Lauck - (Item determined to be Categorically Exempt from environmental review) Variance to construct a 528 square foot garage 9 feet into a 15 foot rear yard building setback on property zoned R-1 (Residential). The property is located on the north side of Holiday Drive, approximately 240 feet west of Merry Way, at 11321 Holiday Drive, Clipper Mills. APN 073-230- 010 (SB) (VAR 01-01) (VIDEO) A video of the proposed project was shown. Mr. Betts gave a brief summary of the project and said that staff does not expect any significant impacts. Chairman Leland noted that the needs tie into the physical characteristics of the lot between the trees, septic tank, and the steepness of the lot. The hearing was opened to the public. Chairman Leland asked if the applicant was present. Mrs. Mary Lauck,project applicant,provided the Commission with two letters from residents who live to the right of her property and directly behind her property;that state they have no objections to the proposed request. She noted that there is no other way to build a garage if the variance is not granted. Commissioner Cage asked Mrs. Lauck if the conditions were satisfactory to her. Mrs. Lauck said yes. The hearing was closed to the public. Commissioner Mooney referenced to the fire safe regulations for Butte County and said that the applicant would not be able to conform to the 30-foot clearance area around the property. He mentioned that when the subdivision was created, the setbacks were probably five feet. Mr. Betts stated that this property is in the city response area. He said the 30-foot clearance area does not apply to parcels that are less than one acre, and that it is normally 15 feet with certain conditions. Mr. Betts noted that the fire department did not object to this request. Mrs. Lauck said that the garage would be made of hardy board, with a metal roof. It was moved by Commissioner Mooney,seconded by Commissioner Cage,and unanimously carried to approve the Variance for Mary L. Lauck, subject to the findings and conditions listed below: I. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305(x) -Minor Alterations in Land Use Lim_ itations, Class 5, of the CEQA Guidelines exempts variances to setbacks not resulting in the creation of any new parcel. II. Approve Variance 01-01 for Mary L. Lauck subject to the conditions found in Exhibit A and subject to the following findings: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ DECEMBER 14,2000 ■ PAGE 7■ A. This Variance may be granted because special circumstances applicable to the property exist, including size, shape, topography, location or surroundings, and the strict application of the setback ordinance would deprive the property owner of privileges enjoyed by other property owners, and would not constitute a grant of special privileges inconsistent with the limitations placed upon other properties in the vicinity and under identical zoning classification,as supported by the following facts: 1. The location of the septic tank, leach field, and propane tank and gas line severely limits where accessory structures can be placed on the property. 2. The location of the proposed garage in the setback does not require the removal of any heritage-quality oak trees or pines. Locating the garage elsewhere on the property would require the removal of oaks and pines. 3. A shed on an,adjacent parcel is located within the fifteen-foot rear yard setback, and has not caused any impacts due to its location within the setback. 4. Other landowners in similar situations couldapply for a Variance. SPECIAL CONDITIONS: Planning Division 1. The variance is approved for a 528 square foot garage to encroach nine (9) feet into the rear yard building setback, in accordance with the application and plot plan as submitted. 2. A Use Permit shall be obtained for any expansion of the garage in the building setback. Butte County Fire Department/CDF 3. The parcel is approximately 0.3 acres, or 13,028 square feet in size. The property is zoned R-1 (Residential) with a General Plan Land Use Element designation of AR(Agricultural Residential). The site is located in a SRA (State Response Area). The application is for a Variance in order to construct a 22' x 24', or 528 square foot garage approximately 9 feet into the 15 foot rear yard setback. This will leave a 6 foot distance between the garage and the rear property line. Characteristics of the property which affect and determine where the applicant is able to build the garage include the following: • Heritage-quality Oak, Fir, and Cedar trees exist near the front area bordering the proposed garage building envelope; • Heritage-quality Oak and Fir trees border the existing driveway; • Heritage-quality Oak and Fir trees exist along the front of the property; • Heritage-quality Oak and Fir trees exist on the east side of the house; • Much of the rear area of the parcel has a 12%+ slope running up and away from the house; • Leach lines for the septic system run across the existing driveway; • A propane gas line runs under the existing driveway; • A water line runs under the existing driveway. The surrounding property owners all enjoy the use of a garage on their property. The applicant is unable to determine if one or more of the neighbors' garage may also be located in their respective parcel setbacks. One neighbor enjoys the use of a storage structure which is located inside the setback for that parcel, on the east side of the applicant's property. The applicant requires the construction of the garage for several reasons: • It snows in Clipper Mills -- the applicant needs the garage to protect her car, and to have it ready and available for work or in case of an emergency; • The applicant purchased the house specifically because it has a rear access with only one step into the house--due to the slope of the parcel and construction of the house. Because the applicant has a physical disability, she needed such an access. The construction of the garage in its proposed location is necessary for two reasons: ■ It will provide the nearest access from the garage to the rear door of the house; ■ This location will preserve the heritage-quality Oaks, Firs and Cedar trees; 0 This location for the garage will not disrupt existing septic, gas and water lines. The dwelling unit on the parcel behind the project site is located approximately 40 feet from the shared property line. ANALYSIS In order to approve a variance,the Planning Commission must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that cause a variance to County code to be necessary. Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. The size,shape, location and surroundings of the Lauck property contribute to special circumstances that allow findings to be made to support a variance to County code. The development of a garage is consistent with the use of residential rear yards, and would not constitute a special privilege not enjoyed by other similar properties. The following sections examine the specific factors allowing for this variance. Parcel Configuration and Improvements The parcel was created in-1965 as a part of the Merry Mountain Village Subdivision. Many of the parcels in this subdivision, including the applicant's parcel, are very small in size (.3 acres). All of the parcels in the subdivision use individual septic systems, which require a fairly large area, and which cannot be covered with structures. Additional area is also needed on these parcels for use as a replacement area should the primary leachfield fail. Due to the small size of the project parcel, and due to the area that is needed for the septic tank and leachfield, the area where structures can be placed is severely limited. The project parcel is developed with a house,septic tank and leachfield,underground water line, and a propane tank and fuel line. The location of the septic system,propane tank, and the water line limit alternatives for development. The current location of the existing improvements are contributing factors that limit alternatives for development. The slopes on the site,which are approximately 12% and are located in the northwest corner and adjacent to Holiday Drive, are also contributing factors that limit alternatives for development. A large shed on the parcel to the east of the site is located approximately nine feet from the property line. This parcel's backyard abuts the project site's side yard. It is not known for certain when the shed was constructed, but it appears to have been installed at a time when the R-1 zone required only a five-foot rear yard setback (Butte County Comprehensive Zoning Ordinance, No. 1750, October 1976). The location of this shed in the backyard setback had not caused any adverse impacts to any of the surrounding parcels. 0 Butte County Department of Development Services 0 Page 2 0 Alternatives The proposed garage could be placed further away from the rear property line, but doing so will require the removal and relocation of the existing septic tank and leachfield. In addition, several large pine and oak trees would also have to be removed if the proposed garage is moved further away from the rear property line. There is sufficient area directly behind the house that the garage could be placed in, but doing this will require that some large trees be removed. Other Issues The Butte County Building Division and the Environmental Health Division do not object to the project and did not recommend any conditions. The Butte County Fire Department/CDF requires that the items checked on the"CDF Fire Safe Requirements" form for the project site be complied with. The Building Division will ensure compliance with the checked items. Conclusion The special circumstances noted in the previous sections allow for the findings necessary to grant this variance and indicate that the adjustment authorized will not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305(a) -Minor Alterations in Land Use Limitations, Class 5, of the CEQA Guidelines exempts variances to setbacks not resulting in the creation of any new parcel. II. Approve Variance 0 1-0 1 for Mary L. Lauck subject to the conditions found in Exhibit A and subject to the following findings: A. This Variance may be granted because special circumstances applicable to the property exist, including size, shape,topography, location or surroundings, and the strict application of the setback ordinance would deprive the property owner of privileges enjoyed by,other'property owners, and would not constitute a grant of special privileges inconsistent with the limitations placed upon other properties in the vicinity and under identical zoning classification,as supported by the following facts: I.
