvement standards.
The final map shall show the cul-de-sac.

11. Prior to the recordation of the final map, construct or provide a performance bond and labor and
material bond for the construction of a 1/2+12' / full street section on 1 to an RS-' county
improvement standard with I curb,gutter,and sidewalk,I"AC,I"AB, prime coat,fog seal and 95 %
relative compaction. Submit design to the Land Development Division for approval prior to
construction. "R" value determination and other data may be required to support the section design.
Form a zone of benefit or other approved maintenance entity within the county's permanent road
division for operation and maintenance of interior street and stone drain facilities.
® 12. Prior to the recordation of the final map, construct or provide a performance bond and labor and
material bond for the construction of a %+ 12' street section on Esquon Road to an RS-3B county
improvement standard with 3" AC, 12" AB, prime coat, fog seal and 95 % relative compaction.
Construct a full street section on access road to an RS-313 county improvement standard with 3"AC,
12" AB, prime coat, fog seal and 95 % relative compaction. Submit design to the Land
Development Division for approval prior to construction. "R" value determination and other data
may be required to support the section design. Form a zone of benefit or other approved
maintenance entity within the county's permanent road division for operation and maintenance of
interior street and storm drain facilities.
❑ 13. Prior to recordation of the parcel map, provide approved access to each parcel from a county
maintained road or from a state highway. Improve parcel I frontage to RS-1 LD-1 county
improvement standard, I feet wide with " of CL II aggregate base and sealcoat. Improve access
road to parcel being divided to RS-1 LD county improvement standard, feet wide with I"of CL II
aggregate base and I sealcoat. (If the parcels being created are 5 acres or less in gross area, submit
road and drainage plans to the Department of Public Works for plan checking and approval prior to
construction).
❑ 14. Prior to recordation of the parcel map, submit road and drainage improvement plans to the Land
Development Division for the installation and construction of street frontage improvements on ' .
Improve parcel I frontage to a %z+ 12' / full street section on I to an RS-1 county improvement
standard including, but not limited to curb,gutter and sidewalk for parcels with gross acreage of one
acre or less. Constructor provide a performance bond and labor and material bond for the
construction prior to recordation of the parcel map.
® 15. Street lighting shall be provided in accordance with Butte County requirements,accepted design
criteria,and recommendations of Pacific Gas&Electric Company. Where the County has
determined that it is not detrimental to health and safety,the developer may choose to only install
electrical outlets for streetlights. If streetlights are to be installed,the annual energy costs shall be
funded through a county service area(CSA),zone of benefit within a permanent road division
(PRD),or other entity as approved by the public works director. The developer must complete the
formation of the CSA,zone of benefit within a PRD,or other approved entity prior to recordation of
the final map. The formation process will require the developer to fund the service until the
beginning of the first fiscal year in which service charges can be collected and to agree to an annual
maximum service charge to ensure continued operation of the facilities.
❑ 16. Prior to recordation of the final map, construct access to lot ' per Butte County Code 20-136.
Submit design to the Department of Public Works for review and approval prior to construction.
Provide a fully executed road maintenance agreement for all non-publicly maintained access roads
on the county approved form. A note shall be placed on a separate document which is to be recorded
concurrently with the map or on an additional map sheet of the final map stating: "In accordance

❑ 17. Prior to recordation of the final map,construct or provide a performance bond and labor and material
bond for the construction of a landscaping strip within the public right-of-way adjacent to parcels 1.
Submit design to the Land Development Division for approval prior to construction. The developer
must complete the formation of a county service area (CSA), zone of benefit within a permanent
road division (PRD), or other Department of Public Works approved maintenance entity for
landscaping prior to recordation of the final map.The formation process will require the developer to
fund the service until the beginning of the first fiscal year in which service charges can be collected
for the maintenance entity and agree to an annual maxi-num service charge to ensure continued
maintenance of the facilities.
B. DRAINAGE
® 1. Prior to recordation of the final map, a plan for a permanent solution for drainage shall be submitted
to and approved by the Department of Public Works. The drainage plans shall detail existing
drainage conditions and shall specify how drainage waters shall be detained or retained onsite and/
or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall
provide that there shall be no increase in the peak flow runoff to said channel or facility. If storm
drainage facilities serve new public roads, the developer must complete the formation of a county
service area(CSA),zone of benefit within a permanent road division (PRD),or other Department of
Public Works approved entity prior to recordation of the final map. The formation process will
require the developer to fund the service until the beginning of the first fiscal year in which service
charges can be collected and agree to an annual maximum service charge to ensure continued
operation of the facilities.
® 2. Prior to recordation of the final map, submit a hydraulic analysis for review and approval that
demonstrates the development does not adversely affect the base flood elevation in compliance with
county code section 26-23 (a)(3).
® 3. Place a note on a separate document which is to be recorded concurrently with the map or on an
additional map sheet stating: "After adoption of the Central Valley Flood Protection Plan by the
Central Valley Flood Protection Board pursuant to Section 9612 of the Water Code and after the
amendments of the Butte County General Plan and Zoning Ordinance required by Sections 65302.9
and 65860.1 of the Government Code have become effective, Butte County will be prohibited from
approving any discretionary permit or entitlement or any ministerial permit that would result in the
construction of a new residence on any lot or parcel depicted on this map unless the county makes
one of the findings required by Section 65962 of the Government Code regarding flood protection.
Such findings must be based on substantial evidence. It shall be the responsibility of the owner of
the lot or parcel, or the agent of the owner, to provide any and all information requested by the
County in order for the County to be able to make the required findings."
® 4. Prior to recordation of the final map, establish 100 year flood plain elevations and the lowest floor
elevations for any structures, in accordance with Butte County Code§26-25. Show on the additional
map sheet the elevations (by contours)and the location of an accepted NGVD29(National Geodetic
Vertical Datum of 1929)benchmark and a temporary benchmark on-site.
® 5. Prior to final improvement inspection by the Department of Public Works, all new drain inlets shall
be labeled with the county approved drain marker per county standard S-40. Improvement plans
shall show and/or note the requirements for labeling inlets pursuant to county standard S-40.
® 6. Prior to grading, a construction storm water permit will be required by the State Water Resources
Control Board if the project results in a disturbance (including clearing, excavation, filling, and
grading)of one or more acres. The permit must be obtainzd from the State Water Resources Control
Board prior to construction. if a construction storm water permit is required, place a note on an
additional map sheet that states: "The development of this final map required a construction storm
water permit. Construction activities that result in a land disturbance of less than one acre,but which
are part of a larger common plan of development, also require a permit. Development of individual
lots may require an additional permit(s)."
C. FINAL MAP
® I. Show all easements of record on the final map.
® 2. Prior to or concurrently with the recordation of the final map, pay in full any and all delinquent,
current and estimated taxes and assessments as specified in Article 8 of Chapter 4 of Division 2 of
Title 7,of the California Government Code commencing with Section 66492.
® 3. Pay the recording fees in effect at the time the final map and related documents are recorded.
❑ 4. Prior to or concurrently with the recordation of the final map, pay all applicable assessments
established by affected assessment districts, in full.
❑ 5. Place a note on a separate document which is to be recorded concurrently with the map or on an
additional map sheet of the final map regarding I.
® 6. Prior to recordation of the final map, a preliminary soils report or acceptable soils waiver letter
prepared by a registered design professional and based upon adequate testing shall be submitted to
the Department of Public Works Land Development Division and Department of Development
Services Building Division for review and approval.

FD conditions for this project are:
• Pressurized water supply for fire protection is not required. The developer will
install an automatic fire sprinkler system in all new residential structures in
accordance with the National Fire Protection Association standard for the
installation of sprinkler systems in one and two family dwellings and mobile
homes.
• Prior to building construction, provide an all weather access of at least 10 feet
wide and vertical clearance of 15 feet that will allow for ingress and egress and
accommodate a 40,000-pound fire apparatus to wifain 150 feet of any point on all
structures.
I know this was just a pre-development meeting, but this is what conditions would be if submitted
as presented today.

2. Parcels are out side of the Durham community boundary,

4. Adjacent existing agriculture on the north and south boundary.
5. Adjacent extensive residential development on the west boundary of both parcels.
Findino and Review Statement:
There is existing agricultural on both parcels,commercial almond orchards. The parcels are G.P.
designation OFC and do not lie within the Durham community boundary and therefore the project is
subject to the Ag Element requirement for agricultural buffers.The proposed parcels are commensurate
with zoning and will support-the standard 300 ft.buffer with limited residential building areas. The
agricultural buffers must be annotated on the site plan/map,
Adjacent pre-existing residential development(lacking a buffer area) impacts the orchard on most of the
west boundary,No Ag Buffer would be required on west boundary of the project with the exception of
approximately 500 feet at the northern end of the west boundary of parcel -027.The remaining three sides
of the proposed project will require Agricultural buffers. Existing residences on Esquon Road sets the
eastern Ag buffer at—200 ft. The width of Esquon Road can be deducted from the eastern Ag buffer.
Clustering of any proposed residential buildings will reduce the requirement for internal buffers.
Recommendations:
Recommended building locations and Agricultural,Buffer areas are designated on the attached map.

Location
The 64+/- acre project site is located 1/4 mile North of Durham Dayton Highway

(a) Immediately Adjacent Parcels. Twenty-one parcels range in size ranges from 1 to 34.55
acres, averaging 7.3 acres. Seventeen (81%) of the twenty-one parcels are less than 10
acres.
(b) Parcels within '/ Mile Radius from the site. 123 parcels were assessed, ranging in size
from 0.18 to 38.76 acres; averaging 3.99 acres in size. 111 (90%) of the 123 parcels are
less than 10 acres.
(c) Parcels within 2,500 ft. Radius from the site. 235 parcels were assessed, range in size from
0.18 to 92.58, averaging 5.54 acres in size. 204 (87%) of the 235 parcels are less than 10
acres.
(d) Parcels within.l Mile Radius from the site. 507 parcels were assessed, range in size from
0.18 to 304.65, averaging 8.58 acres in size. 431 (85%) of the 507 parcels are less than 10
acres.
Environmental Setting
Vegetation, Topography and Soils
The site is currently an operating orchard with very little slope across the
property. The two parcels are bordered in the center by a 5 acre parcel under a
separate owner. The soil type is Conejo Clay Loam, as per the USDA Web Soil
Survey.
Site Development Improvements
At this time the project is for estate planning purposes only. The owners intend
to continue the orchard crop and have increased the number of trees on the site
recently to increase the yield. Of the existing 64 acres, 17.5 ac are currently
impacted by an existing residential impact (within the 300' buffer area).
Access
The primary access to the project would be provided via Esquon Road.'A 60'
wide easement is necessary to provide access to each of the parcels. Currently
the owners utilize the driveway/road of the interior parcel to access the rear of
the property. A private road in this same location is proposed at such time as the
first building permit is obtained for a residential use.
Drainage
The site will remain unchanged so no additional drainage facilities are required
at this time. If future development of the individual parcels does occur the
private drive will require drainage facilities.
Wastewater Disposal
Each lot within the subdivision will prove adequate capacity for an individual
septic system.

5. Adjacent extensive residential development on the west boundary of both parcels.
Findings and Review Statement:
There is existing agricultural on both parcels, commercial almond orchards. The parcels are G.P.
designation OFC and do not lie within the Durham community boundary and therefore the project is
subject to the Ag Element requirement for agricultural buffers.The proposed parcels are commensurate
with zoning and will support the standard 300 ft. buffer with limited residential building areas. The
agricultural buffers must be annotated on the site plan/map.
Adjacent pre-existing residential development(lacking a buffer area)impacts the orchard on most of the
west boundary.No Ag Buffer would be required on west boundary of the project with the exception of
approximately 500 feet at the northern end of the west boundary of parcel -027. The remaining three sides
of the proposed project will require Agricultural buffers. Existing residences on Esquon Road sets the
eastern Ag buffer at—200 ft. The width of Esquon Road can be deducted from the eastern Ag buffer.
Clustering of any proposed residential buildings will reduce the requirement for internal buffers.
Recommendations:
Recommended building locations and Agricultural.Buffer areas are designated on the attached map.

The Pre-Development Conference is a chance to meet with county staff prior to formally submitting
a development application. After receiving a complete application packet, the Department of

Development Service schedule apre-development, inter-departmental review meeting that
includes the applicant and/or applicant's representative and representatives from the Development
Services Department, Environmental Health Division, Public Works Department, County Fire
Department, and any other agency with applicable interest in the proposed development site. The
purpose of the meeting is to inform the applicant of local,state and/or federal requirements that may
apply to their project. This allows the applicant an advanced opportunity to incorporate those
requirements into the design of the project.
Any direction given shall be preliminary and is subject to further refinement or change as the
application progresses through the formal application process. Following the meeting, the
Department of Development Services shall send a letter to the applicant summarizing what was
discussed, including any additional filing requirements for the formal application.
Please submit the following in preparation for the conference:
• A completed, signed Project Information Form.
• A detailed Project Setting Description (instructions attached).
• Twenty (20) copies of a conceptual site plan.
