The project site is a ten acre parcel located approx. 1/2 mile south of Nelson Rd. at Aguas Frias Rd. The parcel is relatively flat and uncultivated. There are two or three trees on the property and an abundance of native and introduced grasses. To my knowledge there are no historic, cultural or scenic aspects to this property. The existing structure is an old house which has no use and will be torn down and removed. There is also an existing well and septic system. 33. It appears that you did not respond to the proposed environmental mitigations as determined by the Initial Study completed by the Planning Division for the Use Permit. On September 8, 1997, a copy of the Initial Study was mailed to you. On October 15, 1997, I sent you a letter requesting that you respond to mitigations contained in the initial study. On May 19, 1998, I talked to Marla of your office, who was not familiar with the Use Permit project. I faxed a copy of the Initial Study to her that same day. We did not receive any subsequent reply from her. Please respond as soon as possible as to the status of this project. Do you wish to go forward with it, or would you prefer to have it withdrawn? If you want to go forward with it, I suggest we meet to go over the project and any changes that you may have in mind. If you wish to withdraw the project please send us a letter stating so. Name of Proponent: C.William Johnson 2. Address: P.O.Box 1009,Durham, CA 95938 Phone:(916)891-6631 3. Name of Proposal, if applicable:Arrowhead Gun Club 4. Type of Project: Use Permit 5. Project Description and Location of Parcels: This project is a use permit to allow a clubhouse,a 60-bed dormitory,and a shotgun range. The purpose of the facility is to provide a living space for members of the Arrowhead Gun Club during duck hunting season and a meeting place and shotgun shooting range year around. During duck season,the club members will leave the project site during the day to hunt on nearby properties. The 10 acre parcel is zoned A-40 (Agricultural,40-acre minimum parcel size),and is designated by the Butte County Land Use Element Map as Orchard and Field Crops. The project is located on the east side of Aguas Frias Road,north of and adjacent to Butte Creek. The proposed use will consist of two structures: a 1,440 sq.ft. clubhouse(with kitchen facilities),and a 3,200 sq.ft.dormitory that will sleep 60 individuals. A shotgun-only shooting range is also proposed. The clubhouse will be used year around but the dormitory will be used only during duck hunting season. The shotgun range will not be used during duck season. Peak use will occur during duck hunting season,which occurs from Novemberthrough January. Most of the gun club facilities will not be open to the public and locked gates will placed on the site's access roads. The shotgun range may be open to the public and several shooting competitions may be held each year. The project site has been developed with a 1,500 sq.ft.dwelling unit which is in disrepair and will be demolished by the applicant.' A large drainage ditch is located on the western property line,and the levee of Butte Creek makes up the southern boundary of the project parcel. The project site is located in an area that has an "A" flood zone designation. The project site is level, and consists of grasses and scattered trees. Several trees are located next to the house,with other trees located along the drainage ditch. Would the proposal: a) Conflict with general plan designation or zoning? X b) Conflict with applicable environmental pians or policies adopted by agencies with jurisdiction over the project? X Response: The project parcel is 10 acres in size, and is zoned A-40(Agricultural, 40-acre minimum parcel size). The Land Use Element Map of the Butte County General Plan designates the project site as Orchard and Field Crops. An extremely old, dilapidated single family dwelling unit sits on the parcel,indicating that a residential use was established on the project site at one time. The parcel is not under any type of agricultural cultivation, and it appears that it hasn't been used for that purpose in some time, if at all. The A-40 zoning ordinance allows, with a use permit, outdoor recreational facilities on sites not less than 5 acres. The Orchard and Field Crops general plan land use designation lists hunting recreation facilities as a secondary use. The proposed use is consistent with the zoning and with the General Plan, subject to obtaining a Use Permit. ■ Butte County Department of Development Services ■ 3 Project:Johnson UP,File#UP 97-23 Potentially Significant Less Potentially Unless Than Significant Mitigation Significant No Impact Incorporated Impact Impact Surrounding parcels are zoned A-40, and range in size from 32 to 257 acres. Surrounding land uses are rice fields and row crops. Glenn County is located on the west side of Aguas Frias Road, where land uses and parcel sizes are similar to that of Butte County. The proposed use will result in a change of land use from residential/open space to a recreational facility. The impact on adjacent agricultural uses will not be significant because the proposed structures will be located approximately 120 feet from the nearest parcel line. The proposed facilities will not cover the whole parcel, but it is unlikely that any agricultural use of the project site will occur. The Butte County Agricultural Commissioner's Office has stated that the proposed use is compatible with the agricultural use of the area and that there is no significant agricultural impacts or issues.. Mitigation: None required. 2. POPULATION AND HOUSING. Would the proposal: a) Cumulatively exceed official regional or local population projections? X b) Induce substantial growth in an area either directly or indirectly (e.g.,through projects in an undeveloped area or extension of major infrastructure)? X c) Displace existing housing, especially affordable housing? X Response: A single-family dwelling unit is located on the project site, but the applicant intends to demolish this dwelling due to its poor condition. The proposed use is seasonal and transitory, and therefore will not increase the population of the area or influence growth. Heaviest use of the gun club facilities will occur on weekends. Permanent residents will be limited to a caretaker and family. Mitigation: None required. 3. GEOPHYSICAL. Would the proposal result in or expose people to potential impacts involving: a) Seismicity: fault rupture? X b) Seismicity:ground shaking/ liquefaction? X c) Seismicity: seiche? X h) Unique geologic or physical features? X Response: All of Butte County is classified as a Moderate Earthquake Intensity Zone Vlll and potential ground shaking is possible. The Butte County Seismic Safety Element Map indicates that no known faults are located near the project site. Construction of any future buildings on the project site to Uniform Building Code standards will provide adequate protection to occupants in case of seismic activity. This proposal will result in some soil disruption,displacement, compaction and overcovering of the site as a result of development of new structures, driveways,parking areas, leachfields, landscaping, and the shotgun range. All grading associated with residential construction will also be subject to the requirements of Chapter 70 of the Uniform Building Code. Grading is expected to be minimal due to the level grade of the project site. Based on this information the project will not result in significant soil impacts. The project site is flat. The soils on the project site are considered to have a low erosion potential. No significant impacts are expected to occur with respect to erosion. However, the Butte County Department of Public Works is requiring that a drainage plan that shows how drainage is to be conveyed off of the project site be submitted and approved prior to issuance of building permits. The project site is located in an area that may be subject to land subsidence to heavy groundwater withdrawal. This is not expected to be significant due to the low density of development. Mitigation: None required. 4. WATER. Would the proposal result in: a) Changes in absorption rates, drainage patterns, or the rate and amount of surface runoff? X b) Exposure of people or property to water related hazards such as flooding? X c) Discharge into surface waters or other alteration of surface water quality(e.g.temperature,dissolved oxygen or turbidity)? X d) Changes in the amount of surface water in any water body? X e) Changes in currents, or the course or direction of water movements? X Response: The project site is located in an "A" flood zone as designated on the FEMA Flood Insurance Rate Map for the project area. The flooding potential comes from Butte Creek, which is located along the south property line. A levee is located between the property and Butte Creek. A large drainage channel is located on the west property line and could cause flooding to the project site. In order to reduce the flooding potential to structures on the project site, a mitigation of this project will require that the lowest floor level all structures placed on the project site be located at least one foot above the flood level. Changes in absorption rates, drainage patterns,or the rate and amount of surface runoff are expected to be minimal because the amount of impervious surfaces that will be created as a result of this project is insignificant when compared with the overall size of the parcel. The two structures, parking lot, shotgun range, and driveway that will be constructed as a result of this project will increase the amount of runoff from the site but it will be minimal and will not have a significant impact. See discussion in Section 3 regarding drainage. Mitigation#1: Prior to the issuance of building permits establish 100 year floodplain elevations and the lowest floor elevations for any structures. Show on the site plan map for building permits the elevations(by contours)and the location of an accepted NVGD benchmark and a temporary benchmark on-site. 5. AIR QUALITY. Would the proposal. a) Violate any air quality standard or contribute to an existing or projected air quality violation? X b) Expose sensitive receptors to pollutants? X c) Alter air movement, moisture, or temperature, or cause any change in climate? X d Create objectionable odors? X ` Response: The proposal will not signficantly affect air quality. The proposed use will generate more vehicle traffic then the area currently experiences. However, air quality will not be impacted because the amount of vehicle traffic generated by the proposed use will be very minimal, approximately 60 vehicle trips per day at ■ Butte County Department of Development Services ■ 6 Project:Johnson UP,File#UP 97-23 Potentially Significant Less Potentially Unless Than Significant Mitigation Significant No Impact Incorporated Impact Impact peak use on weekends during duck hunting season. The shotgun range, which will be open to the public, is not expected to generate very many vehicle trips due to the remote location of the project site. In addition, the proposal will not create significant objectionable odors,smoke or fumes. The shotgun range will generate small amounts of smoke and odors from the firing of the shotguns, but the smoke and odors will only occur around the shotgun range and not off-site. Only large projects such as the construction of a large high-rise buildings, the creation of a large water body (such as a lake or thousands of acres of rice fields), massive defoliation, or introduction of large tracts of vegetation where there was previously none,would have the climactic effects discussed in this question. Since this project has none of these characteristics it will not result in any change in air movement, moisture, temperature, or climate. Mitigation: None required. 6. TRANSPORTATION/CIRCULATION. Would the proposal result in: a) Increased vehicle trips or traffic congestion? X b) Hazards to safety from design features(e.g.sharp curves or dangerous intersections) or incompatible uses(e.g.farm equipment)? X c) Inadequate emergency access or access to nearby uses X d) Insufficient parking capacity onsite/ offsite? X e) Hazards or barriers for pedestrians or bicyclists? X f) Conflicts with adopted policies supporting alternative transportation (e.g. bus turnouts, bicycle racks)? X g) Rail,waterborne or air traffic impacts? X h) Substantial impact upon existing transportation systems, including public transportation services? X Response: The purpose of the gun club is to provide a place for hunters to stay at while duck hunting on nearby properties. Duck hunting season runs from approximately November to January. The dormitory will contain 60 beds, and it is expected, at maximum use, that 60 vehicle trips will be generated over Friday nights and Saturday mornings as club members arrive for a weekend of ■ Butte County Department of Development Services ■ 7 Project:Johnson UP,File#UP 97-23 Potentially Significant Less Potentially Unless Than Significant Mitigation Significant No Impact Incorporated Impact Impact hunting. There will be approximately 60 vehicle trips generated on Sunday afternoons as the hunters depart the project site. If is unknown how many vehicle trips will be generated by the shotgun range use if it is open to the public. The maximum number of shooting positions that can be used at.any one-time is 50, although the applicants have stated that this many shooters at one time will most likely never occur. It is estimated that there will be approximately 5 to 10 shooters at any one time. Shooters will arrive at various times throughout the day,shoot for several hours, and then depart. It is not expected that the shotgun range, if it is open to the public, will generate enough vehicle traffic to significantly impact vehicle traffic in the project area. The applicant's have stated that several shooting competitions may occur each year at the gun club. These competitions may draw many shooters and spectators, which may result in large numbers of vehicle lips. , Short term impacts to vehicle traffic movements in the project area may occur due the competitions held on the project site, but it is not expected to be signifcant due to the low level of vehicle traffic in the project site and the few number of events that may occur. Aguas Frias Road is operating at a level of service of C or better. Slow moving farm equipment uses Aguas Frias Road on a periodic basis, but this is not significant because of the low numbers of farm equipment using the road. The legal speed limit on this section of Aguas Frias Road is 55 MPH, although the actual speed on this section is reduced due to a curve and a narrow bridge located just south of the project site. There is good sight vision of Aguas Frias Road in both directions from the project site which will allow vehicles entering or exiting the project site to clearly see on-coming traffic. Mitigation: None required. 7. BIOLOGICAL RESOURCES. Would the proposal result in impacts to: a) Endangered,threatened or rare species or their habitats(including but not limited to plants,fish, insects, animals,and birds)? X b) Locally designated species(e.g. heritage trees)? X c) Locally designated natural communities(e.g. oak forest, etc.)? X d) Wetland habitat(e.g. marsh, riparian and vernal pool)? X e) Wildlife dispersal or migration corridors? X Response: Vegetation on the project site consists mostly of open areas of tall grasses and scattered' trees. The project site does not contain any wetland habitat. No rare plants are indicated as being ■ Butte County Department of Development Services ■ 8 Project:Johnson UP,File#UP 97-23 Potentially Significant Less Potentially Unless Than Significant Mitigation Significant No Impact Incorporated Impact Impact on this properly per the Areas of Special Biological Importance(ASBI)maps prepared by the California Department of Fish& Game in areas of special biological importance. The birds and mammals that currently use the project site may be permanently displaced by this project. The animals currently using the site may,include such species as mice, rats, possum, racoons,and birds,including hawks and owls. The proposed use will take up approximately 4 acres of the 10 acre parcel, with the remainder being left in open space. Construction activity, and on-going activities associated with the hunting club, such as the noise from the shotgun range, may drive many of the animals off the site. However, none of these species is considered threatened or endangered, and may return to the project site after construction activities are completed and after hunting season has ended, unless the shotgun range is open to public. Mitigation: None required: 8. ENERGY AND MINERAL RESOURCES. Would the proposal: a) Conflict with adopted energy conservation plans? X b) Use non-renewable resources in a wasteful and inefficient manner? X c) Conflict with the extraction of identified;significant mineral resources? X Response: This project will allow for the construction,of a hunting club facility which will include a clubhouse and dormitory. For the short tern, the use of energy will be limited to that fuel needed to operate the machinery required to construct a driveway to serve the facility, prepare the site, and construct the clubhouse and dormitory. For the long term, energy will be required to heat, cool, and light the facilities: This energy use will occur regardless of the location of the hunting club and is really a function of the continued population growth in Butte County and California. Much of the electricity used in Butte County is generated by hydro-electric power plants and is considered a renewable source of energy. The project site does not contain any significant mineral resources. Mitigation: None required. 9. HAZARDS. Would the proposal involve: a) A risk of accidental explosion or release of hazardous substances (including, but not limited to: oil, pesticides, chemicals, or radiation) X b) Possible interference with an emergency response plan or emergency evacuation plan? X d) Exposure of people to existing sources of potential health hazards? X e) Increased fire hazard in areas with flammable brush,grass,or trees? X Response:Lead pellets will be used on the shotgun range. Lead has been shown to be a hazardous material to animal populations and has the potential to leach into surface water and groundwater supplies. In order to prevent lead from being introduced into the environment, the shotgun range will be required to be lined with a barrier that will prevent lead from being absorbed into the soil. In addtiion,a system to recover the lead shall be installed and operated regularly on the shotgun range. A pre-operation soil sample will be taken as a baseline measurement for future comparisons. Soil samples will be required to be accomplished in the future to ensure that the barrier and lead recovery system are working correctly. High lead levels may lead to the shotgun range being closed. The proposal will not involve significant use of any other hazardous materials, nor is located close to any facilities which store or utilize such materials. The project site is located in an 'A"flood zone and may expose structures and people to potential flooding impacts. A mitigation has been proposed in Item 4 that will mitigate flooding impacts to structures located on the project site. Flooding impacts to humans is expected to be insignificant because there will not be any dwelling units located on the project site. The proposed use will allow a shotgun shooting range, which will involve the firing of shotguns at moving clay targets. The discharge of shotguns has the potential to harm people on and off the project site. The members of the Arrowhead Gun Club using the shotgun range understand the risks associated with using the shotgun range and are experienced with weapons. However, the applicant has stated that the shotgun range will be open to members of the public, who may or may not be experienced with weapons. ft is expected that the applicant will have a qualified range supervisor who will enforce safety rules and proper range conduct when the range is in use, thus preventing unsafe weapons handling and harm to people. The site plan submitted with the application for this permit does not show the shotgun range. A condition of this project will require that the shotgun range be shown on the site plan and that the location of the shotgun range shall be approved by the Planning Division. The Shotgun Range Suggestions pamphlet,published by the National Rifle Association, recommends a minimum 300 yard (900 ft.) safety zone for shotgun ranges. There appears to be sufficient room on the project parcel to allow for the 300 yard safety zone. In order to prevent people off site from being struck by shotgun shot or stray bullets, the shooting range will be limited to shotguns only and will be required to be situated so that there is no chance of shotgun pellets traveling off site. Mitigation # 2: Prior to operation of the shotgun range the applicant shall provide a soil analysis for a lead baseline measurement. Future soil tests for lead content shall be required to be performed on the shotgun range, the timing of such tests to be determined by the Planning Division. Mitigation # 3: Prior to operation of the shotgun range, install and maintain a barrier underneath the shotgun range that is designed to prevent lead from leaching into the soil. ■ Butte County Department of Development Services ■ 10 Project:Johnson UP,File#UP 97-23 Potentially Significant Less Potentially Unless Than Significant Mitigation Significant No Impact Incorporated Impact Impact Mitigation#4: Install and operate a lead pellet recovery system on the shotgun range. The lead pellet recovery system shall be approved by the Planning Division. Mitigation#5: The shooting range shall be limited to shotguns only,and shall be situated so that no shotgun pellets can travel off the property. 10. NOISE. Would the proposal result in: a) Increases in existing noise levels? X b) Exposure of people to severe noise levels? X Response: This proposal for a hunting dub facility includes a shotgun range. The noise from the firing of the shotguns will increase the noise level on the project site and on the areas immediately adjacent to the project site. The increase in noise will not be significant on the adjacent parcels because there are no dwelling units, or other sensitive receptors, located in this area. The proposal will result in the exposure of people to severe noise levels due to the shooting of weapons on the shotgun range. However, the severe noise levels will occur only in the area immediately adjacent to the shotgun range. It is common practice at shooting ranges to require people to wear ear protection to protect their hearing. Patrons of the range will be subjecting themselves to the noise by choice. Mitigation: None required. 11. PUBLIC SERVICES. Would the proposal have an effect upon, or result in a need for new or altered government services in any of the following areas: a) Fire protection? X b) Police protection? X c) Schools? X d) Maintenance of public facilities, including roads? X e) Other governmental services? X Response: The project site is located in an area with an unclassified fire hazard designation, indicating the project site is located in either an urbanized area or an irrigated area. The nearest fire station is located approximately 10 miles southeast of the project site in Richvale. This proposal will result in an incremental increase in demand for fire protection in the area. The Butte County Fire Department/California Department of Forestry has requested.that building identification andlor addresses be posted at the beginning of construction and maintained thereafter. The Fire Department has also requested that an all-weather access,at least 10 feet wide with a 15 ft. vertical clearance, and capable of supporting a 40,000 pound fire apparatus, be provided to each structure. These recommendations will be added as conditions of the Use Permit. ■ Butte County Department of Development Services ■ 11 Project:Johnson UP,File#UP 97-23 Potentially Significant Less Potentially Unless Than Significant Mitigation Significant No Impact Incorporated Impact Impact The proposal will result in an incremental increase in demand for fire protection in the area. The Butte County Fire Department(Califomia Department of Forestry has indicated that cumulative development in rural areas will impact their ability to provide fire protection services. They have stated that installation of automatic fire suppression sprinkler systems in residential structures, the use of fire resistance building materials and water supply systems adequate to support the sprinkler system will reduce the demand for fire protection services. A mitigation measure to address impacts to fire protection services is proposed. The proposedproject will result in an incremental increase in demand for police protection. A development impact fee for Sher►frs facilities shall be paid pursuant to the provisions of Chapter 3, Article l/of the Butte County Code, prior to issuance of building permits. Said fee amount will be determined and calculated as of the date of application for the building permit. The proposal will result in an incremental increase in road maintenance in the area because the proposed use will increase the volume of vehicle traffic in the area, causing the roads to deteriorate slightly faster than is currently being experienced without the project. The proposal may result in a dwelling unit be placed on the project site as a caretakers residence. The dwelling unit will result in an incremental increase in demand for school services in the area and may be subject to school impact fees. Mitigation #6: Fire suppression sprinkler systems shall be installed in all new residential structures, including the bunkhouse, in accordance with the National Fire Protection Association Standard for the installation of sprinkler systems in one and two family dwellings and mobile homes, NFPA Standard 13D, unless a pressurized community water system,with hydrants that meet Fire Department specifications,serves the parcels. 12. UTILITIES AND SERVICE SYSTEMS. Would the proposal result in a need for new systems, or substantial alterations to the following utilities: a) Power or natural gas? X b) Communications systems? X c) Local or regional water treatment or distribution facilities? X d) Sewer or septic tanks? X e) Storm water drainage? X f) Solid waste disposal? X g) Special Districts? X Response: Pacific Gas and Electric power lines already extend to the project site.. Less Potentially Unless Than Significant Mitigation Significant No Impact Incorporated Impact Impact Currently, the Butte County Landfill still has capacity to serve the proposed use. There is no mandatory garbage pick-up service required in the rural areas of the County. Sewage disposal for the gun club facility will be handled via an on-site septic tank and leachfield system. The proposal will have to meet the requirements of the Butte County Environmental Health Division and the Butte County Subdivision Ordinance. The domestic water supply for the proposed use will be obtained from an on-site well. The water supply system for the proposed use may be subject to Public Water Supply laws and regulations as found in the California Safe Drinking Water Act. Mitigation: None required. . 13. AESTHETICS. Would the proposal a) Affect a scenic vista or designated scenic highway? X b) Have a demonstrable negative aesthetic effect? X c) Create light or glare? X Response: The facilities will be located approximately 350 ft. from Aguas Frias Road. Aguas Frias Road is not a designated scenic highway. The proposed use will place non-agricultural buildings in an agricultural area, but this will not affect a scenic vista and will not have a demonstrable negative aesthetic effect. Outside lights may be installed on the project site for safety and security reasons. These lights are not expected to cause a significant impact due to the low level of development and the long distance of the project site from the road and from any dwelling units on adjacent properties. Mitigation: None required. 14. CULTURAL RESOURCES. Would the proposal. a) Disturb paleontological.resources? X b) Disturb archaeological resources? X c) Affect historical resources? X Response: The project site is located in an area that has been determined to have a high archaeological sensitivity. The high archaeological sensitivity is due to the site's location along Butte Creek, which was used extensively by Native American Indians. The proposed project will result in ground disturbance and the potential exists that historic or prehistoric archeological resources could be uncovered during development activities. Mitigation # 7: During construction, should any archaeological artifacts be discovered,the Butte County Planning Division shall be notified immediately,and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division,and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. 15. RECREATION. Would the proposal: a) Increase the demand for neighborhood or regional parks or other recreation facilities? X b) Affect existing recreational opportunities? X Response: The proposal will not result in a demand for park and recreation facilities in the area nor will it affect existing recreational opportunities. Mitigation: None required. r 16. X Response:As discussed in Section 4,Subsection 4,9,and 14 of this document, this proposal may has a potential to harm people and structures due to flooding potential,has the potential to harm people off of the project site due to the shotgun range,and has the potential to harm archaeological resources, but the impacts of this project can be mitigated to a level of insignificance by the incorporation of stated mitigation measures as part of the project approval. V. MITIGATION MEASURES AND MONITORING REQUIREMENTS: 1. Prior to the issuance of building permits establish 100 year floodplain elevations and the lowest floor elevations for any structures. Show on the site plan map for building permits the elevations(by contours)and the location of an accepted NVGD benchmark and a temporary benchmark on-site. 2. Prior to operation of the shotgun range the applicant shall provide a soil analysis for a lead baseline measurement. Future soil tests for lead content shall be required to be performed on the shotgun range,the timing of such tests to be determined by the Planning Division. 3. Prior to operation of the shotgun range, install and maintain a barrier underneath the shotgun range that is designed to prevent lead from leaching into the soil. 4. Install and operate a lead pellet recovery system on the shotgun range. The lead pellet recovery system shall be approved by the Planning Division. 5 The shooting range shall be limited to shotguns only, and shall be situated so that no shotgun pellets can travel off the property. 6. Fire suppression sprinkler systems shall be installed in all new residential structures,including the bunkhouse, in accordance with the National Fire Protection Association Standard for the installation of sprinkler systems in one and two family dwellings and mobile homes, NFPA Standard 13D, unless a pressurized community water system, with hydrants that meet Fire Department specifications,serves the parcels. 7. During construction, should any archaeological artifacts be discovered,-the Butte County Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the'site and submitted his or her findings to the Planning Division, and recommended clearance to continue. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Prior to the issuance of building permits,the plans,incorporating all applicable conditions of approval shall be submitted to the Planning Division to verify compliance with said conditions of approval. 3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view obstructing gates and a solid or semi-open shade cover. Plans to be reviewed and approved by the Planning Division prior to construction. 4. Prior to any use of the project site or business activity being commenced thereon, pursuant to this permit, conditions of approval contained herein shall be completed to the satisfaction of the Planning Division. 5. All electrical and mechanical equipment,including but not limited to air conditioning units, electrical boxes,transformers, and backflow preventers,shall be screened from public view. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING 1. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access,shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees,where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter,4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than_gallon size. 3. All landscaped areas shall be maintained in a healthy and thriving condition,free from weeds,trash, and debris,during the term of this permit. ■ Use Permit Standard Conditions-Butte County■ 5 4. All graded slopes,over 5 feet in height, or on slopes greater than_%,shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development,trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project,shall be fully protected through the use of root protection zones(RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading,trenching,fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction,should any archaeological artifacts be discovered,the Planning Division shall be notified immediately,and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division.Archaeological artifacts are defined as follows: 2. Prior to any clearing,grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. 3. Prior to the issuance of the Use Permit,to insure the maintenance and continuance of the orchard or other agricultural use of the property,the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. ■ Use Permit Standard Conditions-Butte County■ 6 5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. 7. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. 8. Approval of this application does not become effective unless, prior to 4:00 p.m. on , 199—,the applicant shall sign and file with the Department of Development Services an Indemnity Agreement in a form satisfactory to the County Counsel. 9. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3,Article II of the Butte County Code. Prior to the issuance of the Use Permit the applicant or property owner shall sign and record the CSA 87 Traffic and Drainage Mitigation Agreement or pay the required fees prior to the issuance of the Use Permit. _ 11. Prior to the issuance of the Use Permit,the applicant shall contact the Butte County Tax Collector's Office to begin the process of a Transient Occupancy Registration Certificate. A Transient Occupancy Registration Certificate shall be required within ten (10)days after commencing business for a motel, hotel,inn,tourist home, bed and breakfast, rooming house, apartment house, mobile home park, recreational vehicle park, campground, or parking area (See Chapter 23A). 12.
