The property is located on the west side of Church Street, 100 feet south of Fruitvale Road, Richvale. APN 029-110-026 (SH) (VAR 01-02) Mr. Durling said he was there to answer questions. The hearing was opened to the public. Grant Lundberg explained the need for the variance. He said based on the location of his buildings and the location with the neighbors this request fits in with the use that they already have. Commissioner Leland said the Commission has to make sure that they are not granting a special privilegq. He asked if any other buildings on the street, encroach into the setback? Mr. Lundberg said he did not know of any encroachments other than a tank on this property that goes into the setback. Commissioner Lambert said prior to the Variance taking affect the abandonment process of 10 feet on either side of Church Street 80 foot right-of-way will need to be completed. She said abandonments come through the Planning Commission. Commissioner Leland said if the abandonment doesn't take place, then the Variance would be for a 23 foot encroachment instead of a 13 foot encroachment. Rick Rodriguez,NorthStar Engineering, said the abandonment request has been submitted to Public Works. The hearing was closed. It was moved by Commissioner Leland, seconded by Commissioner Marin, and unanimously carried to approve the Variance for Eldon Lunberg subject to the findings and conditions listed below adding a finding that states "The proposed encroachment is consistent with the existing development in the area." I. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305 Class 5(a) - Minor Alterations in Land Use Limitations, Class 5(a), of the CEQA Guidelines exempts variances to setbacks not resulting in the creation of any new parcel. II. Approve Variance VAR 01-02 for Eldon Lundberg etal subject to the conditions found in Exhibit r "A" and subject to the following findings: A. r.. This Variance may be granted because special circumstances applicable to the property exist, including size, shape, topography, location or surroundings, and the strict application of the setback ordinance would deprive the property owner of privileges enjoyed by other property owners, and would not constitute a grant of special privileges inconsistent with the limitations placed upon other properties in the vicinity and under identical zoning classification, as supported by the following facts: .r ■ BUTTE COUNTY PLANNING COMMISSION ■MINUTES ■MAY 24,2001 ■PAGE 3■ 1. The applicant'.s parcel, and underlying lots, were created in 1910. 2. The existing mill and accessory structures were constructed in their present location, partially encroaching in the present front setback. 3. The current zoning was approved in 1975, imposing a 20 foot front setback,resulting in the existing improvements to be encroaching in the front setback. 4. The corner location, narrow lot design, and the further constraint of the property by the adjacent Richvale Irrigation District property combine to eliminate feasible alternatives for the proposal. 5. The mill's location within the existing setback, the proximity of the adjacent property owner to the west, the Richvale Irrigation District property to the north, and the existing rice dryer building and accessory facilities to the south on the same parcel, eliminate alternative usable areas for development. 6. The Building Division approved permits for the construction and installation of facilities, some of which were partially located in the front setback. 7. The physical arrangement of improvements on the property took place in accordance with the requirements applicable at the time. This arrangement now limits the acceptable choices for expansion of the mill, due to findings 3, 4 and 5 above. 8. The proposed encroachment is consistent with the existing development in the area. CONDITIONS OF APPROVAL: 1. The abandonment application for the abandonment of 10 feet on each side of Church Street, to reduce the current 80 foot right-of-way to 60 foot right-of-way, will need to be prepared and filed with Public Works to begin the abandonment process. The abandonment process will need to be completed prior to the variance taking affect. 2. There shall be no building of structures or storage of any materials over or under the existing 5 foot public utility easement located on Church Street. . 3. The expansion is required to facilitate the on-going operation of the present agriculture milling facilities. The milling process generates 25 million dollars in revenue per year and employs more than 100 people. 2. Lundberg Farms agriculture milling facilities are located on both sides of Church Street. The expansion of the building is required for the continued efficient and safe operation of the facility. 3. Concurrently with this application is a request for abandonment of 10 feet each side of the street is being prepared and submitted. This will reduce the street width to the standard 60 feet. Public Works is in favor of the abandonment and the variance to the setback line. This variance will not adversely affect the neighborhood as it will affect the applicant's property. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The applicant requests a variance to allow the expansion of an existing agricultural building approximately 13 feet into the 20 foot front setback. This will leave approximately 7 feet front setback to the Church Street Right-of-Way. The applicant proposes to expand an existing mill facility eastward toward Church Street. The building is slightly misaligned north/south with the property line, resulting in the southeast corner of the building encroaching 10 feet into the front setback, and the northeast corner of the building encroaching 13 feet into the front setback, with approval of the request for a variance. ANALYSIS: In order to approve a variance,the Planning Commission must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that cause a variance to County code to be necessary. Additionally, the variance must not constitute a ■ BUTTE COUNTY PLANNING COMMISSION ■ AGENDA REPORT ■ PAGE I ■ grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. The size, shape, location and surroundings of the Lundberg property contribute to special circumstances that allow findings to be made to support a variance to County code. The expansion of the agricultural building is consistent with the long-term, long time use of the property and neighboring properties, and would not constitute a special privilege not enjoyed by other similar properties. The following sections examine the specific factors allowing for this variance. i Development History The project site, APN 029-110-026, consists of Lots, 146, 147, 217, 218, 246, & 247. These lots were created January 10, 1910. Prior to County Building Division, Planning Division, or Environmental Health Division record keeping, commercial agricultural buildings with accessory structures were constructed on lots 218, 146, 246, 147. The original facilities were constructed in such a manner that they encroached into the existing 20 foot front setback. The mill, constructed in the late 1960s, was built in such a manner that the northeast portion of the building encroached 3+/- feet into the setback on Lot 218. The Carbon Dioxide tank was placed in the setback adjacent to the Church Street Right-of-Way on Lot 147. An electrical panel and pump was located approximately 4+/-feet in the right-of-way. Additional structures, including air bins, control room, gas meter, and hull tanks were also located within the 20 foot setback on Lot 246. In 1990,the applicant received Building Division approval for a gas line installation, a portion or all of which was located in the setback on Lot 147 and Lot 246. In 1993, the applicant received Building Division approval for construction of a commercial rice dryer, a portion of which was located in the setback on Lot 246. Parcel Configuration and Improvements The parcel was created in 1910 as a part of the Richvale Colony No. 2 Subdivision. Many of the parcels in this subdivision, including the applicant's parcel, are 120 x 287 feet in size (0.88+/- acre). Due to the small size of the project parcel for the purposes of an agricultural commercial milling operation, and due to the pre-existing facilities currently located on the parcel, any expansion of the existing facilities requires the applicant to expand into the front setback. The parcel is adjacent to Lots 217 &218 on the north, owned by the Richvale Irrigation District. The present mill facility is located approximately up to the side setback of the property line bordering the Richvale Irrigation District's property. There is approximately 30 feet or less of space on the west side of the mill to the property line. This area is used for the hull trucks to access the site, to load and transport the products. On the south side of the mill is the rice dryer, bins, tanks and other facilities adjacent to the mill. Due to the area that is needed for the expansion of the mill, the area where expansion can be placed is severely limited. Alternatives The current location of the existing improvements are contributing factors that limit alternatives for ■BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT■ PAGE 2 ■ development. The location of the mill, and the other structures, has not caused any adverse impacts to any of the surrounding parcels over the years,even while a portion of these structures were located in the present front setback. The proposed expansion of the mill cannot be placed anywhere else on the parcel, as the rest of the parcel is being utilized for the overall operation. There is no other physical space available to expand. The design requirements of the milling operation require that the area on the east side of the building be the location of the expansion. Over the years, the applicant has.attempted to purchase the neighboring parcel to the west, without success. Other Issues Presently, Church Street has an 80 foot right-of-way. The applicant has applied for an abandonment of 10 feet of the Church Street Right-of-Way on both sides of the street. Prior to the variance taking effect,the abandonment process of 10 feet on either side of Church Street's 80 foot right-of-way will need to be completed . The Department of Public Works has indicated it has no issues with the request for a variance and has recommended that the variance be approved once the abandonment of Church Street is completed. The Agricultural Commissioner's office has indicated there are no significant agricultural related issues with approval of the variance request. The Environmental Health Division has stated it has no objections or conditions to add to the variance request. The California Department of Forestry has stated there are no fire department objections nor conditions to the variance request. Conclusion The special circumstances noted in the previous sections allow for the findings necessary to grant this variance and indicate that the adjustment authorized will not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. ■ BUTTE COUNTY PLANNING COMMISSION ■ AGENDA REPORT ■ PAGE 3 ■ ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. This proposal has. been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305 Class 5(a) - Minor Alterations in Land Use Limitations, Class 5(a), of the CEQA Guidelines exempts variances to setbacks not resulting in the creation of any new parcel. II. Approve Variance VAR 01-02 for Eldon Lundberg et al subject to the conditions found in Exhibit "A" and subject to the following findings: A. This Variance may be granted because special circumstances applicable to the property exist, including size, shape, topography, location or surroundings, and the strict application of the setback ordinance would deprive the property owner of privileges enjoyed by other property owners, and would not constitute a grant of special privileges inconsistent with the limitations placed upon other properties in the vicinity and under identical zoning classification,as supported by the following facts: I 1. The applicant's parcel, and underlying lots, were created in 1910. 2. The existing mill and accessory structures were constructed in their present location,partially encroaching in the present front setback. 3. The current zoning was approved in 1975, imposing a 20 foot front setback, resulting in the existing improvements to be encroaching in the front setback. 4. The corner location, narrow lot design, and the further constraint of the property by the adjacent Richvale Irrigation District property combine to eliminate feasible alternatives for the proposal. 5. The mill's location within the existing setback,the proximity of the adjacent property owner to the west, the Richvale Irrigation District property to the north,and the existing rice dryer building and accessory facilities to the south on the same parcel, eliminate alternative usable areas for development. 6. The Building Division approved permits for the construction and installation of facilities, some of which were partially located in the front setback. 7. The physical arrangement of improvements on the property took place in accordance with the requirements applicable at the time. This arrangement now limits the acceptable choices for expansion of the mill, due to findings 3, 4 and 5 above. i ■ BUTTE COUNTY PLANNING COMMISSION ■ AGENDA REPORT ■ PAGE 4 ■ • EXHIBIT A VARIANCE BUTTE COUNTY PLANNING COMMISSION DATE VAR 01-02 VARIANCE NO. 029-110-026 ASSESSOR'S PARCEL NO. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below, Eldon Lundberg, et al, is hereby granted a Variance to expand an existing milling facility 13+/- feet into the front setback of Church Street, Richvale. CONDITIONS OF APPROVAL: 1. The abandonment application for the abandonment of 10 feet on each side of Church Street, to reduce the current 80 foot right-of-way to 60 foot right-of-way, will need to be prepared and filed with Public Works to begin the abandonment process. The abandonment process will need to be completed prior to the variance taking affect. 2. There shall be no building of structures or storage of any materials over or under the existing 5 foot public utility easement located on Church Street. 3. Applicant must also comply with all other applicable State and local statutes,ordinances and regulations. We have been involved in meetings with Northstar Engineering, who is acting on behalf of Lundberg Farms on this project. We have reviewed the existing site usage and the proposed expansion. Public Works would like to offer the following comments relating to the variance request. Public Works has agreed to process the abandonment of Church Street in the form represented in the variance application. That is 10 feet on each side of the street will address the existing encroachments that are now present within the current 80-foot wide right-of-way. The abandonment application will need to be prepared and filed with Public Works to begin the abandonment process. The abandonment process will need to be completed prior to the variance taking affect. The 13-foot encroachment into the proposed building setback that will be created from the building expansion appears to result in no impacts to roadway sight distance.
