(SL) (VIDEO) The Commission waived the presentation of the Staff Report. A video of the site was shown. Mr. Lucas said this is a request to expand an existing church. He said the church has complied with all the conditions of their original Use Permit. The hearing was opened to the public. Pastor Robertson said they would like to accommodate growth that has occurred over the last two years and might occur over the next 10 years. He said he has no problems with the conditions. Gary Edward Wilson, Mr. and Mrs. Henry Posthumus, Regina Hoff, Harold and Shirley Stepp, Roger and Beverly Schreur, and Gordon M. Robbins submitted cards in support of this project. The hearing was closed. It was moved by Commissioner Nelson, seconded by Commissioner Lynch, and unanimously carried for approval as follows: Section 1: Environmental Findings. A. Find that the project is not subject to environmental review under CEQA as per the General Rule Exemption as defined in CEQA Section 15061 (b)(3); and ` B. The proposed project will not cause environmental damage to fish or wildlife or their habitat. Section 2: Zoning Ordinance Findings. A. Hogan, Planning Manat� BY: Stephen Lucas, Planner DATE: 3 August 1994 REQUEST: Use Permit - Forest Ranch Baptist Church on AP#063-210-013: A request for a Use permit to allow the expansion of an existing church building on 3.87 acres of land zoned AR-5 (Agricultural Residential - 5 acres) located on the northeast corner of Schott Road and Wagon Road at 4967 Schott Road, FR. RELATED ITEMS: Use Permit was issued in 1981 for establishment of this church. FOR: Planning Commission Meeting of 22 September 1994 ABSTRACT: This application for a Use Permit is to expand the existing church building. The public use is conditionally consistent with the AR-5 zoning and General Plan designation of Agricultural Residential. Staff recommends approval of application with conditions and findings. PROJECT CHARACTERISTICS: The Forest Ranch Baptist Church is asking to expand the existing 2800+/- sq. ft. building located on 3.87 acres in Forest Ranch. The proposed 4944 sq. ft. expansion includes a 1600 sq. ft. classroom area and a 3344 sq. ft. sanctuary. The church conducts both services and classroom activities at the site and is in need of this expansion to accommodate an expanding congregation. The maximum.anticipated seating capacity of the sanctuary is 180 persons and the classrooms will have a maximum anticipated seating of 20 persons per room. The site is level with large pine trees and chaparral along the perimeter, although the building sites will require no significant vegetation removal. The general area is a rural foothill environment and is sparsely developed with residential uses. The church is served by an existing septic system and well. The parcel is served by all utilities to the existing building. The parcel has a large and adequate 48, space gravel parking area with landscaping along the road frontage to a depth of ten feet and is accessed by entrances on both Schott Road and Wagon Road. The AR-5 zone is conditionally consistent with the General Plan designation of Agricultural Residential, which indicates that quasi-public uses are considered Secondary Uses. The church applied for, and received a Use Permit in 1981 to build the existing church. The increase in square footage from approximately 2800 sq. ft. to approximately 7744 sq. ft. will require the church to meet the additional parking requirements of Butte County Code Section 25-35. The church currently has 48 spaces which exceeds the 36 spaces required in the Code. The Butte County Fire Department requires that the project will meet the Fire Safe Regulations of Butte County and PRC 4290. The Public Works Department will require that the applicant provide a permanent solution for drainage, submit construction and drainage plans to DPW.for approval and install the required facilities. Comments have been requested of Caltrans, but no response has been received. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be a Categorical Exemption under Section 15301(e)(2)(B) of the California Environmental Quality Act (CEQA) and as such, is exempt from environmental review. The Section indicates that additions to existing structures that do not exceed 10,000 sq. ft. are eligible for a Categorical Exemption if the area in which the project is located is not environmentally sensitive. This expansion of the existing church will not require any substantial alteration of the site nor will it create any significant impacts to the environment or surrounding parcels.. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing will occur in the Enterprise Record. Public notices will be mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission approve the Use Permit for the Forest Ranch Baptist Church on AP# 063-210-013, subject to the following findings and conditions. FOR: Planning Commission Meeting of 22 September 1994 ABSTRACT: This application for a Use Permit is to expand the existing church building. The public use is conditionally consistent with the AR-5 zoning and General Plan designation of Agricultural Residential. Staff recommends approval of application with conditions and findings. PROJECT CHARACTERISTICS: The Forest Ranch Baptist Church is asking to expand the existing 2800+/- sq. ft. building located on 3.87 acres in Forest Ranch. The proposed 4944 sq. ft. expansion includes a 1600 sq. ft. classroom area and a 3344 sq. ft. sanctuary. The church conducts both services and classroom activities at the site and.is in need of this expansion to accommodate an expanding congregation. The maximum anticipated seating capacity of the sanctuary is 180 persons and the classrooms will have a maximum anticipated seating of 20 persons per room. The site is level with large pine trees and chaparral along the perimeter, although the building sites will require no significant vegetation removal. The general area is a rural foothill environment and is sparsely developed with residential uses. The church. is served by an existing septic system and well. The parcel is served by all utilities to the existing building. The parcel has a large and adequate 48 space gravel parking area with landscaping along the road frontage to a depth of ten feet and is accessed by entrances on both Schott Road and Wagon Road. The AR-5 zone is conditionally consistent with the General Plan designation of Agricultural Residential, which indicates that quasi-public uses are considered Secondary Uses. The church applied for, and received a Use Permit in 1981 to build the existing church. The increase in square footage from approximately 2800_ sq. ft. to approximately 7744 sq. ft. will require the church to meet the additional parking requirements of Butte County Code Section 25-35. The church currently has 48 spaces which exceeds the 36 spaces required in the Code. The Butte County Fire Department requires that the project will meet the Fire Safe Regulations of Butte County and PRC 4290. The Public Works Department will require that the applicant provide a permanent solution for drainage, submit construction and drainage plans to DPW for approval and install the required facilities. Comments have been requested of Caltrans, but no response has been received. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be a Categorical Exemption under Section 15301(e)(2)(B) of the California Environmental Quality Act (CEQA) and as such, is exempt from environmental review. The Section indicates that additions.to existing structures that do not exceed 10,000 sq. ft. are eligible for a Categorical Exemption if the area in which the project is located is not environmentally sensitive. This expansion of the existing church will not require any substantial alteration of the site nor will it create any significant impacts to the environment or surrounding parcels. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing will occur in the Enterprise Record. Public notices will be mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission approve the Use Permit for the Forest Ranch Baptist Church on AP# 063-210-013, subject to the following Bindings and conditions. Section 1: Environmental Findings. A. Find that the project is not subject to environmental review under CEQA as per the General Rule Exemption as defined in CEQA Section 15061 (b)(3); and B. The proposed project will not cause environmental damage to fish or wildlife .or their habitat. Section 2: Zoning Ordinance Findings. A. The project is in conformance with the Butte County General Plan designation of Agricultural Residential and is conditionally permitted under the AR-5 zoning; and ■ Butte County Department of Development Services - Planning Division ■ 2 B. The project as proposed will not be detrimental'to the health, safety and welfare of the people of Butte County provided the required conditions are complied with. I Section 3: Action A. B. Conditions of Approval: 1. Applicant shall adhere to all conditions prescribed in the original Use Permit #81-28. 2. Applicant shall meet all the parking requirements of Butte County Code Section 24-35 prior to issuance of Building Permits. 3.
