Ron White - (Item determined to be a General Rule Exemption
from environmental review) Rezone from TM-1 (Timber Mountain -

property located on the north side of Wanda Lane at its
intersection with Barry Lane, identified as AP 056-280-042,

Staff said that the request is regarding replacement of condition
2b from a 1984 rezone: "Install a mutual water system under permit
by Dept. of Corporations and Dept. of Environmental Health" with
the following condition: "Prior to recordation of the final map,
the applicant shall meet the requirements of the Butte County
Environmental Health Dept. regarding proof of adequate domestic
water availability. 11 This same request was approved for the
property to the north which was part of the same rezone. This
property is the last piece of property zoned TM-1 which still has
theo i
c nd tion for a mutual water company.
The hearing was opened to the public.
Commissioner Ferguson asked if there is adequate water storage for
fire protection.
Tom Wrinkle, of Sierra West Surveying, said that there is an
approved parcel map on the property and the Fire Dept. conditions
for the parcel map have been met.
Staff noted that in addition to the Fire Dept. conditions for fire
protection, there is a condition on the original rezone to provide
either a storage tank or pools for the Fire Dept.
The hearing was closed.
It was moved by Commissioner Nelson, seconded by Commissioner
Lambert-, and unanimously carried for approval as follows:
A. Find that:
1. The property has received several environmental
evaluations and the removal of the condition and
replacement of it with the below condition does not
represent a significant impact on the environment.
2 . There is no evidence before the County that the project
as revised may have a significant effect on the
environment.

B. Find that the issue of water availability in the Forest Ranch
area has been resolved since the imposition of the condition
in 1984;
C. Find that small private water systems supplying four or fewer

D. Recommend that the Board of Supervisors approve the deletion
of Condition 2b of the Conditional Zoning Agreement on AP 056-
280-043 (Ron White) approved on October 16, 1984, subject to-
adding the following condition:

SITE HISTORY: The property received a rezone approval to TM-
1 on 10/2/84 subject to compliance with several
conditions.
GENERAL PLAN DESIGNATION: Agricultural-Residential
APPLICABLE REGULATIONS: Butte County Code Sections 24-27, 24-28 and
24-29.
COMMENTS RECEIVED:
Butte County Fire/CDF: "The Fire Department does not have objections as long as the other
conditions regarding water remain."

No other comments were received.
Project Discussion:
The applicant is requesting to remove one condition that was added to a 1984 rezone
approval. Condition 2b is worded as follows:
"Install a mutual water system under permit by Department of Corporations and
Department of Environmental Health."
The applicant received approval of a tentative parcel map for four lots on November 18, 1991.
This condition is one of the remaining issues to be resolved prior to recording the map.
Removal of this condition would allow for individual wells to be located on each of the four
parcels. Per Section 24-49 of the Butte County Code, conditions may be removed only by the
Board of Supervisors after a recommendation by the Planning Commission.
ANALYSIS:
Conditions are added to rezones so as to reduce or eliminate potential health, safety and
general welfare conflicts that may occur as a result of a rezone approval. Water availability
was a major issue when the conditional rezone was approved in 1984. A community water
system was required to ensure an adequate and efficient water system. The same request, to
remove this condition from an adjacent ten acre parcel, was approved by the Board of
Supervisors on October 6, 1992. The Board based their decision on a ground water study
conducted by Metcalf and Eddy in 1992. This study indicated that adequate domestic water
supplies are available at deeper aquifers in the range of 700-800 plus feet.
The County Environmental Health Department required standard conditions regarding proof
of water as part of the above mentioned parcel map for this property. Staff requests replacing
the subject condition with the condition added for the adjacent property by the Board of
Supervisors. That condition reads as follows:
"Prior to recordation of the Final Map, the applicant shall meet the requirements of the
Butte County Environmental Health Department regarding proof of adequate domestic
water availability."
Several environmental documents have been prepared for this and adjacent properties. Staff
determined that the removal of this condition will not result in a significant impact on the
environment. Therefore, the request is not subject to CEQA.

Douglas Starr - proposed Negative Declaration regarding
environmental impact and Rezone from TM-5 (Timber Mountain,
5-acre parcels) to TM-1 (Timber Mountain, 1-acre parcels)
located on the south side of Forest Ranch Road, approx. 1/2 mile
southwest from Highway 32, identified as AP 56-26-43, Forest
Ranch.
Laura Tuttle read staff analysis. She added that Commission had been
gi•:en a copy of a memo from Environmental }Health indicating that there
has been a past history of contamination in the Forest Ranch Mutual
Water Supply but that it has not been proved to be sewage oriented and
that the department is not in support of increasing densities because
of the mater supply issue.
Douglas Starr disputed some of the points included in the staff
findings. He said that he has approval from Envircnment.al health and
that they have no objections to the rezone. Mr. Starr also made
reference to policies of the Land Use Element of the General Flan
which ne felt should be taken into consideration in making a decision
regarding this project.
Paul Persons. 18'4 Royal Canyon Drive, Chico, representing the Friends
of Forest Ranch, believes the issue is not of providing affordable
housing in Forest Ranch but that shol.Ad the rezoning proposed be cions
by means of a mitigated negative declaration and that•an EIR should be
done to see the significant adverse impacts which may result from this
change. He also requested that all previous testimony in other
hearings including the Board of Supe-rvisors be made a part of this
record. He said he would like to see a copy of the report Mr. Starr
indicated at a previous hearing would be forwarded from CalTrans. He
further stated that potential impacts need additional study.
Gene Rolls. Forest Ranch. wished to make comments from the fire stand
point. With this residential density there is a significant fire
hazard.
Pill Burch, Frrest. Ranch, was concerned that a redLI tion from 1'f'1-5 to
TM-•1 would be a. precedent setter. Additionally. he was concerned
about excesuive water use, police nrote.ction, and lack of maintained
County roadways.
Howard Snyder, Forest Ranch, believes that Hr. Starr made a fine
approach to the school district after the Board of Supervisors request
for more study and that he is trying to work out a mitigation of the
school problem. This is to be worked out through a $625 fee the
school hopes to levy or through tax money if that measure is
successful in the upcoming election. He feels that before approval of
this project is made information regarding the mitigation of the
school impact should be available.

Commissioner Vercruse indicated that the district is relying on the
current County General Plan which did not anticipate any further
subdivision from TM-5 to TM-1. The district plans to expand current
sites to their capacity which wouldn't apply to Forest P.anch school
because it is already at capacity. A new site would have to be
located or to bus. Also, she doesn't auree with the collection of
fees.
Mr. Snyder reiterated that the mitigation at Forest Ranch is not.
readily apparent from this plan.

increased water usage and feels that a comprehensive study should be
made to determinr- the amount of water needed for the additional lots

Commissioner Vercruse asked staff about discussion at the Eroard level
regarding monies being made available fa- water inventories in the
foothill areas.
Mrs. l:i.rcher indicated that. the Board accepted the crit: pt and that
the money was tied to the Governor 's water bill.
Mr. Rolls indicated that the pumps in the water district are on
restricted water use.
Mr. Willis explained geologically the water situation.
Mr. Starr disputed the testimony of laymen over that of the expertB hr.-�
has hired and the County 's own e;:perts. He said that the school
district has indicated that there is no inpar:t on the school and that
the fire department says there is no impact on fire protection.
Mr. Starr also stated that the properties he proposes to develop have
adequate water. He drilled test wells to insure that.
Mr. Persons further emphasized the need tin his opinion', for an EIR.
Mr. Starr explained his reasoning for doing a conditional rezone
instead of an EIR. 'The EIR would have cost tar less money, but the
money he has agreed to spend to mitiqate certain impacts and benefit
the community is better spent.
Mr. West of the City of Chico stated that he supports the staff
findings.
Chairman Schrader closed the hearing.

Commissioner Behunin expressed his concerns regarding roads, traffic,
police and fire protection, and that this wculd be setting an improper
precedent for that area.
Commissioner Lambert agrees with staff and does not feel it i> a
proper rezone for that area.
Commissioner Vercruse also agrees with staff and feels Forest Ranch is
a small community where a community plan world be appropriate, and if
such a plan were worked on with community input that further growth at
higher densities could be appropriate.
It was moved by Commissioner Vercruse, seconded by Commissioner
Behunin, and unanimomsl•; carried as follows:
A. Note that the requirements o: CEGA have been completed and
considered in making this decision; and
El. Find that the project does not meet the policies of the BtA to
County General Flan, and Butte County Code Sections 24-27, 24-23,
and 24-174• and
C. Deny the proposed rezone from TM-5 to TM-1 on AF 56-28-43,

A. Find that:
1. An Initial Study was completed in ' compliance with the California
Environmental Quality Act.
2. Said Study and comments received thereon identified potentially significant
effects that the project may have had, but:
a. Revisions in the project plans or proposals made by or agreed to by
the applicant would avoid such effects or mitigate such effects to a
point where clearly no significant effects would occur; and
b. There is no evidence before the County that the project as revised
may have a significant effect on the environment.
B. Find that the evidence presented in the 1992 groundwater study prepared by
Metcalf and Eddy indicates that adequate domestic water supplies are available
at deeper aquifers 700-800 plus feet, and that said evidence resolves the water
supply concerns and mitigation measures presented in the 1984 environmental
document prepared for the Rezone.
C. Recommend the Board of Supervisors 'adopt a Negative Declaration with
mitigation measures for property identified as AP 056-360-020 and 021 (Vernon
Koenig); and
D. Recommend that the Board of Supervisors approve the deletion-of Condition 2b
of the Conditional Zoning Agreement on -AP 056-360-020 and 021 (Vernon
Koenig) approved on October 16, 1984, subject to adding the following condition:
1. Prior to Tentative Map approval, adequate proof of stable domestic water
supplies shall be provided. Domestic wells of 800 feet or more in depth
may be required to ensure the adequate supply of domestic water for
residential dwellings.

Staff said they have not had an opportunity to review the document, nor has the Health
Department had an opportunity to review it. _
The hearing was opened to the public.
Tom Wrinkle, Sierra West Surveying, said the hydrologist was present to answer
questions.
Staff requested that this item be continued to August 13, 1992 to allow staff an
opportunity to review the document.
Commissioner Nelson said the Commission has no choice but to continue this hearing.
Bill Bergmann, Hydrologist, said he was retained to do a ground water assessment: He
said he has studied the formation of soil the well penetrates. He felt there was a good
permanent source of water in the area.
Vice-Chairman Lynch asked if the wells would have to be 700 ft. or more?
Mr. Wrinkle said there would be a well sharing agreement note on the final map or for
individual wells if necessary. He said the ten parcels can be served with three wells.
He said the proposal is to have the wells in place prior to the final recordation of the
subdivision map.
Mr. Bergmann said there is no evidence of any problems with the water quality.
Commissioner Matson asked if it was difficult to get water at a deeper level?
Mr. Bergmann said this water was in a different zone at 710 ft. to 800 ft. than the other
wells in the area.
Commissioner Lambert asked if ten wells are dug, would they all be at this level?
Mr. Bergmann said the water would be sufficient at this level, but it is not to say wells
could not be shallower. He said the resource for water is present.
Vice-Chairman Lynch said he would like to read the information before making a
decision and he would like to hear from Environmental Health. He said there also
needs to be a provision for water storage.
Mr. Bergmann said a 5 horse pump should do close to 20-22 GPM. He said once the-
system- is connected to PG&E it should do better.
_ . Staff said the requirement delineated on the Conditional Zoning Agreement is a
mitigation measure and not a condition. Staff said if the Commission is going to remove
this mitigation measure they would have to make certain findings.
Mr. Wrinkle said this was not a long report and should not take long to review. He said
the Commission had all the information needed to make a decision on this request. He
said a continuance will cost the applicant money. He said they are ready to record the
final map.
Mr. Koenig said there is water available and he has proved there is adequate water.
Commissioner Lambert suggested this item be continued to August 13 and that staff
come back with possible mitigation findings for the Commission in the event this request
is approved.
Staff said they would need the time to make the findings.
Mr. Koenig said he is required to have a 30,000 gallon storage tank on-site.

Staff said they had contacted the Department of Corporations on what their duties
include. Staff submitted a memo stating the Dept. of Corporations does no monitoring,
and there is no annual fee, just a one time set up fee.
Commissioner Nelson asked if staff still wanted this condition on the zoning?
Staff said yes, they are still recommending the original condition. Staff said the rezone
to TM-1 in 1984 was approved based on this condition, and that unless there has been
new information that would address and mitigate the concerns of water availability, the
condition should not be removed.
The hearing was opened to the public.
Gorden Shields said there is one well on the property that is deep. He said they have
no objection to Environmental Health inspecting the wells annually. He did not see a
reason to form a corporation that does not monitor the water. . He felt this was
excessive. He said it would cost $10,000 to form a Department of Corporations.
Commissioner Nelson said that drilling wells could cost the same amount.
Mr. Shields said this is not usually a condition on small developments. He would not
be opposed to the Environmental Health Department testing the water yearly and paying
their fees.
Mr. Koenig discussed the fees for the Department of Corporations. He said he is willing
to put in more wells. He said there is good water at this location, but the wells have
to be deep. He said there should not be a problem with the water supply.
Tom Reid, Environmental Health Director, said his department is comfortable with this
project as long as water is proven to be adequate for every lot.
Commissioner Lynch asked Mr. Reid if the water availability problem has been settled
in Forest Ranch since 1984?
Mr. Reid said no, his department still requires proof of adequate water and would
require a well to be drilled before the house is built. He said there are no figures for
the total water supply under the ridge. He said his department looks at each site on an
individual basis.
Commissioner Lambert asked if a Department of Corporations was formed, would the
Department review the availability of water, i.e., whether 10 wells would have an effect
on the water table?
Mr. Reid said he was not sure.
Staff said monitoring of the water system would have to be done by the Environmental
Health Department. -
Mr. Reid said his department would require evidence that private wells could be drilled
on individual parcels and would have adequate water agreements. He said they would
require the same condition as is put on a Parcel Map to "provide evidence that adequate
quantities of domestic water will be available to individual parcels".
Staff said- if this condition is deleted from the Conditional Zoning Agreement, the
Commission needs to make the findings that conditions have improved or changed since
this condition was imposed.
Mr. Koenig said, to the best of his knowledge, there is adequate water with deeper wells.
Commissioner Nelson said he would like a hydrologist report on this property.
Commissioner Lambert said there have been water problems in the Forest Ranch area
and she could not make the findings that the situation has changed.
Commissioner Nelson requested that staff get together with the Environmental Health
Department to help Mr. Koenig.. He said where the subdivision is in a rural area, there
needs to be adequate domestic water.
Staff said this was an environmental determination in 1984 and the Conditional Zoning
Agreement there was a mitigation measure on the project. Staff said it is not only a
question of water availability on this ten acre parcel, but the entire area that was zoned
TM-1. Staff said there is no provision for monitoring and testing of the wells.
Mr. Reid asked if Mr. Koenig would be willing to provide a hydrologic report.

Mr. Koenig said he would not agree to this without knowing the cost.
Commissioner Nelson said he would like to continue this item to allow the applicant time-
to get a report on the water supply.
Mr. Reid said below this subdivision there is another subdivision that did a hydrology
review.
Commissioner Lynch said there are three choices .open to the Commission; maintain
the condition as it is stated, change the number of units served by one well, or drill a-
well for every_ parcel. He was not in favor of changing the number of units served by
one well.
Mr. Koenig-said he has been involved- in well sharing and it has worked in the -past.
Mr. Shields said the last paragraph of Mr. Reid's letter addresses the quantity of water
from 10 wells.
Jim Crain said he has been in Forest Ranch for 24 years and he was not aware of a
water problem or a problem with people sharing a well. He was in favor. of removing
the condition.
Mr. Reid said there is no enforcement process on 4 or fewer parcels. He said his
department would not be involved in services of less than 5 parcels.
Mr. Koenig said the testing and monitoring would be done by a private company.

Commissioner Lynch noted that it takes 800 gallons of water a day to supply a single-
family dwelling.
Staff said if there is new hydrologic information since 1984, staff and the Commission
should have an opportunity to review it.

The Commission waived the reading of the Staff Findings. Staff noted a memo submitted
by the Environmental Health Department on the water issue.
Tom Reid, Environmental Health, said water availability is a concern in this area. He
said it is difficult to develop a community water service company. He said the State does
not encourage small mutual water companies. He said this project would be creating_a
new water company to serve this project.
Staff said at the time of the Starr Rezone, an Environmental Impact Analysis was
prepared with mitigation measures. Staff said the water source and fire protection were
addressed. Staff noted if the condition is removed, the Commission would have to go
back and address the impacts regarding an adequate water supply and fire protection.
Staff said, historically, the Forest Ranch Ridge has not had tremendous water supplies
proven.
.Tom Reid said if the Commission removes this condition, there will be a condition on
the final parcel map to provide adequate water. He said if there was to be a shared well,
it would be by private agreement. He said a shared well for four or fewer parcels, does
not meet the definition of a public water supply. He said he was not aware of a mutual
water company in the Forest Ranch area that would have sufficient water to expand, to
service this project.
Commissioner Nelson said the way he understands it, is the difference between the
condition they have now and the one the applicant is requesting, is whether they are
dealing with the Department of Corporations.
Mr. Reid said the applicant would be dealing with the Department of Corporation with
the existing condition. He said if the condition was changed he would be comfortable
putting a proof of water condition on the map. He said the minimum his department
would ask for are test wells on the property. He said his department would ask for proof
of water prior to the final map being recorded.
Staff questioned how this project differs from any map going through the process today.
Staff said if the County puts the condition on the map at the tentative approval level to
prove water before filing a final map, this is no different than any map that goes through
the County. Staff said at the time of the change from TM-5 to TM-1 there was concern
about domestic water supplies in the Forest Ranch Ridge. Staff asked how did the
concern for water change from 1984 to 1992. Staff said that all of the TM-1 zoning in
this area has this condition on it. Staff said the requirement to provide adequate water
is on all parcel maps now, with or without a Conditional Zoning Agreement.
Mr. Reid said there is the same requirement for proof of water whether the development
is a subdivision or a parcel map for four or fewer parcels.
Staff noted that this condition was the reason for the TM-1 zoning being approved in the
area.
Tom Wrinkle, Sierra West Surveyors, said this condition was not practical for this type
of development. He said the applicant has agreed to put in wells prior to recording the
final map. He said the Fire Department has asked for water storage and this is being
done. He said the applicant did not want to form a mutual water company for this small
development. He said the only- change in the water conditions since 1984 is that the
wells have to be deeper. He said the Department of Corporations charges a yearly fee
of approximately $900.00 to have this under their control and-he did not know what the
Department of Corporations did for the money.
Commissioner Lambert asked what a Geo-Hydraulic report is?
Mr. Wrinkle said it is where a geologist tells he applicant how much water they think is
under the ground and how deep the wells will have to be to reach adequate water.
Commissioner Nelson said they are dealing with the possibility of 10 dwelling units on two
parcels.
Mr. Wrinkle said the difference is whether to have a water company with the Department
of Corporations or private wells. He said the water itself is a separate issue. He said
there will be water either way. He said the Health Department will not let the applicant
record a map without adequate water.
Commissioner Lynch said it was one thing to put 10 wells on 10 lots, test the wells once
at the beginning where they meet the Health Department standards for adequate water,
and then, when the houses are in and everyone is using the water, there is a lack of
adequate water, this could be a problem.
Mr. Wrinkle said just because you deal with the Department of Corporations does not
mean there will be adequate water. Mr. Wrinkle said there are Ordinances in place with
the Health Department that provide minimum standards for wells. Mr. Wrinkle said there
are no guarantees digging a well. He said from his experience in the area, there is
adequate water.
Commissioner Nelson asked what role the Department of Corporations plays?
Staff said the requirement is for a mutual water system, which is controlled under the
Department of Corporations.
Mr. Wrinkle said there will be 30,000 gallons of water storage for fire protection which
will be maintained by the homeowners association. He noted that the subdivision has
been approved.
Mr. Koenig said there have been changes from the time Doug Starr requested this rezone.
He said, originally, this rezone was for three parcels, but we are only dealing with two
parcels at this time. He said the availability of water has been better documented since
the Starr rezone. He said they intend to drill two deep wells. He said as far as the
Department of Corporations is concerned, he did not think they did anything for the fee
they charge.
Commissioner Lambert asked if there would be more wells than the two proposed?
Mr. Koenig said there is an existing well there at this time. He said they are complying
with the Fire Department requirements.
Commissioner Lynch asked if the 30,000 gallons of storage water is going to be available
for domestic use as well as for the Fire Department?
Mr. Koenig said he has talked to the Fire Department about this. He said when they
have everyone's requirements, they will design a system that is agreeable with everyone
concerned.
Commissioner Lynch asked if there is a minimum gallon per minute rate for a well serving
one house, would there be four times the rate for a well serving four houses?
Mr. Reid said yes. He said the department might ask for more than that because of the
competition between houses. Mr. Reid said that once the permits are issued for individual
houses and for sharing agreements on less than 5 lots, the Health Department is no
longer concerned.
Commissioner Nelson asked if the Department of Corporations requires monitor logs on
the water coming out of the wells?
Mr. Reid said the Department of Corporations acts separately from the Health
Department. He was not aware of what services they provide. He said they do ask for
engineering reports and there are conditions for forming the company.
Commissioner Nelson said he could see a one time fee for the company, to process
information, look at logs, and see that there are adequate supplies of water. He said
there should be monitoring on a yearly basis to see that there is adequate water.
Commissioner Lynch asked staff to contact the Department of Corporations and find out

what the water company does.
Commissioner Matson asked if the Regional Water Quality Control Board would be
involved in the quality of the wells?
Mr. Reid said no, the Regional Water Quality Control Board is involved with the quality
of waste water and contamination.
Earl Watson, well driller, said he is not having a problem with getting water from the
wells he has drilled in Forest Ranch.

1. If applicant is not the owner, written authorization by the owner or other proof of agency must
be submitted in order for the applicant to legally sign the: application. Application shall be
considered void if not signed by the owner or legal agent.

3. It is very important that the application include an accurate and complete description of the
property proposed for each requested zone. The applicant will not be processed until we receive
the following information about area(s)to be rezoned:

CONDITIONAL ZONING AGREEMENT
THIS AGREEMENT made this day of , 1993, by and between "First
Party", as identified in item (a) of Exhibit I of this Agreement:, and the COUNTY OF BUTTE, a
political subdivision of the State of California, herein called "Second Party".
WITNESSETH
WHEREAS, First Party is the successor in interest of Douglas Starr and is the owner
of real property, herein call the "Property", which is described as all that certain real property
situated in the County of Butte, State of California more particularly described as: . legal
description attached.
WHEREAS, the County of Butte and Douglas Starr previously entered into a
conditional zoning agreement dated October 2, 1984, recorded as document 84-39802, and
referred to hereafter as the "Conditional Zoning Agreement".
WHEREAS Ron White as the successor in interest f D rr,

County of Butte wish to amend the`Conditional Zoning Agreement by changing a condition
providing that the existing conditions shall apply to the development, and
WHEREAS, a public hearing has been held upon said application before the Board
of Supervisors of the County of Butte, State of California, and after having considered the matter
presented, it has been determined,that such amendment is desirable and must be imposed so
as not to create any problems inimical to the health, safety and the general welfare of the County
Of Butte.
NOW, THEREFORE, IT IS MUTUALLY UNDERSTOOD AND AGREED that:
1. Condition 2b is amended in the Conditional Zoning Agreement to read as
follows:
2b. Prior to recordation of the Final h1ap, the applicant shall meet the
requirements of the Butte County Environmental Health Department

regarding proof of adequate domestic water availability.
2. Notice of violation of provisions of the Conditional Zoning Agreement, as
amended hereby, shall be sent to First Party at 1450 Springfield Drive #89,.Chico, CA 95928.
Any subsequent title holder, any lien holder, or party in possession of the property shall also
receive notice of such violation at their respective addresses if they file with the Clerk of the Board
of Supervisors of Second Parry the address to which the notice is to be sent, with reference to
the Conditional Zoning Agreement as amended.
3. Each and every one of the provisions of the Conditional Zoning Agreement,

as amended, shall bind and inure to the benefit of the successor in interest of each and every
party hereto, in the same manner as if they had herein been expressly named.
4. Except as otherwise provided herein all other provisions of the Conditional
Zoning Agreement shall remain in full force and effect, are hereby re-affirmed as originally stated,
and are binding upon First Parry, Douglas Starr.

The applicant is requesting to remove one condition that was added to a 1984 rezone
approval. Condition 2b is worded as follows:
"Install a mutual water system under permit by Department of Corporations and
Department of Environmental Health."
The applicant received approval of a tentative parcel map for four lots on November 18,
1991. This condition is one of the remaining issues to be resolved prior to recording the
map. Removal of this condition would allow for individual wells to be located on each
of the four parcels. Per Section 24-49 of the Butte County Code, conditions may be
removed only by the Board of Supervisors after a recommendation by the Planning
Commission.
ANALYSIS:
Conditions are added to rezones so as to reduce or eliminate potential health, safety and
general welfare conflicts that may occur as a result of a rezone approval. Water
availability was a major issue when the conditional rezone was approved in 1984. A
community water system was required to ensure an adequate and efficient water system.
The same request, to remove this condition from an adjacent ten acre parcel, was
approved by the Board of Supervisors on October 6, 1992. The Board based their
decision on a ground water study conducted by Metcalf and Eddy in 1992. This study
indicated that adequate domestic water supplies are available at deeper aquifers in the
range of 700-800 plus feet.
The County Environmental Health Department required standard conditions regarding
proof of water as part of the above mentioned parcel map for this property. Staff
requests replacing the subject condition with the condition added for the adjacent
property by the Board of Supervisors. That condition reads as follows:
"Prior to recordation of the Final Map, the applicant shall meet the requirements
of the Butte County Environmental Health Department regarding proof of
adequate domestic water availability."
Several environmental documents have been prepared for this and adjacent properties.
Staff determined that the removal of this condition will not result in a significant impact
on the environment. Therefore, the request is not subject to CEQA.
RECOMMENDATIONS:
A. Find that:
1. The property has received several environmental evaluations and the
removal of the condition and replacement of it with the below condition
does not represent a significant impact on the environment.
2. There is no evidence before the County that the project as revised may
have a significant effect on the environment.
B. Find that the issue of water availability in the Forest Ranch area has been
resolved since the imposition of the condition in 1984;
C. Find that small private water systems supplying four or fewer parcels will not
ensure an adequate and efficient water systems;
D. Adopt a Resolution approving the deletion of Condition 2b of the Conditional
Zoning Agreement on AP 056-280-043 (Ron White) approved on October 16,
1984, subject to adding the following condition:
2b. Prior to recordation of the Final Map, the applicant shall meet the
requirements of the Butte County Environmental Health Department
regarding proof of adequate domestic water availability.
