If prompt notice shall not be given to the Company,then all liability of the Company shall terminate with regard to the manner or matters for which prompt notice is required;provided,however,that failure to notify the Company shall in no case prejudice the rights of any Assured under this Guarantee unless the Company shall be prejudiced by the failure and then only to the extent of the prejudice. 3. No Duty to Defend or Prosecute. The Company shall have no duty to defend or prosecute any action or proceeding to which the Assured is a party,notwithstanding the nature of any allegation in such action or proceeding. 4. Company's Option to Defend or Prosecute Actions;Duty of Assured Claimant to Cooperate. Even though the Company has no duty to defend or prosecute as set forth in Paragraph 3 above: (a)The Company shall have the right,at its sole option and cost,to institute and prosecute any action or proceeding,interpose a defense,as limited in (b),or to do any other act which in its opinion may be necessary or desirable to establish the title to the estate or interest as stated herein,or to establish the lien rights of the Assured,or to prevent or reduce loss or damage to the Assured. The Company may take any appropriate action under the terms of this Guarantee,whether or not it shall be liable hereunder,and shall not thereby concede liability or waive any provision of this Guarantee. If the Company shall exercise its rights under this paragraph,it shall do so diligently. (b)If the Company elects to exercise its options as stated in Paragraph 4(a)the Company shall have the right to select counsel of its choice(subject to the right of such Assured to object for reasonable cause)to represent the Assured and shall not be liable for and will not pay the fees of any other counsel,nor will the Company pay any fees,costs or expenses incurred by an Assured in the defense of those causes of action which allege matters not covered by this Guarantee. (c)Whenever the Company shall have brought an action or interposed a defense as permitted by the provisions of this Guarantee,the Company may pursue any litigation to final determination by a court of competent jurisdiction and expressly reserves the right,in its sole discretion,to appeal from an adverse judgment or order. (d)In all cases where this Guarantee permits the Company to prosecute or provide for the defense of any action or proceeding,an Assured shall secure to the Company the right to so prosecute or provide for the defense of any action or proceeding,and all appeals therein,and permit the Company to use,at its option,the name of such Assured for this purpose. Whenever requested by the Company,an Assured,at the Company's expense,shall give the Company all reasonable aid in any action or proceeding,securing evidence,obtaining witnesses,prosecuting or defending the action or lawful act which in the opinion of the Company may be necessary or desirable to establish the title to the estate or interest as stated herein,or to establish the lien rights of the Assured. If the Company is prejudiced by the failure of the Assured to furnish the required cooperation,the Company's obligations to the Assured under the Guarantee shall terminate. S. Proof of Loss Damage. Mid Valley Title&Escrow Company Form No.23 Order Number: 0401- 1913048 CLTA Parcel Map Guarantee(1-13-78) Page Number: 5 In addition to and after the notices required under Section 2 of these Conditions and Stipulations have been provided to the Company,a proof of loss or damage signed and swom to by the Assured shall be furnished to the Company within ninety(90)days after the Assured shall ascertain the facts giving rise to the loss or damage. The proof of loss or damage shall describe the matters covered by this Guarantee which constitute the basis of loss or damage and shall state,to the extent possible,the basis of calculating the amount of the loss or damage. If the Company is prejudiced by the failure of the Assured to provide the required proof of loss or damage,the Company's obligation to such Assured under the Guarantee shall terminate. In addition,the Assured may reasonably be required to submit to examination under oath by any authorized representative of the Company and shall produce for examination,inspection and copying,at such reasonable times and places as may be designated by any authorized representative of the Company,all records,books,ledgers,checks,correspondence and memoranda,whether bearing a date before or after Date of Guarantee,which reasonably pertain to the loss or damage. Further,if requested by any authorized representative of the Company,the Assured shall grant its permission,in writing,for any authorized representative of the Company to examine,inspect and copy all records,books,ledgers,checks, correspondence and memoranda in the custody or control of a third party,which reasonably pertain to the loss damage. All information designated as confidential by the Assured provided to the Company,pursuant to this Section shall not be disclosed to others unless,in the reasonable judgment of the Company,it is necessary in the administration of the claim. Failure of the Assured to submit for examination under oath,produce other reasonably requested information of grant permission to secure reasonably necessary information from third parties as required in the above paragraph,unless prohibited by law or governmental regulation,shall terminate any liability of the Company under this Guarantee to the Assured for that claim. 6. Options to Pay or Otherwise Settle Claims:Termination of Liability. In case of a claim under this Guarantee,the Company shall have the following additional options: (a) To Pay or Tender Payment of the Amount of Liability or to Purchase the Indebtedness. The Company shall have the option to pay or settle or compromise for or in the name of the Assured any claim which could result in loss to the Assured within the coverage of this Guarantee,or to pay the full amount of this Guarantee or,if this Guarantee is issued for the benefit of a holder of a mortgage or a lienholder,the Company shall have the option to purchase the indebtedness secured by said mortgage or said lien for the amount owing thereon,together with any costs,reasonable attorneys'fees and expenses incurred by the Assured claimant which were authorized by the Company up to the time of purchase. Such purchase,payment or tender of payment of the full amount of the Guarantee shall terminate all liability of the Company hereunder. In the event after notice of claim has been given to the Company by the Assured the Company offers to purchase said indebtedness,the owner of such indebtedness shall transfer and assign said indebtedness,together with any collateral security,to the Company upon payment of the purchase price. Upon the exercise by the Company of the option provided for in Paragraph(a)the Company's obligation to the Assured under this Guarantee for the claimed loss or damage,other than to make the payment required in that paragraph,shall terminate,including any obligation to continue the defense or prosecution of any litigation for which the Company has exercised its options under Paragraph 4,and the Guarantee shall be surrendered to the Company for cancellation. (b)To Pay Otherwise Settle With Parties Other Than the Assured or With the Assured Claimant. To pay or otherwise settle with other parties for or in the name of an Assured claimant any claim Assured against under this Guarantee,together with any costs,attorneys'fees and expenses incurred by the Assured claimant which were authorized by the Company up to the time of payment and which the Company is obligated to pay. Upon the exercise by the Company of the option provided for in Paragraph(b)the Company's obligation to the Assured under this Guarantee for the claimed loss or damage,other than to make the payment required in that paragraph,shall terminate,including any obligation to continue the defense or prosecution of any litigation for which the Company has exercised its options under Paragraph 4. 7. Determination and Extent of Liability. This Guarantee is a contract of Indemnity against actual monetary loss or damage sustained or incurred by the Assured claimant who has suffered loss or damage by reason of reliance upon the assurances set forth in this Guarantee and only to the extent herein described,and subject to the Exclusions From Coverage of This Guarantee. The Liability of the Company under this Guarantee to the Assured shall not exceed the least of: (a)the amount of liability stated in Schedule A or in Part 2; (b)the amount of the unpaid principal indebtedness secured by the mortgage of an Assured mortgagee,as limited or provided under Section 6 of these Conditions and Stipulations or as reduced under Section 9 of these Conditions and Stipulations,at the time the loss or damage Assured against by this Guarantee occurs,together with interest thereon;or (c)the difference between the value of the estate or interest covered hereby as stated herein and the value of the estate or interest subject to any defect,lien or encumbrance Assured against by this Guarantee. 8. Limitation of Liability. (a)If the Company establishes the titre,or removes the alleged defect,lien or encumbrance,or cures any other matter Assured against by this Guarantee in a reasonably diligent manner by any method,including litigation and the completion of any appeals therefrom,it shall have fully performed its obligations with respect to that matter and shall not be liable for any loss or damage caused thereby. (b)In the event of any litigation by the Company or with the Company's consent,the Company shall have no liability for loss or damage until there has been a final determination by a court of competent jurisdiction,and disposition of all appeals therefrom,adverse to the title,as stated herein. (c)The Company shall not be liable for loss or damage to any Assured for liability voluntarily assumed by the Assured in settling.any claim or suit without the prior written consent of the Company. 9.Reduction of Liability or Termination of Liability. All payments under this Guarantee,except payments made for costs,attomeys'fees and expenses pursuant to Paragraph 4 shall reduce the amount of liability pro tanto. 10. Payment of Loss. (a)No payment shall be made without producing this Guarantee for endorsement of the payment unless the Guarantee has been lost or destroyed,in which case proof of loss or destruction shall be furnished to the satisfaction of the Company. (b) When liability and the extent of loss or damage has been definitely fixed in accordance with these Conditions and Stipulations,the loss or damage shall be payable within thirty(30)days thereafter. 11. Subrogation Upon Payment or Settlement. Whenever the Company shall have settled and paid a claim under this Guarantee,all right of subrogation shall vest in the Company unaffected by any act of the Assured claimant. If requested by the Company,the Assured shall transfer to the Company all rights and remedies against any person or property necessary in order to perfect this right of subrogation. The Assured shall permit the Company to sue, compromise or settle in the name of the Assured and to use the name of the Assured in any transaction or litigation involving these rights or remedies. If a payment on account of a claim does not fully cover the loss of the Assured the Company shall be subrogated to all rights and remedies of the Assured after the Assured shall have recovered its principal,interest,and costs of collection. 12. Arbitration. Unless prohibited by applicable law,either the Company or the Assured may demand arbitration pursuant to the Title Insurance Arbitration Rules of the American Arbitration Association. Arbitrable matters may include,but are not limited to,any controversy or claim between the Company and the Assured arising out of or relating to this Guarantee,any service of the Company in connection with its issuance or the breach of a Guarantee provision or other obligation. All arbitrable matters when the Amount of Liability is$1,000,000 or less shall be arbitrated at the option of either the Company or the Assured. All arbitrable matters when the amount of liability is in excess of$1,000,000 shall be arbitrated only when agreed to by both the Company and the Assured. The Rules in effect at Date of Guarantee shall be binding upon the parties. The award may include attomeys'fees only if the laws of the state in which the land is located permits a court to award attorneys'fees to a prevailing party. Judgment upon the award rendered by the Arbitrator(s)may be entered in any court having jurisdiction thereof. The law of the situs of the land shall apply to an arbitration under the Title Insurance Arbitration Rules. A copy of the Rules may be obtained from the Company upon request. 13. Liability Limited to This Guarantee;Guarantee Entire Contract, (a)This Guarantee together with all endorsements,if any,attached hereto by the Company is the entire Guarantee and contract between the Assured and the Company. In interpreting any provision of this Guarantee,this Guarantee shall be construed as a whole. (b)Any claim of loss or damage,whether or not based on negligence,or any action asserting such daim,shall be restricted to this Guarantee. (c)No amendment of or endorsement to this Guarantee can be made except by a writing endorsed hereon or attached hereto signed by either the President,a Vice President,the Secretary,and Assistant Secretary„or validating officer or authorized signatory of the Company. 14. Notices,Where Sent. Every development project which requires a discretionary governmental approval will require at least some environmental review pursuant to CEQA, unless an exemption applies. The environmental review required imposes both procedural and substantive requirements. At a minimum, an initial review of the project and its environmental effects must be conducted. Depending upon the potential effects, a further and more substantial review may be conducted in the form of an environmental impact report (EIR). A project may not be approved if feasible alternatives or mitigation measures cannot substantially lessen the significant environmental effects of the project. At the state level, CEQA requires that public agencies consider the effects of their actions on historical resources eligible for listing on the California Register of Historical Resources. "Historical resource" refers to buildings, structures, sites (prehistoric and historic), objects, districts, and all manner of properties containing material remains of past human life or activity. The Department of Development Services utilizes the Northeast Information Center (NEIC) of the California Historical Resources Information System (CHRIS) to identify projects that may have archaeological significance. The CHRIS is a statewide system for managing information on the full range of historical resources identified in California. This system is under the authority and direction of the Office of Historic Preservation (OHP), the State Historic Preservation Officer (SHPO), and the State Historical Resources Commission (SHRC). The Northeast Center of the CHRIS system, located at California State University, Chico, manages the historical resource records for 11 counties, including Butte County. The Northeast Information Center will furnish a Record Search to Development Services indicating the archaeological/historical significance and sensitivity of the applicant's project area and additionally providing a recommendation as to whether further archaeological survey is warranted. If further archaeological survey is required, the application would be considered incomplete until the appropriate archaeological survey is completed and reviewed. The Department of Development Services will forward applicant's payment (by check) of $60.00 and relevant project application information required for the Records Search to NEIC. NEIC will provide the results of the Records Search to Development Services. Development Services will notify the applicant if further archaeological survey is warranted. The $60.00 fee does not cover the cost of further archaeological survey work. If further archaeological survey work is required, Development Services will work with the applicant to see that it is accomplished, according to set standards, by a qualified archaeologist. The applicant shall bear all costs associated with further archaeological survey work required to continue processing of the planning project application. File#L05-3 Project Review RE: TPM 05-025/Nichols/APN: 064-010-030 T23N, R3E, Section 27; USGS Paradise East 7.5' and Paradise 15' quads Approximately 40 acres (estimated from map) (Butte County) Dear Mr. Michelena, In response to your request, a record search for the above-cited project was conducted by examining the official maps and records for archaeological sites in Butte County. RESULTS: Prehistoric Resources: According to our records, no sites of this type have been recorded in the project area. However, six sites of this type have been recorded in the project vicinity, consisting of bedrock metates, bedrock mortars, lithic scatters, mano fragments, a biface, and a protohistoric burial/cry ceremonial location. The project area is located in a region utilized by Konkow Maidu. Unrecorded cultural resources of this type may be located within the project area. Historic Resources: According to out records, one site of this type, PO4-001363, has been recorded in the project area, consisting of a refuse deposit. Additionally, thirteen sites of this type have been recorded in.the project vicinity, consisting of Ponderosa Way, the remains of Roe School, Upper Centerville Canal, Hupp Ditch, structure remains, refuse deposits, and water conveyance ditches. Unrecorded resources of this type may be located in the project area. The USGS Paradise (1953) 15' quad map indicates that the project area is located on Nimshew Ridge and in Slaughterhouse Ravine, while Middle Butte Creek,Paradise Pines, Magalia, Irish Town,Nimshew, a picnic area, trails, roads, and structures are located in the project vicinity. Previous Archaeological Investigations: According to our records,portions of the project area have been surveyed by registered professional foresters. The reports are listed below: ` Calvert, Jeff 1999 Confidential Archaeological Addendum for Timber Operations on Non Federal Lands in California: Nimshew 11 THP (I. C. Report# 2488). One refuse deposit was updated in the project vicinity as a result of this survey. Rieger, Larry 1994 Confidential Archaeological and Historical Resources Survey and Impact Assessment, A Supplemental Report for a Timber Harvesting Plan: Nimshew THP (I. C. Report#2909). PO4-01363 was recorded in the project area, and a refuse deposit was recorded in the project vicinity, as a result of this survey. Literature Search: Reviewed were the official records and maps for archaeological sites and surveys in Butte County. Also reviewed were the National Register of Historic Places -Listed properties and Determined Eligible Properties (1988,.Computer Listings 1966 through 7-00 by National Park Service), the California Register of Historical Resources (2005),California Points of Historical Interest(1992), California Inventory of Historic Resources (1976), California Historical Landmarks (1996), Directory of Properties in the Historic Property Data File for Butte County(2005), Handbook of North American Indians,Vol. 8, California (1978), Historic Spots in California (1966), and Gold Districts of California (1970). RECOMMENDATIONS: Based upon the above information and the local topography, the project is located in an area considered to be extremely sensitive for historic and prehistoric cultural resources. PO4-001363 is located in the project area. Therefore,we recommend that a professional archaeologist be contacted to conduct a cultural resources survey of the entire project area. This person will be able to offer recommendations for mitigation of the existing site, as well as protection or integration of any new cultural resources encountered as a result of the field survey. The project archaeologist should also contact the appropriate local Native American representatives for information regarding unrecorded Traditional Cultural Properties that may be located within project boundaries for which we have no records. The project archaeologist may also want to consult historic General Land Office (GLO)plat maps in order to aid in the identification of unrecorded historic sites, which may be located within project boundaries. Copies of the reports listed above will be available to the project archaeologist upon request. Additionally, if any potential prehistoric, ethnographic, and/or historic cultural resources are encountered during any phase of project operations, all work should cease in the area of the find pending an examination of the site and materials by the project archaeologist. This request to cease work in the area of a potential cultural.resource find should be made a condition of project approval. Development Review Committee denial of a Tentative Parcel Map on AP 066-520-002 DATE: April 28, 1994 FOR: Board Hearing May 10, 1994 at 10:00 a.m. BACKGROUND: At its meeting of March 7, 1994 the Development 'Review Committee denied the Bob Woodworth tentative parcel map based upon traffic and archaeological concerns which had not been addressed and which the applicant's representative appeared unwilling to address. The applicants have appealed this denial. - The traffic concerns were first addressed by the Board of Supervisors on March 17, 1987, when it established the transportation task force on the upper ridge and charged it with studying the problems of traffic and transportation. This led to an identified Environmental Impact which must be mitigated before development can occur. One method of developing mitigation measures is to have a focused EIR prepared which identifies the impacts, develops a capital improvement program and pro rata fee schedule to mitigate those impacts. To this date a preliminary traffic study has been prepared but no capitol improvement program has been developed. Traffic concerns on Nimshew Road and Ponderosa Way have been reported by several of the neighbors. Sierra West Surveying is aware of the traffic concerns based on.previous involvement in the area. On August 6, 1991 Sierra West appealed the denial of the Ron Robbins tentative parcel map. The Board denied the appeal finding "that the project does.not conform to the land use element and circulation element of the Butte County General Plan". Staff has also discussed the traffic impact issues on the ridge, informally with Sierra West on several occasions. Board of Supervisors April.28, 1994. RE: Woodworth.Appeal - TPM - AP 66-52-02 Page 2 of 2 The archaeological concerns are based on an August 25, 1993 report, from Donald J. Storm Archaeologist, that " a historic Maidu Indian cemetery exists within this parcel". This followed by a letter and map from Fred H. Wilson identifying the approximate location of the Cemetery. The proposal from the Planning Division is for the applicant to contact the Northeast Regional Information Center at CSU Chico, which serves as the areas clearinghouse, for a records search. If the clearinghouse has already identified sites it may be possible to propose mitigation measures to resolve the situation. RECOMMENDED ACTION: Move to deny the appeal finding that there are traffic and transportation concerns in the upper ridge area which must be mitigated,and that this site appears to have significant archaeological artifacts which require some type of protection. Further, find that the existence and type of traffic concerns indicate this project does not conform to the Land Use Element and Circulation Element of the Butte County General Plan. Alternative access routes:' Not a viable solution to mitigate traffic impacts. There is no method to enforce this upon future parcel owners, or even upon Mr. Woodworth's guests. 2. Same proposal as item #1. 3. Payment of mitigation fees; There are no established traffic mitigation fees for this Y 9 9 area, therefore no method of.collection. Also, there is no project established to spend the fee on, even if collected. S , h 4. Existing parcels have an acknowledged right to develop. The traffic generated by existing parcels has been considered. It is the creation of additional parcels that compounds the existing situation to an unacceptable degree. The restriction, in this case, is not on the.ability to develop this parcel. It is on the ability to create additional parcels. 5. The General Plan Conformance Report is just that, a check to see if. the project conforms to the goals and objectives set forth in the General Plan. The parcel zoning is also an independent item from traffic review. Traffic review is an environmental aspect of parcel creation. Only the Planning Division reviews the environmental impacts of the proposed action, not the Health Dept. Fire Dept., nor any other county office. To reiterate, I missed the traffic impact on my first review. The oversight was caught prior to the Development Review Committee hearing, Page 2 September 8, 1993 . -Woodworth Parcel Map allowing me to revise the initial study. Even if it had gone to the Development Review Committee unrevised, the project would have been continued at that time to allow for the revision. This would only have resulted in additional delay to reach this same point. The impact of traffic in the Upper Ridge area of Paradise has been a longtime issue, still unresolved. The Town of Paradise is facing,the same issues and will either develop mitigation fees or prohibit any further parcel splits. This is an issue that will not be easily resolved. I hope this answers your questions and clarifies the issues to be addressed. Nimshew area. Engineer: Sierra West Surveying Tom Wrinkle was present. He said that a revised Planning Director's Report was received. He said that access will be off Nimshew Ridge Road R Skyway cannot be used, or they would be happy to pay a mitigation fee like the one for the bridge if one is established. Mr. Edell said the bridge*mitigation fee was established by the Director of Public Works in 1979 or 1980 when there was a proposal for a major subdivision in the area with an impact on the narrow curve and a box culvert needing replacement. Mr. Wrinkle said they would be happy to pay into any kind of assessment district for Skyway traffic problems. Mr. Wrinkle said that the applicant was not told until the last minute that the traffic problem on Skyway was a problem. However, the project can use Nimshew Ridge Road, going out to Centerville Road and Skyway near Chico, improving ft as necessary. It might be necessary to acquire access through the private property along Nimshew Road. Mr. Edell suggested that the engineer provide a written proposal as to what the applicant intends to do so there is no misunderstanding. Mr. Sanders said that would be a good idea, and he would request a continuance in order to discuss the situation with the Director. Mr. Wrinkle said the choices are either to provide a traffic study or provide access in another direction. Velma Butler, 14073 Nimshew Rd., Magalia, asked what size of parcels are proposed. Mr. Edell said that 2 - 3 acre parcels and 2 -6 acre parcels are proposed. Ms. Butler said she did not understand how there could be access to Skyway without using Nimshew Road. Mr. Edell said the applicant is proposing to use Nimshew Rd. and then go south to Centerville Rd. Ms. Butler said the access is over a cliff to the south, or to the north ft would be a narrow gravel road all the way to Chico. It would be very costly to go south, since there is not a road there. Ponderosa is also a steep narrow mountain road. She asked if the intent is to split the parcels again. Mr. Edell said that a 4 parcel split is being considered. If the proposal is approved, ft would take another proposal to further divide any of the parcels. Mr. Sanders said that there is a 3 acre minimum in the zoning, and,therefore the potential to create 2 more lots. Ms. Butler said that Nimshew Road is paved but narrow with sharp turns and a small narrow bridge. Apparently the concern about Skyway traffic is related to Skyway going over the dam, not stoplights lower down on Skyway. Doris Wilson, 13846 Nimshew Road, said that there is an Indian burial ground that is on the property and ft should be preserved. Ms. Wilson said that there is a water problem in the area. The present zoning is ARM11-3. The Land Use Plan Map of the Butte County General Plan designates this area as Agricultural -Residential. There are no specific or community plans for the area. The. proposal does not conflict with County Zoning, however, it does conflict with an adopted or proposed element of the Butte County General Plan and Specific or Community Plan. As mentioned in the initial study, this project will contribute to the cumulative traffic impacts of the Greater Paradise Ridge Area. The proposed project does not conform to the policies of the Land Use and Circulation Elements of the County's General Plan:The policy states that "adequately maintained approved road access with sufficient capacity to service the area" must be present to allow development. This project would contribute to an existing traffic problem on the Skyway, when coupled with other development already approved on the upper ridge area, traffic would be further impacted. The Skyway facility must be improved and capacity increased to accomodate further subdivisions according to the Joint Advisory Committee appointed by the Butte County Board of Supervisors. The Circulation Element of the County's General Plan contains goals, objectives and policies that require solutions to the traffic impacts on Skyway before additional development can take place. In the absence of specific action or direction by the Board of Supervisors to implement recommendations of the Joint Advisory Committee, or the policies of the Circulation Element, the project cannot be made to conform to the General Plan, Circulation Element or Land Use Element. The Butte County Association of Governments is currently undertaking a Transportation Computer Model Study to develop transportation policies and solutions for the greater ° I Paradise ridge area. Until such study is completed, it is unlikely any transportation policy \'will be developed in the interim to proceed with additional development. Such a mitigation measure does not establish when, or what kind of transportation improvements are needed to service the transportation demands of the greater Ridge area. Nor does such a proposal evaluate the costs of transportation improvements and possible finance options. The California Government Code Article 5 Section 65950 allows sixmonths to take.action on a project not requiring an EIR. Because the applicant has not accepted preparing a focused EIR, nor proposed mitigation measures which could effectively mitigate the cumulative traffic impacts, the Environmental Documents must be deemed incomplete and the project denied. Under Section 65950 of the Government Code, a decision must be-made no later than November 14, 1993, unless the project proponent requests an extension of the time limit . outlined by both Public Resources Code Section 21080.2 and Government-Code Section 65950 and such a request is received and approved. RECOMMENDATION: A. Find that the environmental documents for the project have not been completed and that the project does not conform to the policies of the General Plan. B. In reference to the town adopted Paradise General Plan, the subject project property is located within the "secondary study area" and is assigned a "AR" [Agricultural Residential] land use designation. This designation applies to existing and planned residential areas characterized by larger parcels and accessory agricultural uses, including raising of livestock and other forms of agricultural production. It provides for single-family detached homes, limited agricultural uses, churches and public uses. Residential densities shall be in the range of one or less dwelling unit per gross acre. 3. Based upon the information provided with this application town staff cannot discern whether this project property is afforded potential "year-round" access via two different directions within a "through linkage maintained roadway circulation system" or solely by a single direction within a overly complex cul-de-sac roadway system serving the "Upper Paradise Ridge Area". 4. This project application is subject to a "discretionary" decision-making action by the Butte County decision making body. Given the ongoing and cumulative adverse traffic impacts that this type of land use development places upon the Town of Paradise and the Paradise Ridge area, it is important that Butte County carefully exercise its discretionary decision-making authority. 5.
