(SL) Mr. Lucas said this request was a housekeeping measure to keep timber holdings together. Mr. Hogan said the request for abandonment of roads in this area is not the subject of this hearing and is not a part of this request. The hearing was opened to the public. Jack Bean, Sierra Pacific Industries, said the property is a recent acquisition and this is just a matter of housekeeping. Nick Monte said he has no objection to down zoning when it is requested by the applicant. The hearing was closed. Commissioner Lambert said she had no problem with this request. It was moved by Commissioner Nelson, seconded by Commissioner Lynch, and unanimously carried for approval as follows: Section 1: Environmental Findings. , A. Find that the project is not subject to environmental review under CEQA as per the general rule exemption; and B. The proposed project will not cause environmental damage to fish or wildlife or their habitat; and Section 2: Zoning Ordinance Findings. A. The immediate rezoning would be in the public interest; B. Hogan, Planning Manager BY: Stephen Lucas, Planner DATE: August 4, 1994 REQUEST: Rezone 94-107 - Sierra Pacific Industries.: A request to rezone 6 parcels totaling 433 acres from TM-5, TM-160, & C-F to TPZ, located in the Forest Ranch and Feather Falls areas. RELATED ITEMS: None FOR: Planning Commission Meeting of 25 August 1994 ABSTRACT: The applicant is requesting a rezone of recently acquired timber lands in order to consolidate the holdings under one zoning designation. PROJECT CHARACTERISTICS: This request for a rezone of six parcels is submitted in order to consolidate recently acquired timber lands under one zoning designation. The applicant wishes to rezone the parcels from TM-5 (Timber Mountain - 5 ac.), TM-160 (Timber Mountain 160 ac.), and C-F (Commercial Forestry) to a TPZ-160 (Timber Preserve Zone). The six parcels total 433 acres of timber land previously used for timber production. The parcels are as follows: 060-040-008 - 60 acres zoned TM-5 in the Forest Ranch area. 061-130-008 - 160 acres zoned CF in the Feather Falls area. 073-040-033 - 113 acres zoned CF in the Feather Falls area. 073-040-032 - 40 acres zoned TM-160 in the Feather Falls area. 073-050-014 - 30 acres zoned CF in the Feather Falls area. 073-050-015 - 30 acres zoned CF in the Feather Falls area. The parcels are accessed by private logging roads and will be used solely for the purpose of timber production. The applicant will be required to file a Timber Harvest Plan with the Department of Forestry prior to any timber harvest activity. The rezone to a TPZ zone will remain consistent with the General Plan designation of Timber Mountain. PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION, AND EXISTING LAND USE: Described below are the project and surrounding zoning, general plan land use designation and the existing land uses. ■ Butte County Department of Development Services - Planning Division ■ 1 • •GENDA ITEM Direction Zoning General Plan Existing Land Use Project: TM-5, TM-160, CF Timber Mountain Timber production North: Timber zones Timber Mountain Timber production South: Timber zones Timber Mountain Timber production East: Timber zones Timber Mountain Timber production West: Timber zones Timber Mountain Timber production ANALYSIS: This rezone request is tendered in order to allow the applicant to include recently acquired timber lands in the Timber Preserve Zone. Although the individual parcels are smaller than 160 acres, the zone allows for smaller parcels that are sufficiently near to each other as determined by the Board of Supervisors that they are manageable as a single forest unit. Such parcels must be capable of growing an average annual volume of wood fiber of at least 15 cubic feet per acre. Sierra Pacific Industries currently conducts timber harvest operations on large number of timber lands throughout Butte County and will be adding these parcels to the overall forest management plans. Additionally,the applicant is required by the California Forest Practices Act to include all timber harvest areas in the Timber Preserve Zone. This rezone request can meet the following zoning ordinance parameters that support the rezone action: 1. The immediate rezoning would be in the public interest; 2. The immediate rezoning does not have a substantial and unmitigated adverse effect upon the continued timber growing use or open space use of other lands zoned Timber Preserve and situated within 1 mile of the exterior boundary of the land upon which immediate rezoning is proposed; 3. The soils, slopes, and watershed conditions will be suitable for the uses proposed by the applicant if the immediate rezoning is approved; 4. The immediate rezoning is not inconsistent with the purposes of subdivision (J) of Section 3 of Article XIII of the State Constitution and Of sections 51100 et seq. of the California Government Code. The proposed rezone conforms to all of the above findings since the action will result in no net loss of land zoned Timber Preserve. All rezones to and from TPZ-160 also require approval from the State Board of Forestry. This rezone action shall be subject to this approval. ENVIRONMENTAL DOCUMENTATION: This application has been defined as one that is not a project under the California Environmental Quality Act (CEQA) and as such, is exempt from environmental review under a General Rule exemption, which may be invoked when it can be seen that there is no possibility the request will have a significant effect on the' environment. The change in zoning will not alter the use of these parcels for timber production and will further limit any other permitted uses under the existing zoning. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing will occur in the Enterprise Record. Public notices will be mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission recommend approval of Application No. 94-107, subject to the following findings: Section 1: Environmental Findings. A. Although the individual parcels are smaller than 160 acres, the zone allows for smaller parcels that are sufficiently near to each other as determined by the Board of Supervisors that they are manageable as a single forest unit. Such parcels must be capable of growing an average annual volume of wood fiber of at least 15 cubic feet per acre. Sierra Pacific Industries currently conducts timber harvest operations on large number of timber lands throughout Butte County and will be adding these parcels to the overall forest management plans. Additionally,the applicant is required by the California Forest Practices Act to include all timber harvest areas in the Timber Preserve Zone. This rezone request can meet the following zoning ordinance parameters that support the rezone action: 1. The immediate rezoning would be in the public interest; 2. The immediate rezoning does not have a substantial and unmitigated adverse effect upon the continued timber growing use or open space use of other lands zoned Timber Preserve and situated within 1 mile of the exterior boundary of the land upon which immediate rezoning is proposed; 3. The soils, slopes, and watershed conditions will be suitable for the uses proposed by the applicant if the immediate rezoning is approved; 4. The immediate rezoning is not inconsistent with the purposes of subdivision (J) of Section 3 of Article XIII of the State Constitution and of sections 51100 et seq. of the California Government Code. The proposed rezone conforms to all of the above findings since the action will result in no net loss of land zoned Timber Preserve. I have lived in Concow for over 20 years . I am concerned about losing fire escape routes and recreational use of National Forestlands , I think it is ludicrous that SPI is claiming 4 wheel drivers arecausing erosion and water quality depradation. Anyone who drives up there ( and you don"t need a 4 wheel drive) can see the vast damage that is being caused by illegal logging practices . The Regional Water Quality Control Board must be paid by SPI to be making such ridiculous claims .- At Rag Dump a small creek that crosses Concow road has has a large hole gouged in it so the water trucks can fill up there . Now there are no fish left in that creek. The top of a whole mountain was leveled and thousands of yards of dirt pushed over the side to make a landing pad for helicopter logging. Where will the water quality engineers be this winter when that mountain side turns into a major mudslide? Is SPI motivated to do this to keep out the public and any scrutiny of their illegal logging practices and why would Butte County just hand over roads that have been public roads for over 130 years . I have lived in Concow for over 20 years . I am concerned about losing fire escape routes and recreational use of National Forest lands , I think it is ludicrous that SPI is claiming 4 wheel drivers arecausing erosion and water quality depradation. Anyone who .drives up there ( and you don"t need a 4 wheel drive) can see the vast damage that is being caused by illegal logging practices . The Regional Water Quality. Control Board must be paid by SPI to be making such ridiculous claims .- At Rag Dump a small creek that crosses Concow road has has a large hole gouged in it so the water trucks can fill up there . Now there are no fish left in that creek. The ' top of, a whole mountain was leveled and thousands of yards of dirt pushed over the side to make a . landing Pad for helicopter logging.. Where will the water quality engineers be this winter when that mountain side turns into a major mud slide? Is SPI * s motivated to do this to keep out the public and any scrutiny of their illegal logging .practices and why would Butte County just hand over roads that have been public roads for over 130 years .
