Lee - (Item on which environmental documents have not been completed) General Plan Amendment from Orchard and Field Crop to Agricultural Residential and Rezone from A-10 (Agricultural - 10 acre parcels) to SR-1 (Suburban Residential - 1 acre parcels) on 10 +/- acres to allow future development of a nine lot subdivision with minimum lot sizes of one acres on property located at 2591 Burdick Road, at the southeast corner ` of Burdick Road and Turner Lane, Durham. (SH) (GPA File 96-05 & REZ File 96-06) Stephen Hackney summarized the staff report. HEARING OPEN TO THE PUBLIC James Lee said that he and his sister Martha inherited the property upon the death of their mother. He presented and submitted a written statement from himself and his sister in response to the Agenda Report. He said since the request is for a General Plan Amendment and Rezone, a finding of conflict with the current General Plan and Zoning does not make sense. The request is not in conflict with the way the surrounding land is being used. Mr. Sanders said that since the adjacent subdivisions have been approved, the D2NP and the Ag Element of the General Plan have been adopted, so the inconsistencies are not just with the Land Use Element of the General Plan. Mr. Lee objected to the concept that agriculture and residential uses are in conflict. He said one acre lots would be exactly the same as the subdivision to the north. He noted the Ag Element talks about the capacity to earn a reasonable living from farming. He and his sister, and his mother earlier, have not been able to make a living from the property. He submitted a copy of their profit/loss statement for 13 years. He noted that from the current wheat crop, they will get about $700. He described how the property is surrounded by a subdivision to the north, SR-1 zoning to the east and 5 acre parcels to the south which are not used for farming. He said it is very difficult to find someone to farm the parcel due to its small size. He did not feel the proposal would be in conflict with the goals and policies of the General Plan and would be harmoniouswith surrounding properties. Mr. Lee showed a video of the proposed rezone and surrounding properties. He noted that the 5 acre parcels to the south are zoned A-10 and not being used for agriculture, although owners of those parcels would like the Lee property to remain in agriculture in order to maintain the agricultural character of the area, which seems discriminatory, unfair and arbitrary. He-noted the Peterson subdivision is already zoned SR-1 and will be a subdivision eventually. v BUTTE COUNTY PLANNING COMMISSION,--MINUTES — April 24, 1997 Martha Gore referred to the profit/loss statement from 1983 to 1996 showing profits of $13,249 and losses of$35,533. She said the trees were replanted in March, 1970, with production beginning after 5 years. Since they don't have the equipment to farm the land themselves, they lease it out at 75%/25%. 25% from 8-1/2 acres cannot support one person. Their mother had dementia in the last years of her life and the land across the street had to be sold off to pay for her care. Money was owed on a loan to the Federal Land Bank when their mother died. Ms. Gore and her brother do not have the money to farm the land and make a living on it. Ms. Gore would like to keep the family home and not have to'sell the property. Fred Gerst felt the request should not be approved because of policies of the Ag Element. He said there are crops such as cut flowers and strawberries which can be farmed on 8.51 acres. Gail Raabe submitted a letter of opposition from she and her husband Carl, the adjacent property owners to the south. She said they are opposed to the proposal because it would be detrimental to the area and their property in particular. The proposal is contrary to the General Plan which recognizes that urban development is not compatible with farming. They intend to farm their parcel intensively. She said UC Davis published an article about the problems occuring when urban dwellers move in adjacent to farms one of which is trespassing, which the Raabe's have already experienced with the residents on Burdick Road using their burn pile as a dump. The Raabe's intend to use fish emulsion and manure for their organic farming, which have potent odors which adjacent residents would not appreciate. There will be noise and dust. The Raabe's have built a greenhouse but cannot farm yet because they must go several years without using pesticides or weedkillers. According to a 1992 Wall Street Journal article there are many small labor intensive crops that can be grown on small farms. Approval of the rezone will lessen her property value considering the intended use. If the rezone is approved their only alternative to maintain value will be to subdivide their property which will negatively effect the next .property owner. She thinks residential property should be separated from agricultural property, for instance out by Highway 99, and vina loam should be preserved. Chairman Lambert said there was previous opportunity for input into the D2NP and the Ag Element. She was in favor of leaving the property as a transition zone and could see no reason to change the General Plan or Zoning. Commissioner Nelson felt that the people on five acre parcels have the right to do whatever they want on their property as long as they retain the integrity of the zone. He was opposed to moving the line and was in favor of retaining the transition zone. Chairman Lambert said the five acre parcels were pre-existing to the A-10 zoning.
