(SAL) (File #94-04) (VIDEO) The Commission waived the reading of the Staff Report. A video of the site was shown. Mr. Hogan gave a brief summary of the project. Chairman Lambert said she realized the Planning Commission initiated the project considering SR-1 but she wondered if it could be zoned A-5? Mr. Hogan said that A-5 would be incompatible with the General Plan Land Use Map. The hearing was opened to the public. Mrs. Murline Stockton said the 10 acre parcel is divided into two 5 acre parcels. She said there is a buyer interested in purchasing one 5 acre ;parcel who would also like this property zoned back to A-5 because they want to farm the almond orchard on the property. The hearing was closed. Commissioner Lynch asked if the City of Biggs has commented regarding this request? Mr. Lucas stated a letter was received opposing this rezone because this property is included in their residential sphere of influence. There were no representatives from the City of Biggs present. Commissioner Lynch requested that, in the future, staff show in their videos when ditches are present, that the ditch be shown in such a manner so that the Commission may see ----- - = BUTTE COUNTY PLANNING-COMMISSION--MINUTES-'-.,,MA CH.10,_ 1994 r the relative size. It was moved by Commissioner Lynch, seconded by Commissioner Nelson, and unanimously carried for approval as follows: A. Find that the project is covered by Article 5, Section 15061 (b)(3) of the CEQA Guidelines which states, "the activity is covered by the General Rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment". Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA; and B. Find that the proposed zoning change to SR-1 is consistent with the Butte County General Plan designation of Medium Density Residential; and C. A staff report reviewing the options available to the County and the applicant (Murline Stockton, on AP 022-180-021, located at 260 Dakota Avenue. Biggs) to permit temporary/permanent agricultural accessory buildings in the R-1 zone. Mr. Hogan said that a staff report has been prepared presenting the options available to the Commission. The applicant had explained her position on the subject at the previous hearing. Steve Lucas explained the situation and the options. He said Ms. Stockton is prohibited from constructing an agricultural building to raise emus, since her property areas included in an R1 zone. He said the site to the west is also R1 and the sites to the east and south are A5. Mr. Lucas said the General Plan designation was changed to Low Density Residential at the same time the A5 zoning was put in place. If the zoning is changed back to A5, the General Plan designation would also have to be changed back to the previous designation. Commissioner Lynch said that Option #1 describes the applicant's dilemma, in that she cannot build anything more than the present 10' x 10' building without a Use Permit. Chairman Lambert said there was previous mention of a neighboring property being interested in rezoning also. Mr. Hogan said that the County is in the process of amending and updating the General Plan and would rather not piecemeal the zoning of properties. Allowing a rezone and General Plan change on this property might set a precedent. Staff would encourage the Use Permit process. It would be the quickest process. Commissioner Nelson said that downzoning the property is not normally what people want to do with their property. Mr. Hogan said that the precedent would be in spot zoning--whether it is upzoning or downzoning. Also a zone change and General Plan Amendment would be time consuming and have to go before the Board of Supervisors for final action. The Use Permit would be quicker although more costly. Commissioner Bergman said the dangerous precedent was set in the original rezoning because the property was within the sphere of influence of the City of Biggs. He would favor allowing rezoning to A5 and allow the applicant to raise chicks on her ten acres. BUTTE COUNTY PLANNING COMMISSION-MINUTES-JANUARY 27.. 1994 Mr. Lucas said that according to the City of Biggs, it would be unlikely that the parcel would be expanded to R1 uses, because of the drainage ditch between the City of Biggs and the property. Chairman Lambert favored allowing the applicant her agricultural uses, but was concerned about setting a precedent of giving each property owner preferential treatment in situations which normally require Use Permits. Commissioner Nelson thought it unlikely there would be many situations like this. Commissioner Lynch suggested rezoning the property to SR-1 which would allow the ag uses without a Use Permit. The property would be next to R-1 and diagonal from another SR-1. The property was improperly rezoned in the first place. Geography was not taken into consideration. This commission should not worry so much about precedent in cases where a mistake was obviously made and the mistake should be corrected. Murline Stockton said that her neighbor is retired from farming and does not care about this situation. The ditch in question is an irrigation ditch. The City of Biggs has already talked to her about putting houses on her property and rejected the idea because of the ditch. Commissioner Lynch asked if Ms. Stockton could obtain a letter from the neighbor stating that he would not oppose a rezone to the SR-1. That would take care of the situation until the General Plan can rezone the property to A5. Since the parcel is ten acres, Ms. Stockton would not have to worry about the animal ordinance. Commissioner Lambert suggested rezoning just the Stockton parcel and asking Ms. Stockton to write a letter stating that she wants the property eventually rezoned to A5. Commissioner Ferguson asked why a General Plan amendment is not necessary for a rezone to SR-1. " Mr. Lucas said that the present General Plan designation is Low Density Residential and the A5 zone would have to be an Agricultural designation. It was moved by Commissioner Lynch, seconded by Mr. Bergman and unanimously carried to initiate a rezone on the property in question (AP 022-180-021) to SR-1. BUTTE COUNTY PLANNING COMMISSION MINUTES'-JANUARY 27. 1994 VI. BUSINESS FROM THE FLOOR ON ITEMS NOT ALREADY ON THE AGENDA (Presentations will be limited, to five minutes. The Planning Commission is prohibited by State Law from taking action on any item presented if it is not listed on the Agenda) Murline Stockton said in 1982, her land was rezoned from A-5 to R-1 and she was not notified. She said she just found out in 1992 that the property was zoned R-1. She said she raises Emus and is being denied the right to build a chick barn because of the residential zoning. She said she has talked to the past Planning Director, Bettye Kircher, and Mr. Farrel, the Development Services Director, and was told she would have to apply for a Use Permit or a rezone to A-5. She said she feels she was wronged. She said she is a farmer who is not being allowed to farm. She said she has 10 aces in Biggs and the property was A-5 until 1982. Staff said they have met with Mrs. Stockton and it is true the property was rezoned in 1982. Staff said the notices were sent to the property owners. Mrs. Stockton would have to obtain a Conditional Use Permit to expand what is now a legal non-conforming use in order to add the additional agricultural buildings. The Stockton's could initiate a zoning amendment or wait for the General Plan revisions to address the matter at that time. Commissioner Nelson said there are large fees or deposits connected with a rezone, but did not think this rezone would take a lot of staff time. Staff said the County's original reason for zoning this property to R-1 was because it is contiguous to the urban area of Biggs and it was determined to be a logical urban expansion area. Chairman- Lambert asked that this be put on the next agenda for the Commission,-to take an action regarding initiating a rezone or Use Permit. It was moved by Commissioner Lynch, seconded by Commissioner Nelson, and unanimously carried to put this on the agenda for January 27, 1994 under Miscellaneous. r Lynch said the Commission should try to help someone who is trying Commissions . Hogan, Planning Manager BY: Stephen Lucas, Assistant Planner DATE: 9 February 1994 REQUEST: Rezone 94-04/Butte County Planning Commission (Applicant): A request to rezone 10 acres of land from R1 (Single Family Residential) to SR1 (Suburban Residential) located on the north side of Dakota Avenue at 260 Dakota Avenue, southeast of Biggs. FOR: Planning Commission Meeting of 10 March 1994 ABSTRACT: This Rezone has been initiated by the Planning Commission at the request of Mrs. Murline Stockton so that she may continue agricultural pursuits on her property. The rezone is consistent with the General Plan designation and staff recommends approval. DISCUSSION: This is a rezone request for a 10 acre parcel (AP# 022-180-021) located at 260 Dakota Avenue on the southeast boundary of the City of Biggs. The present zoning is R1 (Single Family Residential) and the request is for SR1 ( Suburban Residential). The parcel was zoned A2 until R1 zoning was adopted in 1983 as part of the Gridley-Biggs Rezone and General Plan Amendment. The Planning Commission unanimously agreed to initiate this Rezone action at the 27 January 1994 meeting. This parcel is in an area of agricultural and residential uses. The property is on the southern boundary of the City of Biggs, separated by a drainage ditch operated by Reclamation District #833. The property has been in continuous agricultural use prior to, and after, the adoption of R1 zoning. The change in zoning was initiated by the City of Biggs so that it could plan on residential growth in its sphere of influence. PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION, AND EXISTING LAND USE: Direction Zoning General Plan Existing Land Use Project: R1 Medium Density Residential Rural Residential North: R1 Medium Density Residential Urban Residential South: A5 Agricultural Residential Agricultural East: A5 Agricultural Residential Rural Residential West: R1 Medium Density Residential Rural Residential I ANALYSIS: The proposed zoning change is in response to continual requests by the land owner dating back to 1983, that the original agricultural zone be reinstated allowing her to continue agricultural pursuits. Mrs. Stockton submitted a letter to the Planning Division in April 1993, again requesting the zoning change to allow the expansion of the current agricultural use. At this time, Mrs. Stockton was informed that a Use Permit would be required to expand the non-conforming use (agriculture in a R1 zone). Mrs. Stockton brought the matter to the attention of the Planning Commission at the 13 January 1994 meeting. The Planning Commission directed staff to research this subject and submit the findings to the Commission. The Commission felt that Mrs. Stockton had reasonable grounds to protest the original zoning change from A2 to R1 to allow Mrs. Stockton to resume her agricultural pursuits. The proposed SR1 zone would maintain the potential for residential use in the Biggs sphere of influence and is consistent with the General Plan designation of Medium Density Residential use (6-13 units/acre). The criteria for this consistency is based on the need for urban residential development in the future, adequate water supply, and accessibility to urban services. ENVIRONMENTAL DOCUMENTATION: An Environmental Impact Report was conducted for the Gridley-Biggs General Plan Amendment and Rezone in 1983. This request has been reviewed in relation to certified EIR. Staff has concluded that this application would result in no significant environmental impacts and can be classified as a general rule exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing occurred on 17 February 1994 in the Gridley Herald. 30 public notices were mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no comments. RECOMMENDATION: Staff recommends that the Planning Commission approve the application for a Rezone and recommend the Board of Supervisors adopt an Ordinance to rezone the property identified as AP# 022-180-021 (Stockton) to SR1. A. If applicant is not the owner, written authorization by the owner or other proof of agency must be submitted in order for the applicant to legally sign the application. TO: Planning Commission FROM: Planning Manager DATE: 20 January, 1994. SUBJECT: Possible rezone for Murline Stockton on A.P# 022-180-021 located at 260 Dakota Ave., Biggs. BACKGROUND: Mrs. Stockton has been attempting to convince the county that her property should have never been zoned R1 considering she has been farming the parcel since 1976 when the zoning was A-2. The area immediately around her home and all land to the south and east is agricultural in nature, and she would Ike to continue agricultural pursuits as well. She claims that her objections to a rezone were ignored in 1982 when the rezone was initiated and she continues to be thwarted in her efforts to be rezoned back to agricultural uses. Although she has a non-conforming use at present she is restricted from expanding the use of her property beyond current use which she says violates her right to farm. The commission minutes from the GPA and rezone pubilic hearings for the Gridley- Biggs area does not indicate that she voiced her concern at that time. The only correspondence from her is dated 22 March, 1993. Mrs. Stockton contends that she attended meetings held by the City of Biggs and protested any changes in zoning at that time. She denies ever receiving any notice from the County concerning the GPA or rezone. PROCEDURAL REVIEW: Review of all documentation concerning the GPA and rezone reveals several questionable areas of concern that should have been more thoroughly addressed at the time. 1. The EIR indicated serious concerns with the drainage capacity of this area and further comments from Reclamation District 833 indicate that existing drainage canals are at capacity and cannot withstand any additional urban run- off. They further comment that any. additional development should be halted until a master drainage plan for the entire area be established. Considering this significant barrier to development an R1 zone would require substantial study be conducted at property owner expense. 2. The selection of boundaries for zoning areas is not consistent and seems to have been affected by individual property owners demands for particular zoning when economically advantageous. `%A 3. The Biggs City Council indicated at the time that rezoning agricultural land to residential uses would leave the current owners with no future protection of non-conforming uses. This appears to be a reality now. PRESENT SITUATION: Mrs. Stockton has a 10 acre parcel on which she currently has some orchard use and she raises emus. She has been told she cannot expand her emu operation beyond present levels without obtaining a conditional use permit, she strongly objects to being forced to adhere to residential zoning restrictions. Mrs Stockton's parcel is surrounded by large parcels (5-40+ acres) that are quasi-agricultural in nature. Her property is also separated from Biggs by a drainage canal (lateral #2) which restricts the continuation of services and isolates her parcel from convenient access to the city. Additionally, the City of Biggs has indicated that it has no intention of extending sewer services beyond current limits unless the property owner assumes the cost of such services. The area is also plagued by poor drainage that makes the area prone to flooding during heavy rains, the Reclamation District manager indicates that this situation is at crisis levels. No other urban improvements have been extended to this area as of present. Mrs. Stockton is further restricted by Environmental Health . determinations that her property cannot support a septic system on a parcel under 5 acres, this condition forces her to consider sewering costs if she were to utilize the R- 1 status. To fully utilize the residential potential of this parcel would cost the owner approximately $25,000., and Mrs. Stockton adds that developers told her that the property is not economically feasible for development. Mrs. Stockton would like to be rezoned to agricultural use and be permitted to expand the agricultural use of her property. OPTIONS: 1. Take no action on the rezone request leaving the property zoned R-1. The Stockton's could then be issued an agricultural exemption permit Pursuant to the Board of Supervisor's Discussion Item 89-172 which allows the construction of agricultural buildings in a R1 zone. This option is acceptable to the Building Division, but would require that the Stockton's apply for a Use Permit to allow for the expansion of a non-conforming use pursuant to Section 24-37.4 of the County Code 2. Rezone the property to SR-1 (Suburban Residential-1 acre min) which would allow for agricultural uses without obtaining a Conditional Use Permit. This designation would be consistent with surrounding uses and still allow for increases in urban residential densities at such time services are economically feasible. However, it raises questons related to spot zoning that will require additional discussion by the Commission. 3. Rezone the property to A-5 (Agricultural 5 acre min) which meets the request of the Stockton's, but has no residential compatibility with the intentions of the City I of Biggs concerning their sphere of influence. The A-5 zoning would be compatible with the land use to the south and east of the property and allow the Stockton's to fully utilize the agricultural potential of their land. RECOMMENDATION: Staff would find either option 1 or 2 acceptable, although option 1 would require the the Stockton's to pay the $1258.00 fee for a Use Permit, a exaction the Stockton's have protested strongly. Under option 2 the Planning Commission would initiate a rezone to change the zoning from R-1 to SR-1 allowing the property to be utilized for agricultural purposes without restricting the Stockton's from expanding their current farming operation. This zoning would be compatible with both the R-1 zones to the north of the property and with the A-5 zones to the south and east. The 1 acre minimum lot size would make increased urban densities possible in the future while preserving agricultural interests at present. As a result of our several conversations, and further internal discussion with staff members, the following situation exists. Your agricultural use of your property constitutes what is known as a legal non-conforming use. You may continue to use your property in its current manner provided that any expansions of the legal non-conforming use are first approved subject to a use permit from the Planning Commission. The addition of emus as you proposed will not trigger the requirement for a Use Permit, however, you would need the Use Permit in order to obtain building permits to construct permanent agricultural buildings on your property. Use of temporary, portable structures are limited to 100 square feet. Anything larger requires a building permit. Provision of water or electrical power to portable structures will also require building permits. I have given considerable additional consideration to your request that the County initiate a general plan change and zoning amendment on your property from single- family residential back to an agricultural designation. On April 5th, I visited your area in order to look at the pattern of development. Based on the physical arrangement of development to which you are in close proximity and after considering the general plan and zoning now in place, it is easy in my view to understand why the County designated your property for single-family residential uses and applied the R-1 zoning. I cannot therefore, support your request that the County initiate or bear the cost of changing your general plan and zoning back to an agricultural designation. As you Mrs. Murline Stockton April 6, 1993 Page 2 may know, the County is now in the process of reviewing the overall County general plan which may lead to some changes in the Biggs area. That effort should be completed within about two years. Following that general plan amendment, any necessary zoning changes will be put into place. The fact that we are now involved in that process is another reason that I would recommend against the County initiating a plan amendment and zoning amendment on your property at this time. You, of course may request a plan and zoning amendment at any time subject to paying the applicable fees. I do feel though that you would be better advised to instead apply for a conditional use permit at an approximate cost of $800.00. If granted, by the Planning Commission, the use permit would enable you to construct the desired agricultural building for your emus, but you would also be able to retain the investment benefit of the R-1 zoning now on your property. How you choose to proceed is clearly your own choice, we will try to help you in whatever direction to choose to pursue. I hope this letter is helpful to you. SUBJECT: Possible rezone for Murline Stockton on AP# 022-180-021 located at 260 Dakota Ave., Biggs. BACKGROUND: Mrs. Stockton has been attempting to convince the county that her property should have never been zoned R1 considering she has been farming the parcel since 1976 when the zoning was A-2. The area immediately around her home and all land to the south and east is agricultural in nature, and she would like to continue agricultural pursuits as well. She claims that her objections to a rezone were ignored in 1982 when the rezone was initiated and she continues to be thwarted in her efforts to be rezoned back to agricultural uses. Although she has a non-conforming use at present she is restricted from expanding the use of her property beyond current use which she says violates her right to farm. The commission minutes from-the GPA and rezone public hearings for the Gridley- Biggs area does not indicate that she voiced her concern at that time. The only correspondence from her is dated 22 March, 1993. Mr. Stockton contends that she attended meetings held by the City of Biggs and protested any changes in zoning at that time. She denies ever receiving any notice from the County concerning the GPA or rezone. PROCEDURAL REVIEW: Review of all documentation concerning the GPA and rezone reveals several questionable areas of concern that should have been more thoroughly addressed at the time. 1. The EIR indicated serious concerns with the drainage capacity of this area and further comments from Reclamation District 833 indicate that existing drainage canals are at capacity and cannot withstand any additional urban run- off. They further comment that any additional development should be halted until a master drainage plan for the entire area be established. Considering this significant barrier to development an R1 zone world require substantial study be conducted at property owner expense. 2. The selection of boundaries for zoning areas is not consistent and seems to have been affected by individual property owners demands for particular zoning when economically advantageous. 3. The Biggs City Council indicated at the time that rezoning agricultural land to residential uses would leave the current owners with no future protection of non-conforming uses. This appears to be a reality now. PRESENT SITUATION: Mrs. Stockton has a 10 acre parcel on which she currently has some orchard use and she raises emus. She has been told she cannot expand her emu operation beyond present levels without obtaining a conditional use permit, she strongly objects to being forced to adhere to residential zoning restrictions. Mrs Stockton's parcel is surrounded by large parcels (5-40+ acres) that are quasi-agricultural in nature. Her property is also separated from Biggs by a drainage canal (lateral #2) which restricts the continuation of services and isolates her parcel from convenient access to the city. Additionally, the City of Biggs has indicated that it has no intention of extending sewer services beyond current limits unless the property owner assumes the cost of such services. The area is also plagued by poor drainage that makes the area prone to flooding during heavy rains, the Reclamation District manager indicates that this situation is at crisis levels. No other urban improvements have been extended to this area as of present. Mrs. Stockton is further restricted by Environmental Health determinations that her property cannot support a septic system on a parcel under 5 acres, this condition forces her to consider sewering costs if she were to utilize the R- 1 status. To fully utilize the residential potential of this parcel would cost the owner approximately $25,000., and Mrs. Stockton adds that developers told her that the property is not economically feasible for development. Mrs. Stockton would like to be rezoned to agricultural use and be permitted to expand the agricultural use of her property. OPTIONS: 1. Take no action on the rezone request leaving the property zoned R-1. The Stockton's could then be issued an agricultural exemption permit Pursuant to the Board of Supervisor's Discussion Item 89-172 which allows the construction of agricultural buildings in a R1 zone. This option is acceptable to the Building Division, but would require that the Stockton's apply for a Use Permit to allow for the expansion of a non-conforming use pursuant to Section 24-37.4 of the County Code 2. Rezone the property to SR-1 (Suburban Residential-1 acre min) which would allow for agricultural uses without obtaining a Conditional Use Permit. This designation would be consistent with surrounding uses and still allow for increases in urban residential densities at such time services are economically feasible. However, it raises questons related to spot zoning that will require additional discussion by the Commission. 3. Rezone the property to A-5 (Agricultural 5 acre min) which meets the request of the Stockton's, but has no residential compatibility with the intentions of the City of Biggs concerning their sphere of influence. The A-5 zoning would be compatible with the land use to the south and east of the property and allow the Stockton's to fully utilize the agricultural potential of their land. RECOMMENDATION: Staff would find either option 1 or 2 acceptable, although option 1 would require the the Stockton's to pay the $1258.00 fee for a Use Permit, a exaction the Stockton's have protested strongly. Under option 2 the Planning Commission would initiate a rezone to change the zoning from R-1 to SR-1 allowing the property to be utilized for agricultural purposes without restricting the Stockton's from expanding their current farming operation. This zoning would be compatible with both the R-1 zones to the north of the property and with the A-5 zones to the south and east. The 1 acre minimum lot size would make increased urban densities possible in the future while preserving agricultural interests at present. Lucas: The Biggs City Council reviewed the Stockton application to rezone from R-1 to SR-1 the ten acre parcel on the North side of Dakota Street known as Assessor' s Parcel No. 022-180-021 at their regular meeting on February 14, 1994. The City Council instructed me to request that the parcel remain as an R-1 zone. The request for SR-1 zoning should be denied for the following reasons. The subject parcel is within the existing City of Biggs sphere of influence boundary, is designated on the Biggs General Plan for single family residential use and is in the expected growth area of the City. The present R-1 zoning in the County matches the planned use of the parcel when it is developed in the City. Due to the closeness of the parcel to the present City boundary, the property may be part of a City annexation in the near future. The northwest corner of the parcel does touch the City boundary. Continuation of the present R-1 zoning will help protect the parcel from other uses which would be adverse to the future growth of the City in this area. Hogan, Planning Manager BY: Stephen Lucas, Assistant Planner DATE: 9 February 1994 REQUEST: Rezone.94-04/Butte County Planning Commission (Applicant): A request to rezone 10 acres of land from R1 (Single Family Residential) to SR1 (Suburban Residential) located on the north side of Dakota Avenue at 260 Dakota Avenue, southeast of Biggs. FOR: Planning Commission Meeting of 10 March 1994 ABSTRACT: This Rezone has been initiated by the Planning Commission at the request of Mrs. Murline Stockton so that she may continue agricultural pursuits on her property. The rezone is consistent with the General Plan designation and staff recommends approval. DISCUSSION: This is a rezone request for a 10 acre parcel (AP# 022-180-021) located at 260 Dakota Avenue on the southeast boundary of the City of Biggs. The present zoning is R1 (Single Family Residential) and the request is for SR1 ( Suburban Residential). The parcel was zoned A2 until R1 zoning was adopted in 1983 as part of the Gridley-Biggs Rezone and General Plan Amendment' The Planning Commission unanimously agreed to initiate this Rezone action at the 27 January 1994 meeting. This parcel is in an area of agricultural and residential uses. The property is on the southern boundary of the City of Biggs, separated by a drainage ditch operated by Reclamation District #833. The property has been in continuous agricultural use prior to, and after, the adoption of R1 zoning. The change in zoning was initiated by the City of Biggs so that it could plan on residential growth in its sphere of influence. PROJECT AND SURROUNDING ZONING GENERAL PLAN DESIGNATION AND EXISTING LAND USE: Direction Zoning General Plan Existing Land Use Project: R1 Medium Density Residential Rural Residential North: R1 Medium Density Residential Urban Residential South: A5 Agricultural Residential Agricultural East: A5 Agricultural Residential Rural Residential West: R1 Medium Density Residential Rural Residential ANALYSIS: The proposed zoning change is in response to continual requests by the land owner dating back to 1983, that the original agricultural zone be reinstated allowing her to continue agricultural pursuits. Mrs. Stockton submitted a letter to the Planning Division in April 1993, again requesting the zoning change to allow the expansion of the current agricultural use. At this time, Mrs. Stockton was informed that a Use Permit would be required to expand the non-conforming use (agriculture in a R1 zone). Mrs. Stockton brought the matter to the attention of the Planning Commission at the 13 January 1994 meeting. The Planning Commission directed staff to research this subject and submit the findings to the Commission. The Commission felt that Mrs. Stockton had reasonable grounds to protest the original zoning change from A2 to R1 to allow Mrs. Stockton to resume her agricultural pursuits. The proposed SR1 zone would maintain the potential for residential use in the Biggs sphere of influence and is consistent with the General Plan designation of Medium Density Residential use (6-13 units/acre). The criteria for this consistency is based on the need for urban residential development in the future, adequate water supply, and accessibility to urban services., ENVIRONMENTAL DOCUMENTATION: An Environmental Impact Report was conducted for the Gridley-Biggs General Plan Amendment and Rezone in 1983. This request has been reviewed in relation to certified EIR. Staff has concluded that this application would result in no significant environmental impacts and can be classified as a general rule exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing occurred on 17 February 1994 in the Gridley Herald. 30 public notices were mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no comments. RECOMMENDATION: Staff recommends that the Planning Commission approve the application for a Rezone and recommend the Board of Supervisors adopt an Ordinance to rezone the property identified as AP# 022-180-021 (Stockton) to SR1. A. Find that the project is covered by Article 5, Section 15061 (b)(3) of the CEQA Guidelines which states, the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA; and B. Find that the proposed zoning change to SR1 is consistent with the Butte County General Plan designation of Medium Density Residential; and C. Recommend that the Board of Supervisors adopt an Ordinance rezoning to SR1, the property identified as AP# 022-180-021 (Stockton). The City Council instructed me to request that the-parcel remain as an R-1 zone. The request for SR-1- zoning should be denied for the following reasons. The subject parcel is within the existing City of Biggs sphere of influence boundary, is designated on the Biggs General Plan for single family residential use and is in the expected growth area of the City. The present R-1 zoning in the County matches the planned use of the parcel when it is developed in the City.
