Chairman Leland said they had a letter of withdrawal from the applicant asking that this hearing be vacated.
It was moved by Commissioner Lambert, seconded by Commissioner Nelson, and unanimously carried to
vacate this hearing.

General Plan Amendment from Orchard and Field Crops - 40 acre minimum to Orchard and Field
Crops - 20 acre minimum, and Rezone from A-40 (Agricultural - 40 acre parcels) to A-20
(agricultural - 20 acre parcels) located on the northeast corner of State Route 99 and Ord Ranch
Road, identified as a portion of APN 025-190-082, Gridley. (SB) (GPA/RZ 97-04)
Mr. Betts said the project was published prior to receipt of the request to withdrawal this application. He
said there is a legal question as to whether the land owner can withdraw the application. He said the
Commission might want to continue this hearing until such time as the applicant and land owner can resolve
the problem. He said the Commission should not be put between the applicant and the land owner.

The hearing was opened to the public.
John Christofferson, GDA, requested this item be continued-open for 2 months for the heirs and applicant
to work this out.
Chris Morris, legal owner, said he will contest this application. He said he was getting a lawyer.
It was moved by Commissioner Nelson, seconded by Commissioner Mooney, and unanimously carried to
continue this hearing open to February 25, 1999, at 9:00 a.m.

I. BACKGROUND:

5. Project Description and Location of Parcels: This project is a request for a General Plan
Amendment to change the land use designation of a 22-acre portion on a 73-acre parcel from
Orchard and Field Crops- 40 to Orchard and Field Crops-20. This project is also a rezone
from A-40 (Agricultural - 40-acre minimum parcel size) to A-20 (Agricultural - 20-acre
minimum parcel size)on the 22-acre portion. A large drainage canal divides the site, and the
proposed zoning boundary follows the canal. The project site is located on the northeast
corner of State Route 99 and Ord Ranch Road, Gridley.
The change in zoning would allow the applicant to apply for land division to create a 22-acre
parcel and a 51-acre parcel. A single-family dwelling unit could be placed on the 51-acre
parcel.
The project site is developed with a dwelling unit, several agricultural buildings, and two
separate prune orchards. A machine shop is being operated out of one of the buildings.
Domestic water for the dwelling unit is obtained from an on-site septic system, while sewage
disposal is handled by an on-site septic system. The project site is level with no unusual
physical features. Surrounding parcels are developed with agricultural uses and single family
dwelling units at rural densities, a PG&E substation, and a garbage/recycling transfer station.
The Gridley Cemetery is located directly across Highway 99 from the project site.
Surrounding parcels range in size from 2.2 to 103 acres. Additional project description and
area description can be found in the data sheet at the end of this document.

Response: The project parcel is 73f acres in size, and is presently zoned A-40. The site has
a General Plan Land Use designation of Orchard and Field Crops-40.
Surrounding parcels are zoned A-40, M-2, and P-Q. Land use on surrounding parcels is
agricultural(orchards and row crops), and many parcels contain a single family dwelling
unit. A PG&E substation and a garbage/recycling transfer station are located on the site's
south boundary. State Route 99 (SR 99) lies on the western boundary, and the Gridley
Cemetery lies directly across SR 99 from the site.
The site has a General Plan Land Use designation of Orchard and Field Crops-40. The
applicant's proposal for Orchard and Field Crops-20 is necessary because of Policy 1.6 of
the Agricultural Element. Due to this policy, an A-40 zone is only consistent with an
Orchard and Field Crops-40 land use designation. As previously mentioned, the applicant
desires to divide the subject property. The proposed boundary of the land division-a large
canal- is a logical location for a property line. The canal functions as a barrier, and has
the effect of creating two separate orchards. Policy 1.6 limits the minimum parcel sizes for
this property to not less than 40 acres. This policy states that the densities currently
established by the existing zoning on Orchard and Field Crops shall be the minimum lot size
allowable.
The proposed A-20 zone will still allow agriculture as a primary use. While approval of this
project may lead to a land division on the site, agricultural uses will still be allowed. A 20+
acre prune orchard is considered an economically viable farming unit for commercial
agricultural. Therefore, this proposal is consistent with the County's land use objective of
preserving agricultural land. The land uses that exist now on the project site -prune
orchards and a dwelling unit-will continue. The residential use that could be established
on the proposed 51-acre parcel may require the removal of some of the orchard, but this is
not considered significant due to the large parcel size.
The Agricultural Element of the General Plan expresses caution about continued subdivision
of large acre parcels and the further parceling of agricultural land with a General Plan
designation of Orchard & Field Crops. One principal concern of this Element is the
continued economic viability of commercial agriculture in the County(Agricultural Element,
pages AE-3-6). The Element addresses the "critical consideration in the definition of
agricultural viability. . . "as being ". . . the scale or the size of an individual operation"
(Element,page AE-5). The applicant desires to divide the property into a 22-acre and a 51-

acre parcel. A properly managed 22-acre parcel planted in orchard or row crops should
be an economically viable farming unit. Also, the existing prune orchard is essentially
farmed as two separate orchards due to the canal that physically divides them. The orchard
on the south side of the canal is mature, while the orchard on the north side of the canal was
planted several years ago and is not yet producing fruit.
The General Plan Agricultural Element also addresses concerns regarding the need to
protect the long term viability of nearby agricultural land from intrusion from residential
development. With this project, the potential exists for an additional residence to be
constructed on the project site. Additional residences in this area could create a scenario
of potential conflict with the agricultural practices employed with orchard crops, such as
aerial spraying, dust and noise resulting from harvesting techniques, discing, burning, and
other related activities. Incorporating the Agricultural Element's policy for a 300 ft. buffer
between residential development and agricultural lands on adjacent parcels is one approach
to insuring against agriculturallresidential conflicts with this project. This would be applied
to any future land division on the project site.
The City of Gridley's 1998 Draft General Plan was reviewed for consistency with this
project. Gridley's Draft General Plan shows that the land south of Ord Ranch Road, which
is currently in the county, is anticipated to be annexed into the city and developed with
commercial uses. The establishment of new commercial uses across from existing
agricultural uses may result in land use conflicts, but these potential conflicts will occur
regardless of this project. The draft plan also shows that the eastern portion (approximately
IS acres) of the project site is to be used for a future Highway 99 bypass around Gridley,
and that an intersection is to be placed on the site. It is not known when the
bypass/intersection will be constructed. This-issue is addressed in Item 6 below.

bypass/intersection is built and the impacts associated with that project will be addressed
at that time.

short-term in nature. A future dwelling on the A-40 portion of the site should be located
away from the garbage/recycling transfer station due to the high levels of noise that this use
generates. Due to the large parcel size it should be no problem to locate a dwelling unit

In response to the questions raised in your letter of April 30, 1998:
Question I - Will it be necessary to continue with the rezone application as submitted?
Yes, I believe this is the most expedient way for your client to achieving their goal of splitting this
particular property.
Question 2- Will an application for a General Plan Amendment be necessary? If so, and the rezone
now submitted is also required, can both applications be processed concurrently? What will the
combined application fee be?
A General Plan Amendment is required. With the adoption of the Agricultural Element, several new
policies were made part of the General Plan. One policy in particular poses a conflict with your
applicant's request. Policy 1.6 states: "Limit the minimum parcel sizes for new land divisions, in
areas identified as Orchard and Field Crops on the General Plan Land Use Map, to not less than the
existing zoning designation from 5 to 160 acres. The densities currently established by the existing
zoning on the Orchard and Field Crops lands shall be the minimum lot size allowable. Further
subdivision of Orchard and Field Crops lands are discouraged."
As stated, this policy is read to mean that in an A-20 zone the underlying Orchard and Field Crops
designation carries with it a 20 acre minimum parcel size. Therefore a change in zoning will also
result in a change to the General Plan. However, the form of the amendment comes into question
because the Orchard and Field Crops designation is not mapped into distinct areas based upon
existing zoning. Both applications can be processed concurrently. In this instance, The Department
would process both application under the Rezone application fee which is a variable fee based upon
time and materials.
Question 3 - Will it be necessary to amend the Agricultural Element of the General Plan? If so,
What other project applications can be processed concurrently? What will the combined application
fee be?
At this time staff does not believe an amendment to the Agricultural Element is necessary. However,
we have requested an opinion from County Counsel in regard to this question. Your applicant's
project may raise other questions relating to the application of policies contained in the Agricultural
Element, which will have to be analyzed by staff.

In response to our meeting on July 1, this letter will serve to confirm that this Department can
process a general plan amendment for a project on lands subject to the policies of the Agricultural
Element. This Department does not interpret policy 1.6 of the Agricultural Element to preclude the
ability to amend the element. It appears to only have established a link between the"existing' zoning
and Orchard and Field Crops minimum lot sizes, as defined in the 1995 Agricultural Element.
It is recommend that the map you submit with the General Plan application show a designation of
Orchard and Field Crops-20 acre minimum for the northerly parcel and a designation of Orchard and
Field Crops - 40 for the southerly parcel. Any policy question regarding the interpretation of the
Agricultural Element will be raised in the Department's agenda report.
Upon receipt of the completed General Plan Amendment application and revised maps, this
Department will give the project a high priority, recognizing the time that has passed since the original
rezone application.

Dear John,
The Planning Division has reviewed the above referenced application and finds that the
requested A-20 zoning is not consistent with the Butte County General Plan, in particular,
policy 1.6 of the Agricultural Element which limits the minimum General Plan parcels size
to not less than the existing zoning. Based upon this very specific policy, this rezone
application must also be accompanied by a General Plan amendment to Orchard and Field
Crops 20 acre minimum or an amendment to the Agricultural Element changing or
eliminating this policy.
Your clients options at this point are to either submit a General Plan amendment
application or withdraw the rezone application. Attached is a General Plan Amendment
application. No additional maps would be required, just the completed application and
filing fee of $2043.00. Since this was an issue that should have been brought to your
clients attention by this Department prior to the submittal of the rezone, a withdrawal of the
application will be accompanied by a full return of fees.

The Gridley Union School District and the Gridley Union High School District jointly adopted a
facilities Master Plan in 1994. The District's have also adopted growth mitigation resolutions.
Both District's are concerned about the issue of mitigation associate with the impacts of any
future residential growth. We strongly support the requirement that such development be
required to pay its fair share of the impact of providing school facilities for students generated by
this growth. The proposed projects will increase density and will therefore create additional
growth. Mitigation is necessary if we are to provide future families and their students with
school facilities consistent with the community's standard for quality education.

PROJECT SUMMARY: Staff recommends approval of this General Plan Amendment and rezone
project subject to the findings found in this report.
PROJECT DESCRIPTION: The applicant requests a General Plan Amendment and rezone to
allow for a proposed land division to create a 22-acre parcel and a 51-acre parcel. A single-family
dwelling unit could be placed on the 51-acre parcel.
The project site is developed with a dwelling unit, several agricultural buildings, and prune orchards.
A machine shop is operating out of one of the buildings. A large drainage canal divides the site.
State Route 99 is located on the site's western property line. The project site is level with no unusual
physical features. Surrounding parcels are developed with orchards and single family dwelling units
at rural densities, a PG&E substation, and a garbage/recycling transfer station. The Gridley Cemetery
is located directly across Highway 99 from the project site. Surrounding parcels range in size from
2.2 to 103 acres.
CEQA ISSUES: A Negative Declaration is recommended for this project. No mitigation measures
are proposed.
ANALYSIS: The subject property is 73f acres in size, and is presently zoned A-40. The site has
a General Plan Land Use designation of Orchard and Field Crops-40. The applicant's proposal for

Orchard and Field Crops-20 is necessary because of Policy 1.6 of the Agricultural Element. Due to
this policy, an A40 zone is only consistent with an Orchard and Field Crops-40 land use designation.
As previously mentioned, the applicant desires to divide the subject property. The proposed
boundary of the land division- a large canal - is a logical location for a property line. The canal
functions as a barrier, and has the effect of creating two separate orchards. Policy 1.6 limits the
minimum parcel sizes for this property to not less than 40 acres. This policy states that the densities
currently established by the existing zoning on Orchard and Field Crops shall be the minimum lot size
allowable.
The proposed A-20 zone will still allow agriculture as a primary use. While approval of this project
may lead to a land division on the site, agricultural uses will still be allowed. A 20+ acre prune
orchard is considered an economically viable farming unit for commercial agricultural. Therefore,
this proposal is consistent with the County's land use objective of preserving agricultural land. The
land uses that exist now on the project site -prune orchards and a dwelling unit -will continue. The
residential use that could be established on the proposed 51-acre parcel may require the removal of
some of the orchard, but this is not considered significant due to the large parcel size.
The Agricultural Element of the General Plan expresses caution about continued subdivision of large
acre parcels and the further parceling of agricultural land with a General Plan designation of Orchard
& Field Crops. One principal concern of this Element is the continued economic viability of
commercial agriculture in the County(Agricultural Element, pages AE-3-6). The Element addresses
the"critical consideration in the definition of agricultural viability . . . " as being". . . the scale or the
size of an individual operation" (Element, page AE-5). The applicant desires to divide the property
into a 22-acre and a 51-acre parcel. A properly managed 22-acre parcel planted in orchard or row
crops should be an economically viable farming unit. Also, the existing prune orchard is essentially
farmed as two separate orchards due to the canal that physically divides them. The orchard on the
south side of the canal is mature, while the orchard on the north side of the canal was planted several
years ago and is not yet producing fruit.
The General Plan Agricultural Element also addresses concerns regarding the need to protect the long
term viability of nearby agricultural land from intrusion from residential development. With this
project, the potential exists for an additional residence to be constructed on the project site.
Additional residences in this area could create a scenario of potential conflict with the agricultural
practices employed with orchard crops, such as aerial spraying, dust and noise resulting from
harvesting techniques, discing, burning, and other related activities. Incorporating the Agricultural
Element's policy for a 300 ft. buffer between residential development and agricultural lands on
adjacent parcels is one approach to insuring against agricultural/residential conflicts with this project.
This would be applied to any future land division on the project site.
The City of Gridley's 1998 Draft General Plan was reviewed for consistency with this project.
Gridley's Draft General Plan shows that the land south of Ord Ranch Road, which is currently in the
county, is anticipated to be annexed into the city and developed with commercial uses. The
establishment of new commercial uses across from existing agricultural uses may result in land use
conflicts, but these potential conflicts will occur regardless of this project. The draft plan also shows
that the eastern portion(appro)dmately 15 acres)of the project site is to be used for a future Highway

99 bypass around Gridley, and that an intersection is to be placed on the site. It is not known when
the bypass/intersection will be constructed.
General Plan Zoning Factors
The Land Use Element of the Butte County General Plan specifiezoning factors that are to be
considered in the evaluation of consistent zones and the choice of the most appropriate zoning
classification. These factors should guide decisions on residential densities and intensity of uses for
rezonings. The zoning factors for the Orchard and Field Crops land use designation are:
1. Existing parcel sizes and dwelling densities- Surrounding and nearby parcels range in size
from 1.76 to 238 acres,with the predominant size in the 20 to 30-acre range. Approximately
75% of the surrounding parcels are developed with a single family dwelling unit. The sizes
of the proposed parcels on the site are consistent with most of the surrounding parcel sizes.
2. Proximity to urban development-The City of Cradley is located approximately .6 mile to the
south of the site. The property to the south of the site, across Ord Ranch Road, is shown on
the City of Gridley's 1998 Draft General Plan as being proposed for commercial uses.
Gridley's Draft General Plan also shows that the eastern portion of the site is proposed to be
used for an interchange for the proposed Highway 99 bypass around Gridley.
3. Effects on adjacent uses-Uses on surrounding parcels include orchards, row crops, single
family dwellings at rural densities, the Gridley Cemetery, a PG&E substation, a garbage
transfer/recycling center, and Highway 99. The GPA/Rezone and a subsequent land division
will allow for a new dwelling unit to be placed on the site. Due to the large size of the new
parcel,the dwelling unit can be easily located away from adjacent agricultural uses, the PG&E
substation, the garbage transfer/recycling center, and away from Highway 99. Therefore, a
future dwelling unit will not have an impact on adjacent uses. If commercial uses are
established along Ord Ranch Road, as proposed by Gridley's Draft General Plan, there could
be land use conflicts between the adjacent agricultural uses and the commercial uses. These
conflicts may occur regardless of this project.
4. Potential for pest breeding-The proposed GPA and rezone, and a subsequent land division,
will not cause an increase in the potential for pest breeding. The current agricultural use will
continue and which will not cause an increase in pest breeding.
5. Economic viability- The proposed GPA and rezone will allow for a land division to create
a 22-acre parcel and a 51-acre parcel. A 22-acre parcel and a 51-acre parcel planted with
orchards or row crops are considered large enough to be an economically viable farming unit
for commercial agriculture. The current agricultural use will not decrease due to this project
or a subsequent land division.
6. Local desires - The City of Gridley's 1998 Draft General Plan shows that the city is not
proposing to change the land use on the site. However, the Draft General Plan does show
that commercial uses are proposed on the south side of Ord Ranch Road, directly across from
the site. Additionally, an interchange for the future Highway 99 Gridley bypass is proposed
to be placed on the eastern portion of the project site. These two proposed land use changes

may significantly change the character of the project area, and which may encourage
agricultural operators to seek to develop their lands with non-agricultural uses.

ENVIRONMENTAL DOCUMENTATION: An Initial Study has been prepared for this project

RECOMMENDATION: Staff recommends that the PlanningCommission recommend approval

a: FINDINGS
Section 1: Environmental Findings.
A. An Initial Study was completed in compliance with the California Environmental
Quality Act and no significant environmental impacts were identified; and
B. The design of the proposed project improvements will not cause environmental
damage to fish and wildlife or their habitat, and a de minimus exemption to the
collection of Department of Fish and Game Environmental Filing Fees is approved;
and
C. The Planning Commission has independently reviewed, analyzed and considered the
proposed Negative Declaration prior to making its decision on the project, and
recommends that the Board of Supervisors adopt a Negative Declaration, reflecting
the independent judgement of the County of Butte; and
Section 2: General Plan and Zoning Findings.
A. Find that the General Plan Amendment and Rezone conforms to the policies,
including the text and map of the Butte County General Plan, and is consistent with
all other General Plan Elements and constitutes an internally consistent action,
because the requested A-20 zone is listed as a zone that is consistent with the
requested Orchard and Field Crops-20 General Plan land use designation and the uses
permitted by the zone will be consistent with the General Plan and surrounding
properties; and
B. The requested General Plan Amendment and Rezone will not change the current
agricultural use of the property; and
C. The sizes of any new parcels created as a result of a future land division on the site
are considered an economically viable farming unit for commercial agricultural; and
Action.
A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, move to
recommend that the Board of Supervisors approve GPA/RZ 97-04 and adopt a
resolution approving a General Plan Amendment changing the Land Use Designation on
a 22-acre portion of APN 025-190-082 from Orchard and Field Crops-40 to Orchard
and Field Crops-20 and adopt an ordinance changing the zoning from A- 40 to A-20.

DISCUSSION: Attached please find the draft staff report and initial study for this project. I have
my doubts about this Orchard and Field Crops-20 land use designation that I discussed, although not
in any real detail because I am not sure if that is how to interpret Policy 1.6 of the Ag Element. I
think that is what Craig is referring to in his letters to the applicant. This seems to be a new land use
designation?
Anyway, here it is. Have. I believe that the applicant's engineer (John Christofferson) has
discussed this project`witl✓i Tom � d maybe he might have a better idea of this Orchard and Field
Crops-20/Orchard and Field Crops-4 land use designation issue. Christofferson has been on me to
get this thing finished since it has been anging around for so long.
