Copy of Use Permit/Variance to Planning Technician: Roger Rossberg, proposed Negative Declaration with mitigation measures regarding environmental impacts and Use Permit to allow a kennel for up to 30 dogs on property zoned AR-10 (Agricultural Residential - 10 acre parcels). The property is located at the end of Wild Game Place, approximately 3,000 feet west of Wilbur Road, Oroville. APN 030-250-068 (SB) (UP 00-08) (VIDEO) Mr. Betts gave a brief summary of the project. A video of the site was shown. He said barking is a problem because no one lives on the property. He said staff is recommending denial of this project. Wendy Castillo,Butte County Animal Control, said she supports the staff recommendation for denial. She said she has been involved with this problem for a year. She said she has taken Mr. Rossberg to court for a violation. She said the existing conditions of the kennel are bad. She said the waste looks like it has not been picked up for at least a month. She said they found a dead rat in one of the pens and traces of rats in other pens. She said there is no water on this property. She said Mr. Rossberg had a similar problem in Sacramento County. Commissioner Nelson asked what would happen if the permit is denied. Ms. Castillo said the animals would have to be moved. Commissioner Lambert asked if the dogs were moved,where would they be moved to? Ms. Castillo said she has talked to the District Attorney's office to find out if they have enough evidence to seize the dogs. The hearing was opened to the public. Mike Jones said he can not put in a well or clean up the kennels until the permit is issued. He said he is over to the kennels a lot. He said he is a neighbor and works for Mr. Rossberg. He said if the permit is approved he will be a full time care taker of the dogs. Bob Forte said he is moving out to the property northeast of the kennel site. He said he is against this permit based on noise. Craig Erickson,Butte County Environmental Health, said the Animal Control Officer has spent a lot of time on this problem. He said the owner has shown a total disregard for any sanitation at this kennel. He said he was not allowed in just the other day. He said staff's recommendation for denial is well founded. Mr. Jones said there are ways to stop the barking, i.e.; collars, etc. Mr. Rossberg said he has lived on a farm for a long time and these animals are well fed and loved. He said they are well cared for. He said he plans to put in a$50,000 kennel,but not until he has an approved permit. He said he would appreciate if the Commission would approve this. The hearing was closed. Chairman Leland said kennels are a problem in a residential area. IN ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ MAY 25;2000 ■ �W_ y LL rJ Commissioner Lambert said that usually you get the permits for the septic, well, etc. and then you bring in the dogs. She said she could not see any choice but to deny this request. It was moved by Chairman Leland, seconded by Commissioner Lambert, and unanimously moved to deny the request for a Use Permit for Roger Rossberg subject to the findings listed below. 1. Deny Use Permit 00-08 for Roger Rossberg, subject to the following findings: A. The proposed dog kennel will be incompatible with, and will adversely affect, and be detrimental to, adjacent uses and natural resources because: 1. The dog kennel has the potential to create excess noise from the barking of the dogs, which will cause a nuisance to future residents in the project area. The barking will also interfere with the recreational users on the adjacent Thermalito Afterbay. 2. The dog kennel has the potential to create surface and ground water pollution. Polluted drainage from the site may enter the Thermalito Afterbay, which serves as a recreational area and provides habitat for wildlife. B. The proposed dog kennel will be detrimental to the public health, safety, and welfare, and injurious to properties or improvements in the vicinity: C. Conditions in the kennel have.not improved since the applicant applied for a Use Permit. Mr. Erickson said that an Animal Control Advisory Board is working on standards for kennels. He told Commissioner Nelson that it is very expensive to seize the animals and it takes time. Ms. Castillo said there is also a problem with where to place the dogs. Most shelters are full. Commissioner Cage asked where the dogs came from. Ms. Castillo said they came from Sacramento County over a year ago. PROJECT DESCRIPTION/SITE CHARACTERISTICS: Project Description This is an application for a Use Permit to allow a dog kennel for up to thirty (30) dogs. The kennel already exists on the site and is in violation of the AR-10 zone. Approval of this Use Permit will rectify the zoning violation. The dogs, which are Labrador and Golden Retrievers, are used for breeding purposes, with the puppies being sold. Some of the puppies are raised and trained for hunting by the applicant. The applicant does not propose to board dogs owned by other people. The kennel consists of approximately 20 individual cages;which are approximately 6 feet x 6 feet in size. The kennels are made of wood, are not covered, and do-not contain a floor. One to three dogs are kept within each cage. A dog house or a barrel in each cage provides shelter for the dogs. Water and food for the dogs are kept in large containers in each individual cage. At the time of staff's site visit (April 11, 2000) there were 22 adult dogs (all females) and approximately five puppies. A dwelling unit has not been placed on the site and the dogs are unsupervised. The dogs ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE I ■ barked continually during the site visit. Excrement from the dogs had not been removed from the kennels for several weeks and the odors from the feces was very strong. Site Characteristics The project site is zoned AR-10 (Agricultural-Residential, 10-acre minimum parcel size) and has a General Plan land use designation of Agricultural-Residential. The 11-acre project site is developed with a travel trailer and the dog kennels. The northern portion of the parcel has slopes of 5 to 10%, and the southern portion has slopes of less than 1%. Vegetation on the site is exclusively grasses. Surrounding parcels range in size from 10 to 95 acres, with the predominant size being 10 acres. The property is surrounded by eight parcels, seven of which are currently undeveloped, but could be developed with a dwelling unit. The property to the west of the site is owned by the California Department of Water Resources,which includes the Thermalito Afterbay. The Thermalito Afterbay is located approximately 1,200 feet from the kennels. A private paint ball course is located to the south of the site. ANALYSIS: During staff's site visit, the dogs appeared to be healthy, but the living conditions of the dogs were noted to be very poor. The floors of the kennels were muddy. A dead rat was observed in one kennel, and Animal Control personnel noticed indications of rat infestation in many of the other kennels. According to the Environmental Health Division, the rats are attracted to the dog feces. Complaints about the dog kennel have been received by the Animal Control Division. On October 8, 1999, the applicant was cited by the Butte County Health Department, Rabies Prevention Division, for failure to obtain a kennel license. On November 12, 1999, the applicant failed to appear for a court hearing on the citation. The failure to appear and pay the fine is not an infraction, and has been turned over to the Butte County Central Collections Department for collection action. The applicant was cited again in January.2000 for failure to obtain a kennel license,but enforcement of that citation has been temporarily suspended pending the outcome of this Use Permit project. Planning staff has received several calls from landowners in the project area expressing their opposition to the project. They stated that the barking from the dogs can be readily heard throughout the project area and is a nuisance. The initial study prepared for this project recommends six mitigation measures to reduce impacts to a less than significant level. Many of these mitigation measures require compliance within a very short time period, such as two months to install a well and septic system, and four months to establish a residence on the site. RECOMMENDATIONS Staff recommends that the Planning Commission deny the Use Permit for Roger Rossberg. The applicant applied for the Use Permit, yet failed to present a quality, safe, and compatible project for the area. Staff believes that the dog kennel will be an on-going problem and it will be very difficult ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 2 ■ to ensure compliance with the conditions of project approval. The project will be incompatible with the neighborhood due to the dogs barking and potential health concerns due to lack of proper maintenance of the kennel. Should the Planning Commission decide to approve the project, staff recommends that the Commission make a motion of intent to approve the project and continue the project closed for one month to allow staff to prepare the necessary findings and conditions of project approval. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Deny Use Permit 00-08 for Roger Rossberg,with the following findings: A. The proposed dog kennel will be incompatible with, and will adversely affect, and be detrimental to, adjacent uses and natural resources because: 1. The dog kennel has the potential to create excess noise from the barking of the dogs,which will cause a nuisance to future residents in the project area. The barking will also interfere with the recreational users on the adjacent Thermalito Afterbay. 2. The dog kennel has the potential to create surface and ground water pollution. Polluted drainage from the site may enter the Thermalito Afterbay, which serves as a recreational area and provides habitat for wildlife. B. The proposed dog kennel will be detrimental to the public health, safety, and welfare, and injurious to properties or improvements in the vicinity as the applicant has not demonstrated proper maintenance of the existing kennel. C. Conditions in the kennel have not improved since the applicant applied for a Use Permit. Comment: Our property is located directly northeast (640 Sparky Way in the High Sierra Subdivision, APN 030-250-062) of the proposed dog kennel. An existing dog kennel is located approximately 1000 feet from our planned home. On several occasions we have been working on our property when the dogs are barking. This barking is loud, annoying, and occurs often. We have spoke to our neighbors (Randy Haupt, APN 030-250-060; Terri Hollingsworth, APN 030-250-061) about the proposed use permit. Both neighbors indicated they did not want a large-scale kennel built on this location because of noise from up to 30 dogs. I, Bob Forde, spoke to Roger Rossberg about the kennel and we discussed ways to minimize the effects of barking dogs. After looking at the location of the proposed kennel to the surrounding properties, it is our opinion that this location for a kennel of this size will create similar problems for most of our neighbors. There are 14 undeveloped lots in High Sierra Subdivision, and numerous other lots adjacent to the proposed kennel. Unfortunately this area has no trees to reduce noise. I The Butte County Air Quality Management District reviewed this project and recommends that.measures be taken to control fugitive dust emissions from all road and other construction activities during project improvement. This will be added as a condition of project approval. e. The solid wastes from the dogs may create objectionable odors if not properly disposed of in a timely manner. The Butte County Animal Control Division and the Environmental Health Division state there is a strong odor of dogs feces near the kennels, which was confirmed by Planning staff. Currently, dogs feces are disposed of on-site in various locations. According to the Butte County Environmental Health Division, this method of waste disposal is not allowed and creates potential health problems. Mitigation Measure# 1, found in Item 8,requires the applicant to pick up all dog wastes at least once a day and to dispose of the wastes in a septic system reserved for handling solid wastes from the dogs. The floors of the kennels are not paved,and water runoff from the site may be polluted due to the dog feces, resulting in contamination to surface and ground waters. The California State Department of Water Resources is concerned that contaminated surface water runoff from the site may drain into the Thermalito I Afterbay, which is located just to the west of the site. To address this potential impact, the Butte County Environmental Health Division recommends the installation of a septic system to handle wastes from the dogs. To allow for convenient disposal of the wastes in the septic system, a waste disposal basin that drains into the septic tank is required to be installed in the dog kennel. Another way to prevent water quality impacts is to pick up dog feces at least once per day and dispose of them in the septic system. Until the septic system is operational, the Environmental Health Division recommends that dog wastes be disposed of on- site by burying in holes that are lined with lime. Water for use by the kennel will be obtained from an-site well. This project will not j cause a significant decrease in groundwater supplies because the proposed kennel use requires only very minor quantities of water. This project will not result in the creation of large impervious surfaces because the only new impervious surfaces will be the small waste disposal basin. Ij g. - i. The project site is not located within a 100-year flood zone as shown on the Federal Emergency Management Agency's Flood Insurance Rate Map 06007C-0960C,dated June 8, 1998. i j. The property is not located in an area prone to seiche, tsunami, or mudflow. Intense animal uses are allowed as a Secondary Use under the Agricultural-Residential General Plan land use designation. Surrounding parcels are zoned AR-10 and R-C (Resource Conservation) and have a General Plan land use designation of Agricultural-Residential and Public. Surrounding and nearby parcels range in size from approximately 10 to 95 acres. The property is surrounded by eight parcels,seven of which are currently undeveloped but could be developed with a dwelling unit. The property to the west of the site is owned by the California Department of Water Resources, which includes the Thermalito Afterbay. The proposed dog kennel could result in land use conflicts with future residential uses due to high noise levels from barking dogs and from odors due to improper disposal of dog wastes. The project could also cause water I quality impacts to the Thermalito Afterbay. Mitigation Measures 1 through 2, found in item 8 (Hydrology and Water Quality), and Mitigation Measures 3 and 6, found in item 11 (Noise), are recommended to reduce these impacts to a less than significant level. The project site is not located within the City of Oroville's Sphere of Influence or the Oroville Enterprise Zone. C. The property is not within a habitat conservation plan or natural community conservation plan. No impact will be incurred. 10. MINERAL RESOURCES. Additional noise comes from vehicle traffic on the roads in the area and from aircraft arriving and departing the nearby Oroville Municipal Airport. During the site visit by Planning Division staff, the dogs barked extensively. The dogs began barking even before staff entered the property. There is no dwelling unit j on the project site,and there is usually no one on the site to attend to the dogs to keep them quiet. I The proposed dog kennel use may incrementally and cumulatively have a significant I noise impact on the surrounding area. The property is surrounded by eight parcels, seven of which could be developed with a dwelling unit. The proposed dog kennel may impact the residents of these future dwellings by excessive barking. Barking may also have an impact to people on the adjacent California Department of Water Resources property, which is used for recreational purposes. i Several measures could be taken to reduce barking noise from the dog kennel. One measure is to require that the applicant, or a caretaker, live on the project site. Currently there is no dwelling unit on the site and the applicant states that he comes out to the site only every other day. Placing a dwelling on the site will allow the I applicant, or a caretaker,to be present on the site most of the time to watch over the dogs and prevent excessive barking. According to the applicant, he intends to live on the parcel once the project has been approved. In order to ensure this occurs, a I mitigation measure is proposed that requires the applicant,or a caretaker,to live full- time on the property. Another way to prevent noise impacts is to reduce the number of dogs kept in the kennel. To prevent noise impacts on the adjacent parcel a mitigation measure is proposed that limits the number of dogs over the age of four (4) months in the kennel to no more than fifteen (15) dogs, with five additional dogs over the age of four months allowed as the personal pets of the land owner or other resident. Yet another way to reduce noise impacts to adjacent parcels is to locate the kennel as far away as possible from property lines. The kennel is currently located 45 feet from the nearest property line. Due to the "No Development Area" for burrowing owl habitat on the property, it is not possible to place the kennel near the center of the parcel, where it would have the least impact on adjacent parcels. However,there is a 6,000 square foot area,just north of the existing kennel, that is at least 100 feet ffrom all property lines. A mitigation measure is recommended that requires the kennel be moved to somewhere within the 6,000 square foot area. There are no physical constraints in this area that would preclude the kennel from being placed there and leaves adequate area for a.dwelling unit. Attachment B of this document contains a map showing the 6,000 square foot area. I Other measures that may be taken to reduce noise impacts include sound walls 'i around the dog kennel, anti-bark collars on the dogs, a noise-activated sprinkler system. A mitigation measure requires the use of noise reduction measures if complaints of excess barking are received by the County. e. - f. The project is located approximately 1.7 miles west of the Oroville Municipal Airport and is within the Oroville Municipal Airport's Comprehensive Land Use Plan. Concurrently with the installation of the septic system,a waste disposal basin to handle solid waste from the dogs shall be installed in the dog kennel. The waste disposal basin shall be substantially similar to the disposal basin as designed by the Environmental Health Division(drawing dated October 4, 1999) as shown on Attachment A of i this document. A four-inch pipe, extending to the septic tank inlet, shall be connected to the basin drain. A water tight, self closing lid shall be installed on the basin drain. Waste placed into the disposal basin shall be flushed into the septic tank by water. A garden hose or a bucket of water may I be used for this purpose. The waste basin, lid, and pipe shall be maintained in good working order. The waste disposal basin shall be located so as to allow for gravity feeding into the septic tank. Until such time as the septic system is operational,the dog wastes may be disposed of on-site by burying in holes lined with lime. l The septic system shall be installed under permit from the Environmental Health Division and the waste disposal basin and pipe installed under permit from the Building Division. A plan showing the type and location of the waste disposal basin shall be submitted to and approved by the Planning Division and the Environmental Health Division prior to issuance of the required permit from the Building Division. One concern is the dog feces in the kennel. It appears that the feces have not been picked up for many weeks, if not longer. This cannot be healthy for the dogs and could be considered cruelty to animals. Wendy told me that Animal Control cannot issue a citation for the dog feces, that it must come from EHD. However, I spoke with Doug and Charlotte after the site visit, and was told that they can only act if the dog feces are a hazard to humans, which they aren't because no one lives near the site. Doug told me that the SPCA is the agency that can enforce the dog feces issue. Is this correct? Maybe the SPCA needs to be brought in. The second concern I have is that the dog kennel attracts rats. Wendy and I saw a large dead rat in one of the kennels that had two dogs in it'. Wendy also noticed holes dug by rats in some of the other kennels. According to Doug, the rats are attracted to the dog feces. Are there any County Codes that deal with uses that attract rodents? Like the dog feces issue, this may not be a hazard to humans, but is to the dogs. It appears that Mr. Rossberg is not taking proper care to the dogs, which to me is bordering on neglect. I am sure that I will recommend denial of the Use Permit due to the horrible conditions that the dogs are living in. Any additional information that you can provide would be greatly appreciated. I hope that your department and/or the SPCA can investigate the dog feces and rat issues, and any other issues with regards to possible cruelty to the dogs. Thanks. [there's lots more] Anyone who sees the site thinks this guy is a real pro...nothing could be farther from the truth. The pictures make everything seem really wonderful. I really hope you go along on the site investigation, you won't believe R. The people who alerted me are:Laura Moore [916]646-8282 Byron Lynn [408]385-6715 and Dale Soehme(pronounced bayme] I have also been working with Steve Heffelfinger of the sheriffs office who gave me your name. I visited the place Sun Feb.22, 1998 and it was awful. All the dogs are kenneled on dirt [& poop]with little or no shelter[some broken down dog houses] there is a portable chain link kennel in the garage[no garage door]with a fruit bin for a whelping box. The box has I layer of wet, dirty newspaper and the 5 pups are huddling in a corner to try to stay warm..it would not surprise me if there were more in the litter& some died of cold. The mom is thin to the point of starvation...there was no food in the kenne!&only a tall [too tall for the pups]bucket of very dirty water. The rest of the dogs are in good flesh but all cringe when Roger speaks. He shows you how well behaved they all are by holding up his clenched fist as he gives a command. There is no question this is a puppy mill. I have not visited the house down the road, but I will bet my life it's an annex. I would be interested in seeing the registration papers on the second house's dogs..,bet they are Rossberg or just transferred. Rossberg was cited by AKC recently& I understand he transferred ownership of dogs to his son. This guy is VERY slick. He knows the game &will make a great show of his own wonderfulness. Thanks! 0 Hello Steven Betts, Feb. 1.0,2000 The kennel I porpose to build at 517 Wild Game Place would have30 dogs maximum. The kennel will consist of Labradors and Golden Retrievers,and they will be my personal pets that I pal to raise and train for hunting,and breeding. I hope to use shotguns in the training of my dogs,but there are a lot of ways to train a dog and if the firing of a gun is prohibited,then I will use other methods. I don't really plan to train or board other peoples dogs,but it would be nice to have the option. At first I don't plan to hire anybody to help run the kennel because I would like to keep it small,something I can handle myself when I am not busy practicing my regular profession of teacher. Some one will always be at he kennel,either my son or daughter or wife. When I am at work the dogs will be lock up inside 6 x 12 metal kennels inside the larger cement kennel. No dog will be allowed to roam around free without supervision. A five foot metal horse wire will surround the kennel and the whole property. A metal roof will enclose the kennel to help mitigate any noise and the kennel will only be an indoor kennel,not an indoor/outdoor kennel. I like to sleep also. If anti-barking collars are necessary I will buy them,but I will not debark my dogs surgically. I do not plan to build any structure in the"No Development Zone". The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit B"and dated 19_and is incorporated herein by this reference. 2. Prior to the issuance of building permits,the plans,incorporating all applicable conditions of approval shall be submitted to the Planning Division to verify compliance with said conditions of approval. 3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view obstructing gates and a solid or semi-open shade cover. Plans to be reviewed and approved by the Planning Division prior to construction. 4. Prior to any use of the project site or business activity being commenced thereon, pursuant to this permit, . conditions of approval contained herein shall be completed to the satisfaction of the Planning Division. 5. All electrical and mechanical equipment,including but not limited to air conditioning units,electrical boxes,transformers,and backflow preventers,shall be screened from public view. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING _ 1. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the existing on-site mature trees,located in any area proposed for buildings and vehicular access,shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees,where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter,4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than_gallon size. 3. All landscaped areas shall be maintained in a healthy and thriving condition,free from weeds,trash, and debris, during the term of this permit. 4. All graded slopes, over 5 feet in height, or on slopes greater than_%, shall be seeded,planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development,trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer,no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees,but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered,the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division,and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division.Archaeological artifacts are defined as follows: 2. Prior to any clearing,grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. —3. Prior to the issuance of the Use Permit,to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. —4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire(unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add,change,or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval.
