I would like to be sure all items are set for the Board of Supervisors actions to abandon a portion
of Lincoln Boulevard adjacent to the Glaum property. Please review and comment on the

RESOLUTION GIVING NOTICE OF HEARING
ABANDON A PUBLIC RIGHT OF WAY
LINCOLN BOULEVARD
WHEREAS, this Board has received a request and proposes abandonment of a public right of way
as described below; and
WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of California Streets and Highways
Code (commencing with Section 8320) this Board shall set a date; hour and place for a hearing on the
petition for abandonment.
NOW,THEREFORE,BE IT RESOLVED by the Board of Supervisors:
1. That this board hereby gives notice that at its regular meeting on October 9, 2007, at �0�:310
a.m., in the Board Chambers, Butte County Administration Building, 25 County Center Drive, Oroville
California, a hearing shall be held to hear all persons interested in the abandonment of that certain Lincoln
Boulevard right of way situate in the County of Butte, State of.California, more particularly described as
follows:
The westerly 10 feet as measured at right angles to the westerly line of the following described
parcel.
Being a portion of Lot 147 as said lot is shown on that certain map entitled, "Map of Paxton
Subdivision in the southwest quarter of Section 20, T19N, R4E, M. D. B. & M, Butte County,
California," which map was recorded in the office of the Recorder of the County of Butte, State of
California, April 4, 1923 in Book 8 of Maps at page 50, more particularly described as follows:
BEGINNING at the northeast corner of said Lot 147;
THENCE South 21° 19' 02" East, along the easterly line of said lot, 107.13 feet to the southeast
corner of said lot;
THENCE South 89°41' 58" West, along the southerly line of said lot, 32.14 feet;
THENCE North 21° 19' 02" West, 107.13 feet to the northerly line of said lot;
THENCE North 89° 41' 58" East, along the northerly line of said lot, 32.14 feet to the POINT OF
BEGINNING.
Containing an area of 1071 square feet, more or less.
Reserving therefrom a public services easement, within the herein described property, for the
benefit of Pacific Gas and Electric and SBC California, and their heirs or assigns, and the right at

any time or from time to time to construct, operate, maintain, replace, removal, renewal and enlarge
lines of pipe, conduits, cable wires, poles, lines and other facilities, including access and the right to
keep the property free from inflammable material and wood growth, and otherwise protect the same
from all hazards, in, upon, over and across the portion Lincoln BoulevardLincoln Boulevard right
of way to be abandoned by Resolution.
The above described lands are to be combined with and become a part of those lands as described
in the deed to Thomas W. and Patti E. Glaum as filed for record in Butte County. Official Records
at Serial Number 1998-0016961, and cannot be sold separately. No additional lots or parcels are
created hereby.
2. That a map showing the public right of way to be abandoned is on file in the Office of the Butte
County Department of Public Works, 7 County Center Drive, Oroville, California 95965
3. That at the conclusion of said hearing the Board intends to abandon said public right of way.
4. That this abandonment proceeding is being conducted pursuant to Chapter 3 of Part 3 of Division 9
of the California Streets and'Highways Code (commencing with Section 8320).
5. That this Resolution be posted and published pursuant to the provisions of Chapter3 of Part 3 of
Division 9 of the California Streets and Highways code.

You have notified the District that Mr. Glaum has requested abandonment of the public
rights to a 10' wide strip of the Lincoln Boulevard right of way adjacent to his property at
4780 Lincoln Boulevard.
The District does not have facilities within this 10' strip and has no objections to the
abandonment.

Dear Mr. Edell:
Pacific Gas and Electric Company(PG&E)has been asked to provide comments
related to the proposed subject abandonment.
A check of our plats shows that PG&E owns and operates both underground gas
facilities and overhead electric pole line facilities within close proximity to the area to
be abandoned.
PG&E has no objection to the proposed abandonment provided that a reservation
clause and or a Public Utilities Easement are inserted in the County's Resolution of
Abandonment,Pursuant to the Streets and Highways Code to protect our existing
facilities that extend through the abandonment area.

SUMMARY OF REQUEST:
Abandonment of a portion of the of Lincoln Boulevard right of way adjacent to 4780 Lincoln Boulevard, Oroville
Area. Approval of this request was recommended by the Planning Commission at their August 23, 2007,
meeting. On September 11, 2007, the Board of Supervisors adopted a "RESOLUTION GIVING NOTICE OF
HEARING ON PETITION.TO ABANDON A PUBLIC RIGHT OF WAY", setting a public hearing for FELD
a.m. on October 9, 2007. This hearing has been properly noticed and posted pursuant to Chapter 3 of Part 3 of
Division 9 of the California Streets and Highways Code, commencing with Section 8320. Property is owned in
fee by Butte County and conveyance would be subject to payment of an appropriate amount, for the abandoned
property.
ACTION REQUESTED:
Open the public hearing, if there is no public objection, find the public right of way described in the notice of
hearing and petition is unnecessary for present or prospective public use, and adopt the Resolution Abandoning
the described portion of the Lincoln Boulevard right of way. Authorize Chair to sign the deed subject to payment
for the 0.02 acres adjoining Glaum and payment of recording fees.

WHEREAS, This matter came on regularly for hearing before the Board of Supervisors of the
County of Butte, State of California, on October 9, 2007, in the Board Chambers, Butte County
Administration Building, 25 County Center Drive,Oroville, California; and,
WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the
petition for the abandonment of the public rights of way.in question was duly and regularly given as required
by law; and
WHEREAS, testimony and evidence, both oral and documentary, having been produced at said
hearing, from which said Board now finds that: (1) there is no possibility the proposed abandonment of
these public rights of way may have a significant effect on the environment, and it is-therefore not subject to
the California Environmental Act; (2) the proposed abandonment is in conformance with the Butte County
General Plan; and (3) the public.rights of way in question, as hereinafter described are unnecessary for
present or prospective public use.
NOW,THEREFORE, BE IT RESOLVED by the Board of Supervisors:
1. That the public rights of way situated in the County of Butte, State of California, as
hereinafter more particularly described, are hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9
of the California Streets and Highways code(commencing with Section 8320).
2. That said public rights of way so abandoned are located in the unincorporated area of the
County of Butte, State of California, are identified as Lincoln Boulevard and are more particularly described
as follows:

Pacific Gas and Electric Company(PG&E)has been asked to provide comments
related to the proposed subject abandonment.
A check of our plats shows that PG&E owns and operates both underground gas
facilities and overhead electric pole line facilities within close proximity to the area to
be abandoned.
PG&E has no objection to the proposed abandonment provided that a reservation
clause and or a Public Utilities Easement are inserted in the County's Resolution of
Abandonment,Pursuant to the Streets and Highways Code to protect our existing
facilities that extend through the abandonment area.

A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION FINDING
THAT THE GLAUM ABANDONMENT RA07-0002 IS NOT INCONSISTENT WITH THE
BUTTE COUNTY GENERAL PLAN
WHEREAS, the Planning Commission has considered RA07-0002 for Thomas and Pattie
Glaum, in accordance with the Butte County General Plan and California Government Code 65402,
on Assessor's Parcel Numbers 035-223-010; and
WHEREAS, the Planning Commission has determined an abandonment to be categorically
exempt in accordance with Section 15305 of the California Environmental Quality Act; and
WHEREAS, said abandonment was referred to various affected public and private agencies,
County departments, and referral agencies for review and comments; and
WHEREAS, a public meeting was held on August 23, 2007; and
WHEREAS, the Planning Commission has considered public comments and a report from
the Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission:
I. Finds this project is categorically exempt from the California Environmental Quality
Act (CEQA) provisions under Section 15305. The project parcel complies with
minor alterations in land use limitations in areas with an average slope of less than
twenty percent.
A. Because the project is exempt from the provisions of CEQA, the payment of
fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not
required.
B. The custodian of the record is the Department of Development Services. The
location of the record is 7 County Center Drive, Oroville CA 95965.
II. Report to the Board of Supervisors on the General Plan consistency of the request by
Thomas and Pattie Glaum to abandon the 10-foot right-of-way encumbering the east
10 feet of APN 035-223-010 (Lot 147 of the Paxton Subdivision (Book 8 of Maps,
Page 50).
A. The proposed abandonment does not conflict with any goal or policy of the
Butte County General Plan.
B. The abandonment of the right-of-way will not have an impact because a
public services easement will be reserved for public utilities.

As we discussed, attached is the information packet and request for a Planning Commission
determination of conformance with the General Plan, for the above referenced project.
The Board of Supervisors has agreed, at County expense, to process a request to vacate a 10'
wide strip of the Lincoln Boulevard right of way adjacent to 4780 Lincoln Boulevard (location
map attached for your reference). Attached for your staff's review and further action are plats
delineating the subject area (Parcel 1 on Exhibit A). Letters from the utility companies will be
forthcoming, a copy of our December 18, 2006, request for information letter is included for your
reference.
Please have the proposed abandonment submitted to the Planning Commission at the earliest
opportunity, to be considered in regard to the findings that the project is categorically exempt
from environmental review and the proposed abandonment is in conformance with the Butte
County General Plan. Following Planning Commission action our department will further
process the abandonment with County counsel and the Board of Supervisors. Note that there
may be a public services easement reservation for utilities, however this should not affect the
Planning Commission decision.
Please advise us of the schedule of processing by your department and provide us a copy of the
Planning Commission minutes documenting the Commission's action.

Lincoln Boulevard right of way adjacent to his property at 4780 Lincoln Boulevard(location map
attached for your reference). Please provide written confirmation to this office that your agency
either does not object to the vacation or does not object to the vacation if a public.services
easement as defined in Streets and Highways Code Section 8306 is reserved on your behalf. If
we do not have a response or comments from your office within 30 days of the date of this letter -
we will reserve a public service easement on your behalf.

VACATION(ABANDONMENT) PROCEDURE
Abandonment has historically been used to describe the process used to vacate public interest in
an existing road right of way or utility easement. The vacation process, as setforth in the
California Streets and Highways Code, is used to abandon or vacate portions of public rights of
way (roads, public utility easements, public service easements, drainage easements, etc.) which
are no longer necessary for public purposes. The process Butte County uses is pursuant to the
requirements setforth in the California Streets and Highways Code. Following is the
recommended process for requesting vacation of a public right of way:
1. Contact the Department of Public Works, 7 County Center Drive, Oroville, CA
95965, with a written request for vacation. The request must include a map or plat clearly
showing the area proposed for vacation.
2. The Department of Public Works will provide written response to your request
indicating either support or opposition and requesting the following information should
you choose to pursue your request:
a. Letters from the utility companies (Pacific Gas and Electric, Telephone,
Water, Sewer, Cable) stating they either do not object to the vacation or the will
not object if an easement is reserved for their use. In order to speed up their
response, a map detailing exactly what you propose to vacate should accompany
your written request to each of the utilities.
b. A legal description and plat of the proposed area to be vacated, which
conforms to the map submitted to the utilities. Plats shall be drawn at a legible
scale on an 8 '/2"Xl 1" sheet, suitable for recording.
c. The attached "PETITION FOR VACATION OF PUBLIC HIGHWAY" or
"PETITION FOR VACATION OF PUBLIC UTILITY EASEMENT" with a copy
of the legal description (per item.b above) on page 1 and original signatures and
address information of ten free holders (owners 10 different properties) on page 2
for vacation of a public highway or five free holders (owners of 5 different
properties) for easement vacation. Pursuant to Streets and Highways Code §8321:
in order to vacate a public highway at least two of the required ten petitioners
(free holders) shall be residents of the road district in which some part of the street
or highway proposed to be vacated is situated and shall be taxable therein for j
street or highway purposes; in order to vacate a public utility or public service

easement at least one of the required five petitioners (free holders) shall be a
resident of the township in which the public service easement proposed to be
vacated is situated.
d. A check payable to the County of Butte, for current application fees. The
application fee on the date of this letter is $2,740.10.
e. A separate check payable to the Butte County Recorder, in the amount of
the current filing fee, for filing of the Notice of Determination, if the vacation is
approved. If the vacation is not approved this check will be returned to you. The
filing fee on the date of this letter is $36.00.
3. Once all of the requested information has been received by the Department of
Public Works, we will, within 30 days, review it for completeness and confirm the
signatures on the petition are property owners within the County and .the petition
complies with Streets and Highways Code §8321. For complete applications, Department
of Public Works will file a report with recommendations to be reviewed and considered
by the Planning Commission.
4. If the Planning Commission recommends approval, the results of the Planning
Commission Hearing, file information and Public Works recommendations will be sent to
the Board of Supervisors with a Resolution of Intent to take an action setting a hearing
date of not less than 15 days after the adoption of this Resolution. The public hearing on
your request will commence on the date established by the adopted Resolution of Intent.
At the conclusion of the hearing, if approval is recommended, the Board of Supervisors
will adopt a Resolution of Vacating the street, highway or easement and cause it to be
recorded. Typically the public hearing process through the Planning Commission and
Board.of Supervisors is completed within 90 to 120 days after your application is deemed
complete.

The Board of Supervisors has agreed, at County expense, .to process a request to vacate a 10'
wide strip of the Lincoln Boulevard right of way adjacent to 4780 Lincoln Boulevard (location
map attached for your reference). Attached for your staff's review and further action are plats
delineating the subject area (Parcel 1 on Exhibit A). Letters from the utility companies will be
forthcoming, a copy of our December 18, 2006; request for information letter is included for your
reference.'
Please have the proposed abandonment submitted to the Planning Commissionat the earliest
opportunity, to be considered in regard to the findings that the project is categorically exempt
from environmental review and the proposed abandonment is in conformance with the Butte
1 County General Plan. Following.Planning Commission action 'our department will further
process the abandonment with County counsel and the Board of Supervisors. Note that there .
may be, a public services easement reservation for utilities, however this should not affect the
Planning Commission decision.
Please advise us'of the schedule of processing by your department and provide us a copy of the
Planning Commission minutes documenting the Commission's action.
