95-216 Public hearing - Butte County Board of Supervisors -
consideration of a proposal to rezone (determined to be
a general rule exemption from environmental review) all
properties within the unincorporated area of Butte County
that are currently zoned A2 Ltd. , R-1 A&C, or RMH. This
proposal is in response to the elimination of these three
zones from the Butte County Zoning Ordinance which was
adopted by the Board of Supervisors on" January 24, 1995.
All property currently zoned A2 Ltd. shall be rezoned to
A-5, all property currently zoned R-1" A&C shall be
rezoned to SR, and all property currently zoned RMH shall
be rezoned_ to RT-1. The proposed zones will permit all
currently, established uses to continue and does not
substantively change future uses of any property. The
properties affected are AP 042-050-068 (zoned A2 Ltd. ) ,
AP 048-220-047 and -048 (zoned R-1 A&C) , and various AP
numbers in the- upper Paradise ridge area (zoned RMH) .
Notice to all properties zoned RMH, - this zone- is being
eliminated because it has been determined to be illegal .
in that it prohibits wood frame constructed homes,
permitting only mobile homes. The effect of the RT-1
.zone. will be to permit wood frames homes. All other uses

to RT-1 - Butte County/Applicant A proposal to rezone all properties within the
unincorporated area of Butte County that are currently zoned A2 Ltd, R 1 A&C, or RMH
This proposal is in response to the elimination of these three zones from the Butte County
Zoning Ordinance which was adopted by the Butte County Board of Supervisors on
January 24, 1995. All property currently zoned A2 Ltd. shall be rezoned to A-5, all
property currently zoned R-1 A&C shall be rezoned to SR, and all property currently
zoned RMH shall be rezoned to RT-1. The proposed zones will permit all currently
established uses to continue and does not substantively change future uses of any property.
The properties affected are A.P. 042-050-068 (zoned A2 Ltd.), A-P. 048-220-047 &048
(zoned R-1 A&C), and various A.P. Numbers in the upper Paradise ridge area (zoned
RMPI). Notice to all properties zoned RMK this zone is being eliminated because it has
been determined to be illegal in that it prohibits wood frame constructed homes,
permitting only mobile homes. The effect of the RT-1 zone will be to permit wood frame
homes. All other uses within the zone shall remain the same. (BKH) (95-167)
Mr. Sanders said this item is a continuance of the "clean up" of the Zoning Code Amendment that went
into effect in February 1995, which eliminated 3 zones. The proposed zones will replace those
eliminated zones. The zones are compatible with existing uses on the properties. The change in zoning
will not effect the current uses of the properties.
Commissioner Lambert asked what is the minimum or maximum density of the RT-1 zone?
Mr. Sanders said it is the same density as the R 1. He said there is an RT-1 and a RT-1-lA. The RI7
A is for one acre, and the RT-1 is the 1/4 acre minimum lot size.

findings of June 2, 1995.

ABSTRACT: This rezone is required as a result of the adoption of the revised zoning ordinance which deletes the A2
LTD,R-1 A&C,and RMH zones.Staff recommends approval of this application.
PROJECT CHARACTERISTICS: This project rezones one parcel (A.P.042-050-068) from A2 LTD to A-5 and two
parcels(A.P.048-220-047&048)from R-1 A&C to SR in the Chico area. The third area to be rezoned is located in the
upper Paradise ridge and will affect approximately 400 parcels. The property in the Paradise area will be rezoned from
RMH to RT-1.
The property zoned A-2 LTD is currently developed with a commercial building which was originally approved with a Use
Permit as a paint storage building in 1973. The site is located on the northwest corner of East Ave.and Nord Road and
is adjacent to the Southern Pacific Railroad tracks. This parcel is on the agricultural side of the Greenline and is located
within the Bell-Muir study area. The boundary of the Greenline in this location is the railroad tracks and East Ave.
PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION,AND EXISTING LAND USE:
Described below are the project and surrounding zoning,general plan land use designation and the existing land uses.

The R-1 A&C parcels are located on the east side of Floral Ave approximately 300' south of East Ave. Both parcels are
approximately 1.2 acres in size and are developed with single family residences. The Chico City limits line abuts to the
south and east.
R-1 A&C parcels:

The Paradise properties are located on the east side of the Skyway between Rosewood Drive on the south and Imperial
Way on the north,extending east to Magnolia Drive. This area was zoned RMH from RT-1 in 1978 at the request of the
property owners in the area who wanted a mobile home only zone.

ANALYSIS: This rezone involves properties in three different locations in the County. The project was initiated by the
Board of Supervisors as a result of the adoption of the revisions to Chapter 24 of the Butte County Code (Zoning
Ordinance). The revised ordinance eliminated the A2 LTD, Rl-A&C, and RMH zones. The A2 LTD zone was
eliminated because it applied to only one parcel,as was the R-1 A&C which applied to only two parcels. The RMH zone
was eliminated because it was not considered legal or defensible as it restricted conventional homes while permitting other
housing types.
The A-2 LTD zone permits one single family residential use per parcel and agricultural uses. Other uses,including
commercial uses,require a use permit. In 1973 the subject property was granted a use permit for a commercial use. Any
change or expansion to that use also requires a use permit. If rezoned to A-5,which is consistent with the surrounding
parcels and the Greenline,the commercial use could still be changed or expanded with a use permit pursuant to the non-
conforming use provisions of the zoning code. The change in zoning would not affect the existing use. The A-5 zone is
consistent with the Butte County General Plan Land Use Element which designates this property Orchard and Field Crops.
The R-1 A&C zone was developed to allow people to have an arts and craft related business in their home. The zone was
adopted prior to the County's home occupation ordinance. With home occupations now permitted in all residential zones,
the need for the R1 A&C zone no longer exists. The SR zone is recommended for these two parcels to be consistent with
surrounding County zoning. The SR zone is consistent with the Butte County General Plan Land Use Element which
designates this property Low Density Residential.

The RMH zone evolved as a result of the residents within an area of the upper Paradise ridge wanting to restrict
conventionally constructed homes from their subdivision. The RMH zone permits only mobile homes. As per an opinion
from County Counsel, the County can not impose a residential zoning the restricts the construction of a single family
dwelling on individual lots. the RT-1 zone is recommended to replace the RMH zone as they are identical except for the
restriction on houses in the RMH zone. The RT-1 zone is consistent with the Butte County General Plan Land Use
Element which designates this property Low Density Residential. Property owners affected by this rezone will be notified
of the purpose and effects of the action.
ENVIRONMENTAL DOCUMENTATION: This project appears to be exempt from CEQA review under section 15061
(3),the general rule exemption,which states:
"CEQA applies only to projects which have the potential for causing a significant effect on the environment.
Where it can be seen with certainty that there is no possibility that the activity in question may have a significant
effect on the environment,the activity is not subject to CEQA."
Approval will not result in any physical changes to the environment nor will the development allowed by the proposed
zoning classifications be different than the existing zones.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held.
Advertisement of the public hearing was published in a local newspaper and were mailed to all property owners within a
300 foot radius of the subject property. As of the date of this report we have received no public comment.
RECOMMENDATION: Staff recommends that the Planning Commission recommend that the Board of Supervisors
approve this rezone of various properties in the County,subject to the following findings.

ABSTRACT: This rezone is required as a result of the adoption of the revised zoning ordinance which deletes the A2
LTD,R-1 A&C,and RMH zones.Staff recommends approval of this application.
PROJECT CHARACTERISTICS: This project rezones one parcel(A.P.042-050-068) from A2 LTD to A-5 and two
parcels(A-P.048-220-047&048) from R-1 A&C to SR in the Chico area. The third area to be rezoned is located in the
upper Paradise ridge and will affect approximately 400 parcels. The property in the Paradise area will be rezoned from
RMH to RT-1.
The property zoned A-2 LTD is currently developed with a commercial building which was originally approved with a Use
Permit as a paint storage building in 1973. The site is located on the northwest comer of East Ave.and Nord Road and
is adjacent to the Southern Pacific Railroad tracks. This parcel is on the agricultural side of the Greenline and is located
within the Bell-Muir study area. The boundary of the Greenline in this location is the railroad tracks and East Ave.
PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION,AND EXISTING LAND USE:
Described below are the project and surrounding zoning,general plan land use designation and the existing land uses.

The R-1 A&C parcels are located on the east side of Floral Ave approximately 300' south of East Ave. Both parcels are
approximately 1.2 acres in size and are developed with single family residences. The Chico City limits line abuts to the
south and east.
R-1 A&C parcels:

The Paradise properties are located on the east side of the Skyway between Rosewood Drive on the south and Imperial
Way on the north,emending east to Magnolia Drive. This area was zoned RMH from RT-1 in 1978 at the request of the
property owners in the area who wanted a mobile home only zone.

ANALYSIS: This rezone involves properties in three different locations in the County. The project was initiated by the
Board of Supervisors as a result of the adoption of the revisions to Chapter 24 of the Butte County Code (Zoning
Ordinance). The revised ordinance eliminated the A2 LTD, Rl-A&C, and RMH zones. The A2 LTD zone was
eliminated because it applied to only one parcel,as was the R-1 A&C which applied to only two parcels. The RMH zone
was eliminated because it was not considered legal or defensible as it restricted conventional homes while permitting other
housing types.
The A-2 LTD zone permits one single family residential use per parcel and agricultural uses. Other uses, including
commercial uses;require a use permit. In 1973 the subject property was granted a use permit for a commercial use. Any
change or expansion to that use also requires a use permit. If rezoned to A-5,which is consistent with the surrounding
parcels and the Greenline,the commercial use could still be changed or expanded with a use permit pursuant to the non-
conforming use provisions of the zoning code. The change in zoning would not affect the existing use. The A-5 zone is
consistent with the Butte County General Plan Land Use Element which designates this property Orchard and Field Crops.
The R-1 A&C zone was developed to allow people to have as arts and craft related business in their home. The zone was
adopted prior to the County's home occupation ordinance. With home occupations now permitted in all residential zones,
the need for the Rl A&C zone no longer exists. The SR zone is recommended for these two parcels to be consistent with
surrounding County zoning. The SR zone is consistent with the Butte County General Plan Land Use Element which
designates this property Low Density Residential.

The RMH zone evolved as a result of the residents within an area of the upper Paradise ridge wanting to restrict
conventionally constructed homes from their subdivision. The RMH zone permits only mobile homes. As per an opinion
from County Counsel, the County can not impose a residential zoning the restricts the construction of a single family
dwelling on individual lots. the RT-1 zone is recommended to replace the RMH zone as they are identical except for the
restriction on houses-in the RMH zone. The RT-1 zone is consistent with the Butte County General Plan Land Use
Element which designates this property Low Density Residential. Property owners affected by this rezone will be notified
of the purpose and effects of the action.
ENVIRONMENTAL DOCUMENTATION: This project appears to be exempt from CEQA review under section 15061
(3),the general rule exemption,which states:
"CEQA applies only to projects which have the potential for causing a significant effect on the environment.
Where it can be seen with certainty that there is no possibility that the activity in question may have a significant
effect on the environment,the activity is not subject to CEQA."
Approval will not result in any physical changes to the environment nor will the development allowed by the proposed
zoning classifications be different than the existing zones.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held.
Advertisement of the public hearing was published in a local newspaper and were mailed to all property owners within a
300 foot radius of the subject property. As of the date of this report we have received no public comment.
RECOMMENDATION: Staff recommends that the Planning Commission recommend that the Board of Supervisors
approve this rezone of various properties in the County,subject to the following findings.
FINDINGS:
Section 1: Environmental Findings.
A. The project is not subject to environmental review under CEQA as per the general rule exemption;
Section 2:Zoning Ordinance Findings.
A. Find that the rezone conforms to the policies,including the text and map of the Butte County General
Plan, in that the A-5 zone is listed as a zone compatible with the Orchard and Field Crop designation;
The SR zone is listed as a zone compatible with the Low Density Residential designation;and the RT-1
zone is listed as a zone compatible with the Low Density Residential designation;and
Section 3:Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report,move to recommend that the Board
of Supervisors adopt an ordinance rezoning to A-5,all property currently zoned A2 LTD. (AP No.042-
050-068),rezoning to SR,all that property currently zoned R-1 A&C(AP No.048-220-047&048),and
rezoning to RT-1,all property currently zoned RMH(various AP Numbers).

FOR: Board of Supervisors Meeting of July 25, 1995
SUMMARY: This rezone is a"housekeeping" item and is required as a result of the revised zoning
ordinance adopted by the Board earlier this year. Since these zones no longer exist, it is necessary to
apply a new designation to each of the properties. The Planning Commission has recommended
adoption of the rezone. A copy of their agenda report is attached. An ordinance is attached for your
consideration. Adoption is recommended.
ENVIRONMENTAL DOCUMENTATION: This project was found to be exempt by the Planning
Commission from CEQA review under section 15061 (3), which states:
"CEQA applies only to projects which have the potential for causing a significant effect on the
environment. Where it can be seen with certainty that there is no possibility that the activity
in question may have a significant effect on the environment, the activity is not subject to
CEQAu"
Approval will not result in any physical changes to the environment nor will the development allowed
by the proposed zoning classifications be different than the existing zones.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised
and held. Advertisement of the public hearing was published in a local newspaper and notices were
mailed to all property owners within a 300 foot radius of the subject property. As of the date of this
report we have received no public comment.
RECOMMENDATION: The Planning Commision recommends that the Board of Supervisors adopt
the attached ordinance approving the rezones.
