It was moved by Commissioner Lambert, seconded by Commissioner Nelson, and unanimously carried for approval. 1 BUTTE COUNTY PLANNINGCOhII°ITSSION MINUTES- January 28, 1993 Michael Martin - (Item determined to be categorically exempt from environmental review) jUse Permit to allow an additional mobile home site for residential use as an expansion of a nonconforming use on property zoned "U" (Unclassified) located on Cherokee Road, approximately 3 miles northeast of Table Mountain Blvd., identified as AP 041-300-011, Oroville. a The Commission waived the reading of the Staff Findings. The hearing was opened to the public. Chairman Lambert said with two existing homes on the property, this permit will allow a third. Staff said they did not support this application. Commissioner Lynch noted that in the "Aunt Minnie" ordinance it was the interpretation of the Board of Supervisors that second dwelling means "2" dwellings on the property. Chairman Lambert suggested getting another interpretation from the Board. Staff noted that the Commission is not talking about a temporary mobile home, but a third dwelling unit. Commissioner Lynch said the Commission could put conditions on this permit to have control of the third dwelling similar to conditions on a temporary mobile. Staff noted that the question is really of density allowed in the General Plan. The hearing was opened to the public. Michael and Donna Martin said the mobiles were put on the property prior to zoning. They wanted to put another mobile on the property for their daughter and her baby. They agreed to the conditions for removal 120 days after the mobile was no longer being used by the daughter. The hearing was closed. Chairman Lambert asked staff to get an interpretation from the Board of Supervisors for the allowance of a third mobile for the Aunt Minnie ordinance. Chairman Lambert was also concerned that this request;,: did not meet the density of the General Plan. Staff said that "Aunt Minnie" trailers are not a density problem because they are temporary. BUTTE COUNTY PLANNING COMMISSION MINUTES - December 14 , 1989 �` ••�j,r.! � .�F '.`. .. a_ ..+'ASM, Chairman Lambert said she could accept this application as an"Aunt Minnie", but could not make the findings for a permanent density on the General Plan the way it is. i Commissioner Lynch said the application was not before the Commission as an "Aunt Minnie" because it is for a third unit. He said he was in favor of the permit. It was moved by Commissioner Lynch, seconded by Commissioner Ostrowski, and carried for approval as follows: A. Find that the project is categorically exempt from environmental review; and B. The proposed uses of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health,welfare and safety of the County because although it does not comply with the densities of the General Plan the total occupancy of the property will not be incompatible with the provisions of the General Plan and the conditions that are laid down in paragraph C of this Use Permit will mitigate any problem with the General Plan; and C. Approve the Use Permit to allow an additional mobile home as an expansion of a nonconforming use on AP 041-300-011, subject to the following conditions: 1. The third trailer shall be limited to a family member only and the Use Permit shall become null and void upon sale of the property or when family members no longer reside on-site. 2. In the event that the applicant who is residing within the mobile home or the conventional residence, for any reason, moves to another location or is deceased, then in that event, the Use Permit granted herein shall automatically expire and the mobile home shall be removed within one hundred twenty (120) days. In the event the mobile home is not removed within one hundred twenty (120) days pursuant to the terms of the Use Permit, the County shall remove the mobile home and store it at the owner's expense. 3. The applicant is to pay a deposit or post a bond to cover the cost of removal in the amount of $1,500.00. 4. The driveway of Cherokee Road shall meet Butte County Public Works Department requirements. 5. The applicant shall obtain the necessary permits and inspections for the installation of additional leach lines from the Butte County Health Department. SITE HISTORY: Both existing structures were established under the A-2 zone prior to the 1985 Zone change to U. GENERAL PLAN DESIGNATION: Grazing and Open Space. 1 BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - December 5, 1989 APPLICABLE REGULATIONS: Butte County Code. Sections 24-37 , 24-47 , 24-195 . COMMENTS RECEIVED: Environmental Health: "Install additional leach lines under permit and inspection from the Butte County Health Department" . Public Works: "Driveway at Cherokee Road shall meet Butte County Requirements" . ANALYSIS: The applicant is requesting a Use Permit to expand a non-conforming use that would allow an additional mobile home. The ten (10 ) acre parcel, a legally created non-conforming lot, currently contains two (2 ) mobile homes. One mobile home is occupied by the applicant and the second by his mother. The request for the third mobile home would be for his daughter and for her child. Both existing mobile homes were established prior to the country-wide Unclassified Rezone changes in 1985. With a General Plan designation of Grazing and Open Land, this request would exceed the maximum density permitted (1 dwelling unit/40 acres) . In addition, section 24 . 195 (d) of the County Code states that the density of the related General Plan designation cannot be exceeded. The three ( 3 ) structures on ten (10 ) acres for this request would establish a density of 12 d.u. /40 acres . Section 24. 37 .4 indicates that non-conforming uses may only be expanded upon finding that the request will not conflict with the uses both permitted or conditionally permitted within the zone in which it is located or adjoins. Section 24-47 reinforces this by stating that the use will not impair the integrity or character of the zone and would not be unreasonably incompatible with surrounding properties. The primary uses adjacent to or in the vicinity consist of vacant land, with minor grazing activities at this time, and very limited residential development. This current activity is consistent with the primary uses identified in the General Plan. The General Plan Land Use Element implies that each zone should regulate all land uses as needed to maintain the primary uses and protect adjacent uses. The only developed land adjacent to the site is an alcohol and drug rehabilitation center located to the south. 2 If '3 r G BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - December 5, 1989 Staff has analyzed the Use Permit, with respect to the corresponding General Plan and zoning regulations in relation to the request being limited to a family member. Even though this request would not create a detrimental health and safety impact on surrounding uses, the zone should regulate uses to maintain primary uses and protect adjacent uses. Since there are additional smaller, non-conforming lots in the area, approval of this request has the potential to set a precedent for future proposals. Policy III . D.2 (c) of the Land Use Element provides support to this by stating that densities need to be related to the intensity and compatibility of adjacent uses. The proposal has been identified as a Class 3-A Categorical Exemption from the provisions of the California Environmental Quality Act (CEQA) . RECOMMENDATIONS: A. Note that the project is categorically exempt from environmental review; and B. Find that the request conflicts with the intent of the Butte County General Plan Land Use Elements and its policies . C. Find that the Use Permit does not meet the intent of Sections 24-37, 24-47 , and 24-195 of the Butte County Code. In addition, the proposed uses of the property will impair the integrity and character of the zone in which the land lies and that the use would be incompatible with, or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County because and D. Deny the use Permit on AP# 41-30-11 to allow an expansion of a non-conforming use. If the Planning Commission can make the finding listed in sections 24-37, 24-47 , and 24-195 of the Butte County Code in addition to the policies listed in the General Plan, then the following findings and conditions are recommended. A. Find that the project is categorically exempt from environmental review; and B.
