Dear Mr: Hogan:
I am writing to respectfully request that you schedule a. pre-development conference for the
subject project. I have enclosed a check in the amount of $250.00 for the processing fee. I
have also attached 12 copies of the map as you have suggested, which along with this letter,
have briefly described our proposal.
Our goal is to achieve a rezone and General Plan change from the existing A-40 to an M-1
designation with a specific plan overlay. It is our intention to ultimately be able to provide
industrial development sites for agricultural processing users.
The following is a brief list of the infrastructure elements contemplated for this project:
Streets:- 60' right-of-ways are proposed for the interior streets with 30 foot radius
returns. An 80 foot width on the entry street is also proposed.
- The entrance will have a monument wall with a landscaped median at the entry
road.
- Street lights are proposed.
- The attached map shows dashed lines on the westerly edge of the site as well
as on the southerly and southeasterly portions. These represent the potential of
future roads and / or the ability to create parcels tailored to the future users
specific needs. At the County's direction, the developers would reserve these
dashed areas as r/w dedications.available for County acceptance during an agreed
upon time period. Should the County decide in the future that it would be
beneficial to provide a through street, these would be available to meet those
needs. N
Fire Protection: A community system is proposed with fire hydrants at County approved
intervals.

Wastewater Treatment: The adjacent industrial developments utilize conventional septic
tank and leach field disposal systems. Initially, we will propose similar systems.
It is understood however, that thorough soils analysis, percolation testing, and
ground water monitoring will be conducted with favorable results achieved prior
to any approval of such a concept. Other solutions may be discussed as more
information regarding the soils make-up is accumulated.
Drainage:- A community storm water treatment facility is proposed. This facility shall
serve as an on-site basin for detention to eliminate any downstream storm peaking
problems as well as to allow filtration and sedimentation of accumulated
pollutants in the storm runoff.
- Interior drainage conveyance is to be achieved via lot line swales and ditches.
These allow for efficient, inexpensive conveyance with the added benefit of
vegetative filtration occurring in the ditch bottoms.
- The treatment facility as shown on the map is also to be utilized for any habitat
restoration or relocation to be done on site.
Landscaping: - It is the developer's intention to landscape the entrance to the project,
the drainage swales, as well as the perimeter of the project along the freeway.
- Walking paths are to be incorporated into the landscaping for the drainage
swales.
- The perimeter of the drainage treatment facility shall be landscaped.
- There shall be CC&R's implemented to insure that on site landscaping be
installed by the lot owners. This is intended to insure adequate landscaping of the
street frontages in-lieu of public right-of-way landscaping.
Biological Resources: - It is understood that a biological and botanical study be
performed in effort to locate any endangered species or habitat residing on the
site. If such are located, a mitigation plan will be prepared and circulated
through the interested agencies for approval. It is anticipated that the drainage
treatment facility can receive a second benefit as a habitat enhancement and
restoration site as well.

A general plan amendment and rezone of. 114 acres at the
intersection of Hwy 99 and Durham-Dayton Road must include the
following Fire Department requirements in order to mitigate the. -
environmental impacts of such a project:
1. A pressurized, water system adequate to produce the minimum
fire flow required for the size and type of buildings proposed.
The hydrant spacing would be a minimum of 300 feet (head to
head) , with minimum of 20 psi for 2 hours.
2. Annexation to CSA 137 (across Durham-Dayton Road) for
redundancy and reliability.
_ 3. Incorporation of the California Fire Code.
4. Automatic fire sprinkler systems as required by the
California Fire Code and the Uniform Building Code.
5. A 1.5 acre minimum site deeded to the County of Butte for use
as a future fire station.
6. ' Some type of funding mechanism to fund a firefighter I
positionat the Butte County Y Fire Station in Durham.
The potential for large and numerous buildings and further
development in the. local proximity dictates the above
requirements Additional items may be added as this project is
expanded with definite plans.

Thank you for the opportunity to review and comment on the above referenced document.
COMMENTS
This conversion constitutes a major change in land use. The County should require a
traffic study as a condition of approval.
The traffic study should consider:
• The potential impacts in the short- and long-term.
• An AM peak hour analysis, when Butte College is in session, as that would be a critical
time period.
• Adding right-turn lanes at the southbound ramp intersection should be considered as
possible mitigation measures for this proposal's impacts on traffic in the area.
• Both safety and operational impacts should be considered, including an analysis of a
truck effects.
The proposed intersection should be located at least 60,40 feet away from the ramp
intersection.
Our review of this document is still pending and additional comments may be forthcoming.

addition to our letter of February 17, 1995.
COMMENTS
A forty foot(+/-)Utility Easement exists adjacent to the State right of way.
Will discharges from the double 8'X 4'reinforced box culvert flow through the southern
boundary of the development?
Provisions to intercept and convey discharges from the cross culverts beneath the Durham-
Dayton Highway and the southbound State Route(SR) 99 on-ramp should be provided.
Approximate location of these culverts have been delineated on the General Plan
Amendment.
A drainage plan and design calculation should be required to demonstrate the conveyance of
runoff from the SR 99 cross-culverts.
Copies of Caltrans As-Built Plans are enclosed for your use.

PG&E operates and maintains an 8 inch high pressure gas pipeline within the boundaries of the
subject property. This gas pipeline is located within a 40-foot wide strip easement lying
adjacent of, and westerly of, the general easterly boundary line. This easement is described in
the following deeds: Book 2592 at page 225 and Book 2592 at page 229 of Official Records,
Butte County Recorder.

The Butte County Development Services Department has received a request for a pre-
development conference regarding a proposed . development located at the southwest
corner of Durham Dayton Hwy. and Hwy. 99. The request will involve a General Plan
Amendment and a Rezone of approximately 114 acres from an agricultural designation
to an industrial designation. The existing zone is A-40, the proposed zone is M-1.
Attached is a copy of a possible subdivision layout.
The purpose of the meeting is to inform the applicant of local or state requirements that
may apply to their project. This allows the applicant to incorporate those requirements
into the design of the project when the actual application is made.
The pre-development conference willbe held in the Development Services Department
conference room located at 7 County Center Drive,Oroville on February 15, 1995 at 9:30
