Jim Miller, the applicant's representative, was notified by Mark Michelena, Associate Planner, on April 8, 2003, about the need for the title report. On April 8, 2003, I discovered that the project site is subject to a CLCA with a 10-acre minimum parcel size. The requested zoning district and the sizes of the proposed parcels are below the 10-acre minimum parcel size. I spoke on the telephone with Jim Miller on April 9, 2003, regarding the CLCA. He stated that he was aware of the agreement and wanted to know how to get out of it. I briefly explained the normal withdrawal procedure and the immediate withdrawal procedure. I told him that I did not know if we could continue processing these projects knowing that they are not consistent with the CLCA on the project site or if we could condition the project to require withdrawal from the - CLCA prior to recordation of the final map. I will check with Joe Baker, Planning Manager, and county counsel regarding this issue. I also told Mr. Miller that we needed the title report ASAP because we cannot process the project without it. Until the title report is received, the TPM project is deemed incomplete.
