Specifically, the following additional information was required before the application could be accepted as complete: 1. The project is on a county maintained road that dead ends into a private road. Section 20- 133 of the County Code prohibits more than 20 lots or parcels being served by a dead end road. This count of 20 parcels includes those that may be on a private road, but must use the county maintained road for access. Therefore you must do one of the following: A. Show that no more than 20 parcels are required to use the county maintained portion of Pinecrest Road for access, or B. Submit a letter requesting an exception from the requirements of Section 20-133 of the County Code, and have that exception approved. The Department of Development Services seeks to process projects in a timely manner to avoid them persisting in the system for long periods of time without progress towards completion. From the Department's perspective, there are three options that you have on the project: 1. Withdraw the application; 2. Submit the information requested in items 1 through 3 above; or 3. The proposed parcels appear consistent with-the AR-5 (Agricultural Residential 5-acre minimum) zone and conditionally consistent with the Butte County General Plan Agricultural Residential (1 to 40-acre minimum parcel size) land use designation and other elements of the General Plan. The proposed project is not consistent with Butte County Code (BCC) Section 20-133, allowing no more than 20 parcels on a cul-de-sac in force at the time the project was found complete, or with the recently adopted BCC 20-133 revision. In addition, the project is not in compliance with BCC Section 20-8 which requires proof of the right to use a private road. Map Act. On April 28, 2005, the project was found to be incomplete until these issues are resolved. Staff recommends adoption of the attached resolution, denying without prejudice Tentative Parcel Map TPM 05-23 for Wesley North, subject to the findings contained in Attachment A. This process allows for the Planning Commission to take action while allowing the applicant to re-apply for the parcel map without time restrictions. PROJECT HISTORY: • Wesley North applied for the Tentative Parcel map on April 1, 2005. • The applicant was notified on April 28, 2005, that the project was found to be incomplete (see Attachment B). • The project has remained incomplete since April 28, 2005. • On August 9, 2008, the county sent a letter (Attachment C) to Wesley North informing that the project would be moved forward to the Planning Commission in 60 days unless proof of the right to use Pinecrest Road is provided, and a creation deed is submitted for review. There has been no response from the property owner. ANALYSIS: Access to the property would be via Pinecrest Road, the east one half of which is not a County maintained road. The subject parcel fronts on the County maintained portion. Pinecrest Road extends from Upper Palermo Road (County maintained) to Dresher Tract Road (private) then continues to Lower Wyandotte Road (County maintained). The first issue impeding the approval of the project is the applicant has not submitted the creation deed for the subject parcel as requested by Public Works. There is a question whether the subject parcel was created in conformance with the State Subdivision Map Act. On April 28, 2005, the project was found to be incomplete until these issues are resolved. The second issue is that the applicant has not demonstrated the right to use the private portion of Pinecrest Road and Dresher Track Road for access to the project as required by Butte County Code Section 20-8. Without this right, all of the lots on Pinecrest Road must be counted under Butte County Code Section 20-133 requiring no more than 20 lots on a cul-de-sac road. There are 21 lots on Pinecrest Road between upper Palermo Road and the terminus of the public portion of Pinecrest Road, and length is 3,500 feet. BCC Code 20-133 (revised) set a new standard of a maximum of 2,640 feet for parcels zone for 5-acre minimum.
