The Commission waived the presentation of the Staff Report. A video of the site was
shown.
The hearing was opened to the public.
Lynette Redmon said they agreed with the conditions.
The hearing was closed.
It was moved by Commissioner Seegert, seconded by Commissioner Nelson, and
unanimously carried for approval as follows:
Section 1: Environmental Findings.
A. The request is categorically exempt from environmental review; and
li B. The design of the proposed project improvements will not cause
environmental damage to fish of wildlife or their habitat; and
Section 2: Zoning Ordinance Findings.
A. The proposed use of the property will not impair the integrity and character
of the zone in which the land lies and that the use would not be
unreasonably incompatible with or injurious to surrounding property or
detrimental,to the health, safety and general welfare of the persons residing
or working in the neighborhood or to the general health, welfare and safety
of the County; and
Section 3: Actions.
A. Subject to the findings indicated in Sections 1 and 2 of this report, approve
the Use Permit for James & Phyllis Redmon on AP#041-490-028 to allow
a temporary mobile home. Approval shall be subject to the following
conditions:

B. Conditions of Approval:
1. Occupancy of the mobile home is limited to William Huyck, Lynette
Redmon and her two children.
2. No rent is to be charged to the occupant of the mobile home.
3. Meet the requirements of the Butte County Environmental Health
Department for domestic water supply and sewage disposal. (install
septic system under permit and inspection from Health.)
4. The mobile home is to be a temporary use on the property pursuant
to the requirements of Section 24-304 of the Butte County Code.
5. The Use Permit shall expire two years from the date of issuance of
the Use Permit. If an application for extension is filed 60 calendar
days prior to permit expiration, the Planning Commission may grant
extensions of the Use Permit not exceeding one year per extension.
6. In the event that the applicant who is residing within the mobile home
or the conventional residence, for any reason, moves to another
location or is deceased, then in that event, the Use Permit granted
herein shall automatically expire and the mobile home shall be
removed within one hundred twenty (120) days. In the event the
mobile home is not removed within one hundred twenty (120) days
pursuant to the terms of the Use Permit,the County shall remove the
mobile home and store it at the owner's expense.
7. The applicant is to pay a deposit or post a bond to cover the cost of
removal in the amount of $1,500 for a single-wide mobile or
$2,000.00 for a double-wide mobile.
8. Meet the requirements of the Building Division of the Butte County
Department of Development Services.
9. Meet the requirements of the Butte County Fire
Department/California Department of Forestry. (Pay $200 into the
Water tender fund. All new structures must meet the fire safe
regulations of PRC 4290.)
10. Building permit fees and any current, or new, impact fees are to be
paid at the fee level in place at the time of the application for the
building permit.

11. Applicant must also comply with all other applicable State and local
statutes, ordinances, and regulations.
NOTE: Minor changes may be approved administratively by the
Director of Development Services, or his designee, upon
receipt of a substantiated written request by the applicant.
Prior to such approval, verification shall be made by each
Department or Division that the modification is consistent with
the application, fees paid and environmental determination as
conditionally approved. Changes deemed to be major or
significant in nature shall require a formal application for an
amendment.

& Phyllis Redmon : A request for a Use Permit to allow a temporary mobile
home, on property in the "U" zone. Located on the west side of Chrishelle Way
approximately 400 feet south of Patterson Lane, in the Cherokee area.

ABSTRACT: This request is consistent with both the current zoning and General Plan. There
are no major issues for this project. Staff recommends approval of the project subject to the
findings and conditions listed in this report.
PROJECT CHARACTERISTICS: This project is a request for a Use Permit to allow a mobile
home as a temporary second dwelling. The parcel is developed withan existing 1600 square
foot mobile home. The project site is located on Table Mountain.

ANALYSIS: The applicant is requesting to house their daughter and her family. Mr Redmon
has suffered a head injury and needs care.This need complies with Butte County Code Section
24-303. The location of the mobile home would provide access for the daughter to care for her
parent. The "U" zoning is consistent with the General Plan Land Use designation of Agricultural-
Residential. The Land Use designation allows for a temporary second dwelling.
Butte County Code Section 24-304 provides for removal of the mobile home within 120 days
after occupancy ceases. The Code also makes provision for a bond or deposit of suffucent size
at the time of application to ensure removal expenses should the County be required to
remove the mobile home. If the applicant removes this mobile home voluntarily, then the bond
or deposit is returned. The County has determined that a deposit of$1,500 per single-wide and
$2,000 for a double-wide mobile home are reasonable to ensure mobile home removal. The
applicant proposes to place a double wide mobile home on the property.
ENVIRONMENTAL DOCUMENTATION: This proposed request is categorically exempt from
the requirements of the California Environmental Quality Act (CEQA), in accordance with
Section 15303 of the Public Resources Code which states:
"Class 3 consists of construction and location of limited numbers of new, small facilities
of structures..."
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be
advertised and held. Prior to the public hearing, notices are mailed to all property owners within
a 300 foot radius of the subject property, but not less than 10 parcels.
RECOMMENDATION: Staff recommends that the Commission approve the application for a
temporary second dwelling for James & Phyllis Redmon on AP#041-490-028, subject to the
following findings and conditions.
Section 1: Environmental Findings.
A. The request is categorically exempt from environmental review; and
B. The design of the proposed project improvements will not cause environmental
damage to fish of wildlife or their habitat; and

A. The proposed use of the property will not impair the integrity and character of the
zone in which the land lies and that the use would not be unreasonably
incompatible with or injurious to surrounding property or detrimental to the health,

neighborhood or to the general health, welfare and safety of the County; and
Section 3: Actions.

The Board of Supervisors has found that for the health, safety, and welfare of the people
of the County that it has often become necessary for the care of persons who by reason
of old age, disease (either mental or physical), infirmity or other cause, are unable,
unassisted, properly to manage and take care of themselves, or would benefit from
familial assistance, to allow mobile homes to be placed on smaller parcels than present
County codes or ordinances permit so ' that such persons will not have to be
institutionalized, but rather can reside near their close relatives who can help care for
them. The abil'itV to care for one's close relatives will not only result in better care for
citizens, but will also negate in many situations the necessity for public assistance which
many citizens find degrading and damaging to the pride of-the persons concerned and
their immediate relatives. This will also provide privacy and dignity for the relative as
well as independence, of which these people are deserving.

INSTRUCTIONS TO USE PERMIT APPLICANTS
1. If applicant is not the owner, written authorization by the owner or other proof of agency must
be submitted in order for the applicant to legally sign the application. Application-shall be
considered void if not signed by the owner or legal agent.
2. All items on application shall be filled in as completely as possible. If an item is not appli-
cable, please indicate by the term "NA".
3. It is important that the applicant supply an accurate description of the location of the proposed
project, including the following:
a. Assessor's parcel number(s) (from the tax bills or Assessor's maps).
b. Street addresses (if available).
c. Distances and directions to named streets, bodies of water or railroads.
4. � copies of a detailed plot .plan of adequate scale to clearly show proposed build-
ings and improvements, folded to 8Y2 x 11 inches, shall accompany and be made part of the
"Application for Use Permit". If the use permit is approved, .the plot plan becomes the ap-
proved development plan for the property.The plot plan shall include the following information:

5. The "Application for Use Permit" is subject to public hearings and approval by the Planning
Commission. Any special conditions of approval shall be made a part of the approved "Use
Permit" and shall be binding on the applicant. The procedures for County action on use per-
mit applications are stated in Chapter 24 of the Butte County Code.
6. The .Planning Commission, on the basis of the evidence submitted at thepublic hearing,may
grant use permits when it finds that the proposed uses of the property will not impair the
integrity and character of the zone in which the land lies and that the use would not be un-
reasonably incompatible with or injurious to surrounding properties nor detrimental to the
health and general welfare of the persons residing or working in the neighborhood norto the
general health, safety and welfare of the county.
7. In approving a use permit, the Planning Commission may include such conditions as are
deemed reasonable "and necessary under the circumstances to preserve the integrity and
character of the zone and to secure the general purposes of the Butte County General Plan
and Chapter 24, of the Butte County Code. Such conditions may include, but are not limited
to: time limitations, development plan approval, hours of operation, fencing, dedication of
right-of-way, and street and drainage improvements. Conditions imposed upon issuance of a
use permit must be reasonably related to the use for which the permit is requested.

rhe Board of Supervisors has found that for the health, safety, and welfare of the people of the County that it has often become
)ecessary for the care of persons who by reason of old age,disease(either mental or physical),infirmity or other cause, are unable,
inassisted,to property manage and take care of themselves, or would benefit from familial assistance,to allow mobile homes to
oe placed on smaller parcels than present County-Codes or Ordinances permit, so that such persons will not have to be
institutionalized, but rather can reside near their close relatives who can help care for them. The ability to care for one's close
elatives will not only result in better care for citizens, but will also negate in many situations the necessity for public assistance which
.many citizens find degrading and damaging to the pride of the persons concerned and their immediate relatives. This will also
provide privacy and dignity for the relative as well as independence, of which these people are deserving.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: James and Phyllis Redmon are hereby granted a Use Permit
in accordance with application filed: August 15, 1994 to allow a mobile home as a
temporary second dwelling on property zoned "U" (Unclassified) located on the west side
of Chrishelle Way, approximately 350 feet south of Patterson Lane west of Cherokee
Road, at 8711 Chrishelle Way,*Oroville, CA.
I. Failure to comply with the conditions specified herein as the basis for
approval of application and issuance of Permit, constitutes cause for the
revocation of said permit in accordance with the procedures set forth in the
Butte County Zoning Ordinance, including Butte County Code Sec. 24-62.
2. Unless otherwise provided for in a special condition to this use permit, all
conditions must be completed by the Permittee within 12 months of the
delivery of the countersigned permit to the Permittee.
3. If any use for which a use permit has been granted is not established within
one year of the date of receipt of the countersigned permit by the Permittee,
the permit shall become null and void and reapplication and a new permit
shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the 'benefit of the heirs, legal representatives, successors, and
assigns of the Permittee.
SPECIAL CONDITIONS:
1. Occupancy of the mobile home is limited to William Huyck, Lynette Redmon and
her two children.
2. No rent is to be charged to the occupant of the mobile home.
3. Meet the requirements of the Butte County Environmental Health Department for
domestic water supply and sewage disposal. (Install septic system under permit
and inspection from Health.)
4. The mobile .home is to be a temporary use on the property pursuant to the
requirements of Section 24-304 of the Butte County Code.
5. The Use Permit shall expire two years from the date of issuance of the Use Permit.
If an application for extension is filed 60 calendar days prior to permit expiration,
the Planning Commission may grant extensions of the Use Permit not exceeding
one year per extension.
6. In the event that the applicant who is residing within the mobile home or the
conventional residence, for any reason, moves to another location or is deceased,
then in that event, the Use Permit granted herein shall automatically expire and the
mobile home shall be removed within one hundred twenty (120) days. In,the event
the mobile home is not removed within one hundred twenty (120) days pursuant
to the terms of the Use Permit, the County shall remove the mobile home and
store it at the owner's expense.
7. The applicant is to pay a deposit or post a bond to cover the cost of removal in
the amount of $1,500 for a single-wide mobile or $2,000.00 for a double-wide
mobile.
8. Meet the requirements of the Building Division of the Butte County Department of
Development Services.
9. Meet the requirements of the Butte County Fre Department/California Department
of Forestry. (Pay $200 into the Water tender fund. All new structures must meet
the fire safe regulations of PRC 4290.)
10. Building permit fees and any current, or new, impact fees are to be paid at the fee
level in place at the time of the application for the building permit.
11. Applicant must also comply with all other applicable State and local statutes, .
ordinances, and regulations.
NOTE: Minor changes may be approved administratively by the Director of
Development Services, or his designee, upon receipt of a substantiated
written request by the applicant. Prior to such approval, verification shall be
made by each Department or Division that the modification is consistent
with the application, fees paid and environmental determination as
conditionally approved. Changes deemed to be major or significant in
nature shall require a formal application for an amendment.
I hereby declare under penalty of perjury that I have read the foregoing conditions,
that they are in fact the conditions which were imposed upon the granting of this use
permit, and that I agree to abide fully by said conditions.

Dear Mr. and Mrs. Redmon:
The Butte County Planning Commission held a meeting on October 13, 1994, your
request for a Use Permit to allow a temporary mobile home on property zoned "U"
located on the west side of Chrishelle Way, Cherokee area, was approved subject to the
following conditions:
1. Occupancy of the mobile home is limited to William Huyck, Lynette Redmon and
her two children.
2. No rent is to be charged to the occupant of the mobile home.
3. Meet the requirements of the Butte County Environmental Health Department for
domestic water supply and sewage disposal. (Install septic system under permit
and inspection from Health.)
4. The mobile home is to be a temporary use on the property pursuant to the
requirements of Section 24-304 of the Butte County.Code.
5. The Use Permit shall expire two years from the date of issuance of the Use Permit.
If an application for extension is filed 60 calendar days prior to permit expiration,
the Planning Commission may grant extensions of the Use Permit not exceeding
one year per extension.
6. In the event that the applicant who is residing within the mobile home or the
conventional residence, for any reason, moves to another location or is deceased,
then in that event, the Use Permit granted herein shall automatically expire and the
mobile home shall be removed within one hundred twenty (120) days. In the event ,
the mobile home is not removed within one hundred twenty (120) days pursuant
to the terms of the Use Permit, the County shall remove the mobile home and
store it at the owner's expense.
7. The applicant is to pay a deposit or post a bond to cover the cost of removal in
the amount of $1,500 for a single-wide mobile or $2,000.00 for a double-wide
mobile.
8. Meet the requirements of the Building Division of the Butte County Department of
Public Works.
9. Meet the requirements of the Butte County Fire Department/California Department
of Forestry: (Pay$200 into the Water tender fund, All new structures must meet the
fire safe regulations of PRC 4290.)
10. Building permit fees and any current, or new, impact fees are to be paid at the fee
level in place at the time of the application for the building permit.
11. Applicant must also comply with all other applicable State and local statutes,
ordinances, and regulations.
NOTE: Minor changes may be approved administratively by the Director of
Development Services, or his designee, upon receipt. of a substantiated
written request by the applicant. Prior to such approval, verification shall be
made by each Department or Division that the modification is consistent
with the application, fees paid and environmental determination as
conditionally approved. Changes deemed to be major or significant in
nature shall require a formal application for an amendment.
Should you desire to appeal any of the conditions imposed by the Planning Commission,
you must do so in writing with the appeal fee of $250.00, to the Clerk of the Board of
Supervisors, 25 County Center Drive, Oroville, California, prior to 5:00 p.m., Friday,
October 21, 1994. If you do not appeal and if there are no other appeal within the 8-day
appeal period, your use permit will be issued after October 21, 1994.
For purposes of the California Environmental Quality Act, a Notice of Exemption must be
filed. The fee for the filing of a Notice of Exemption is a $25.00 documentary handling
fee. A check made payable to the Butte County Treasurer in the amount of $25.00
should be submitted to the Planning Division by October 24, 1994.
