After receiving a complete application packet, the Department of Development Services will schedule a pre-development, inter-departmental review meeting that includes the applicant and/or applicant's representative and representatives from the Development Services Department, Environmental Health Division, Public Works Department, County Fire Department,and any other agency with applicable interest in the proposed development site. The purpose of the meeting is to inform:the applicant of local,state and/or federal requirements that may apply to their project. This allows the applicant an advanced opportunity to incorporate those requirements into the design of the project. Any direction given shall be preliminary and is subject to further refinement or change as the application progresses through the formal application process. Following the meeting, the Department of Development Services shall send a letter to the applicant summarizing what was discussed, including any additional filing requirements for the formal application. Please submit the following in preparation for the conference: • A completed, signed Project Information Form. A detailed Project Setting Description(instructions attached). • . The only applicable proposed development schedule would be the approved parcel map of 24 months. Other than that, no schedule exists. 2. This project abuts.the Green Line, and therefore, would require a reduction in the 300' setback in order to develop additional lots. 3. The 5 plus/minus acre site is used for residential purposes only. As it exists today, the home site sits in the southwest corner of the property and covers approximately 37,000 sf. Generally speaking, the land is without any major sloping and the soil conditions are typical of the Durham area of=Jones Avenue. Plants and animals are indigenous to the area and no known cultural, historical or scenic aspects are known to exist. 4. The property that abuts the project site to the north is zoned: A-10 with an OFC general plan designation. There is home site in the southwest corner of said parcel and the parcel appears to be in full agricultural production. The properties to the east of APN 040-180-051 are zoned: PUD with an AR general plan designation. Those properties are all part of the Durham Green PUD. The property to the south is zoned: SR-1 with an AR general plan designation. The home site on the property roughly occupies the westerly one third of the parcel. To the west of Mr. Lorenz' property lies a parcel that is zoned: A-5 with an AR general plan designation. The parcel appears to be in full agricultural production with a home site south and west of the subject parcel. 5. No special studies have been prepared for the project site. Locate wastewater ponds separate, as required, from areas of residential development. Meet design requirements for control of mosquitoes and nuisance insects in the wastewater ponds to the satisfaction of the appropriate Mosquito and Vector Control District. ❑ 5. If a homeowners association is provided, obtain approval of the By-laws and CC & Rs by Butte County Environmental Health, and, if required, by the California State Regional Water Quality Control Board. In accordance with the Chico Area Nitrate Action Plan, provide for a connection to the public sewer, if practical and feasible. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than gallon size. ❑ 3. For division of land, where lots of 1 acre or less are created, street trees of not less than 15-gallon size shall be installed in accordance with Butte County standards as specified in . The street trees shall be planted at an average of one every 30 feet on streets inside the land division and at an average of one every 20 feet on Circulation Element roads. ❑ 4. All graded slopes, over 5 feet in height, or on slopes greater than %, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. ❑ 5. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. P. FINAL MAPS ❑ 1. Place a note on a separate document which is to be recorded concurrently with the map or on an additional map sheet which states, "Structures, dumping, fill material, vegetation removal and/or excavation shall not be allowed within the 50 foot No Disturbance Setback as depicted." The 50 foot "No Disturbance Setback" shall be measured from the top of bank or outer edge of the riparian vegetation along Creek, whichever is greater. Limited vegetation removal necessary for flood control and normal orchard operations is permissible within the "No Disturbance Setback;" however, all living and thriving native trees shall be retained and all vegetation removal shall be approved by the Department of Fish and Game prior to removal. ❑ 2. Place a note on a separate document which is to be recorded concurrently with the map or on an additional map sheet which states, "Residences constructed on lots and shall be constructed in a manner to bring the sound levels from dBA exterior source to 45 dBA interior." ❑ 3. Place a note on a separate document which is to be recorded concurrently with the map or on an additional map sheet which states, "At the time of building permit application, if a Deer Herd Impact fee(s) is currently in effect, it shall be paid prior to the issuance of the building permit." ❑ 4. Place a note on a separate document which is to be recorded concurrently with the map or on an additional map sheet which states, "Fencing for areas other than residential areas shall be limited to a maximum of 5 wire strands. The lower strand shall be at least 16" above the ground and the upper strand shall be no higher than 48" above the ground." ❑ 5. Prior to the recordation of the Final Map, the applicant shall pay all overdue or outstanding County fees. Q. John Lowell Hanley 9/27/2007 Ordinance No.3_ AN ORDINANCE ADDING SECTION 24-286 AND DELETING SECTION 24-285 OF ARTICLE V OF CHAPTER 24 OF THE BUTTE COUNTY CODE The Board of'Supervisors of the County of Butte ordains as follows: Section 1. Article V, Section 24-286 of the Butte County Code is added to read as follows: 24-286 Agricultural Buffer Setback. (a) Purpose. The purpose is to conserve and stabilize agricultural land uses in order to protect d conversion to urban uses and for the following: agricultural lands from encroachment an g (1) To require development to provide land use transitions, setbacks and buffers between urban development and agricultural uses,in.order to reduce interference and conflict. (2) To create development and performance standards designed to protect agricultural uses from urban encroachment conflicts. (3) .To provide a clear delineation between long-term agricultural production lands and city/community areas. (b) Applicability. These requirements are applicable to arras with a general plan land use designation of Grazing and Open Lands (GOL) and Orchard and Field Crop (OFC) and areas abutting those two land use designations along the interior 300 feet of community boundaries and spheres of influence lines in order to protect existing agricultural uses from incompatible use conflicts. A separate exhibit adopted by resolution and as amended illustrates the applicability of this section. The requirements of this section are in addition to other zoning standards. Where there is a conflict, the more restrictive shall apply. Page l of 5 (c) Standards (1)Residential a. Setback. The setback distance for dwellings shall be 300 feet from all property lines. This C istance may be adjusted based upon an Unusual Circumstance Review in subsection(d). b. Alternatives to the above setback requirement may be considered by the Department of Development Services Director (Director), who shall consult with the County Agricultural Commissioner, as follows: 1. The dwellings are proposed in close proximity to each other such that the same practical effect of providing the 300-foot setback is provided. 2. If an existing parcel is of such size and/or shape that :he setback distance identified in subsection (c) is not possible and conditions referenced in subsection (d) do not exist, then the dwelling shall be placed the greatest distance from all relevant property tine(s), or other location that presents the least detriment to agricultural practices on adjacent properties,provided there is no interference with easements, septic systems and/or prior conditions of approval, and considering parcel shape, slope,topography and/or other physical features,. (2) Buffer Guidelines. Buffer guidelines are as adopted by resolution by the Board of Supervisors for the purpose of illustrating buffer requirements for various situations. These guidelines shall be utilized in rendering determinations relating to the required setback. If such guidelines have not been adopted, then the Director's review and consultation with the County Agricultural Commissioner's Office shall serve that purpose. (d) Unusual Circumstance Review. The setback distance identified in subsection (c) shall be reviewed for Unusual Circumstances that may result in an adjustment in the setback distance as Page 2 of 5 identified in subsection (c) above. The setback distance may be adjusted by the Director. The Director shall consult with the Agricultural Commissioner prior to rendering a determination to adjust the setback distance_ An adjustment by the Director shall be based upon an evaluation of the following criteria, as they exist on the subject or surrounding property, provided that such adjustment would not result in a modification to adjacent agricultural practices: (1) Parcel size and shape (2) Location of residence(s) (.3) Infrastructure and other existing uses (4) Natural physical features and topography (5) Other circumstances not specified above. (e) Non-Residential- (reserved) (f) Consultation with Agricultural Commissioner. The Director shall consult with the Agricultural Commissioner on permits (non-discretionary) and projects(discretionary) actions as follows: (1) Permits. Permits shall be reviewed concurrently with the':)uilding permit review process. (2) Projects. Projects shall be reviewed during the project review process. The Director shall consult with the County Agricultural Commissioner prior to rendering a recommendation to the Planning Commission. (g)Determination. (1) Permits (Non-discretionary). The procedure for non-discretionary review by the Director ,t shall be as follows: Page 3 of 5 . a. The Director shall review and render a determination for applicable non-discretionary permits and approvals. b.No hearing is required for any non-discretionary permit reviaw. c. The decision may include permit application modifications to establish consistency with this chapter. (2) Projects (Discretionary). The Planning Commission shall review and render a determination on the Director's recommendation regarding Unusual Circumstances for discretionary actions for which the Planning Commission has authority. If a project requires the Planning Commission to make a recommendation to the Board of Supervisors, then the Board of Supervisors shall render a determination. (h) Review Fee. Applicant shall pay the required review fee for consideration of compliance with this chapter for projects and permits at the time of filing the application in an amount as established by the Board of Supervisors. 24-287---24-289 Reserved. Section 2. Article V, Section 24-285 of the Butte County Code is deleted to read as follows: 24-285 (Deleted) Section 3. Severability. If any provision of this Ordinance or the application thereof to any person or circumstances is for any reason held to be invalid by a court of competent jurisdiction, such provision shall be deemed severable, and the invalidity thereof shall not affect the Page 4 of 5 remaining provisions or other applications of the Ordinance which can be given effect without the invalid provision or application thereof. Section 4. Effective Date and Publication. This Ordinance shall take effect thirty(30) days after the date of its passage. The property is adjacent to the green line and OFC-designated land that appears to be in active agricultural operation, according to the application. So, the ag buffer applies. The 5 acres property is just 292'wide. The ag buffer would need to be substantially reduced or waived entirely in order to approve the map. Staff did not find any unusual circumstances to support the reduction or waiver of the ag buffer. As for the pre-development conference request, Northstar Engineering put together a very thorough package. We did not believe we had new research to provide. My last discussion with project planner Steve Troester was that Steve would call the applicant and offer a refund of fees, since we did not believe we could provide additional information. (If the applicants want to get the item to the decision-makers, irrespective of ag buffers, then we need an application. A pre-development request doesn't get them there.) I am not sure if Steve reached the applicants before his vacation; he'll be back on Monday August 13. Please let me know if I can provide additional assistance. She indicated that he will not likely be available until next week. Another related issue was that the applicant was under the understanding that we were not going to deposit her check and when she was balancing her checkbook, she noticed the check has been deposited. It turns out that Stu has some background information on this property. You had wondered why this and the parcel to the south is a pocket of SR-1. Stu says that there had been an approved tentative subdivision with 9 lots on the two parcels with a cul-de-sac running down the middle. This was approved when the D2N Plan was in process. At the time of the Plan adoption, this property had an approved tentative map on it. For this reason, the property was zoned with SR-1 to account for the map. The applicants did not final the map and it expired. think as submitted, there is no much value in conducting pre-development review. However, if they augment 9/17/2007 Page 2 of 2 itheir application showing proposed house locations, locations of all adjacent houses/structures and a proposal for a reduced buffer distance including a buffer strategy that will give us more information so that they can get additional feedback to include in the Map application if they choose to file one. LAFCo as the authorizing agency for an annexation or formation should be consulted early to allow for a meaningful analysis of the issue prior to County consideration of the development application. This early coordination will allow for the anticipated LAFCo action to be fully integrated into the project review process and should result in the proposal being: A. Fully described in the project description; and B. Fully addressed in the appropriate environmental documents; and C. Circulated to LAFCo for review as an agency with an approval role; and D. Fully integrated into the public hearing process. The absence of this early coordination and failure to address the LAFCo related issues as described will require additional environmental review and related studies at such time an annexation/formation is requested resulting in unnecessary costs and delays. It should be understood that such a request would be reviewed based on state law and local LAFCo policies which are clearly directed at maximizing service efficiencies, minimizing the creation of new governmental entities, limiting urban sprawl and directing new development to areas with existing urban service providers. If the County proposes to create a new County Service Area/Community Service District to provide services to the project, a Municipal Service Review (MSR) and Plan for Services for the CSA/CSD would need to be prepared by the County and reviewed and approved by LAFCo. The MSR would be used to determine what type of services the CSA/CSD is expected to provide and the extent to which it is expected to do so. As an alternative to a CSA/CSD, the County could form a Landscaping and Lighting District or a Benefit Assessment District to provide urban services to the project. These types of districts do not require LAFCo review or approval. 2. The project site abuts parcels that are designated as Orchard and Field Crops. The project has the potential to cause significant impacts to agricultural uses, including the conversion of prime agricultural lands, which needs to be thoroughly addressed in the initial study for the project. 3. If any LAFCo action is required,pursuant to Butte LAFCo Policy 2.13.4. in making the determination whether conversion will adversely impact adjoining prime agricultural, LAFCo will consider the following factors: a. The agricultural/open space significance of the subject and adjacent areas relative to other agricultural/open space lands in the region; b. Applicable provisions of the County's General Plan Agricultural Element, Open Space and Land Use Elements, applicable growth-management policies, or other i statutory provisions designed to protect agriculture or open space. 4. Continued divisions of unincorporated parcels for large lot residential development within, or adjacent to, existing City's Sphere of Influence or established communities such as Durham, does not facilitate the creation of a compact urban form, maximize the use scarce available residential lands or result in the efficient provision of urban type services. These are fundamental issues to LAFCo pursuant to Government Code Section 56000 and will be of consequence if any LAFCo action should be required.
