(CS)' (95-149) Mr. Hogan summarized the Agenda Report. Mr. Sanders said.that the property is now in two 40 acre parcels. One 40 acre parcel will be divided into 3 parcels -- a 20 acre parcel and two 10 acre parcels. There was discussion about the 5 acre parcels across the road from the subject property. HEARING OPEN TO THE PUBLIC Steve Lotti said the 5 acre parcels across the street were created with leachpits for effluent disposal. He is proposing a standard leachfield system. It was moved by Commissioner Nelson, seconded by Commissioner Lynch, and carried unanimously to recommend approval of the Rezone for Steve Lotti, File 95-149, subject to the findings in the Agenda Report dated January 4, 1996. FINDINGS: Section 1: Environmental Findings. A. The project is exempt from CEQA review under section 15061 (3), the general rule exemption, which states: "CEQA applies only to.projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility-that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA."; and Section 2: Zoning Findings. A. Find that the rezone conforms to the policies, including the text and map of the Butte County General Plan, because the requested zone is listed as a zone that is consistent with the Agricultural Residential General Plan designation and the uses permitted by the zone will be consistent with the General Plan and surrounding properties; and Section 3: Action. A. Hogan, Planning Manager BY: Craig Sanders, Senior Planner DATE: January 4, 1996 REQUEST: Project - Steve Lotti Rezone, File# 95-149: A request to rezone 80 acres from PUD to FR-10 located on the east side of Cohasset Road approximately 1/4 mile north of Richardson Springs Road, north of Chico. RELATED ITEMS: None FOR: Planning Commission Meeting of January 25, 1996 SUMMARY: The proposed rezone is consistent with the adopted general plan for the area and is consistent with past zoning actions in the area. Staff recommends that the Planning Commission recommend the Board of Supervisors approve this application. PROJECT CHARACTERISTICS: This is a request to rezone 80 acres of land from PUD (Planned Unit Development) to FR-10 (Foothill Recreation 10 acre minimum parcels size). The site is located on the east side of Cohasset Road, approximately 1/4 mile north of Richardson Springs Road, in the north Chico area. The property is located at the edge of the foothills and is in an oak woodlands and grasslands vegetation system. Oak trees cover the northerly and easterly areas of the site and are more thinly spread over the remainder of the site. A seasonal drainage traverses the property from east to west. The drainage has been dammed to create a pond in accordance with Department of Fish and Game regulations. Soils on site are not suitable for any intensive agricultural uses, but are suited for some grazing. There is one developed homesite on the property located in the northerly 20 acres of the site. Access to the property is directly from Cohasset Road. Surrounding properties to the north, east, and south are generally 40 acres in size and zoned either FR-40 or TM-40. To the west, across Cohasset Road, the land is zoned SR-5 and is divided into 5 acre parcels ANALYSIS: This property has been the subject of two previous rezones within the last 8 years. Originally zoned FR-40, consistent with the surrounding properties east of Cohasset Road, the ■ Butte County Planning Commission Agenda Report ■ 1 Board of Supervisors approved, on appeal, a rezone to FR-5 in 1988. The property owners made two subsequent subdivision applications. The first application was denied due to incomplete environmental documents (the applicant did not want to prepare an EIR). The second application proposed the use of evaporation ponds for sewage disposal since the conventional septic tank and leachfield system could not meet the County standards on 5 acre parcels. Both the Planning Commission and Board of Supervisors agreed that this method of sewage disposal was not appropriate in the FR-5 zone and the project was denied. At this time it became evident that 5 acre parcels were not feasible using conventional septic tank and leachfield systems. The rezone to PUD was made in 1992 and approved in 1993 for 16 parcels approximately 1 acre in size, with the balance of the property being held as common area. Also included in the PUD proposal was an on-site package sewage treatment facility with an evaporation pond to address sewage disposal. Upon approval of this rezone the PUD zone and all rights of the associated tentative subdivision map will be eliminated. The proposed FR-10 zone will require a future parcel map or subdivision map approval for the creation of new parcels. The potential for development under the FR-10 will be for a maximum of eight 10 acre parcels. This reduces the potential development on-site to half that allowed by the PUD. All new parcels will be served by individual wells and septic systems . The applicant has performed soils testing on-site including percolation test and winter groundwater monitoring. The Butte County Environmental Health Division and California Regional Water Quality Control Board have given tentative approval for septic systems for two 10 acre parcels, a 20 and 40 acre parcel. Access to future interior lots will be via private roads that will only require a gravel surface. Section 65860 of the California Planning and Zoning law requires County zoning to be consistent with the County general plan. The Butte County General Plan Land Use Element designates this property as Agricultural Residential. The FR-10 zone is identified in the Land Use Element as a zoning designation that is consistent with the Agricultural Residential general plan designation. ENVIRONMENTAL DOCUMENTATION: This project appears to be exempt from CEQA review under section 15061 (3), the general rule exemption, which states: "CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA." Butte County Planning Commission Agenda Report . 2 The basis of this determination is the fact that this rezone will reduce the over all residential density on the site by at least 50%, and the fact that additional environmental documentation will be required at the time of parcel map or subdivision map application. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing was published in a local newspaper and were mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission approve Application No. 95-148, Rezone to FR-10 for Steve Lotti, subject to the following findings. RELATED ITEMS: None FOR: Board of Supervisors Meeting of March 12, 1996 SUMMARY: The proposed rezone is consistent with the adopted general plan for the area and is consistent with past zoning actions in the area. Staff recommends that the Board of Supervisors approve this request and adopt an ordinance rezoning this property to FR-10. PLANNING COMMISSION ACTION: On January 25, 1996 the Planning Commission held a public hearing on this rezone request. No one spoke against this project and overall there was little discussion on this request. The Planning Commission accepted the staff report and unanimously recommended that the Board adopt an ordinance rezoning this property. SCHOOL FACILITIES FOR NEW STUDENTS GENERATED BY THE PROPOSED DEVELOPMENT Se—ng The rezone proposes three new residential units. Applying the District's .43 student yield factor, the development will generate approximately two school age children. Utilizing current District actual student enrollment data and projected student enrollment data from already approved new residential development, each elementary, junior high and senior high school in the District is filled to capacity. To accommodate a 50+ percent increase in student enrollment in recent years, the District(1)reutilized existing school facilities, (2) utilized interim elementary school facilities, (3) placed relocatable classrooms on existing elementary school campuses, (4) instituted multi-track year-round education in three existing elementary schools, (5) occupied one new urban elementary school on a year-round schedule, (6) occupied one new elementary school on a traditional school schedule, (7) is in the process of constructing a third elementary school, (8) has placed interim facilities on the secondary campuses pending the availability of new school facilities, (9) acquired a site and has planned to build a new junior high/middle school and (10) has planned to expand one existing senior high school. a Administrative Office i 1163 East Seventh Street .i Chico, CA 95928-5999 i (916)898-3000 The District continues to be a participant in the State School Building Program wherein the cost of constructing new school facilities is shared by the State and by the local district in a pro rata fashion. The State-wide need to construct new schools far exceeds available pro rata State funding; therefore, needed new Chico Unified School District school facilities have not been provided in a timely manner. Local Chico Unified School District revenues generated from school impact fees, coupled with the proceeds from the general obligation bonds approved by the voters in April 1988, will not meet the student housing needs generated by local birth rates and previously approved residential developments without additional funding mechanisms being established. The District will not be able to meet the student housing needs generated by new development which has not yet been approved. The District anticipates housing increasing numbers of students in interim facilities until funding becomes available to construct new schools. Impact of Proposed Development on Chico Unffed School District Schools Since District elementary, junior and senior high schools are filled to capacity, it is evident that students generated from the rezone cannot be served by existing facilities. In addition, there is currently no funding mechanism that will enable the District to provide facilities for these students. Based on the District's .43 student yield factor per average (1,532 square feet) household, the three new residential units in this development will yield approximately two students that must be housed in District schools. The District projects that larger residential units will yield more than .43 students per household and smaller residential units will yield less than .43 students per household. To adjust for the higher student yield factor in larger than average households and the lower student yield factor in smaller than average households, the District utilizes a mitigation cost based on square footage of habitable space in each household. This project must be consistent with the Butte County General Plan and the impact on the District must be recognized and addressed in the project approval process. Mitigation of Impact on Chico Unified School District Schools The District is opposed to County approval of the proposed rezone application unless the project fully mitigates its impact on the District. Acceptable mitigation measures include: • cash or in lieu equivalent (land or school facilities), approved by the District, which is equal to the full mitigation cost as described below; • imposition of a controlled phasing of single or multi-family residential development to coincide with provision of adequate school facilities; or • denial of the project. The 1993/94 per habitable space square foot cost to fully mitigate the impact of each residential unit is $4.45 per square foot. This amount will be adjusted as needed to reflect the impact of inflation, school facilities needs, regulatory changes and other cost influencing factors. The full mitigation cost of $4.45 per square foot of new residential development will include school j impact fees (currently $1.72 per square foot). The school impact fee will be supplemented with an appropriate amount of cash or in lieu equivalent (land or school facilities) approved by the District. The combination of school impact fees and cash or in lieu equivalent must fully mitigate the impact of the development on District schools. Since the school mitigation cost established by the District is based on habitable square footage of the residential unit and District representatives are not informed of the habitable space of each residential unit in the proposed development, it is not possible to confirm the total cost of the . mitigation at this time. The following calculation is provided to allow one who is knowledgeable of the habitable space of each residential unit in the proposed development,to make her/his own calculations: CALCULATION Total habitable space in residential unit(s) times the current cost for full mitigation in effect when paid ($4.45 per square foot in 1993/94) equals total mitigation. For example: 3 units @ 1,200 square feet/unit x $4.45 = $16,020; or 3 units @ 1,532 square feet/unit x $4.45 = $20,452; or 3 units @ 1,800 square feet/unit x $4.45 = $24,030. Of course additional physical work is still required in order that the entire area on parcel 1 indicated on the map can be used for sewage disposal . Specifically , the existing drainage Swale near the proposed north boundary of this parcel must be relocated as indicated on your map . Please ,notify this office when this relocation is completed so that we can verify the acceptability of the relocation and the usable on parcel 1 .
