APN 068-130-043 (DB) (VIDEO) A video of the site was shown. Mr. Breedon gave a brief summary of the project. Commissioner Lambert asked if all corner lots have two setbacks? Mr. Breedon said there is a difference when a lot abuts a Federal Aid Road. The hearing was opened to the public. Roger Grubbs said the setback became a problem after the lot was surveyed. He said he spotted the problem and went to Public Works to solve the problem. The hearing was closed. It was moved by Commissioner Nelson, seconded by Commissioner Lambert, and unanimously carried to approve a Variance for Roger Grubbs,VAR 00-01,APN 068-130-043,subject to the findings and conditions listed below, add a condition which states."Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations." I. Approve a Categorical Exemption with the following finding: The project is categorically exempt from the California Environmental Quality Act(CEQA) under CEQA Guidelines Section 15305(a)(Class 5 exemption)which allows for exemptions for variances to setbacks not resulting in the creation of any new parcel. II. Approve Variance 00-01, for Roger Grubbs, subject to the condition found in Exhibit "A" and subject to the following findings: A. This Variance may be granted because special circumstances applicable to the property exist, including size, shape,topography, location or surroundings, and the strict application of the setback ordinance would deprive the property owner of privileges enjoyed by other property owners, and would not. constitute a grant of special privileges inconsistent with the, limitations placed upon other properties in the vicinity and under identical zoning classification, as supported by the following facts: 1. The property is encumbered by two 25 foot Federal Aid Highway setbacks which is unique compared to other developed commercial properties within the Light- Commercial zone located in the vicinity. 2. Other properties located within Light-Commercial zone have commercial improvements which encroach into the required 25 foot Federal Aid Highway setback. 3. The Land Development Division indicates that the proposed variance will not present sight distance problems to vehicles traveling on Canyon Drive or entering Canyon Drive from the development. 6. The Department of Public Works indicates that the proposed variance will not hinder any future road improvements within the existing right-of-way of Canyon Drive. Conditions of Approval. 1. In accordance with Butte County Code Section 24-240.10(e), 5-percent of the gross lot area shall be devoted to landscaping. That portion of the property fronting Canyon Drive and State Highway 162 shall be landscaped in this manner. 2. The site is being developed as a Mini Storage and the variance is required to allow for a 4.00' encroachment into the building setback along Canyon Drive. There will be no sales area or load facilities. - Items 32-33 The site is graded and ready for building construction. The property is zoned commercial and is located at the corner of Canyon Drive and State Highway 162. There are residential single family dwellings to the north of the project and undeveloped land to the west. The east and south sides of the project are bounded by Canyon Drive and Highway 162 receptively. 1. To develop the site effectively requires a 4.00 foot encroachment into the building setback zone along Canyon Drive. 2. Commercial property is generally appraised and sold by the square foot. Because of this valuation, it is common practice in many jurisdictions to have no setbacks on commercial properties. This allows the developer to maximize his return and encourages economic growth of a community. 3. The encroachment into the building setback zone will likely be unnoticed by passing motorist or pedestrians on Canyon Drive. The building will be set substantially below the grade of Canyon Drive, and will'be set back 40.00 feet from the existing edge of pavement. In addition, the building will be shielded by existing trees and landscape. Site Plan Location: The property is located on the northwest corner of Canyon Drive and Olive Highway STAFF COMMENT Staff is recommending approval of a variance with conditions and findings. PROJECT DESCRIPTION The applicant requests approval of a variance to allow for the construction of a mini-storage building, 9 feet into the required 25 foot front(east)property line setback along Canyon Drive. The mini-storage building will be 25 feet by 220 feet and will be 11 feet high. Butte County Code Section 24-75 (D)requires a 25 foot minimum front yard setback from the ultimate right-of-way of all public or private roads classified as Federal Aid Roads. Canyon Drive is classified as a Federal Aid Road according to the Butte County Department of Public Works. The property is being developed with a 44,000 square foot mini-storage facility which is a permitted use within the C-1 (Light Commercial) zone. The necessity for a variance to County Code became evident during survey work performed for the project. A survey conducted previously indicated that the proposal conformed to the setback. The applicant notified the County upon learning that the proposed storage unit would encroach into the setback. 0 Butte County Department of Development Services 0 Page 1 ■ A single family dwelling is also being constructed for use as a caretaker's residence, and is also permitted as an accessory use within this zone. The property has been graded and several concrete pads have been installed for the mini-storage buildings. Access is provided by private driveway entering Canyon Drive. ANALYSIS In order to approve a variance to the setback, the Planning Commission must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that cause a variance to County code to be necessary. Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. The following sections examine the specific factors involved in recommending approval for this variance. Surrounding Land Uses The Grubbs' property is a corner lot bound by Canyon Drive to the east and State Highway 162 (Olive Highway) to the south. Developed residential property lies to the north and undeveloped residential land lies to the west. Commercial property lies adjacent to the area of the variance, across Canyon Drive to the east. Light Commercial uses have been developed in the proximity of State Highway 162 and Canyon Drive. Residential development is served by Canyon Drive to the north of the project. Design Constraints As a corner lot,the property is constrained by two street-side setbacks. A 25 foot setback from both streets is required since both State Highway 162 and Canyon Drive are Federal Aid Highways. This is a unique situation within this Commercial zoning district. Other commercial properties in the area are encumbered by a single 25 foot front property line setback. Other commercial properties located on a corner lot are only constrained by a 20 foot setback on their front property line since they do not front on Federal Aid Highways. The only other exception is the undeveloped commercial land across Canyon Drive from the Grubbs' property. This property is also a commercial lot and has a 25 foot setback requirement on each street frontage. This information supports a finding that the property's location and surroundings contribute factors causing a variance to County code to be necessary. Surrounding Encroachments The applicant has submitted photos indicating where commercial improvements encroach into the 25 foot setback along State Highway 162 within the Light Commercial zone. In addition, although other properties along Canyon Drive are not located within the Light Commercial zone, several properties have been observed to be non-compliant with the 25 foot setback in this area. Staff has confirmed that these sites are located along State Highway 162 and Canyon Drive. However, the individual sites have not been surveyed and the individual encroachments are based upon field observation only. This information supports a finding that the strict application of the 25 foot 0 Butte County Department of Development Services 0 Page 2 0 setback in this instance would deprive this property of privileges enjoyed by other properties in the vicinity and zone in which this property is located. Traffic Safety The Butte County Land Development Division indicates that the proposed encroachment will not have any effects on sight distance for vehicles traveling on Canyon Drive or entering the Canyon Drive- State Highway 162 intersection. The applicant will be required to obtain an encroachment permit for the private driveway connection at Canyon Drive which will serve the mini-storage facilityand the caretaker's residence. According to the Department of Public Works, the proposed variance will not have adverse effects on sight distances for vehicles exiting or entering the driveway. In addition,the Department of Public Works indicates that the proposed variance would not present a problem for any future improvements to Canyon Drive and that the existing right of way of Canyon Drive is adequate to serve any future road improvements. Alternatives Alternatives available to the applicant in order to comply with the 25 foot setback are as follows (staff analysis is provided beneath each alternative): 1. Reduce the width of the mini-storage unit by 9 foot,thus eliminating encroachment into the setback. By reducing the size of the building by 9 feet, a 16 foot building would result. This storage unit is primarily designed for the storage of boats and other large items. The 16 foot size would preclude the use of the building for this purpose, and may take any usable benefit away from developing a building for the intended purpose. 2. Adjust the layout of the entire development in order to comply with the required setback. Adjusting aisle widths throughout the development would have deleterious effects on the site's drainage plan and maneuvering room. 3. Eliminate the proposed mini-storage building fronting on Canyon Drive. This alternative may deprive the applicant of the full use of the property as enjoyed by other commercial properties in the surrounding Light Commercial Zone. Conclusion The special circumstances noted in the previous sections allow for the findings necessary to grant this variance. These circumstances demonstrate that the required adjustment will not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. In summary, special circumstances are applicable to the property including location and surroundings that justify a variance to County code setback requirements. 0 Butte County Department of Development Services 0 Page 3 0 Conditions The Butte County Code requires that 5-percent of the gross lot area be devoted to landscaping. This equals approximately one-quarter acre. It is recommended that the portion of the property fronting Canyon Drive and State Highway 162 be landscaped in this manner. This is recommended as a condition of this variance. ACTIONS FOR CONSIDERATION Staff recommends that the Development Review Committee take the following actions* I. Approve a Categorical Exemption with the following finding: The project is categorically exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15305(a) (Class 5 exemption) which allows for exemptions for variances to setbacks not resulting in the creation of any new parcel. II. Approve Variance 00-01, for Roger Grubbs, subject to the condition found in Exhibit "A" and subject to the following findings: A. This Variance may be granted because special circumstances applicable to the property exist, including size, shape, topography, location or surroundings, and the strict application of the setback ordinance would deprive the property owner of privileges enjoyed by other property owners, and would not constitute a grant of special privileges inconsistent with the limitations placed upon other properties in the vicinity and under identical zoning classification,as supported by the following facts: 1. The property is encumbered by two 25 foot Federal Aid Highway setbacks which is unique compared to other developed commercial properties within the Light-Commercial zone located in the vicinity. 2. Other properties located within Light-Commercial zone have commercial improvements which encroach into the required 25 foot Federal Aid Highway . setback. 3. Other properties in the vicinity along Canyon Drive have residential improvements that encroach into the required 25 foot Federal Aid Highway setback. 4. The proposed mini-storage use is a permitted use within the Light Commercial zone. That means a plain metal wall and roof will be very close to and quite visible from Canyon Drive. If this variance is granted by the Planning Commission it would seem only reasonable that a condition for such variance be landscaping with trees and shrubs (including irrigation)to soften the visual impact. Perhaps the additional income from the developer's use of approximately 1800 square feet of building setback will more than offset his additional cost of landscaping to screen this error in survey and/or.judgement. I would also hope that lighting and signage would improve the safety for eastbound motorists turning off Olive Highway onto Canyon Dam. Rain, fog, and darkness currently make that a dangerous intersection. Improved safety of this turnoff is my main reason for favoring—in general—this development. While I do not,personally need the storage at this time I am sure many residents nearby and visitors from other areas will benefit from the services offered by this storage facility. But please don't let it be a plain and ugly metal wall along 200 plus or minus feet of Canyon Drive. Thanks, Chad A variance is required for the Grubbs Mini Storage based on the following factors: • If required to move the buildings closer together, the grade form the upper building pads to the valley gutters will be too steep, causing accessibility difficulties. Raising the valley gutters will cause flooding of the lower building pads, or route runoff into the wrong drainage basin. • Any further reduction of the alley widths will cause problems with the ability of moving vans to pull-out, turn-around, or pass. Since this initial determination, it has been brought to staff's attention that Canyon Drive is a federal-aid road. The Butte County Code requires that the setback from the ultimate right-of-way along federal-aid roads be 25-feet. This is an increase of 5-feet over the previous amount. As a consequence,the proposal to encroach into this setback with the mini-storage unit no longer qualifies as a minor variance and must be processed as a regular variance. Because a minor variance was initially required, no further fees will be necessary for the regular variance. Staff will continue to bill against the original$350.00 submitted. Additionally,the time necessary to process the variance will stay the same. Staff has scheduled this variance before the Planning Commission on August 26, 1999. I would also like to point out that the 25-foot setback has implications on site development if the variance is not approved. Should the variance be denied by the Planning Commission the 25-foot setback may not provide for development of the storage unit. As we have discussed,Planning Division staff must present information to the Planning Commission that would help support the findings necessary to approve a variance. Any evidence of other encroachments within the commercial zoning district within which this property is located would help support these findings. In addition,information relevant to encroachments along Canyon Drive would be helpful. Lastly, I am requesting that you submit a letter to justify the variance based upon the physical constraints of the site. Variances; appeal. The appeal procedure for any action taken by the planning commission on a variance request shall be the same as for a use permit as specified in section 24-45.30. (Ord. No. 3176, § 1(Exh.A), 1-24-95) Sec. 24-51. Reserved. =` a. Sec. 24-52. Minor variances. (a) Purpose and intent. The section provides procedures for the preparation, filing, processing by the planning division, and the approval or disapproval of a discretionary permit that authorizes specific minor variances to zoning standards on specific sites. (b) Application and review procedures: (1) Applications for a minor variance shall be made in writing on a form prescribed by the planning manager. (2) Applicants shall be notified in writing of incomplete appli- cations within thirty (30) calendar days of the mailing of t said notice. Failure to so respond and complete the appli- cation, may result in the application being deemed aban- doned, and no further action shall be taken upon it. (3) All applications for minor variances shall be reviewed by the planning division and forwarded to other applicable county agencies or departments for review and comments. The review period shall not exceed fourteen (14) working days. Upon completion of the review period, a recommen- dation to either approve or disapprove the request shall be submitted to the planning manager for a decision on the project. The report to the planning manager shall include any recommended conditions of approval. (4) The planning manager shall provide public notice of the proposed project. The notice shall include a general expla- nation of the matter being considered, a general descrip- tion of the area to be affected and the date and location of the public hearing.The notice shall be given by mail to the ten(10)closest properties to the subject parcel at least ten (10)calendar days prior to the public hearing. Said notice 240.30 Supp.No.6-95 j §24-52 ZONING §24-52 shall be mailed to said property owners using the address from the latest equalized assessment roll of the County of Butte.Failure to receive the notice shall not invalidate any action on the application. (c) Approval or disapproval. After holding the public hearing, the planning manager, shall make the findings of intent to �+ ;r:'-.:::•;:" recommend approval or denial of the project to the planning commission.Approval of a minor variance.can be as it was applied for or in modified form and conditions may be imposed. Minor variances for signs may be conditioned to expire with the change of copy for the use,be reviewed on a periodic basis or be required to conform upon change of ownership, and/or shall automatically expire upon any designated period of time. The project along with the recommendation of the planning manager and any conditions of approval shall then be set as a consent agenda item before the planning commission. The plan- ning commission may only confirm the recommendation of the planning manager as a consent agenda item, approving of deny- ing the permit. If the planning commission wishes to change any of the conditions or take an action that is different from the recommendation of the planning manager, the item must be removed from the consent agenda, set for a public hearing, and noticed in the same manner as specified in subsection (b) above. (d) Findings. The approving authority shall make the follow- ing findings before granting the permit: Minor variances from the terms of this chapter shall be granted only when,because of special circumstances applicable to the property, including size, shape, topography, location or surroundings, the strict application of this chapter deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification.Any variance or adjustment granted shall be subject to conditions to assure that the deviation thereby authorized shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated. 240.31 Supp.No. 6-95 i §24-52 BUTTE COUNTY CODE §24-52 (e) Limitations. The power to grant a minor variance does not extend to use regulations. Flexibility to the use regulations is provided in the conditional use and minor use provisions of this chapter. The planning manager may grant a minor variance, at a maximum reduction of twenty (20) percent of the prescribed requirements of this chapter with respect to fences,walls,hedges, screening, or landscaping; width, or depth; front, rear, or side yards, coverage; height of structures; usable open space, .or frontage on a public street or other standard, as the minor variance was applied for or in modified form,if,on the basis of the application and.the evidence submitted, the approving authority makes findings of fact that establish that the circumstances prescribed in paragraphs (1) through(6) below do apply: (1) That there are special circumstances applicable to(the property, (size, shape, topography, location or surround- ings) or the intended use of the property, and because of this, the strict application of zoning standards code de- prives the property of privileges enjoyed by other proper- ties in the vicinity under identical zoning classification. (2) That granting the minor variance or its modification is necessary for the preservation and enjoyment of a substan- tial property right possessed by other property in the same vicinity and zone and denied to the property for which the .. minor variance is,sought. (3) That granting the minor variance or its modification will not be materially detrimental to the public health, safety or welfare,or injurious to the property or improvements in . such vicinity and zone in which the property.is located. (4) The granting of this minor variance does not constitute a special privilege inconsistent with the limitations !upon other properties in the vicinity and zone in which such property is situated. (5) The granting of this minor variance does not allow a use or activity which is prohibited by the zoning regulation gov- erning the parcel of property. 240.32 Supp. No. 6-95 �� All § 24-53 ZONING §24-55 (6) That granting the minor variance or its modification will not be incompatible with the Butte County general plan. (f) Appeals. The appeal procedure for any action taken by the planning commission on a minor variance request shall be the same as for a use permit as specified in section 24-45.30. (g) Lapse of minor variance. A minor variance shall lapse and shall become void one 1 year following the date on which the minor variance became effective, unless prior to the expiration of one (1)year: (1) A building permit is issued and construction is commenced and diligently pursued toward completion on the site which was the subject of the minor variance application;or (2) A certificate of occupancy is issued for the structure which was the subject of the minor variance application; or (3) The site is occupied in accordance with the minor variance, if no building permit or certificate of occupancy is required. A minor variance may be renewed for an additional period of up to one(1)year,provided that sixty(60)calendar days prior to the expiration date,an application for renewal of the variance is filed with the planning manager on the prescribed form and accompa- nied by the necessary data and fees.The approving authority may grant or deny an application-for renewal of a minor variance.
