The Commission waived the reading of the Staff Report. A video of the site was shown. Mr. Hogan gave a brief summary of the project. Mr. Hogan said staff is recommending approval based on surrounding parcel sizes and zoning. The hearing was opened to the public. Doug Sutherland said the northeasterly parcel has no trees and one old existing dwelling. He said there are pockets of open areas within the olive orchard. He said olive production from this orchard is minimal. He said Mr. Quiles does intend to split 20 acres of the 40 acre parcel into 4 five acre parcels with a 20 acre parcel remaining. I� The hearing was closed. Commissioner Lynch said he would hate to see the orchard removed, but was not opposed to this rezone. Chairman Lambert asked Mr. Hogan how the Agricultural Committee would look at this property in relation to the Agricultural Ordinance being proposed? Mr. Hogan said the Committee would probably consider this as non-agricultural land. It was moved by Commissioner Bergman, seconded by Commissioner Ferguson, and unanimously carried to recommend approval as follows: Environmental Findings. A. An Initial Study was completed in compliance with the California Environmental Quality Act identifying no potential significant environmental effects and a Negative Declaration is recommended; and B. The design of the proposed project improvements will not cause environmental damage to fish of wildlife or their habitat; and C. Hogan, Planning Manager BY: Lisa Purvis Wilson, Associate Planner DATE: May 17, 1994 REQUEST: Rezone for Euripedes & Celina Quiles (File #94-37) on AP# 026-010-071: A request to rezone from "U" to ARMH-5 approximately 44 acres of land located on the northeast corner of Lone Tree Road at Palermo Road intersection, Palermo area. RELATED ITEMS: None FOR: Planning Commission Meeting of June 23, 1994 ABSTRACT: This parcel is currently zoned "U" (Unclassified). The request is to rezone approximately 44 acres to ARMH-5. The General Plan designation is Agricultural-Residential and will remain the same, as it is conditionally consistent with the requested zone. PROJECT CHARACTERISTICS: The site is currently planted in olives and contains a single family residence with a barn. The parcel has access from two County Roads, Lone Tree and Palermo. There is a small drainage that feeds Wyman Ravine crossing the western end of the parcel. The parcel is fairly flat, with slopes ranging from 0-8%. PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION, AND EXISTING LAND USE: Direction Zoning General Plan Existing Land Use Project: "U" Ag-Residential ag, residential North: ARMH-5 Ag-Residential ag, residential South: ARMH-2.5 Ag-Residential grazing East: "U" Ag-Residential ag, residential West: ARMH-2.5 Ag-Residential grazing ANALYSIS: ARMH-5 zoning is considered a conditionally consistent zone within the Agricultural-Residential General Plan Land Use designation category. The conditional criteria identified within the General Plan Land Use policies are provided to establish basic guidelines ■ Butte County Department of Development Services - Planning Division ■ 1 C� AGENDA ITEM for decision making. The criteria requires that residential i densities correlate with the natural site characteristics: availability of water, sewage disposal requirements, proximity to public facilities and traffic capabilities. The property has frontage access from two main County roads. There is a public water main along both Palermo Road and Lone Tree Road. The unincorporated town of Palermo is approximately 1 mile east of the project and offers many services, including a school, postal substation, fire station, markets and churches. There is a potential concern identified by the Environmental Health Department regarding the quality of the soils to percolate properly. The project surveyor has performed percolation tests that indicate the adequacy of the soils for percolation. The zoning in this area ranges from 2.5 to 20 acre minimums, and the City of Oroville is within a half mile to the northeast. Parcel sizes range from 0.99 acres to 40 acres, predominantly 5 to 10 acres in size. The requested proposal is consistent with the ARMH-5 zoning adjacent to the north of the project site. The parcels west of the project are zoned ARMH-2.5, allowing greater density. The rezone, if approved, would allow for a parcel map application. The maximum number of parcels allowed under the new zoning would be 8. The applicant has indicated they would like to make an application for 4 parcels following the rezone. The creation of new parcels will require additional review by the Planning Division and approval by the Development Review Committee. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as Such, is subject to the requirements of CEQA. An Initial Study has been prepared by County Staff. Based upon the Initial Study, Staff has determined that there are no significant impacts created by the project and a Negative Declaration is recommended. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Prior to the public hearing, public hearing notices will be mailed to all property owners within a 300 foot radius of the subject property, but not less than 10 parcels. RECOMMENDATION: Staff recommends that the Planning Commission approve the Application for rezone for Euripedes & Celina Quiles, subject to the following findings and conditions. Painter: We have made an on-site inspection of the Quiles , Euripides & Celina Rezone (AP #026-010-071 ) . Hobby farm sized parcels such as these often develop new mosquito breeding sources due to improper land development and use of the property. In the event that any of the proposed parcel is to be irrigated, we recommend the use of sprinkler irrigation as opposed to flood irrigation methods. Irrigation applications should be timed to prevent excessive runcff from the irrigated areas . Drains used to accommodate surface drainage should be to grade and maintained free of obstructive debris and emergent vegetation. We urge the property owners to assume responsibility in establishing good mosquito prevention practices as the properties are developed and used. Proper water management is the key element in preventing mosquito problems in ag-residential developments . These comments are consistent with the District ' s adopted policy called "Guidelines, Checklist and Standards for Vector Prevention in Proposed Developments" .
