Dear Mr. Bennett: Notation II.A. of the Conditions of Approval for the"Sierra Moon" Subdivision Map 903-01, approved September 29, 2004, provides that: Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. The Butte County Departments of Development Services, Public Works, Environmental Health, and the California Department of Forestry (Cal-Fire) have reviewed and commented on the requested amendments. These departments have recommended that the requested amendments are consistent with the application, the fees paid, and the environmental determination as conditionally approved. It is our assessment that these amendments are also consistent with the Mutual Conditional Settlement Agreement and Release between Stephen J. Schuster and Reasonable Expansion Saves Chico's Urban Environment(RESCUE) of May 11, 2006. The following requested changes are therefore deemed to be minor changes and are hereby approved: Approval of Amendments to"Sierra Moon"Subdivision Map#03-01 1 I. Amend the Tentative Map's Condition of Approval No. 26 to specify, solely by changing the date, that the temporary cul-de-sac at the west end of Spyglass Road in the Project shall be kept closed through at least the end of September, 2012 (although provisions for emergency vehicle access at the westerly end of Spyglass Road are and will remain acceptable). 2. Amend the Tentative Map's Condition of Approval No. 8 to permit lot coverage in excess of 15%, consistent with the sliding scale provided for by revised Table "7-2" of the North Chico Specific Plan. (Note: This table was amended August 17, 2004 by the Butte County Board of Supervisors and satisfies this amendment) 3. Amend the Tentative Map to conform to the proposed configuration of lots attached as Exhibit A. to the Mutual Conditional Settlement Agreement and Release between Stephen J. Schuster and RESCUE of May 11, 2006. 4. Add paint striping to the existing section of Spyglass Road, if requested by a majority of households on Spyglass Road, per Exhibit C to the "Sierra Moon Subdivision Traffic Impact Study Update" prepared by W-Trans, dated April 10, 2006. Upon permission from the Public Works Department, owner is responsible for any costs associated with the paint striping. The Public Works Department has only approved Phase 1 of the development which is located south of Keefer Slough. We are therefore not aware of improvement plans for Sierra Moon east of Guntren. Our department does not have any encroachment permits on file for work to be performed on Guntren. (An encroachment permit is required for any work within the public right-of-way). An inspector from our department will inspect Guntren tomorrow and if possible, inform the contractor of the need for an encroachment permit. When the permit is applied for, we will have more information as to the type of work that is being proposed. In response to your other question, the development of Sierra Moon Subdivision does not require that the existing portion of Guntren Road be widened. The applicant is requesting a FIVE (5) year extension of TSM 03-01 making the expiration date September 28, 2011. The North Chico Specific plan (NCSP) specifics minimum standards to which roads should be built.
