Street lighting shall. be provided in accordance with Butte County requirements, accepted design criteria, and recommendations of Pacific Gas & Electric Company. If the developer chooses to install the streetlights and pay energy costs through a County Service Area (CSA), he/she must complete the formation of the CSA prior to recordation of the Final Map. The CSA formation process will require the Developer to fund the service until the beginning of the first fiscal year in which service charges can be collected for the CSA, and agree to an annual maximum service clarge to ensure continued operation of the facilities. B. DRAINAGE ❑ 1. Prior to recordation of the Parcel/Final Map, a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall detail existing drainage conditions and shall specify how drainage waters shall be detained or retained on- site and/ or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. ❑ 2. Prior to final improvement inspection by the Department of Public Works, all new drain inlets shall be labeled with the county approved drain marker per County Standard S-40. Improvement plans shall show and/or note the requirements for labeling inlets pursuant to Butte County Standard S-40. ❑ 3. Prior to recordation of the Parcel/Final Map, establish 100 year flood plain elevations and the lowest floor elevations for any structures, in accordance with Butte County Code §26-25. Show on the additional map sheet the elevations (by contours) and the location of an accepted NGVD29 (National Geodetic Vertical Datum of 1929) benchmark and a temporary benchmark on-site. ❑ 4. Prior to, or concurrently with the recordation of the Parcel/Final Map, pay the applicable drainage fees in effect at the time of recordation of the Parcel/Final Map for the drainage area. (The current fee is now $ /acre.) ❑ 5. Prior to grading, a Construction Storm Water Permit will be required by the State Water Resources Control Board if the project results in a disturbance (including clearing, excavation, filling, and grading) of one or more acres. Prior to or concurrently with the recordation of the Parcel/Final Map, pay in full any and all delinquent, current and estimated taxes and assessments as specified in Article 8 of Chanter 4 of Division 2 of Title 7, of the California Government Code commencing with Section 66492. ❑ 3. Association shall have power to construct collective wastewater facilities if individual systems threaten public health or water quality. h. Association shall have power to raise money to do all of the above by dues, liens, service charges or mortgages. i. Association shall have power to do all of the above (except construction of collective systems) by action of Board rather than majority of homeowners. j. Association shall discharge monitoring and maintenance requirements with appropriately qualified personnel (wastewater treatment certificates or registered sanitarian) by contract or its own employees. k. Association shall provide for short and long-term reliability of treatment systems by: i. including reserve leachfield areas. ii. including easements for sewers. iii. including immediate reserve funds for operations until sufficient income is generated by homeowners. iv. contracting for maintenance and monitoring until its own staff is available and qualified. V. constructing required monitoring wells before discharge begins. J. COMMUNITY SEWER SPECIAL NITRATE AREA ❑ 1. Prior to recordation of the final map, in accordance with the Chico Area Nitrate Compliance Plan, provide for a connection to the public sewer, if practical and feasible. The current zoning is AR-5 and is generally surrounded by both small acreage ranches(5-15 acres)as well as a few large acre ranches(200 acre plus).We are proposing to submit a large lot parcel map that we believe is not only a good use of the land but is unique compared to the surrounding subdivisions.You will see that the preliminary layout is very low in density with relation to the surrounding subdivisions as well as with the maximum potential under the current designation. Finally, we believe this project will maintain the historical ranching atmosphere of the area while allowing us to offer small to midsize ranches to prospective buyers. The project ownership is under the name of South Oroville Land Development, LLC. This entity consists of me Pete and John Mastelatto,Mike Hutton and Rich Sutherland. PSDI Items: 1. The proposed project schedule would ideally be the submittal of Tentative Parcel Map by the end of October 2007, having an approved T-Map by spring 2008, approved improvement plans by summer 2008, Site work complete by mid summer 2008 and sales by the end of summer 2008. This schedule will allow prospective buyers to potentially submit for building permits before the end of 2008 hence construction by spring 2009. 2. There are no other permits needed outside the counties jurisdiction. 3. The site is gently rolling to flat with a gradual topography.There are a few seasonal drainages which generally flow north to south crossing Cox Lane. The soils are stabile and will defiantly support potential structures as well as support the density with regards to septic demands(see below and attached). The existing plant species are seasonal grasses and oak along the northern 1/3 and the .norh%vest areas of site of the site. The property has two WAPA transmission lines crossing it from south to north via easement 4. As mention above the surrounding properties are ranches ranging from 5 acres to 500 acres. The following is a brief summary of the comments discussed at the meeting: Planning— 1. The project area has a general plan land use designation of AR(Agricultural Residential - 20 acres consistent/1 to 19 acres conditionally consistent) and is zoned A-5 (Agricultural — 5 acre minimum). Based'on the above information, I completed the following rough table that addresses the number of possible lots: General Plan Zoning AR A-5 Acres 732 732 Lots 36 146 Total 36 146 The acre count in the table above was generated from maps on GIS, which are used for informational purposes only, so number of lots could change slightly. The General Plan will determine the density (allowable number of lots). The Agricultural Residential general plan land use designation has consistent parcels sizes of 20 acres or larger and conditionally consistent parcels sizes of 1 to 19.9 acres. (I have attached the conditionally consistent requirements of Agricultural Residential land use designation) 2. Appears, per the aerial photo, that there are potential wetlands on site. A wetlands survey done by a qualified wetlands specialist would most likely be required for project review (to complete environmental document). 3. The parcel site has a larger amount of oak trees (woodland). It was discussed that a tentative map that identified building site (envelopes) would make it easier to prepare an oak tree survey for areas of disturbance (Access roads and building envelopes). Otherwise an oak tree survey may be required for the entire site. 4. Discussed the required 300 foot agricultural buffer setback for residential dwellings along the eastern and portions of southeastern and western boundaries of APN 027-230-002 and the northern boundary of APN 027-230-110. (see included exhibit) Public Works— 1. Project exceeds requirements of number of lots (20) on a cul-de-sac under Butte County Code 20-133 (attached). The project is creating a circulation issue. Connectivity needs to be provided or an exception needs to be requested for the number of lots and the length (per Cal Fire/Butte County Fire Department regulations—see below) Page 2 of 4 2. Please review the Public Works Department's draft conditions of approval. Note that draft conditions submitted are based on preliminary review and based on plans submitted for the Pre-Development Meeting. The project will be re-evaluated at time of project application submittal. 3. Discussed the possible option of gating the new access road at the northern edge, prior to connecting to Crestmont Court. The applicant stated they would not want to bring additional traffic, other than what would be generated by the project, down to Cox Lane. The County was not supportive of gating the northern access. Cal Fire/Butte County Fire Department would need to comment on this proposal. Environmental Health— 1. Water is an issue (the project is located within our water concern area) -- at least one test well will be required at the pre-application stage. 2. Septic - 6 of 9 test pits showed evidence of possible groundwater intrusion within 5 feet of the surface. 5 of 9 test pits indicated that clay was the predominate soil type. At least one test pit, perc test and groundwater monitoring pipe will be required on each parcel. We suggest more than one on each parcel, particularly in questionable areas such as the flatter parcels. 3. Engineered systems are not yet available. They may be in a year or two. Engineered systems may or may not be a useful tool for the creation of parcels in this particular proposal. 4. You should begin your groundwater monitoring immediately since the season begins Nov. 1. 5. There is available a "disclosure statement" that permits parallel processing with EH and DDS. Cal Fire/Butte County Fire Department — (Please review attachment for details and contact Darren Read at Cal Fire/Butte County Fire Department at 538-7888 to address these issues) 1. The project site is located in the State Responsibility Area and is in a high fire danger zone. 2. Cox lane is considered a dead end road (cul-de-sac) 3. The length of the cul-de-sac exceeds 3 miles from the closest public street intersection (Palermo Honcut Highway & Cox Lane). From the nearest intersection, Cox Lane & Wayne Charles Road (private), the cul-de-sac is approximately 2 miles. These lengths exceed what is allowed under Public Resources Code 4290. PRC 4290 allows the cul-de-sac to be 2,640 feet(one-half mile). Two options proposed: a. The new proposed road north of Cox Lane would need to connect to Crestmont Court. Cox Lane from Palermo Honcut Highway, the new road north to Crestmont, and the connection to Reservoir Road, would need to meet or exceed PRC 4290 standards. (Please contact). b. Cox Lane would need to provide access to Dunstone Road that meets or exceeds PRC 4290 standards. Page 3 of 4 Agricultural Commissioner— 1. Project site is adjacent to Grazing and Open Land (GOL) general plan land use designation. A 300 foot buffer for residential (habitable) structures is required from GOL designation. This early coordination will allow for the anticipated LAFCO action to be fully integrated into the project review process and should result in the proposal being: A. Fully described in the project description; and B. Fully addressed in the appropriate environmental documents; and C. Circulated to LAFCO for review as an agency with an approval role; and. D. Fully integrated into the public hearing process. The absence of this early coordination and failure to address the LAFCO related issues as described will require additional environmental review and related studies at such time an annexation/formation is requested resulting in unnecessary costs and delays. It should be understood that such a request would be reviewed based on state law and local LAFCO policies which are clearly directed at maximizing service efficiencies, minimizing the creation of new governmental entities, limiting urban sprawl and directing new development to areas with existing urban service providers. If the County proposes to create a new County Service Area/Community Service District to provide services to the project, a Municipal Service Review (MSR) and Plan for Services for the CSA/CSD would need to be prepared by the County and reviewed and approved by LAFCO. The MSR would be used to determine what type of services the CSA/CSD is expected to provide and the extent to which it is expected to do so. As an alternative to a CSA/CSD, the County could form a Landscaping and Lighting District or a Benefit Assessment District to provide urban services to the project. These types of districts do not require LAFCO review or approval. 2. The project site is within two tax rate areas, with the difference being that APN 027-230- 110 is located within the Oroville Cemetery District. It appears that proposed Lot 6 would cross a line of assessment, resulting in one parcel being within two tax rate areas. The Butte County Assessor's Office may not allow the recordation of the final map due to Lot 6 being within two TRAs. Comments on this proposal should be obtained from the Assessor's Office. 3. APN 027-230-002 is within the South Feather Water and Power Agency's Sphere of Influence and is adjacent tc•parcels within this district. Annexation into this district will be required in order to provide public irrigation or domestic water to the proposed parcels.
