BACKGROUND A. Dan Pickard - Rezone B. Project No. 96-01 and AP No.: APN 064-010-031 C. 1531 Newaurgh Drive, Fairfield, CA 95533 D. Project Description and Location: This application is a request for a Rezone to extend the ARMH-3 (Agricultural Residential Mobile Home-3 acre minimum) zoning classification toward the east, to the Hupp Canal, adding an additional 31.6 acres to the already existing 6.02 acres with this classification. The project site consists of a 94 acre parcel located off Nimshew Road (off of Tika Lane). The property has two zoning classifications: ARMH-3 (Agricultural Residential Mobile Home, 3 acre minimum) and R-C (Resource Conservation). The property also has two General Plan designations: Agricultural Residential and Grazing & Open Land. The parcel's dual General Plan designations and zoning classifications divide the parcel north/south along the section line. The result leaves a narrow 6+/- acre portion of the parcel (100' wide X 2600' long), along the western side, zoned ARMH-3 and designated Agricultural Residential. The remaining 88+/-acres is currently zoned R-C and designated Grazing&Open Land. The project is located a the end of Tika Lane south of Nimshew Road, in the Magalia area. The project is located in Supervisorial District 5. Additional project description and area description can be found in the data sheet at the end of ' this document. II. EVALUATION OF ENVIRONMENTAL IMPACTS 1. Earth. Will the proposal result in: a. Unstable earth conditions or changes in geologic substructures? Yes No X Maybe Response: This project is a Legislative action, not a development project. No earth moving activities are involved. This is a project that may result, if approved,in the changing of a zoning classification. However, if approved along with the concurrent general plan amendment, potential will exist for the creation of'a maximum of 10 additional parcels. These parcels could then be developed with single family dwellings. The direct physical impacts of this development will have to be addressed in the Initial Study prepared for the land division. The extent of the impacts cannot be accurately gaged at this time. Experience with other similar projects in the area has shown that the expected impacts can be mitigated to a level that is not significant. Mitigation: None required. b. Changes in deposition or erosion of beach sands,or changes in siltation, deposition or erosion which may modify the channel of a river or stream or the bed of any lake? Yes No X Maybe Response: See Response Item la. Mitigation: None required. g. Loss of prime agriculturally productive soils outside designated urban areas? Yes No X Maybe Response: See Response Item la. Mitigation: None required. h. Exposure of people or property to geologic hazards such as earthquakes, landslides, mud-slides, ground failure, or similar hazards? Yes No X Maybe ■ Butte County Development Services Department Planning Division ■ 2 Response: The site is not near any known fault or in a high landslide area. The Butte County Seismic Safety Element does not indicate any faults in the area and the risk of ground rupture in the event of a seismic event is remote. However, all of Butte County is still classified as a Moderate Earthquake Intensity Zone VIII and potential ground shaking is possible. Mitigation: None required. 2. Air. Will the proposal result in: a. Substantial air emissions or deterioration of ambient air quality? Yes No X Maybe Response: The proposal does not alter or change the ability of the applicant to build his one (permitted use) residential unit on this site. The approval of this rezone does not, in and of itself, allow additional residences to be constructed, leading to additional air quality impacts — from traffic, paints, chemicals, barbecues, and other uses. What the rezone will allow the applicant to do, with approval of a GPA, is to construct his home further back from his (western) property line. Mitigation: None required. b. The creation of objectionable odors? Yes No X Maybe Response: The proposal will not create objectionable odors, smoke or fumes. See Response Item 2a. Mitigation: None required. c. Alteration of air movement, moisture, temperature, or any change in climate, whether locally or regionally? Yes No X Maybe Response: See Response 2a. Mitigation: None required. 3. Water. Will the proposal result in: a. Substantial changes in currents, or the course or direction of water movements, in fresh waters? Yes No X Maybe Response: There is one water course on the project site (Middle Butte Creek). This project will not affect this water course. This project is a planning project, a Legislative action, not a development project. No earth moving activities will occur as a direct result of this project. However, if approved along with the concurrent general plan, potential will exist for the creation of a maximum of 10 additional parcels. These parcels, subject to additional environmental documentation, could then be developed with single family dwellings. The direct physical impacts of this development will have to be addressed in the Initial Study prepared for the land division. The extent of the impacts cannot be accurately gaged at this time because lot configurations, road locations, and the number of parcels is not ■ Butte County Development Services Department ■ Planning Division ■ 3 known. There is one water course on the project site (Middle butte Creek). The creek is approximately 800'away from the easterly edge of the proposed Agricultural Residential boundary. Based on past experience with other similar projects, potential impacts to the water quality in Butte Creek can be mitigated to a level that is not significant at the development phase. Mitigation: None required. b. Substantial changes in absorption rates, drainage patterns, or the rate and amount of surface runoff on-site or into any water body? Yes No X Maybe Response: See Response Items la, 2a & 3a. Mitigation: None required. c. Need for off-site surface drainage improvements, including vegetation removal, channelization or culvert installation? Yes No X Maybe Response: See Responses la & 2a. Mitigation: None required. d. Alternations to the course or flow of flood waters? Yes No X Maybe Response: The site is not prone to flooding, nor are there any water courses in the area that could cause a flood and therefore no impact to flood waters is possible. Approval of this project, a GPA, does not affect the physical issue of altering or influencing the flow of flood waters. Mitigation: None required. e. Discharge into surface waters, or in any alteration or surface water quality, including, but not limited to, temperature, dissolved oxygen or turbidity? Yes No X Maybe Response: See Response Items 1a, 2a & 3d. Mitigation: None required. f. Alteration of the direction of rate of flow of ground waters? Yes No X Maybe Response: The proposal will not affect the direction or flow of ground waters. However, approval of this project along with the concurrent rezone will result in the potential of 10 additional residences being placed in the area. ■ Butte County Development Services Department Planning Division . 4 • I All new homes will receive water from private wells. Groundwater in the area maybe limited and proof of adequate water will be required prior to final approval of any land divisions for the property. This impact is best addressed in the environmental documents prepared for a future land division. Mitigation: None required. i g. Change in the quantity of ground waters, either through direct additions or withdrawals, or through interception of an aquifer by cuts or excavations? Yes No X Maybe Response: The proposal will not directly affect any aquifer. l Mitigation: None required. h. Substantial reduction in the amount of water otherwise available for public water supplies? Yes No X Maybe Response: A substantial reduction in public water supplies will not occur as a result of project approval. Mitigation: None required. i. Exposure of people or property to water related hazards such as flooding? Yes No X Maybe Response: The project site is not within a designated flood zone area and therefore no people or property will be subject to a flood hazard. See Response Item 3d. Mitigation: None required. 4. Plant Life. Will the proposal result in: a. Change in the diversity of species, or number of any'native species of plants (including trees, shrubs, grass, crops and aquatic plants)? Yes No X Maybe Response: The property is located in a foothill woodland habitat and the proposed project will not significantly affect the diversity of the area plant life. See Response Items 1a & 3d. Mitigation: None required. b. Reduction of the numbers of any unique, rare or endangered species of plants? Yes No . X Maybe Response: See Response Item 1a. ■ Butte County Development Services Department ■ Planning Division ■ 5 Mitigation: None required. c. Introduction of new species of plants into an area of native vegetation, or in a barrier to the normal replenishment of existing species? Yes No X Maybe Response: There are no physical changes affecting plant life that would result from this rezone. See Response Item la. Mitigation: None required. d. Substantial reduction in acreage of any agricultural crop? Yes No X Maybe Response: The site does not contain any agricultural crops and is presently undeveloped. The character of the site is foothill woodland and canyon land. The nature of this project would not, in and of itself, impact the site were it characterized by agricultural acreage or not. See Response Item la. Mitigation: None required. 5. Animal Life. Will the proposal result in: a. Change in the diversity of species or numbers of any species of animals (birds, land animals, reptiles, fish, shellfish, benthic organisms or insects)? Yes No X Maybe Response: The proposal will not result in a substantial change in animal habitat. Mitigation: None required. b. Reduction of the numbers of any unique, rare or endangered species of animals? Yes No X Maybe Response: The proposal will not result in any reduction of any species of animals. See Response Item la. Mitigation: None, required. c. Introduction of new species of animals into an area, or in a barrier to the migration or movement of animals? Yes No X Maybe Response: See Response Item la. Mitigation: None required. d. Deterioration to existing fish or wildlife habitat? ■ Butte County Development Services Department ■ Planning Division . 6' Yes No X Maybe Response: See Response Item 1a. Mitt ation: None required. 6. Noise. Will the proposal result in: a. Substantial increases in existing noise levels? Yes No X Maybe Response: The proposal will not result in a substantial increase in noise created on-site or in the vicinity. Mitigation: None required. b. Exposure of people to severe noise levels? Yes No X Maybe Response: No noise will result from this project. Mitigation: None required. 7. Light and Glare. Will the proposal produce substantial new light or glare? Yes No X Maybe Response: This project will not create any new light or glare. See Response Item la. Mitigation: None required. 8. Land Use. Will the proposal result in a substantial alteration of the present or planned land use of the area? Yes No X Maybe Response: The proposal will not alter the land use in the area. The proposal will not alter the rural residential use of the parcel. The project site is zoned ARMH-3 and R-C. The ARMH-3 zone allows one dwelling unit per 3 acres, while the R-C zone does not allow any residential uses. The site is designated by the Butte County General Plan as Agricultural Residential in the ARMH-3 zoning area, and Grazing&Open Land in the R-C zoning area. The proposed project would extend the ARMH-3 zoning classification eastward to encompass an additional 31+/-acres, bringing the total acres of the parcel to approximately 37 acres with this classification. The remaining approximate 58 acres would remain R-C (Resource Conservation). Mitigation: None required. 9. Natural Resources. Will the proposal, result in: a. Substantial increase in the rate of use of any natural resource? ■ Butte County Development Services Department ■ Planning Division ■ 7 Yes No X Maybe Response: The proposal will not affect the use of any natural resource. See Response Item la. Mitigation: None required. b. Substantial depletion of any non-renewable natural resource? Yes No X Maybe Response: See Response Items la and 9a. Mitigation: None required. 10. Risk of Upset. Will the proposal involve: a. A risk of an explosion or the release of hazardous substances (including, but riot limited to, oil, pesticides, chemicals, or radiation) in the event of an accident or upset conditions? Yes No X Maybe Response: See Response Item la. Mitigation: None required. b. Possible interference with an emergency response plan or an emergency evacuation plan? Yes No X Maybe Response: There is not an adopted emergency response plan or evacuation plan that for this area and therefore the proposed project will not affect any such plan. This is not a development project that could potentially impact upon any emergency evacuation plan, were there one in existence. Mitigation: None required. 11. Population. Will the proposal alter the location, distribution, density, or growth rate of the human population of an area? Yes No X Maybe Response: The proposal will not affect the population of the area because the proposal is not a development project but rather a plan project, that is, a change in zoning classification. Mitigation: None required. 12. Housing. Will the proposal affect existing housing or create a demand for additional housing? Yes No X Maybe Response: This project will not result in the creation of new parcels for residential development. Approval of this proposal will allow the applicant, with approval of a General Plan amendment, to have more flexibility in determining n Butte County Development Services Department ■ Planning Division ■ 8 ' his building site.. Any creation of additional parcels that would affect existing housing or create a demand for additional housing would first require an application for a Tentative Parcel Map. Mitigation: None required. 13. Transportation/Circulation. Will the proposal result in: a. Generation of substantial additional vehicular movement? Yes No X Maybe Response: This proposal will not generate any additional vehicular traffic to the local area than is already permitted. Mitigation: None required. b. Effects on existing parking facilities or demand for new parking? Yes No X Maybe Response: The proposal will not affect parking because compliance with the parking standards contained within Butte County Code Section 24-240 will be enforced. Mitigation: None required. c. Substantial impact upon existing transportation systems, including public transportation services? Yes No X Maybe Response: An increase in congestion and maintenance requirements on area roads and on public transportation services will not result due to project approval. At this stage of entitlement changes--approval of a GPA and rezone -- the applicant will only be able to construct his one home on this 95 acre parcel, only with a greater degree of flexibility regarding where that building envelope shall be located. Currently, he is permitted to build his one residence, but is confined to a narrow portion of his parcel without a GPA and rezone. Mitigation: None required. d. Significant alterations to present patterns of circulation or movement of people and/or goods? Yes No X Maybe 4 Response: The proposal will not alter the present pattern of circulation in the area. The existing access to the parcel, Tika Lane, will continue to provide access to Nimshew Road,a collector street/minor arterial. The circulation pattern on Nimshew Road will not be affected. Mitigation: None required. e. Alterations to waterborne, rail or air traffic? Yes No X Maybe ■ Butte County Development Services Department Planning Division . 9 Response: The project is not located near any railroads,'harbors, or airports and will therefore have no effect on those facilities. Mitigation: None required. f. Increase in traffic hazards to motor vehicles, bicyclists or pedestrians? Yes No X Maybe Response: The proposal will not result in an increase in traffic and related traffic hazards in the area. See Response Items 12, 13c and 13d. Mitigation: None required. 14. Public Services. Will the proposal have substantial effect upon or result in a need for new or altered governmental services in any of the following areas: a. Fire Protection? Yes No X Maybe Response: The project is located in an area with a high fire hazard designation. The proposal will not result in an incremental increase in demand for fire protection in the area. Were this rezone the only step, or discretionary act, the applicant had to meet in order to proceed with his development plans, approval of this rezone would pose a potentially significant increase in demand for public services. At this stage, approval of this rezone only means that the applicant, with approval of an additional discretionary step(an approved General Plan amendment), will be given more flexibility as to where he may build his home. Mitigation: None required. b. Police protection? Yes No X Maybe Response: See Response Item 14a. Mitigation: None required. c. Schools? Yes No X Maybe Response: The proposal, a legislative act, is subject to full mitigation costs. Mitigation: None required. d. Parks or other recreational facilities? Yes No X Maybe Response: See Response Item 14a. Mitigation: None required. e. Maintenance of public facilities including roads? Yes No X Maybe Response: See Response Item 14a. ■ Butte County Development Services Department . Planning Division . 10 • • Mitigation: None required. f. Other governmental services? Yes No X Maybe Response: See Response Item 14a. Mitigation: None required. 15. Energy. Will the proposal result in: a. Use of substantial amounts of fuel or energy? Yes No X Maybe Response: See Response Items la, 2a, 13c, and 14a. Mitigation: None required. b. Substantial increase in demand upon existing sources of energy or require the development of new sources of energy? Yes No X Maybe Response: See Response Items la, 2a, 13c, and 14a. Mitigation: None required. 16. Utilities. Will the proposal result in a need for new systems or substantial alterations to the following utilities: a. Power or natural gas? Yes No X Maybe Response: See Response Item 2a. Pacific Gas and Electric already has distribution lines in the area and can serve the energy requirements of this project without substantial alteration to existing facilities. Mitigation: None required. b. Communication systems? Yes No X Maybe Response: See Response Items la and 2a. Mitigation: None required. c. Water? Yes No X Maybe Response: See Response Items la, 2a and 3d. Mitigation: None required. d. Sewer or septic tanks? Yes No X Maybe Response: The applicant is currently allowed to build one single family residence on his parcel. With approval of this rezone, the applicant still will only be allowed to build one single family residence on his parcel. With approval ■ Butte County Development Services Department Planning Division ■ 11 of a rezone to be configured with the GPA„ the applicant will still only be allowed to build one single family residence on his parcel, but now will have flexibility as to where he may build it. The demands on any septic system will not be increased by this rezone over what the current status of the property would require. Any additional substantial changes to septic requirements resulting from the future potential of further development on this parcel as a result of approval of this rezone will require an application of a Tentative Parcel Map. At that time, the County will have an opportunity to address any and all potentially significant, substantial, incremental, and cumulative impacts relating to a development project. Mitigation: None required. e. Storm water drainage? YesNo X Maybe Response: See Response Item 16d. Mitigation: None required. f. Solid waste and disposal? Yes No X Maybe Response: Currently, the Butte County Landfill still has capacity to serve any development proposed on this parcel by the applicant. See Response Item 16d. Mitigation: None required. 17. Human Health. Will the proposal result in: a. Creation of any health hazard or potential health hazard (excluding mental health)? Yes No X Maybe Response: The proposal will not create any health hazard. See Response Items la, 2a, 14a, and 16d. Mitigation: None required. b. Exposure of people to potential health hazards? Yes No X Maybe Response: The proposal will not expose people to any health hazard. See Response Items la, 2a, 14a, and 16d. Mitigation: None required. 18. Aesthetics. Will the proposal result in the obstruction of any scenic vista or view open to the public or will the proposal result in the creation of an aesthetically offensive site open to public view? Yes No X Maybe Response: See Response Items la, 2a, 8, 13c, 14a, and 16d. Mitigation: None required. 19. Recreation. Will the proposal result in an impact upon the quality or quantity of existing recreational opportunities? l ■ Butte County Development Services Department Planning Division ■ 12 Yes No X Maybe Response: The proposal will not result in an impact on the quality or quantity of existing recreational opportunities in the area. See Response Items la, 2a, and 16d. Mitigation: None required. 20. Cultural Resources. a. Will the proposal result in the alteration of or the destruction of a prehistoric or historic archaeological site? Yes No X Maybe Response: The proposal will not affect archaeological sites. The subject property is located in an area designated as having high archeological sensitivity in a portion of the parcel. The area which is indicated as being most sensitive will remain in the Grazing & Open Land General Plan designation and R-C zone (Butte County Archaeological Constraints Map). See Response Items la, 8, 14a, and 16d. Mitigation: None required. b. Will the proposal result in adverse physical or aesthetic effects to the prehistoric or historic building, structure or object? Also please find fees in the amount shown on the attached fee schedule. You will notice that I have also included a statement from the owner regarding his need for the requested actions and his proposal for accomplishing same. In discussions with staff, I was told that the general plan designation boundary is not necessarily parcel specific. As such, might it be possible that the appropriate body could simply use this application to make a more precise determination of the actual boundary? As you are aware the existing boundary is the section line. This boundary seems at best arbitrary and we would hope that a critical analysis of the existing topography would allow some discretion as to the exact . boundary location. It is quite obvious that the canyon area on both sides of Butte Creek are unsuitable for development due to slope and is correctly identified as RC. However, west of the Hupp canal the ground is much flatter and could be seen to have viable residential uses. Considering this, would it not make sense to utilize the Hupp Canal as a physical, identifiable boundary between the two land use designations? I am unsure of the authority needed to make such a determination, but if it were possible, we would need only to apply for a rezone. Please research this possibility and contact this office. With this letter we would also like to acknowledge the existing traffic problem on the upper Skyway. As a result of this acknowledgement, we understand that any land divisions would require mitigation of this problem. It is the current desire of the applicants to secure a more acceptable building site, but they would also like to have the option of creating a few additional parcels if and when the traffic problem is solved. 20 DECLARATION DRIVE _ CHICO, CALIFORNIA 9.5.9.26 916-893-1600 June 9, 1995 ' Rezone and General Plan Amendment Page 2 Should you have any questions, or require further information, please give me a call at 893- 1600. Sincerely, NORTHSTAR ENGINEERING 0 James A. Stevens, PIS cc: Dan Pickard 6/19/95 Dear Mr. Sanders, I have recently purchased a 94 acre parcel, located off Nimshew Road. The property is currently zoned R-C with an awkward 100x2600 ft. strip zoned AR-MH-3. Since my primary purpose for purchasing the property is to build a home, the awkward shape of the buildable section is extremely undesirable. While there are a few buildable spots on this small strip, there are several other factors which make it even less desirable. First, the buildable strip is adjacent to several lots which have the potential to be divided into small 3-acre parcels. Hence, the adjacent land may eventually contain relatively dense housing and I would be restricted to build within 100 feet of it. Additionally, the adjacent land has been heavily logged and will be extremely sparse for many years to come. Finally, because of the shape of the AR-MH-3 zoning, my home will be restricted to unrealistically long and narrow dimensions. I am therefore including a proposal that would extend the AR-MH-3 boundary line to yield a more practical building site.. I realize that there is a need for R-C zoning to provide wildlife habitat in the area, particularly near the Middle Butte Creek. However, I believe that the enclosed proposal will not adversely affect the region's wildlife habitat. Indeed, I am including several measures which will enhance the existing habitat. I have included two checks ($2291.00 for the rezoning fee and$2043.00 for the general plan amendment). The requested action may be possible without a general plan amendment by making a more precise interpretation of the land use designation line. If this is the case, it is my hope that the amendment check can be returned. If you have any further questions I can always be reached at my pager number (510) 321-5744 or you can leave a message at (707) 425-5435. I appreciate you spending the time to look at the proposal and I look forward to any comments you might have on how I might improve it. Thank you, Dan Pickard Requested Action A. Rezone of parcel#064-010-031 to extend the existing AR-MH-3 zoned section Proposed Habitat Enhancements A. Reforestation of previously logged regions with native trees B. Determination and re-establishment of native flora C. Introduction of nesting boxes for several bird species Details The enclosed drawing (Fig. 1) illustrates the approximate location of several natural features of the property. The information was extracted from a recent boundary survey and the "Paradise East"USGS map (inset on Fig. 1). Of particular interest is the flat or gently sloping region on the west boundary of the property (indicated by green shading). While most of this flat region is very similar to the flat region west of the property, only a 100 ft. segment is zoned AR-MH-3 (indicated by blue shading). The limited extent of the buildable region appears to be an artifact of the arbitrary location of the section lines rather than a natural geographic feature. It therefore seems reasonable that a modest zoning line adjustment to follow the geographic features would keep in the spirit of the original zoning yet provide a more practical building site. In fact, it appears as though the rezoning might be accomplished by simply making a more specific interpretation of the land use designation line thereby increasing the precision of the delineation between the two zones. There are several possible configurations for the zoning line modification. The most logical configuration would simply extend the AR-MH-3 boundary to the Hupp Canal (an abandoned ditch used for mining). The latter seems particularly desirable because the Hupp Canal follows the natural geographic contour lines which tends to separate the property's flat regions from the steep region. Additionally, the Hupp Canal is an unambiguous and easily recognizable feature. To improve the property's wildlife habitat, several enhancements are proposed. First, to speed up the recovery from the recent logging, the thinnest regions and most of the logging roads will be reforested with native trees. Second, native flora will be replanted throughout the property. A botanist will be consulted to determine which species are native to the area and which will be the most beneficial to wildlife of the region. Finally, two dozen nesting boxes of varying sizes will be positioned throughout the property. These should provide additional nesting sites for a wide variety of birds. r A roximte Boundary - pp ou dary of Parce 064-010 031 j 3 r 482' ' r 27 ' ,z .J Proposed Rezoning Configuration 673' Photo Copy of USGS Topographical Map Paradise East, parts of section 26 & 27 1211' Parcel#064-010-031 outlined o x.
