The southern most portion of the project lies at the eastern end of Nora Way. The entire project is located approximately two (2) miles southeast of Palermo. 'RELATED ITEMS: Negative Declaration for TPM, March 30, 1990 FOR: Board of Supervisors Meeting of September 27, 1994 ABSTRACT: This is a rezone request that was initiated by Betty Simpson on July 12, 1990, in order to comply with the conditions of her Tentative Parcel Map. On May 21, 1990, the Butte County Advisory Agency approved a Tentative Parcel Map to divide the 740+ acre site and create thirty-seven (37) parcels of twenty (20) acres each. As a Condition of the map, the applicant was required to pursue a 20 acre minimum zoning. The Planning Commission recommended adoption of the Negative Declaration and adoption of an Ordinance rezoning the land to A-20. Publishing fees were not paid, so Rezone #90-36 (new File No. 95-36) was not heard by the Board of Supervisors. Rezone #90-36 has been dormant since that time. The purpose for the Rezone still remains and this item needs to be completed. Adoption of the Rezone is recommended. PROJECT CHARACTERISTICS: The project site consists of approximately 740+ acres of rolling foothill terrain with numerous drainage channels/ravines. Slopes vary from 2%to 30+%. Elevation varies from 275' to 475'. Natural hazards for the site include: * a fault zone traversing the property; * extreme fire hazard * high potential for expansive soil; and ■ Butte County Department of Development Services - Planning Division ■ 1 • AGENDA ITEM * erosion-disturbed slopes. Vegetation consists of Oak Foothill Woodland. A portion of the project is located within a winter deer range. The project area represents a large undisturbed area that provides habitat for numerous animals. The site provides some visual qualities, with rolling hills, and some vistas open to the valley with views of the Sutter Buttes. The area-is characterized by rural residential uses and grazing. Parcel sizes of surrounding land vary from 5 acres to 400 acres. The nearest urban area is Palermo, four miles away, and Oroville, eight to ten miles away. While researching background information on the Bernard Gucker Tentative Parcel Map, AP# 027-130-026 (also under consideration by the Board), it was discovered that this parcel was one of the 37 parcels incorporated in Rezone #90-36. The Gucker TPM was found, by the Development Review Committee, to be inconsistent with the General Plan designation and denied. ANALYSIS: A Rezone is a legislative act, therefore, it is not subject to time limits under the Permit Streamlining Act, even,though four years have passed. . This project is for a Rezone from A-5 (Agricultural - 5 acre minimum) to A-20 (Agricultural - 20 acre minimum) on 740+ acres located approximately four miles southeast of Palermo. The proposed rezone is a Condition that was required by the Butte County Advisory Agency (Development Review Committee) to allow the recordation of the Betty Simpson Tentative Parcel Map, AP# 027-130-009, 012, etc.. The parcel map was approved, finalized, and recorded in 1990. While both projects were supposed to proceed in a concurrent manner, the publishing fees for the rezone were not paid and the project was not placed on the agenda for the Board to hear. The Butte County General Plan designates the project area as Agricultural-Residential. The A-5 zone became effective in 1970, approximately nine (9) years prior to the adoption of the current General Plan. The A-5 zoning classification is considered a conditionally consistent zone within the requirement of specific criteria be present to deem the zone consistent with the Plan. The Butte County Advisory Agency (DRC) found the present A-5 zoning classification did not meet the conditional zoning or development criteria nor the zoning factors outlined in the Butte County General Plan Land Use Element. Existing A-5 zoning for this property, therefore, is inconsistent with the General Plan. i I ■ Butte County Department of Development Services - Planning Division ■ 2 AGENDA ITEM To prevent any further subdividing of the 37 lots approved as part of the Simpson TPM, and to eliminate the conditional conformance with the General Plan, since it has been determined not to apply, the Planning Commission recommended the A-20 zoning. The A-20 zoning classification is considered a consistent zone under the Agricultural-Residential General Plan designation. The A-20 zoning classification also represents the characteristics of the project site and the overall rural residential aspects of this portion of the County. The A-20 zoning amendment was reviewed for general environmental quality and an Initial Study was completed under the California Environmental Quality Act (see Initial Study for the Tentative Parcel Map dated .March 30, 1990). This Initial Study was considered adequate in addressing the environmental concerns of Rezone#90-36 (Letter to applicant, August 1, 1990; Memo to Board of Supervisors, August 7, 1990). The Initial Study concluded that although the proposed project could have a significant effect on the environment, there would not be a significant effect in this case because the mitigation measures adopted for the tentative parcel map reduces the environmental impact to less than a significant degree. A Negative Declaration was prepared stating such. . The primary mitigation of this 1990 Negative Declaration for the TPM was that the applicant was to: "Apply for and diligently pursue a 20 acre minimum zoning." Dating back to 1989, the applicanct's engineer and representative, responding to County staff's suggestion, agreed ". . . to apply for and diligently pursue a 20 acre minimum rezone (see.Letter, October 31, 1989)." In March 1990, County staff recommended the following mitigation measure: 1. Apply for and diligently pursue a 20 acre minimum zoning (see Letter, March 6, 1990)." The project engineer agreed to this and other mitigation measures in a letter dated March 21, 1990. With this agreement, County staff completed the final Initial Study for the Tentative Parcel Map on March 30, 1990. A Negative Declaration that had been prepared for the Simpson TPM, was accepted as the Negative Declaration for the Simpson Rezone in accordance with the California Environmental Quality Act. No significant affects are anticipated from the proposed zoning amendment to A- ' 20. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality.Act (CEQA) and as such, is subject to the requirements of CEQA. An Initial Study has been prepared by County staff for the Simpson TPM and accepted by the Planning Commission for the Simpson Rezone. Based upon the review of the Initial Study, staff has determined that there are no project impacts anticipated, from the proposed zoning amendment to A-20. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. ■ Butte County Department of Development Services - Planning Division ■ 3 AGENDA ITEM Public notices are mailed to all property owners within a 300 foot radius of the subject property, but not less than 30 parcels. RECOMMENDATION: Staff recommends that the Board of Supervisors adopt an Ordinance approving the Rezone File No. 95-36 (old File No. 90-36) on AP# 027-130-015, 027-130- 020/028, 027-180-024/051 (formerly AP# 027-130-009, 012, 013 and 027-130-011, 014), subject to the following findings. Section 1: Environmental Findings. A. An Initial Study was completed in compliance with the California Environmental Quality Act identifying potentially significant environmental effects that the project may have. Provisions and the design of the project and the conditions added to the project will mitigate such effects to a level of insignificance; and B. A proposed Negative Declaration has.been completed in compliance with the California Environmental Quality Act. C. The Board of Supervisors has independently reviewed, analyzed and considered the Negative Declaration and finds that said Negative Declaration sufficiently addresses this project; and Section 2: Zoning Ordinance Findings. I really hate to see government hand out so many dictates . How about a. burglar alarm requirement for better police protection? A mandatory course in C.P.R. , if a person lives more than 4 minutes from a medical facility, would save alot of lives . I bet statistics would prove very few wildlands -fires are started by a house burning down. Usually, the wildlands fire burns the house and a sprinkler system would be of little or no use in this I nstance. However, I won't debate philos?pbies with you as I know you have little or no control over these things . I just felt something should be said on behalf of my clients . It seems we just sit . by while more and more restrictions are "piled on" . Individually they may not be bad, but as we say in the environmental world the "cumu- lative effect" is- burdensome, costly, time consuming and in my opinion not justified. The present zoning is A-5. . The 5 acre minimum was originally adopted in 1957. The Land Use Plan Map of the Butte County General Plan designates this area as Agricultural-Residential . There are no specific or community plans for the area. An archaeological survey has been prepared on-site. Four prehistoric and three historic cultural resources were recorded. No mitigation measures. are required. Clearance is recommended. The geologic survey recorded numerous faults, lineaments and ground ruptures in the vicinity . No faults cross this property ; geologic ' hazards are moderate. The California State Department of Real Estate has determined that the map does not qualify as a land project. A specific pian is not required. Palermo Union School District has expressed concerns about providing transportation to students generated by the subdivision . A review of the deer herd maps indicates the land is within winter range of migratory deer herds. Department of Fish and Game recommends 20-40 acre minimums. A Zone A floodway covers portions of Lots 13-26. This floodway must be designated a no-development area. Development of 48 lots will significantly increase demands for governmental services. There are no Sheriff patrols or fire hydrants; fire protection is 5 miles west in Palermo. No mitigation measures have been offered to reduce impacts to public services. The development is large enough to support a County Service Area for construction and maintenance of infrastructure such. as fire hydrants, road maintenance, and septic system maintenance. Adjacent to the property are contract grazing .lands. Parcel sizes are 400 , 386, and 154 acres. Small -lot development is not compatible in grazing land. Palermo is an important grazing area in Butte County and will be significantly impacted by the development of rural ranchettes. As land use conflicts increase, the industry will be displaced. Adopted policy of the County of Butte is to balance residential densities with traffic carrying capacity of existing and proposed circulation plans. The area circulation system (Grubbs, Dunstone) was developed to serve an agricultural community. Page 49 of the Land Use Element -- the site designation criteria, conditional zoning and development criteria, and zoning factors for Agricultural-Residential do not support the creation of parcels of less than 20 acres in size in the project vicinity ( adequate water, sewage disposal capacity , fire protection , ag. compatibility ) . 5. Page 57 of the Land Use Element -- required consistency finding for either a subdivision or zoning may not be based solely on a map determination ' ( 1 - to 40-acre range for Agricultural-Residential ) , but rather upon the objectives, policies, general land uses and programs specified in the entire General Plan . 6. Existing A-5 zoning General-P_lan.� 2 BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS-August 30, 1990 To prevent any further subdividing of the project site and to bring the zoning into conformance with the General Plan,the Butte County Advisory Agency recommended the A-20 zoning. The A-20 zoning classification is considered a consistent zone under the Agricultural-Residential General Plan designation. The A-20 zoning classification also represents the characteristics of the project site and the overall rural residential aspects of this section of the County. The A-20 zoning amendment was reviewed for general environmental quality and an Initial Study was completed under the California Environmental Quality Act. The Initial Study concluded that although the proposed project could have a significant effect on the environment, there would not be a significant affect in this case because the mitigation measures adopted for the tentative subdivision map reduces the environmental impact to less than a significant degree. A Negative Declaration was prepared stating such. The project site has been reviewed by Jenson and Associates Archaeological Consulting and Research and Cultural Resource Management Services for possible archaeological resources and an archaeological clearance was given for all project area lands,except the land area identified as Site Simpson C within the report dated December 6, 1989. For the land area identified as Site Simpson C, the preferred action is project impact avoidance. If impact avoidance cannot be insured, then the site should be formally evaluated for national register of historic places eligibility. As part of that evaluations final report, any effects of the project to those qualities which might be discovered to render this site eligible for the register should be clearly delineated in appropriate recommendations offered. The project site is located in the proximity of Cleveland Hills Fault Zone. As a result the Initial Study required a geologic survey be conducted of the project site to determine the seismic hazard of the area. The geologic survey revealed a suspected fault and concealed fault which runs through the center of the project site. Mitigation measures were approved by the Butte County Advisory Agency to reduce the seismic hazards to future occupants of the site. A Negative Declaration has been prepared for the proposed project in accordance with the California Environmental Quality Act. The State Department of Fish and Game has designated the area as a development zone due to surrounding smaller parcel sizes. Riparian vegetation Is rapidly being lost throughout California. It Is Important to protect and Preserve this plant community for wildlife purposes and erosion control along our stream ways. A "No Development Zone' should be adopted within 100 feet of Wyandotte Creek to preserve the riparian vegetation. "No Development" means no structures, landscaping, vegetation removal or alteration of the soll or topography will be allowed within the designated zone. 6a: Incremental Increases In nolse will occur as people move Into this area. Residential noises at ? density of one dwelling unit per 20 acres will not be significant. 13a,e: The construction at full build out will result In approximately 220 vehicle trips being generated per day. These trips will be divided between 4 different roads leaving the project. Impacts on any one road should not be significant. Most traffic will , however, eventually go through the Intersection of South Villa Avenue and Upper Palermo Road. The latest traffic counts taken In 1989 show an average dally traffic volume of 1,030 vehicle trips on South Villa Avenue. Traffic at this Intersection has steadily Increased over the years from 440 trips In 1983 to 720 trips In 1985 and 770 trips In 1987. 13d: Completion of this project will result In providing a new route for traffic circulation from Grubbs Road to Reservoir Road. This route will not be used by through traffic because of Its Indirect route; but it will provide the necessary circulation and a secondary route for emergency vehicles. 14a: This project Is located In an area of extreme fire hazard. The closest fire station Is located In Palermo, 4 to 6 miles to the northwest. Butte County's ability to provide adequate fire service Is In Question due to financial constraints. The applicant will be required to contribute a $200.00 per iot water tender fee under a current resolution adopted by the Board of Supervisors. This fee will not, however, entirely mitigate the Impacts resulting from this development. It Is anticipated that 37 new homes will be constructed as a result of this project and that these homes will result In additional calls for fire and emergency medical services. Existing bus routes may need to be extended or new routes established to provide transportation to school children. 14e,f: Additional traffic on the rural roads In the area may result In a need for Increased maintenance.. Many roads in the area are dirt or gravel and deteriorate rapidly during the winter months. Most of the roads are private and not maintained by the County so It should not affect the County's Public Works Department. 14f: All development requires governmental services. This project represents a minor Incremental Increase in demand for all county services. 16a,b: Power and phone Imes will have to be extended to serve this development. 17b: If fault lines cross the project, the potential would exist for a seismic hazard. Homes constructed directly on a fault line could be subject to extensive damage. It Is recommended that a geological survey be performed for this project. Should any fault lines be Identified proper mitigation measures will have to be adopted. Unstable earth conditions may occur as a result of seismic activity especially In areas of steeper slopes. I b,c, e,f&3c: There will be some disruption, compaction, displacement and overcovering of the soil as a result of the development of the lots being created. Due to the large lot sizes (20 acres) , the percentage of overcovering Is insignificant. Disruption, compaction and displacement of the soil will occur from road, driveway and homeslte construction. The main road as proposed on the tentative parcel map crosses at least 5 drainage channels, and has sections on slopes exceeding 15%. The amount of earth that will have to be moved and the cuts and fills required to construct the road In the proposed location will be significant, and may require changes In the topography on site.
