(SL) (95-143) Commissioner Lynch said that Item 3 on Page 4 of Exhibit A, says that the use must be established within "one year', but on the Church of Christ Use Permit, the sante Item, said "two years." .He said that there should be consistency. Mr. Hogan said that there is a regulation which states that the use must be established within 24 months. There is also a regulation which states that the Use Permit can be revoked by the Planning Manager if the use for which the permit was granted has ceased or been suspended for 12 months. Item 3 should be "two years" rather than "one years Commissioner Lambert said there is a difference in that Itenm 3 refers to the use being established within one year, but Item 2 talks about completion of the conditions within 2 years. Mr. Hogan said that on the Ted Stares Use Permit, Item 3, Page 4 should say, "two years." Mr. Lucas said that there will be a building where the parking/storage area is now near the creek. The creek will not be further impacted; in fact the building will protect the creek from further encroachment. Commissioner Lambert said that Comanche Creek is actually irrigation for the Parrot Ranch, and it is a year around stream, and possibly wider than 5 feet. Mr. Lucas said that the creek is actually 5 feet wide at this point, and is viewed as an intermittent drainage course by the Fish and Crone Dept. Commissioner Lambert said.that she'prefers a Use Permit for this use, and does not agree that this area should be rezoned to M-1/M-2 as discussed in Paragraph One under Land.Use. _ HEARING OPEN TO THE PUBLIC Cal Bachman, the representative,was present. He said that Mr. Stares wishes to increase the size of his building, L which will be on the existing pavement. The conditions are acceptable. Commissioner Lambert asked if"substantially" could be deleted from Condition 1? Mr. Lucas said that the reason for use of the word "substantially" is because the pavement is not exact. Mr. Bachman said there might be a difference of 2 or 3 feet from the pavement. Mr. Hogan suggested adding to the condition, "as shown on the maps on file in the Planning Division." Mr. Bachman said the pavement is not in a straight line, and of course buildings have to be in straight lines. Commissioner Lynch asked the proposed length and width of the building? BUTTE COUNTY Planning Commission Minutes - July 27 , 1995 • Mr. Bachman said the existing building would be matched It will depend on the best price available from the building manufacturer. Commissioner Lynch said that if the proposed building is 40 ft.wide there would be an encroachment onto the back of the property. Mr. Hogan said the intention is for the front of the building to lineup with the existing building,but the proposed building would be less deep to the rear than the existing building. Mr.Lucas said there is no required setback to the rear of the property. The applicant bad originally intended a larger building which would have required a variance to the front setback,but decided to have a smaller building and stay within the 50 ft. setback. Commissioner Lynch was concerned that the proposed building would be 40 ft.wide to match the existing building, which would overhang the creek. Mr. Bachman said that was not the intent, and that there would be a jog in the back. Commissioner Seegert said the proposed building should not encroach upon the creek any more than the current paving does. Mr. Bachman said the building might be 34 or 35 ft. wide. Commissioner Lambert wanted to have a condition that there would not be any outside storage allowed, such as bicycle component parts and metal roofing. Mr. Bachman said in the parking area there would be some materials used for construction, which are stored there now. Probably the only material that would be outside would be something like rock and sand materials for roofing. Mr. Lucas said there is currently a fenced storage area on one end of the existing building. Commissioner Lambert said she was only concemied about the area near the proposed building, next to the creek. 1 Mr. Lucas said the entire property line is fenced around the side and up to the front on the end where the proposed buildingwill be. Ted Starnes said that junk or trash from roofs is taken care of in a 2.5 ton drop box which is attached to a truck. ; Every job is cleaned up and put in the box and taken to the landfill. "There is no trash on the lot. 'There are shrubs. ; The blacktop is blown off and kept clean. t Commissioner Lynch said that Condition 4 covers the outside storage concem pretty well. Mr. Hogan said Condition 4 addresses the area behind the building. There could be a condition to state: "There shall be no outdoor storage of junk, scraps or trash." Chairman Nelson said there doesn't really seem to be a problem anyway. Commissioner Lambert said her main concern is protection of the,creek,and to keep things from being thrown in the creek: BUTTE COUNTY Planning Commission Minutes - July -2-7; 1.995 _ Commissioner Lynch asked if Mr. Starnes has piles of things he night possibly use in the future? Mr. Starnes said he has no such piles. All the roofing is housed inside and nothing is stored outside, except some stacks of plywood Commissioner Lynch thought there might be some bicycle parts outside. Mr. Stames said they would all be stored inside. "Contnussioner Seegert asked the location of the existing fire hydrant? Mr. Bachman said there is.a hydrant about 300 ft. from the property on Scott Avenue, right around the comer. E Commissioner Seegert said that there is a requirement for a fire hydrant in front of the building, but there must be existing fire hydrants in the area, since there are existing buildings. Mr. Bachman said Cal Water has no problem with putting in a fire hydrant, but there is one by Korets on Park Avenue about 600 ft. away from the property. The other hydrant is around the comer on Scott Avenue. Commissioner Lambert asked how the City of Chico relates to the property? Mr. Lucas said the property is within the Chico Urban Area,which triggered the urban area improvements. Commissioner Lambert asked if the property has septic and well? Mr. Lucas said that is correct. Mr. Bachman said the property would have to be annexed to the City of Chico in order to annex to the city sewer system. Commissioner Seegert was concerned about Condition 5 for a fire hydrant if there is an existing fire hydrant within 300 ft. He questioned if that is a necessary condition. I Commissioner Lynch suggested only requiring a fire hydrant if there is not already a hydrant within 300 ft. Commissioner Seegert said that in the Development Review Committee it has been stated that 1,000 ft. distance to a hydrant is acceptable. Commissioner Lynch suggested requiring a fire hydrant if there is not one within 500 ft. Chairman Nelson noted that this is a manufacturing operation. Commissioner Seegert said there are reasons why it would not be desirable to have fire hydrants any closer than 300 ft. or on every parcel. He is not opposed to requiring a fire hydrant, but questions whether it is necessary.- Chairman ecessary.Chairman Nelson asked what a reasonable distance to a fire hydrant is? Commissioner Lambert said that some insurance rates may be reduced if there is a fire plug within 1,000 ft.+ � BUTTE COUNTY Planning Commission Minutes - July 27 1995 , ! Mr. Hogan said that 300 ft. in an urban area is the spacing he has heard about. He thought the 1,000 & distance light apply in rural areas. Chairman Nelson noted that the existing building is 150 ft. long. That might be why the hydrant was required, in I rder to meet the 300 ft. rule. I Mr. Lucas said the applicant is not opposed to installing a fire hydrant, but would suggest deleting the words, "in 'front of the proposed building expansion," in order to work out the exact location with the Fre Dept. Lnirii'*ssioner Seegert said he was simply discussing the subject in general temms and was not opposed to the !condition to-install a fire hydrant. It was agreed to invite Ted Crawford of CDF to speak at a Planning Commission meeting and discuss the rural and urban standards. Commissioner Lynch suggested requiring a hydrant if there is not one within 300 ft. of the.proposed structure. Commissioner Lambert said that she was in favor of the condition the way it is, especially in this industrial area It was moved by Commissioner Lynch,seconded by Commissioner Lambert,and carred unanimously for approval of the Use Permit, Items 1 and 2 as stated, Item 3 should be changed from "one yeas" to "two years." Hogan, Planning Manage BY: Stephen Lucas, Planner DATE: July 17, 1995 REQUEST: Use Permit for Ted Starnes (owner/applicant) on APN 005-520-029: A request for a Use Permit to allow the expansion of an existing warehouse and manufacturing business on a one (1) acre parcel of land zoned U (Unclassified) located on the south side of Fair Street, approximately 600 ft. south of East Park Avenue at 1258-1280 Fair Street in the south Chico area. RELATED ITEMS: None FOR: Planning Commission Meeting of July 27, 1995 ABSTRACT: This application for a Use Permit is to expand the existing manufacturing and warehouse building. The use is conditionally consistent with the Unclassified zoning and General Plan designation of Industrial. Staff recommends approval with conditions and findings of this application. PROJECT CHARACTERISTICS: The applicant is asking to enlarge the existing 6000 sq. ft. industrial building located on approximately one (1) acre in south Chico. The building is shared by a small business enterprise that produces nationally recognized bicycle components and a roofing firm. The bicycle component firm will occupy the entire existing building while the roofing firm will utilize the proposed 2500+/- sq. ft. expansion for materials storage. The elongated site is level and covered by existing paved and gravel parking areas with the exception of a grassy strip.between the building and Comanche Creek. The property has approximately 350 ft of frontage along Fair St and approximately 400 ft. of rear property line bordered by Comanche Creek. Comanche Creek consumes approximately 15,200 sq. ft of the site, making the site very difficult to plan for improvements. The general area is a manufacturing/industrial environment which includes a junk yard, animal shelter,petroleum distribution center, and other similar uses. The parcel is served by an existing septic system, a well, and all utilities to the existing building. The parcel is located within the Chico Urban Area and will be required to meet the standards developed by the City for road improvements. ANALYSIS: The applicant would like to expand the existing building to accommodate the needs of the rapidly growing bicycle component business that involves the development, engineering, production, and marketing of the components. The bicycle firm will occupy the entire existing building while the roofing company will utilize the 25004/- expansion to warehouse its materials. Without the expansion, the bicycle component business may have to relocate to another location that would provide adequate space. There are three issue raised by the proposal, land use, the proximity to Comanche Creek, and parking/infrastructure improvements. ■ Butte County Department of Development Services -Planning Division ■ 1 AGENDA ITEM Land Use The proposed building expansion is considered a modification of an existing conditional use under the U zoning which requires a Use Permit The proposed use is consistent with the General Plan designation of Industrial and is surrounded by properties either zoned M-1/M-2 or in industrial use. The project site is anticipated to be rezoned in the future to M-1/M-2 in order to bring the area into conformance with the General Plan. Were the property appropriately zoned M-1/M-2, a use permit would not be required for this request The project site is located in an area of various industrial land uses including an auto wrecking yard to the north, the Butte County Animal Shelter across the street to the east, a petroleum distribution center across Comanche Creek to the west, and a variety of other manufacturing and service industries within the immediate 1/2 mile vicinity. The significance of these uses relates to the impact of the proposed expansion in terms of the suitability of a manufacturing expansion in the area and the protection of Comanche Creek. The viability of Comanche Creek as a recreational greenway in this area is a non- issue, the development of uses along the creek has effectively sealed off access to the creek. The proposed project is compatible with surrounding land uses and does not have the potential for causing the noise or pollution impacts generated by the wrecking yard, fuel dump, or animal shelter. Comanche Creek The project site is bordered to the southwest by Comanche Creek, a narrow 5 ft. wide intermittent stream/drainage course that flows to the west The existing building is located approximately 25 ft from the creek at the south end of the building and 7 ft from the creek at the north end. The existing paved outdoor storage area at the north of the parcel is located 5 ft from the creek. The proposed 2500 sq. ft building will be built directly over the existing paved storage area which will not require the alteration of any existing development setbacks from the creek. Essentially, the structure will be new, but the developed land will remain unchanged. The erection of a structure on the paved surface will have the benefit of creating a permanent separation along the creek that will effectively screen the creek from any potential encroachment by equipment or other debris,where, as now,there is no effective barrier between the paved storage area and the creek. The City of Chico has responded with comments regarding the creek setback. The Chico General Plan indicates a 25 ft. setback along Comanche Creek in which no development shall occur, including parking areas, pools, structures, etc. A 25 ft. setback on this particular property would render the vacant area useless by the landowner. However, this setback requirement does not apply to areas already developed such as the existing paved storage area where the new building is proposed. To further improve an already developed parcel, a condition will be added to require the building owner/applicant to erect a chain link fence to either side of the new and existing buildings connecting the corner of the buildings to the north/south property lines. Additionally, the new building will not be permitted any rear doors along Comanche Creek. The fence and door restrictions will limit the access and use of the grassy area along Comanche Creek and protect the bank from encroachment The grassy area along the creek can be used for an employee break area, but no storage of materials or alteration of the ground shall be ■ Butte County Department of Development Services -Planning Division ■ 2 AGENDA ITEM allowed. With the addition of this condition, the project will have no significant impact to the creek and will actually allow for greater protection of the resource. The Department of Fish & Game were given the opportunity to respond and did not comment. It is presumed that the intense urban nature of this area combined with the irretrievable access to the creek, makes protecting the resource beyond current levels not feasible. II Parking/infrastructure The elongated parcel presently provides 6 parking spaces with 7 additional spaces proposed. The Butte County Code requires the business to provide 5 spaces and the City of Chico requires 6 spaces. Additional parking could be available if one or more of the four existing driveways is eliminated, as recommended by the Department of Public Works.The removal of driveways would require the applicant to install a curb and gutter in those areas. With adequate parking available, driveway removal is not necessary. The City of Chico has indicated that the project should also address the first flush quality and quantity of drainage. However, drainage on-site will not be significantly altered because the proposed building will be built atop a paved storage area, thus, no increase in impervious surfacing will occur. Road improvements along Fair St may be required, although curbs and gutters are in place,the City may require a sidewalk to be installed. Other concerns The Environmental Health Division has responded with no recommendations or conditions. The Butte County Fire Department requires the installation of a fire hydrant capable of producing 2000 gpm in front of the building expansion on Fair Street The type and location of the hydrant shall be coordinated with the Butte County Fire Department. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be a Categorical Exemption under Section 15301(e) of the California Environmental Quality Act (CEQA) and as such, is exempt from environmental review. The Section indicates that additions to existing structures that do not exceed 50% of the original structure or are under 2,500 sq. ft. are eligible for a Categorical Exemption. The proposed expansion of the building will not require any substantial alteration to the site nor will it create any significant impacts to the environment or surrounding parcels. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing will occur in the Chico Enterprise Record. Public notices were mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment RECOMMENDATION: Staff recommends that the Planning Commission approve the application on APN 005-520-029, subject to the findings and conditions in the attached Exhibit "A". The proposed use of the property would not be detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health,welfare and safety of the residents of the County in that the proposed building expansion does not involve any new uses.nor will the expansion cause any significant health or safety impacts; and Section 3: Action A. Subject to the findings indicated in Sections 1 and 2 of this Permit and the conditions below, a Use Permit is approved for Ted Starnes on APN 005-520-029 to allow the expansion,of an existing manufacturing and warehouse building on property zoned U located on the south side of Fair Street in Chico. B. Minor changes may be approved administratively by the Director of Development Services or designee upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 1. The proposed building expansion shall substantially conform to the existing paved storage area, the exact area shall be reviewed by the Planning Division prior to issuance of building permits. 2. The proposed building shall not have access doors or other entrances to the rear of the building bordering Comanche Creek. 3. Install and maintain a 6 ft. high chain link fence extending from the rear corners of the existing and proposed buildings to the side property lines to limit access to the rear of the building and Comanche Creek. 4. No storage of materials or alteration of the ground shall be allowed between the buildings/fence and Comanche Creek. This area can be used for an employee break area or other similar purpose approved by the Planning Division. 5. Install a fire hydrant capable of producing 2000 gpm in front of the proposed building expansion. The type and exact location of the fire hydrant must be coordinated with the Butte County Fire Department. 6.
