The Department of Fish and Game (DFG) has reviewed the Arlo
and Bette Wells Rezone, a proposal to rezone A.P. 56-120-44 (40
acres) from TM 20 to TM 10 . Located in Cohasset, the project
site lies in critical winter range of the East Tehama deer herd.
Subdivision of land into small parcels has an adverse impact
on migratory deer. As lands within critical winter range are
divided into parcels smaller than 40 acres, deer use becomes
impaired, migratory movement affected, and forage and space needs
drop below the level .to sustain herd numbers.
Subdivisions have adversely affected more than 40 percent of
the winter range (i .e. , critical and designated winter ranges) in
Butte County. In an effort to resolve the subdivision/deer
conflict in Butte County, the DFG has recommended a series of
actions for the Board of Supervisors to implement. The DFG also
identified a "Designated Development Zone" (DDZ) where
development may occur, provided certain mitigation measures are
adopted and implemented by the Board.
We object to the rezone because it would conflict with what
we perceive to be a joint County-State effort to mitigate
residential encroachment impacts on deer winter range. The
subject parcel lies out of a DDZ and is at the recommended 40-
acre minimum size, therefore, a rezone to 10-acre minimum size is
inappropriate.

After review of the Wells Rezone 93-27 , we offer the .
following as an informational item.

This area has historically produced Aedes sierrensis ,
commonly called the Treehole Mosquito. This mosquito breeds in
water holding cavities within Oak and other trees and is the
primary vector of the parasite which causes dog heartworm. Land
which is subdivided and thereby encourages urbanization in this
area will result in an increased risk of this disease.
Tree cavities that hold water especially Oak trees , need to
be drained by drilling or notching the cavity or filled with
sand, dirt or other water displacing mater=al .
This land includes areas that are typical habitat for ticks
including the vector of Lyme Disease. Any increased residential
use could increase the risk of disease transmission to those
residents . During the tick season (the cooler part of the year,
usually October thru June ) , it is advisable for residents to
practice tick avoidance procedures and to periodically check pets
and children for attached ticks .
These comments are consistent with the District ' s adopted
policy called "Guidelines, Checklist and Standards for Vector
Prevention in Proposed Developments" .

Dear Mr. and Mrs. Wells:
The Department of Development Services, Planning Division, has completed a cursory
review of the above project. Our review indicates that the above property is located
within a "critical winter range" for the East Tehama Deer Herd. The County policy is
to maintain parcels in sizes greater than 40 acres. Your proposed Rezone to TM-10 is
in conflict with this policy. As of this date, we have not received comments from the
Department of Fish and Game. They have been very adamant against changes to these
designations.
Therefore you have three options to consider. One, to request a delay in processing so
that you can meet with Fish and Game to resolve potential concerns. Two, you can
request withdrawal of the application and request a partial refund of the fees. The final
option would be to request the County to continue processing the application as
presented. If the latter option is selected, our Division will immediately schedule this
proposal for denial at the next available Planning Commission meeting.
An additional item of concern that I discussed with Mr. Wells on July 17, 1993, is that
there is no TM-10 in the vicinity and at least several miles from the property. This
brings up the issue of spot zoning, which could result in legal challenges. If a zone
change would be supported it should be consistent with the surrounding zoning
designations.
