A. D.A.J.Trust -proposed Negative Declaration regarding environmental review
and Rezone from FR-40 (Foothill Recreational - 40 acre parcels) to FR-20

Mr. Lucas summarized the Agenda Report. ---
Commissioner Lambert asked if the PUD between these parcels has been developed.
Mr. Lucas said the PUD was never completed and the parcel has been recently rezoned to FR-10.
Commissioner Lynch asked about the parcel zoned A-160 to the south connected by a thin strip
to Keefer Road.
Mr. Lucas said that is the location of the former Titan missile facility. He said that the parcel map
on the FR-10 parcel created two ten acre parcels and a twenty acre parcel and appears to have
adequate sewage disposal capacity.
Commissioner Cage asked if the access would be from Richardson Springs Road.
Mr. Lucas said the northern parcel would have access from Cohasset Road and the southern'two
parcels would have access from Richardson Springs Road. There would be no additional access
from Cohasset Road beyond what is currently there.
Commissioner Cage asked about the roads listed on the map.
Mr. Lucas said there are poor dirt roads which will need to be improved to Public Works
standards.
HEARING OPEN TO THE PUBLIC
Mark Adams was present. He said that the parcel configuration is based on logical building sites
and soil quality. Each of the parcels has a good building site. A lot of work has already been
done to resolve the septic issue in order to be able to move forward with the tentative map
process once the rezone is approved.
Commissioner Lambert asked how many parcels will actually be created.

Mr. Adams said the three 40 acre parcels will be made into six 20 acre parcels. The original map
that created the parcels was done in the 1970's. Panorama Drive is basically a "paper road" and
only a goat trail on the ground.
HEARING CLOSED TO THE PUBLIC
Commissioner Lambert asked about the status of the City of Chico study of the foothills.
Mr. Lucas said the study has not been completed at this time. A habitat conservation plan is still
being developed which would include this area. There would not appear to be a tremendous
conflict with this rezone, and any land division would require further review as a parcel map.
Commissioner Seegert did not think this rezone would create a major impact.
Commissioner Lynch said the project is a long way from the City of Chico.
Mr. Sanders said the project is outside the sphere of the City of Chico.
It was moved by Commissioner Lynch, seconded by Commissioner Lambert, and carried
unanimously, for approval of the rezone for DAJ Trust Rezone on AP 047-230-061 and 072, 047-
280-063, as per the findings of the Agenda Report dated June 4, 1996.
FINDINGS:
Section 1: Environmental Findings.
A. An Initial Study was completed in compliance with the California Environmental
Quality Act and no potentially significant environmental effects were identified.

B. This project has the potential to cause environmental damage to fish or wildlife or
their habitat and the collection of Department of Fish and Game Environmental
Filing Fees is required; and
C. .The Planning Commission has independently reviewed, analyzed and considered
the proposed Negative Declaration prior to making its decision on the project, and
the Negative Declaration reflects the independent judgement of the County of Butte;
and
Section 2: General Plan and Zoning Findings.
A. Find that the rezone conforms to the policies, including the text and map of the
Butte County General Plan, because the requested zone is listed as a zone that is
consistent with the requested Agricultural-Residential General Plan designation and
the uses permitted by the zone will be consistent with the General Plan and
surrounding properties; and

Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, move to
recommend that the Board of Supervisors adopt an Ordinance rezoning to FR-20,
that property identified as APN's 047-230-061 & 072 and 047-280-063.
B. Minor changes may be approved administratively by the Director of Development
Services, or designee, upon receipt of a substantiated written request by the
applicant. Prior to such approval, verification shall be made by each Department or
Division that the modification is consistent with the application, fees paid, and
environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.

located on the east side of Cohasset Road between Richardson Springs Road and Keefer
Road, north of Chico.

FOR: Planning Commission Meeting of July 11, 1996
SUMMARY: The proposed rezone to FR-20 is consistent with the adopted General Plan designation of Agricultural
Residential for the area and is consistent with past zoning actions in the area. Staff recommends that the Planning
Commission recommend the Board of Supervisors approve this application.
PROJECT CHARACTERISTICS: This is a request to rezone three parcels of land totaling 121.5 acres of land from
FR-40 (Foothill Recreational-40 acre min.) to FR-20 (Foothill Recreational-20 acre min.) Of the three 40+/- acre
parcels, Site A-047-280-063 is located at the intersection of Richardson Springs Road and Cohasset Road, Site
B - 047-230-061 is located at the intersection of Keefer Road and Cohasset Road and Site C - 047-230-072 is
located on the north side of Richardson Springs Road approximately one mile east of Cohasset Road, in the north
Chico area.
The properties are located at the edge of the foothills and are in an oak woodlands and grasslands vegetation
system. Several seasonal drainages traverse the property from east to west and drain towards Cohasset Road into
the Mud Creek watershed. Soils on site are identified by the U.S. Department of Agriculture as scabland and are
not suitable for any intensive agricultural uses, but are viable for limited seasonal grazing activities.
All three parcels are presently undeveloped. Existing access to Site B is from Cohasset Road, existing access to
Sites A and C are from Richardson Springs Road. Surrounding properties to the north, east, and sduth are generally
40 acres in size and.zoned either FR-40 or TM-40. To the west, across Cohasset Road, the land is zoned SR-5 and
is divided into 5 acre parcels.
ANALYSIS: Section 65860 of the California Planning and Zoning law requires County zoning to be consistent with
the County general plan. The Butte County General Plan Land Use Element designates this property as Agricultural
Residential. The FR-20 zone is identified in the Land Use Element as a zoning designation that is consistent with
the Agricultural Residential general plan designation. The analysis of this project looks at three areas of concern,
a change in land use density, the future access to the sites and the adequacy of the sites for septic systems.
III Land Use
The 121.5 acres located on the east side of Cohasset Road has historically been utilized for grazing activities and
open space. The predominant zoning dictates 40 acre minimum parcel sizes, but the Agricultural Residential
General Plan designation extends for two miles into the foothills, allowing for the potential of 1-40 acre parcels.
Resource oriented and conservation uses have been traditional although residential uses are allowed. This rezone
request would allow the creation of 20 acre parcels which may result in the potential for three additional homesites.
This is a 100% increase in density for the parcels. The Board of Supervisors approved a rezone to FR-10 in March
1996 on an 80 acre parcel located along Cohasset Road adjacent to the parcels in question. This earlier rezone

initial application for FR-5 zoning which could not be exercised due to sewage disposal problems on five acre lots
resulting in the attempt to resolve the issue with a PUD rezone. This PUD was not acted on and the applicant
eventually requested the FR-10 zoning.
The Agricultural Residential General Plan designation indicates that single family dwellings at rural densities are a
primary use and the FR-20 zoning is conditionally consistent based on the following criteria:
1. Compatible with neighboring agricultural activities; and
2. -.Evidence of-adequate water and sewage disposal capacity; and
3. Avail ability'of;adequata fire.protection facilities; and
4. Adequately,maintained approved road'access with sufficient capacity to service area; and
5. Reasonable accessibility to commercial services.
Based on this criteria,the rezone will not impact any agricultural activities, place a substantial burden on fire protection
services or impact water availability. Access to the site is adequate from existing road easements and Cohasset Road
considering the limited traffic generated by the project and commercial services are available in close proximity to the
site. The only criterion that is in question is evidence of adequate sewage disposal capacity. This issue is addressed
in detail later in this report.
This rezone and the subsequent division of the parcels is not expected to create a significant impact to the environment
due to the large parcel sizes and the inclusion of standard conditions that would be attached to a tentative parcel map
approval that would regulate the use of the land for residential uses. The FR-20 rezone would not change any of the
other permitted uses which can be done under the current FR-40 zone. The end result of this action if approved, is
to allow the property owner to make an application for a tentative parcel map for three additional single family parcels.
If it is determined at that time based on current information,that impacts from 20 acre parcels are unmitigable,then
the project may not be recommended for approval. At this juncture in the process,there is little justification to deny
the request,while a substantial arguement can be made for its approval. ,
Access
The rezone would allow for the creation of three additional parcels which would require access from a County
maintained road. The Department of Public Works has indicated that no access to Cohasset Road will be approved.
All subsequent land divisions would require access to taken from Richardson Springs Road which.is poorly
maintained. Given the potential for three additional homesites,the expected traffic on Richardson Springs Road would
be approximately 21 trips a day,which is not expected to be a significant impact.
Septic adequacy:
The Environmental Health Division has indicated that the area proposed for this rezone is characterized by marginal
soil quality and perched groundwater making conventional septic systems problematic. The creation of 20 acre
parcels may not be possible due to these conditions. The recent rezone of the 80 acre parcel adjacent to this project
was plagued by-these same concerns, however,the Environmental Health Division and California Regional Water
Qua lity-Control`Board-.have,given tentative-approval'forseptic systems for two 10 acre parcels, a 20 and 40 acre
parcel..Given,this tentative.approval,,it.is reasonable to-conclude that 20 acre parcels could be provide adequate
septic system requirements. This issue would be thoroughly reviewed at the time of application for a land division and
any land division approval must meet Environmental Health Division and Regional Water Quality Control Board
standards. It may be determined that ten acre parcels cannot support a septic system in this area and no land
divisions will be permitted.

The City of Chico has requested that the County deny this request or continue to action until the County's General Plan
update is complete. The City reasons that any further subdivision of foothill lands is inappropriate until a
comprehensive study of the foothill resources are completed through a cooperative effort by the City and County. The
City states that a foothill resource study would include wildlife and biotic resources,groundwater recharge,viewshed
and animal husbandry. There was also concern for the proximity of this project to the Chico Municipal Airport and the
overflight of this area. The development of the foothills is clearly an issue to be addressed in a comprehensive,
cooperative manner. The proposed rezone will not prevent this type of analysis because the 20 acre parcel sizes will
not create unmanagable developemnt pressures and allow large areas of open space to remain. The airport issue
is suspect in that the City is supporting the Foothill Park East and Bidwell Ranch subdivisions which will put
approximately 2000 residential units directly under the southern approach/departure of the airport. Given these City
actions it does not appear the above airport related concerns are warranted.
The Sheriffs Department has indicated no significant impacts will result from this rezone or the anticipated creation
of six, 20 acre parcels. The Butte County Fire Department indicates that the rezone will result in an incremental
increase in the demand for fire protection services and that all new residential development shall adhere to Public
Resources Code 4290 and the Fire Safe Regulations of Butte County.
ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California
Environmental Quality Act(CEQA) and is subject to the requirements of CEQA. An Initial Study Part 1 has been
prepared by the applicant and Part 2 has been prepared by County staff. Based upon the review of the Initial Study,
staff has determined that the project will not have any impacts to the environment.
PUBLIC NOTICE AND COMMENTS: This application requires.that a public hearing be advertised and held.
Advertisement of the public hearing was published in a local newspaper and were mailed to all property owners within
a 300 foot radius of the subject property. As of the date of this report we have received no public comment.

RECOMMENDATION: Staff recommends that the Planning Commission recommend approval of Application No.
REZ 96-05 for D.A.J Trust,subject to the findings and conditions listed in Exhibit A.

FR-20 located on the east side of Cohasset Road between Richardson Springs Road and
Keefer Road, north of Chico. Supervisorial District 3.

SUMMARY: The proposed rezone is consistent with the adopted general plan for the area and is consistent with past
zoning actions in the area. Staff recommends that the Board of Supervisors confirm the Planning Commission
recommendation and approve this request and adopt an ordinance rezoning this property to FR-20.
PLANNING COMMISSION ACTION: On July 11, 1996 the Planning Commission held a public hearing on this rezone
request. No one spoke against this project and overall there was little discussion on this request. The Planning
Commission accepted the staff report and unanimously recommended that the Board adopt an ordinance rezoning this
property. The Planning Commission agenda report is in attached to this document.
ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California
Environmental Quality Act (CEQA) and is subject to the requirements of CEQA. An Initial Study Part 1 has been
prepared by the applicant and Part 2 has been prepared by County staff. Based upon the review of the Initial Study,
staff has determined that the project will not have any significant impacts to the environment. Additional environmental
documentation will be required at the time of parcel map or subdivision map application.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held.
Advertisement of the public hearing was published in a local newspaper and were mailed to all property owners within
a 300 foot radius of the subject property. As of the date of this report we have received no public comment.
RECOMMENDATION: Staff recommends that the Board of Supervisors confirm the Planning Commission
recommendation and approve this request,Application No. REZ 96-05, and adopt an ordinance rezoning this property
to FR-20 for D.A.J. Trust, subject to the following findings.
FINDINGS:
Section 1: Environmental Findings.
A. An Initial Study was completed in compliance with the California Environmental Quality Act and no
potentially significant environmental effects were identified.
/ This project has the potential to cause environmental damage to fish or wildlife or their habitat and the
collection of Department of Fish and Game Environmental Filing Fees is required; and
C. The Board of Supervisors has independently reviewed, analyzed and considered the proposed
Negative Declaration prior to making its decision on the project, and the Negative Declaration reflects
the independent judgement of the County of Butte; and

EVALUATION OF ENVIRONMENTAL IMPACTS
1. BACKGROUND

D. Project Description and Location: The project to be reviewed is a Rezone to change the zoning on three parcels
of land from FR-40 (Foothill Recreational-40 acre minimum)to FR-20 (Foothill Recreational-20 ace minimum).
The rezone request is consistent with the General Plan designation of Agricultural Residential which allows parcel
sizes between one and forty acres. The three parcels total approximately 120 acres and are further described as
Project Site"A!'(047-280-063)40.7 acres,Project Site"B"(047-230-061)40.3 acres,and Project Site"C"(047-230-
072) 40.5 acres. The property is located in a rural area just north of the City of Chico that is characterized by
increasing numbers of large lot rural residential uses, marginal grazing activities and open space. Project Site"B"
is located on the east side of Cohasset Road at the intersection with Keefer Road. Project Sites"A"and "C"are
bordered on the south by Richardson Springs Road and on the west by Cohasset Road.
The parcels, at present are without any significant improvements other than fencing and cattle grazing related
improvements.The parcels currently have the potential for one single family dwelling per parcel and other resource
extraction or conservation related uses. With an approved rezone to FR-20,the parcels could be divided in half with
a residential density change from 3 units on 120 acre to 6 units. The environmental issues that may result from
such a land division would be completely addressed when an application is made for a land division that indicates
parcel configurations and access requirements. This Initial Study will only address the impacts directly related to
a change in the zoning designation and how this increased density may impact the environment. The parcels if
and when developed with residential uses will utilize private septic systems and wells. Additional project description
and area description can be found in the data sheet at the end of this document.
II. EVALUATION OF ENVIRONMENTAL IMPACTS
1. Earth. Will the proposal result in:
a. Unstable earth conditions or changes in geologic substructures? Yes No X Maybe —
Response: The proposed rezone would allow a density change from one unit per 40 acres to one unit per 20 acres
resulting in a potential increase of 3 additional residential units on 120 acres, a density standard consistent with the
General Plan. This change in residential density will not have a significant impact on earth conditions or geologic
substructures due to the large parcel sizes. Any future attempts to divide the land will require additional environmental
review to assess the potential impacts of additional land divisions on the site at the time an application is made for such
action. Site specific criteria would be examined and all development would be required to meet current county
development standards and Chapter 70 of the Uniform Building Code for earthmoving and related site preparation.

that would be allowed.Any future development of the sites is not anticipated to require substantial modifications to the
existing topography to accommodate site development and no significant surface relief features are located on the site.
Any future attempts to divide the land to the extent permitted by the rezone will require additional environmental review
to assess the potential impacts of additional divisions on the site.

d. The destruction, covering or modification of any unique geologic or physical features?

Response: The site has no unique geologic or physical features that will be impacted by the proposed rezone and future
land divisions would be restricted to 20 acre minimum lot sizes which would provide for considerable open space to
accommodate even insignificant land features. Any future attempts to divide the land to the extent permitted by the
rezone will require additional environmental review to assess the potential impacts of additional land divisions on the site
at the time an application is made for such action.

e. Any substantial increase in wind or water erosion of soils,either on or off-site?

Response: The proposed rezone would allow a density change from one unit per 40 acres to one unit per 20 acres
resulting in a potential increase of 3 additional residential units on 120 acres, a density standard consistent with the
General Plan. The project site is traversed by a number of seasonal drainages that direct stormwater off-site into the Mud
Creek watershed. The expected development of the sites will not result in a substantial impact to these drainage courses
or an increase in erosion of soils because of the large parcel sizes and the limited development that can occur. Itis not
anticipated that future land divisions will cause a significant erosion impacts because impervious surfacing will not be
proportionately significant on 20 acre parcels and all drainage will be required to be maintained at pre-development
levels.Any future attempts to divide the land to the extent permitted by the rezone will require additional environmental
review to assess the potential impacts of additional land divisions on the site at the time an application is made for such
action.
Mitigation: None required.
f. Changes in deposition or erosion of beach sands,or changes in siltation,deposition or erosion which may modify the

occur and all development will be required to meet Uniform Building Code standards enforced by the Building Division.

quality created by the increased traffic generated and the use of wood burning devices. The Butte County Air Pollution
Control Plan does not address the air quality impacts of small developments for possible mitigation measures,but does
recommend panScu/ate control strategies be implemented during construction. Any future attempts to develop the land
to the extent permitted by the rezone will require additional environmental review to assess the potential impacts and
standard air quality control measures will be incorporated at that time.

smoke or fumes beyond what is customary and expected from residential uses at rural densities.

Response: This proposed change in residential density will not significantly affect the local or regional climate. Only
large projects such as the construction of high rise buildings, the creation of large water bodies, massive defoliation, or

no impact on the fire department, but the cumulative affect of such rezones and higher densities does result in an
incremental increase in demand for fire protection services. The proposed rezone will result in the potenfial for three
additional parce/wihomesites in the area and any future attempts to divide the land to the extent permitted by the rezone
will require additional environmental review which will result in mitigation measures/conditions requiring fire sprinkler
systems, water availability requirements and the application of fire safety standards found in Public Resources Code

through a standard septic system. The EHD will require the applicant to submit septic system plans for review and
approval at the time an application is made for a land division. Any proposed system will be required as a
mitigation/condition to comply with the Butte County Environmental Health requirements for usable area as specified in
the County Subdivision Ordinance Improvement Standards(Appendix VII). The property situated between the project
sites was recently approved for a land division and installed a septic system under permit from the EHD. It is possible
that this project will have to design an engineered sepfic system to meet EHD standards.

presence in these areas exposes property owners to potential mountain lion confrontations and/or attacks. Incidents of
mountain lion sightings,confrontations and attacks have been well documented throughout the foothill and mountainous
regions along the Sierra Nevada. At this time no regulations or guidelines exist for mountain lion control or avoidance.

SURVEY FOR VASCULAR PLANTS LISTED AS SENSITIVE,
CONDUCTED BETWEEN APRIL 17 AND APRIL 28 1996, ON APPROXIMATELY
120 ACRES OF PROPERTY LOCATED NORTHEAST OF CHICO MUNICIPAL
AIRPORT, IN SECTIONS 23 AND 26, T 23 N, R 1 E, BUTTE COUNTY,
CALIFORNIA
I
A. Habitat
There are two project sites, both located within a Foothill
Woodland habitat toward the western base of Cohasset Ridge . The
south site consists of about 80 acres of property that has been
disturbed by cattle grazing; the grazing is presently continuing.
The north site, which consists of 40 acres of rolling low hills
with volcanic rock outcroppings, has been grazed in the recent
past but is presently relatively undisturbed. The soils, which
include clay lenses, are generally thin, and volcanic boulders
are strewn throughout all parcels . Although there are ephemeral
drainages throughout the site, there are no permanent streams on
the property itself . However, Mud Creek flows from east to west
just south of the south margin of the south parcels . Elevations
range between 320 and 400 feet .
Access to the sites is via either Cohasset Road or Keefer
Road, a mile or two north of Chico Municipal Airport . The south
site is in the vicinity of the entrance to Richardson Springs
Road, and the north site is at the southeast corner of the inter-
section of Keefer and Cohasset Roads .
There are no paved roads on the property, except for an
abandoned segment of the old Cohasset road toward the northern
margin of the north site . There are gates in the barbed wire
fencing, and a rock fence along the western margin of the site .
A power line traverses the south property from southeast to
northwest in the western half . Past and present disturbances
have permitted the establishment of non-native plant species
throughout the sites, particularly along the roadside margins,
but a significant remnant of native flora persists .
Foothill Woodland
Blue oaks and gray pines characteristic of Foothill
Woodland habitats occur throughout the project area, although
blue oaks are much more abundant than the pines in the south
parcels . At this particular site grassland areas also associated
with Foothill Woodland habitat are extensive .
In addition to the oaks and pines, woody species associated
with the habitat and observed during the field survey include
Parry manzanita, holly-leaved redberry, toyon, California bay,

buckbrush, coffeeberry, western redbud, interior live oak, poison
oak, chaparral honeysuckle, snowberry, and squawbush.
Foothill Woodland habitats also include a variety of annuals
whose seeds germinate during the late winter and early spring
rainy season, and then complete their life cycles by the onset of
summer. Among the annuals observed during the field survey were
valley goldfields, tansy navarretia, tidy tips, blow wives,
silver European hairgrass, cowbag clover, rose clover, tomcat
clover, small-headed clover, white-tipped clover, valley tassels,
johnny tuck, yellow carpet, toad rush, red-stemmed filaree, big
heronbill, windmill pink, field madder, dove ' s foot geranium,
cutleaf geranium, sticky mouse-eared chickweed, poison sanicle,
purple clarkia, lesser rattlesnake grass, peppe.rgrass, popcorn
flowers, dwarf stonecrop, fescue, foxtail grass, dogtail grass,
soft chess, Mediterranean barley, hare wall barley, frying pan
poppy, Italian rye, wild baby' s breath, bicolored linanthus,
bristly Koeler' s grass, Sacramento Valley pogogyne, hedge
mustard, common hedge parsley, whitlow grass, bulbous bluegrass,
bicolored lupine, sky lupine, chick lupine, old man of spring,
small-flowered lotus, foothill lotus, prickly sow thistle,
diamond clarkia, royal larkspur, variable-leaved nemophila,
slender phlox, miner' s lettuce, pink plectritis, field buttercup,
western buttercup, prickleseed buttercup, scarlet pimpernel,
field speedwell, and others .
Perennials occurring in Foothill Woodland habitats often are
bulbous, with some flowering later in the year than do the
annuals . Included in the perennials observed during the field
survey were wild hyacinth, grass nuts, twining brodiaea,
California soaproot, Hansen' s spike mosss, valley manroot,
j pipevine, wild grape, long-tubed iris, and lowland shooting
stars .
A checklist of identifiable vascular plants observed during
the field survey is included at the end of this report .
B. Sensitive Species
The fifth edition of the Inventory of Rare and Endangered
Vascular Plants of California, published by the California Native
Plant Society in February, 1994 , lists for Butte County some 71
taxa that are considered sensitive to varying degrees . A number
of the taxa are also on, or candidates for, federal and state
lists of such plants, and several candidate taxa have been added
since publication of the Inventory.
Several species on state and federal lists of sensitive or
rare and endangered vascular plants have previously been reported
from areas within a few miles of the project site . Most,

however, are associated with special habitats such as vernal
pools, which are not present on the property.
The sensitive species most likely to occur at this site is
Butte fritillary (Fritillaria eastwoodiae) and possibly Butte
checker (Sidalcea robusta) . A few other listed taxa such as Red
Bluff dwarf rush (Juncus leiospermus) , Shippee meadowfoam
(Limnanthes floccosa ssp. californica) , Ahart ' s nailwort
(Paronychia ahartii) , and Tehama navarretia (Navarretia
heterandra) also potentially could occur here .
C. Methods
The field survey was undertaken on dates that may have been
toward the end of normal flowering times for the some of the
sensitive plants . However, the fruiting bodies or other remains
of such plants still were readily identifiable in known local
populations of such plants . When this fact is combined with the
lateness of the flowering. season this year, the timing of the
field survey should not have constituted a significant impediment
to definitive identification.
The survey, which utilized meandering transects throughout
all the property and was conducted entirely on foot, gave special
attention to microhabitats likely to support sensitive species .
Some specimens were taken for microscopic examination, and field
notes were compiled. The scientific nomenclature given in the
checklist conforms to that of Hickman, James : The Jepson Manual,
published by the University of California Press in 1993 . Common
names given are generally those listed in Vernon Oswald' s Manual
of the Vascular Plants of Butte County, California, published by
the California Native Plant Society in 1994 .
A microhabitat that would be ideal for the Butte fritillary
occurs at the base of some large rocks toward the north end of
the north site, and in a few other scattered areas in both the
north and south sites . There are a few more open sites that
could support the rare meadowfoam, and also a few wetter sites
that could support the dwarf rushes and one or two other listed
sensitive species . Several populations of Navarretia seedlings
that were not yet flowering and were unidentifiable were
observed. The seedlings could be those of Tehama navarretia
(Navarretia heterandra) which is not presently on federal or
state lists of sensitive plants, but is designated by the
California Native Plant Society as a "List 4" taxon. List 4
constitutes a watch list of plants with limited distributions
whose vulnerability or susceptibility to threat appears low at
present . Because plants on the list could become threatened if
extensive destruction of their habitat occurs, they are being
monitored and could be transferred to lists of more sensitive

plants in the future . The elevation at the sites is a little
lower than is typical for the Butte checker, but all sensitive
taxa potentially in the area were nevertheless searched for.
With the possible exception of Tehama navarretia (see the
Mitigations section below) , no evidence of current or recent past
occurrence of listed sensitive species was found, despite the
suitability of some of the microhabitats for the support of such
species . Listed sensitive species (with the exception noted)
are presumed not to be present at this time. Accordingly,
mitigations for them do not appear to be required.
D. Miticrations
As indicated above, the Tehama navarretia may be present on
the property along the margins of ephemeral runoff sites . Since
the developer is not planning to disrupt or build on the runoff
areas, and mitigations for the species are not presently
required, it would appear that the plants will have sufficient
protection, should they, indeed, prove to be Tehama navarretia.
There are no valley oaks (Quercus lobata) on the property at
this time . Valley oak is listed by the California Native Plant
Society as not being rare but nevertheless a species whose occur-
rence needs to be monitored. There are, however, numerous blue
oaks (Quercus douglasii) throughout the site, and most state and
local agencies are recommending or requiring that development
plans include mitigations for the preservation of all native
oaks . The requirements generally indicate that plans for the
development of roads and other construction areas should avoid
removing oaks as much as possible, and that when alternative
locations are not feasible, any oaks that are removed should be
replaced by planting new oaks of the same species in a ratio of
at least two replacements for each tree removed. In addition,
native oaks should be avoided in the construction of paved park-
ing areas and buildings, and runoff from fertilized lawns,
streets, and other areas should be diverted away from native
flora.

ATTACHMENT
City of Chico Planning Division staff have received this rezone
request and forwarded the following comments:
The recently adopted City of Chico General Plan included the
subject properties within its General Plan update Planning Area.
The Land Use Diagram of the General Plan designates the subject
properties as Open Space for Environmental Conservation and
Safety. This designation generally assigns density at one
residential dwelling unit per 40 acres, consistent with the
County's General Plan and FR-40 zoning for foothill areas. The
City's Plan also contains policies directing it to seek
cooperation from the County in retaining its designation and 40-
acre minimum parcel size in order to protect foothill resource
values including, but not limited, to wildlife and biotic
resources, groundwater recharge, viewshed and animal husbandry.
This area also is located in proximity to the Chico Municipal
Airport and is subject to overflight to CMA flight operations.
The City's concern is establishing a land use precedence before
the County's General Plan has been updated. Approval of this
.rezone pre-empts the County and the City from a comprehensive
analysis of foothill resources and establishing appropriate land
use- classification through the General Plan process. The City's
understanding at the. time the Agricultural Element to the
County's General Plan was adopted, was' that the County would
conduct a comprehensive review of Grazing Land areas along the
foothills during the Land Use and Open Space Element portions of
its Plan update. The City respectfully -requests that the County
deny or continue action on this request until such review occurs,
including an opportunity for a broader public input.
