Turner - Use Permit (Categorically Exempt from environmental review) to allow a mobile home as a temporary second dwelling on property zoned A-5 (Agricultural - .5 acre parcels) located at the northeast corner of Muir Avenue and Rodeo Avenue, identified as AP 42-06-13, Chico. The Commission waived the reading of the staff analysis. The hearing was opened to the public. Nelsyne turner was there to answer questions. The hearing was closed. Commissioner Walter. had no objections. It was moved by .Commissioner Lambert, seconded by Commissioner Walter, and unanimously carried as follows: A. Note that this.project is Categorically Exempt from environmental review; and B. Find that the project does meet Butte County Code Section•24-47 that states: "The proposed uses of the property will not impair the integrity and character of-the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in. the neighborhood or to the general health, welfare and safety of the County";, and C. The 10 acre site is currently occupied by one single family dwell i nra. and approximately 9 acres of mature walnut orchard. The proposed temporary mobile home will take access off of Rodeo Avenue. Trees may have to be removed to allow adequate building site and leach field area. . The proposed location of the mobile home is not near .-Iny neighboring dwellings and will not cause any undue hardship on neighboring properties. The mobile home is to be occupied by the applicant 's daughter. BUTTE COUNTY PLANN AQUOMM I SS I ON STAFF FINDING - March 20, 1986 Page 2 provide domestic water from the existing well and to install a new septic system for the mobile. This project is Categorically Exempt from environmental review. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to insure that the taxpayers at large (via the General fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the, Code. Of course, if the applicant removes this mobile home voluntyrily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reipbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal . Cost , of course, would vary due to installation of landscaping , decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1 ,000 per single wide and $1 ,500 for a double wide mobile home. These amounts seem reasonable to insure that the mobile home is removed at no cost to the county or the taxpayers. The applicant proposes to place a single wide mobile home on the property. This project is Categorically Exempt from environmental review and appears to conform to the requirements of Butte County Code Section 24-304 regarding the placement of temporary mobile homes. RECOMMENDATIONS L A. Note that this project is categorically exempt from environmental review; and B. Find that this proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with , or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health , welfare and safety of the County; and C. This project is C .tegorically Exempt from environmental review. ' . � Butte County Code Section 24-304 providC.?s for remoyal of the mobile home | � within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also makes provision for the County � requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to insure that the taxpayers at large (via the General fund) are not charged those expenses should the County be forced to remove the mobile home pursuant � to the Code. Of course , if the applicant removes this mobile home � voluntarily , then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant . A survey of several mobile home dealerships in� Butte County has indicated a rather wide range of estimated costs of removal . Cost , of course, would vary due to installation of - landscaping , decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1 ,000 per single. wide and $1 ,500 for a double wide mobile home! These amounts seem reasonable to insure that the mobile home is removed at no cost to the county or the taxpayers. The applicant proposes to place a single wide mobile home on the property. This project' is' Categorically Exempt from environmental review and appears to conform to the requirements of Butte- County Code Section 24-304 regarding the placement of temporary mobile homes. ` A. Note that this project is categorically exempt from environmental review; and B. Find that this proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with , or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health , welfare and safety of the County; and C.
