located north and south of Humboldt Road, approximately 1/2 mile east of
Skyway, at the Humboldt Bridge over Butte Creek, identified as AP 060-070-026

The Commission waived the reading of the Staff Report. A video of the site was shown.
Chairman Lambert asked staff to make sure the maps that go forward are correct. She
noted the difference between the applicant's map and the one done by staff.
Commissioner Ferguson asked why this has to be found in the public's interest?
Mr. Hogan explained that the State has standard language in regards to timber land.
Commissioner Ferguson asked if there was any problems. with steep slopes?
Mr. Hogan said no.
The hearing was opened to the public.
There was no one present to speak, including the applicant.
The.hearing was closed.
it was moved by Commissioner Lynch, seconded by Commissioner Ferguson, and
unanimously carried to recommend approval as follows:

A. Find that the project is not subject to environmental review under CEQA as per the
general rule exemption; and
B. The proposed project will not cause environmental damage to fish or wildlife or
their habitat; and
Zoning Ordinance Findings.
Find that:
A. The immediate rezoning would be in the public interest;
B. The immediate rezoning does not have a substantial and unmitigated adverse
effect upon the continued timber growing use or open space use of other lands
zoned Timber Preserve and situated within 1 mile of the exterior boundary of the
land upon which immediate rezoning is proposed;

C. The soils, slopes, and watershed conditions will be suitable for the uses proposed
by the applicant if the immediate rezoning is approved;
D. The immediate rezoning is not inconsistent with the purposes of Subdivision (J) of
Section 3 of Article XIII of the State Constitution and of Sections 51100 et seq. of
the California Government Code in that equal areas of merchantable timber are
being exchanged;
E. The rezone conforms to the policies, including the text and map of the Butte
County General Plan, because the proposed rezone does not represent any
significant changes to the area and is consistent with existing adjacent zones; and
Action:
A. Subject to the findings indicated, move to recommend that the Board of
Supervisors adopt an Ordinance for immediate rezone of a portion of AP 060-110-
092 from TM-5 (Timber Mountain - 5 acre minimum) to TP-160 (Timber Preserve -
160 acre minimum) and rezoning a portion of AP 060-070-026 from TP-160 to TM-
2 (Timber Mountain - 2 acre minimum) for Glen Biggers and Diamond Lands
Corporation.
B. Direct staff to forward to the State Board of Forestry this action with a request for
their approval. Upon approval of the conversion by the State Board of Forestry,
the Board of Supervisors tentative approval shall become final.

REQUEST: Rezone 94-06 - Glen Biggers/Diamond Lands Corp.: A request
to rezone .57± acres from TP-160 to TM-2 and .55± acres from TM-
5 to TP-160, located on both sides of Humboldt Road
approximately .5 miles east of Skyway in the Butte Meadows area.
FOR: Board of Supervisors Meeting of July 26, 1994
RELATED
ITEMS: This request will require approval from the State Board of Forestry after the Board
Of Supervisors has given tentative approval.
ABSTRACT: The Planning Commission held a public hearing on this item and recommended
that the Board of Supervisors approve the request on a unanimous vote. The project is a
minor rezone that is required to allow a boundary line modification between Glen Biggers and
Diamond Lands Corporation. There are no major issues associated with this project. There
will be no substantial net loss in land zoned TP-160. Staff concurs with the Planning
Commission recommendation.
PROJECT CHARACTERISTICS: This request is required in order to complete a minor
boundary line modification involving a total of approximately 1.1 acres in two parcels. Without
this rezone a small sliver of TP-160 zoned land would be combined with one of the residential
lots of the Biggers Glen Subdivision that is zoned TM-2 and a small parcel of TM-5 would be
deeded to Diamond Lands. Only one parcel is dpvizloped with a residence. The original parcel
is 2.53 acres, zoned TM-2, that as a result of re BLM will be enlarged to 3.1 acres. The
boundary line modification will not result in any setback violations or reduce any parcel to a size
that would violate the zone.
PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION, AND EXISTING
LAND USE: Described below are the project and surrounding zoning, general plan land use
designation and the existing land uses.

ANALYSIS: All immediate rezones from TPZ-160 to another zone requires the Board to
approve the rezone with a 4/5 majority vote and The following findings must be made:
1. The immediate rezoning would be in the public interest;
2. The immediate rezoning does not have a substantial and
unmitigated adverse effect upon the continued timber growing use
or open space use of other lands zoned Timber Preserve and
situated within 1 mile of the exterior boundary of the land upon
which immediate rezoning is proposed;
3. The soils, slopes, and watershed conditions will be suitable for the
uses proposed by the applicant if the immediate rezoning is
approved;
4. The immediate rezoning is not inconsistent with the purposes of
subdivision (J) of Section 3 of Article XIII of the State Constitution
and of sections 51100 et seq. of the California Government Code.
The proposed rezone conforms to all of the above findings since the action will result in no net
loss of land zoned Timber Preserve, the land being traded is of equal timber growing potential
and the fact that the parcels involved are of such a small size.
All rezones to and from TPZ-160 also require approval from the State Board of Forestry. This
rezone action shall be subject to this approval.
'ENVIRONMENTAL DOCUMENTATION: This application has been defined as one that is not
a project under the California Environmental Quality Act (CEQA) and as such, is exempt from
environmental review under a General Rule exemption, which may be invoked when it can be
seen that there is no possibility the request will have a significant on the environment.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be
advertised and held. Advertisement of the public hearing was published in the Enterprise
Record in accordance with the required timelines. 14 public notices were mailed to all property

owners within a 300 foot radius of the subject property. As of the date of this report we have
received no public comment.
RECOMMENDATION: Staff and the Planning Commission recommend that the Board of
Supervisors approve rezone application No. 94-06, subject to the following findings:

Subdivision. The land is relatively flat, and is covered by timber. There are
no existing structures, cultural, or historical sites on the property. The
property is scenic, and animals and birds typically characteristic to mountain
terrain are present on the property.

Acting for the State Board of Forestry, I concur with the
Butte County Board of Supervisors in its tentative approval of
the subject rezoning. Your Board's action and my concurrence
satisfy the requirements of Section 4621. 2 of the Public
Resources Code.
This rezoning is essentially a lot-line adjustment. We
would not require a Timberland Conversion Permit since the impact
in this instance is "de minimis, " all on paper and not on the
ground.

project. This request is a result of a Boundary Line Modification between land owners.

Therefore, the County is requesting the State Board of Forestry to approve the conversion
per Section 4621.2 of the Public Resources Code. Attached are the staff reports, `

approximately, .5 miles east of Skyway in the Butte Meadows area.

RELATED
ITEMS: This request will require approval from the State Board of Forestry after the Board
Of Supervisors has given tentative approval.
ABSTRACT: This is a minor rezone that is required to allow a boundary line modification
between Glen Biggers and Diamond Lands Corporation. There are no major issues associated
with this project. There will be no substantial net loss in land zoned TP-160. Staff recommends
approval of this application.
PROJECT CHARACTERISTICS: This request is required in order to complete a minor
boundary line modification involving a total of approximately 1.1 acres in two parcels. Without
this rezone a small sliver of TP-160 zoned land would be combined with one of the residential
lots of the Biggers Glen Subdivision that is zoned TM-2 and a small parcel of TM-5 would be
deeded to Diamond Lands. Only one parcel is developed with a residence. The original parcel
is 2.53 acres, zoned TM-2, that as a result of he BLM will be enlarged to 3.1 acres. The
boundary line modification will not result in any setback violations or reduce any parcel to a size
that would violate the zone.
PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION, AND EXISTING
LAND USE: Described below are the project and surrounding zoning, general plan land use
designation and the existing land uses.

ANALYSIS:
All immediate rezones from TPZ-160 to another zone requires the Board to approve the rezone
with a 4/5 majority vote and The following findings must be made:
1. The immediate rezoning would be in the public interest;
2. The immediate rezoning does not have a substantial and
unmitigated adverse effect upon the continued timber growing use
or open space use of other lands zoned Timber Preserve and
situated within 1 mile of the exterior boundary of the land upon
which immediate rezoning is proposed;
3. The soils, slopes, and.watershed conditions will be suitable for the
uses proposed by the applicant if the immediate rezoning is
approved;
4. The immediate rezoning is not inconsistent with the purposes of
subdivision (J) of Section 3 of Article XIII of the State Constitution
and of sections 51100 et seq. of the California Government Code.
The proposed rezone conforms to all of the above findings since the action will result in no net
loss of land zoned Timber Preserve, the land being traded is of equal timber growing potential
and the fact that the parcels involved are of such a small size.
All rezones to and from TPZ-160 also require approval from the State Board of Forestry. This
rezone action shall be subject to this approval.
ENVIRONMENTAL DOCUMENTATION: This application has been defined as one that is not
a project under the California Environmental Quality Act (CEQA) and as such, is exempt from
environmental review under a General Rule exemption, which may be invoked when it can be

seen that there is no possibility the request will have a significant on the environment.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be
advertised and held. Advertisement of the public hearing occurred on April 21, 1994 in the
Enterprise Record. 14 public notices were mailed to, all property owners within a 300 foot
radius of the subject property. As of the date of this report we have received no public
comment.
RECOMMENDATION: Staff recommends that the Planning Commission recommend approval
of Application No. 94-06, subject to the following findings:
ACTION:
Section 1: Environmental Findings.
A. Find that the project is not subject to environmental review under CEQA as per
the general rule exemption; and
B. The proposed project will not cause environmental damage to fish of wildlife or
their habitat; and
Section 2: Zoning Ordinance Findings.
Find that:
A. The immediate rezoning would be in the public interest;
B. The immediate rezoning does not have a substantial and unmitigated adverse
effect upon the continued timber growing use or open space use of other lands
zoned Timber Preserve and situated within 1 mile of the exterior boundary of the
land upon which immediate rezoning is proposed;
C. The soils, slopes, and watershed conditions will be suitable for the uses proposed
by the applicant if the immediate rezoning is approved;
D. The immediate rezoning is not inconsistent with the purposes of subdivision W)
of Section 3 of Article XI III of the State Constitution and of sections 51100 et seq.
of the California Government Code in that equal areas of merchantable timber
are being exchanged;

E. The rezone conforms to the policies, including the text and map of the Butte
County General Plan,. because the proposed rezone does not represent any
significant changes to the area and is consistent with existing adjacent zones;
and
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to
recommend that the Planning Commission recommend that the Board of
Supervisors adopt an ordinance for immediate rezone of a portion of AP# 060-
110-092 from TM-5 - Timber Mountain 5 acre minimum to TP-160 - Timber
Preserve 160 acre minimum, and rezoning a portion of AP#' 060-070-026 from
TP-160 -Timber Preserve 160 acre minimum to TM-2 -Timber Mountain - 2 acre
minimum parcel size, for Glen Biggers and Diamond Lands Corporation.
B. Direct staff to forward to the State Board of Forestry this action with a request for
their approval. Upon approval of the conversion by the State Board of Forestry,
the Board of Supervisors tentative approval shall become final.

acres. Located north and south of Humboldt toad approx. 1/2 mile east of Skyway at
the Humboldt bridge over Butte Creek.
We are making an assessment of possible environmental impacts and
will be preparing an environmental document, either a Negative
Declaration, Negative Declaration with Mitigation Measures or an
Environmental Impact Report (EIR) .
Please provide any factual statements, ideas for investigation,

Notice is hereby given by the Butte County Planning Commission that public hearings will
be held on Thursday, May 26, 1994, in the Butte County Board of Supervisors' Room,
