Euripides Quiles - proposed Negative Declaration regarding environmental
impacts and Rezone from "U" (Unclassified) to AR-MH-5 (Agricultural Residential
Mobile Home = 5 acre parcels) for property located on the northeast corner of
Palermo Road and Lone Tree Road, identified as AP 026-010-071, Palermo.
The Commission waived the reading of the Staff Report. A video of the site was shown.
Mr. Hogan gave a brief summary of the project. Mr. Hogan said staff is recommending
approval based on surrounding parcel sizes and zoning.
The hearing was opened to the public.
Doug Sutherland said the northeasterly parcel has no trees and one old existing dwelling.
He said there are pockets of open areas within the olive orchard. He said olive
production from this orchard is minimal. He said Mr. Quiles does intend to split 20 acres
of the 40 acre parcel into 4 five acre parcels with a 20 acre parcel remaining.
I
The hearing was closed.
Commissioner Lynch said he would hate to see the orchard removed, but was not
opposed to this rezone.
Chairman Lambert asked Mr. Hogan how the Agricultural Committee would look at this
property in relation to the Agricultural Ordinance being proposed?
Mr. Hogan said the Committee would probably consider this as non-agricultural land.
It was moved by Commissioner Bergman, seconded by Commissioner Ferguson, and
unanimously carried to recommend approval as follows:

AGENDA ITEM
AGENDA REPORT
TO: Honorable Chair and Planning Commission
FROM: Barry K. Hogan, Planning Manager
BY: Lisa Purvis Wilson, Associate Planner
DATE: May 17, 1994
REQUEST: Rezone for Euripedes & Celina Quiles (File #94-37) on AP#
026-010-071: A request to rezone from "U" to ARMH-5
approximately 44 acres of land located on the northeast corner of
Lone Tree Road at Palermo Road intersection, Palermo area.
RELATED
ITEMS: None
FOR: Planning Commission Meeting of June 23, 1994
ABSTRACT: This parcel is currently zoned "U" (Unclassified). The request is to rezone
approximately 44 acres to ARMH-5. The General Plan designation is Agricultural-Residential
and will remain the same, as it is conditionally consistent with the requested zone.
PROJECT CHARACTERISTICS: The site is currently planted in olives and contains a single
family residence with a barn. The parcel has access from two County Roads, Lone Tree and
Palermo. There is a small drainage that feeds Wyman Ravine crossing the western end of the
parcel. The parcel is fairly flat, with slopes ranging from 0-8%.
PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION, AND EXISTING
LAND USE:
Direction Zoning General Plan Existing Land Use
Project: "U" Ag-Residential ag, residential
North: ARMH-5 Ag-Residential ag, residential
South: ARMH-2.5 Ag-Residential grazing
East: "U" Ag-Residential ag, residential
West: ARMH-2.5 Ag-Residential grazing
ANALYSIS: ARMH-5 zoning is considered a conditionally consistent zone within the
Agricultural-Residential General Plan Land Use designation category. The conditional criteria
identified within the General Plan Land Use policies are provided to establish basic guidelines

C
AGENDA ITEM
for decision making. The criteria requires that residential i densities correlate with the natural site
characteristics: availability of water, sewage disposal requirements, proximity to public facilities
and traffic capabilities.
The property has frontage access from two main County roads. There is a public water main
along both Palermo Road and Lone Tree Road. The unincorporated town of Palermo is
approximately 1 mile east of the project and offers many services, including a school, postal
substation, fire station, markets and churches. There is a potential concern identified by the
Environmental Health Department regarding the quality of the soils to percolate properly. The
project surveyor has performed percolation tests that indicate the adequacy of the soils for
percolation.
The zoning in this area ranges from 2.5 to 20 acre minimums, and the City of Oroville is within
a half mile to the northeast. Parcel sizes range from 0.99 acres to 40 acres, predominantly 5
to 10 acres in size. The requested proposal is consistent with the ARMH-5 zoning adjacent to
the north of the project site. The parcels west of the project are zoned ARMH-2.5, allowing
greater density.
The rezone, if approved, would allow for a parcel map application. The maximum number of
parcels allowed under the new zoning would be 8. The applicant has indicated they would like
to make an application for 4 parcels following the rezone. The creation of new parcels will
require additional review by the Planning Division and approval by the Development Review
Committee.
ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under
the California Environmental Quality Act (CEQA) and as Such, is subject to the requirements
of CEQA. An Initial Study has been prepared by County Staff. Based upon the Initial Study,
Staff has determined that there are no significant impacts created by the project and a Negative
Declaration is recommended.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be
advertised and held. Prior to the public hearing, public hearing notices will be mailed to all
property owners within a 300 foot radius of the subject property, but not less than 10 parcels.
RECOMMENDATION: Staff recommends that the Planning Commission approve the
Application for rezone for Euripedes & Celina Quiles, subject to the following findings and
conditions.

family residence with a barn. The parcel has access from two County Roads, Lone Tree and
Palermo. There is a small drainage that feeds Wyman Ravine crossing the western end of the
parcel. The parcel is located in the valley grasslands and is fairly flat, with slopes ranging from
0-8%. Surrounding.parcels contain single family dwellings and several are undeveloped.

AGENDA ITEM
ANALYSIS: ARMH-5 zoning is considered a conditionally consistent zone within the
Agricultural-Residential General Plan Land Use designation category. The conditional criteria
identified within the General Plan Land Use policies are provided to establish basic guidelines
for decision making. The criteria requires that residential densities correlate with the natural site
characteristics: availability of water, sewage disposal requirements, proximity to public facilities
li and traffic capabilities.
The property has frontage access from two main County roads. There is a public water main
along both Palermo Road and Lone Tree Road. The unincorporated town of Palermo is
approximately 1 mile east. of the project and offers many services, including a school, postal
substation, fire station, markets and churches. There is a potential concern identified by the
Environmental Health Department regarding the quality of the soils to percolate properly. The
project surveyor has performed 'percolation tests that indicate the adequacy of the soils for
percolation.
There is a mix of zoning designations in this area, with parcel sizes ranging from 2.5 to 20 acre
minimums, and the City of Oroville is within a half mile to the northeast. Parcel sizes range from
0.99 acres to 40 acres, predominantly 5 to 10 acres in size. The requested proposal is
consistent with the ARMH-5 zoning adjacent to the north of the project site. The parcels west
of the project are zoned ARMH=2.5, allowing greater density. Therefore, the request is
consistent with surrounding zoning and will be compatible with existing parcel sizes.

I. BACKGROUND
A. Applicant and/or Project Name: Euripides & Celina Quiles
B. Project No. (If applicable) and AP No.: Rezone #94-37, AP#026-010-071
C. Address of Applicant and Representative (if applicable): 7300 Lower Wyandotte Road, Oroville CA 95966
D. Project Description and Location: Rezone of approximately 44.39 acres from "Unclassified" to ARMH-5.
Located on the northeast corner of Palermo Road at Lone Tree Road intersection, Palermo area. Additional
project description and area description can be found in the data sheet at the end of this document.
II. EVALUATION OF ENVIRONMENTAL IMPACTS
1: Earth. Will the proposal result in:
a. Unstable earth conditions or changes in geologic substructures?
Yes No X Maybe
Response: The proposal will not affect subsurface earth conditions.
Mitigation: None required.
b. Disruptions, displacements, compaction or overcovering of the soil?
Yes No X Maybe
Response: The project site is characterized by relatively level terrain which will require only minor grading to
accommodate any future proposal for residential development. This impact is not considered significant
because standard drainage and grading controls will be enforced.
Mitigation: None required.
c. Substantial change in topography or ground surface relief features?
Yes No X Maybe
Response: The proposal will not significantly affect topography or ground relief features because the property

Project: Quiles, File #94-37
is nearly level.
Mitigation: None
d. The destruction, covering or modification of any unique geologic or physical features?
Yes No X Maybe
Response: The site has no unique geologic or physical features.
Mitigation: None required.
e. Any substantial increase in wind or water erosion of soils, either on or off-site?
Yes No X Maybe
Response: A small tributary to Wyman Ravine does cross the western portion of this site. Any subdivision
maps would have to consider the location of this ephemeral stream, however with parcels limited to 5 acre
minimums the impacts are not significant.
Mitigation: None required.
f. Changes in deposition or erosion of beach sands, or changes in siltation, deposition or erosion which may modify
the channel of a river or stream or the bed of any lake?
Yes No X Maybe
Response: The project contains a tributary to Wyman Ravine. The rezone itself will not have an impact,
however a subsequent parcel split could. Since development activity will not encroach into the drainage
system and with 5 acre minimum parcel sizes, no change in deposition or erosion of the stream channel is
expected to occur.
Mitigation: None required.
g. Loss of prime agriculturally productive soils outside designated urban areas?
Yes No X Maybe
Response: This proposal does not contain prime agricultural soils.
Mitigation: None required.
h. Exposure of people or property to geologic hazards such as earthquakes, landslides, mud-slides, ground failure,.
or similar hazards?
Yes No Maybe X
. Butte County Planning Division ■ Environmental Review ■
2
Project: Quiles, File #94-37
Response: All of Butte County is in a Moderate Earthquake Intensity Zone VIII. The subject property is located
approximately 1 mile from the Foothill Shear Zone. Construction of buildings to Uniform Building Code
standards will provide adequate protection to occupants in case of seismic activity.
Mitigation: None required.
2. Air. Will the proposal result in:
a. Substantial air emissions or deterioration of ambient air quality?
Yes No Maybe X
Response: If approved, the rezone will result in a parcel map which could create a cumulative impact on air
quality created by increased traffic generated by the project. The California Air Resources Control Board has
identified Butte County as a Non-attainment Area in meeting the standards of the California Air Quality Act.
The Butte County Air Pollution Control Plan does not address air quality impacts of small developments for
possible mitigation measures.
Mitigation: None required.
b. The creation of objectionable odors?
Yes No X Maybe
Response: The proposal will not create objectionable odors, smoke or fumes.
Mitigation: None required.
c. Alteration of air movement, moisture, temperature, or any change in climate, whether locally or regionally?
Yes No X Maybe
Response: The proposal will not affect the local or regional climate.
Mitigation: None required.
3. Water. Will the proposal result in:
a. Substantial changes in currents, or the course or direction of water movements, in fresh waters?
Yes No X Maybe
Response: The proposal will riot affect any watercourse or the direction and movement of any such
watercourses.
Mitigation: None required.
■ Butte County Planning Division ■ Environmental Review ■
3
Project: Quiles, File #94-37
b. Substantial changes in absorption rates, drainage patterns, or the rate and amount of surface runoff on-site or
into any water body.
Yes No Maybe X
Response: This rezone will ultimately result in the creation of new parcels on which impervious surfaces such
as roads, structures, and driveways will be constructed. An increase in surface water runoff can be expected
due to the reduced absorption rate created from the impervious'surfaces. With 5 acre minimum parcel sizes,
the increase in runoff is insignificant.
Mitigation: None required.
c. Need for off-site surface drainage improvements, including vegetation removal, channelization or culvert
installation?
Yes No X Maybe
Response: No off-site surface drainage improvements are needed.
Mitigation: None required.
d. Alternations to the course or flow of flood waters?
Yes No X Maybe
Response: The proposal will not significantly affect any flood control channels or watercourses.
Mitigation: None required.
e. Discharge into surface waters, or in any alteration or surface water quality, including, but not limited to,
temperature, dissolved oxygen or turbidity?
Yes No X Maybe
Response: The proposal will neither discharge pollutants into any surface water body nor alter any water body
that could result in an impact to water quality.
Mitigation: None required.
f. Alteration of the direction of rate of flow of ground waters?
Yes No X Maybe
Response: The proposal will not affect the direction or flow of ground waters.
■ Butte County Planning Division ■ Environmental Review ■
4
Project: Quiles, File #94-37
Mitigation: None required.
h. Change in the quantity of ground waters, either through direct.additions or withdrawals, or through interception
of an aquifer by cuts or excavations?
Yes No X Maybe
Response: The proposal will not directly affect any aquifer.
Mitigation: None required.
i. Substantial reduction in the amount of water otherwise available for public water supplies?
Yes No X Maybe
Response: A substantial reduction in public water supplies will not occur as a result of project approval.
Mitigation: None required.
j. Exposure of people or property to water related hazards such as flooding?
Yes No X Maybe
Response: The proposal will not expose people or property to flooding.
Mitigation: None required.
4. Plant Life. Will the proposal result in:
a. Change in the diversity of species, or number of any native species of plants (including trees, shrubs, grass,
crops and aquatic plants)?
Yes No X Maybe
Response: The property is located in valley grasslands and is planted in olives and has an existing residential
unit. The proposed project should not significantly affect the diversity of the area plant life.
Mitigation: None required.
b. Reduction of the numbers of any unique, rare or endangered species of plants?
Yes No X Maybe
Response: The property does not contain habitat that would support any unique, rare or endangered plant
species.
■ Butte County Planning Division ■ Environmental Review ■
5
Project: Quiles, File #94-37
Mitigation: None required.
c. Introduction of new species of plants into an area of native vegetation, or
in a barrier to the normal replenishment of existing species?
Yes No X Maybe
Response: This parcel is already developed with a single family residence and olive orchard. Exotic species
already exist on the site.
Mitigation: None required.
d. Substantial reduction in acreage of any agricultural crop?
Yes No Maybe X
Response: The site does contain an older olive orchard. Additional residential use could reduce the crop
production. Surrounding agricultural use is grazing.
Mitigation: None required.
5. Animal Life. Will the proposal result in:
a. Change in the diversity of species or numbers of any species of animals (birds, land animals, reptiles, fish,
shellfish, benthic organisms or insects)?
Yes No X Maybe
Response: The proposal will not result in a substantial change in animal habitat.
Mitigation: None required.
b. Reduction of the numbers of any unique, rare or endangered species of animals?
Yes No X Maybe
Response: The property does not contain habitat that would support any unique, rare or endangered species
of animals.
Mitigation: None required.
c. Introduction of new species of animals into an area, or in a barrie,to the migration or movement of animals?
Yes No X Maybe
Response: This project is in an area that is already developed, the introduction of additional pets is not

III. MANDATORY FINDINGS OF SIGNIFICANCE.
1. Does the project have the potential to degrade the quality of the environment, substantially reduce the habitat
of a fish or wildlife species, cause a fish or wildlife population to drop below self sustaining levels, threaten to
eliminate a plant or animal or eliminate important examples of the major periods of California history or
prehistory?
Yes No X Maybe
Response: As discussed in Section 11 of this document, this project will not significantly degrade the quality
of the environment.
2. Does the project have the potential to achieve short-term,to the disadvantage of long-term,environmental goals?
(A short-term impact on the environment is one which occurs in a relatively brief, definitive period of time while
long-term impacts will endure will into the future.)
Yes No X Maybe
Response: The project, as discussed in Section ll, will not result in short-term benefits of the expense of
impacting long-term environmental goals.
3. Does the project have impacts which are individually limited, but cumulatively considerable? (A project's impact
on two or more separate resources may be relatively small, but where the effect of the total of those impacts on
the environment is significant.)
Yes No X Maybe
Response: This proposal will not have a significant cumulative impact on the environment.
4. Does the project have environmental effects which will cause substantial adverse effects on human beings, either
directly or indirectly?
Yes No X Maybe
Response: As discussed in Section 11 of this Initial Study, this proposal will not have a significant adverse
effect on human beings.
IV. DETERMINATION On the basis of this initial evaluation:

Dear Mr . Painter:
We have made an on-site inspection of the Quiles , Euripides
& Celina Rezone (AP #026-010-071 ) . Hobby farm sized parcels such
as these often develop new mosquito breeding sources due to
improper land development and use of the property.
In the event that any of the proposed parcel is to be
irrigated, we recommend the use of sprinkler irrigation as
opposed to flood irrigation methods. Irrigation applications
should be timed to prevent excessive runcff from the irrigated
areas . Drains used to accommodate surface drainage should be to
grade and maintained free of obstructive debris and emergent
vegetation.
We urge the property owners to assume responsibility in
establishing good mosquito prevention practices as the properties
are developed and used. Proper water management is the key
element in preventing mosquito problems in ag-residential
developments .
These comments are consistent with the District ' s adopted
policy called "Guidelines, Checklist and Standards for Vector
Prevention in Proposed Developments" .
