These two maps were Book 62 Parcel Maps, Page 2 recorded June 29, 1977 and Book 92 Parcel Maps, Page 55 recorded March 30, 1983. According to Darrel Parsley, who recorded the 4-parcel parcel map in March 1983, said barn was there when he purchased the property in 1979. COMMENT #2: Mr. Minton purchased the property with the intent of utilizing all of the buildings on site. The fact that neither of the two parcel maps addressed the location of the barn and that no conditions to remove or relocate the barn were imposed it was Minton's interpretation that the location of the barn was, in each case, accepted as a pre- existing non-conforming use. To deny the variance request would deny Mr. Minton from enjoying the property rights that he, or anyone else, should be entitled to from any pre- existing use. COMMENT #3: During the period from said Parsley map (1983)to the present there has never been a complaint or inquiry into the existing location of the barn or the legality of the barn from any of the neighbors or from the County of Butte, including the County's inspection "to determine encroachment of various structures into easements and setbacks." See attached letter dated February 6, 1996. PROJECT DESCRIPTION The applicant requests approval of a variance to allow an existing 7,500 sq. ft. barn to remain four (4)feet into the five(5)foot side yard building setback. The SR-1 zone requires a five-foot side yard building setback. The barn is located one(1)foot from the property line as determined by a licensed land surveyor. The barn,is considered a nonconforming structure because it is located in the side yard building setback. A variance is not normally required for an existing nonconforming structure. A variance is being pursued for the barn because Condition 20 of the Blanshei Tentative Parcel Map on the project site, approved by the Butte County Development Review Committee in 1.997,requires the barn be either 0 Butte County Department of Development Services 0 Page 1 0 demolished, or set back five feet from the property line, or that verification of prior acceptance of the location of the barn in the setback be provided to the County. Condition 20 states: "The existing barn on Parcel 1 that extends into the side yard shall be set back five feet from the property line or demolished prior to recording the parcel map. If the structure is to be demolished, a demolition permit shall be obtained. If building is relocated, it shall be brought up to code or applicant shall provide uerificationof prior acceptance of the existing location." The Development Review Committee modified Condition 20 by adding "... or applicant shall provide verification of prior acceptance of the existing location." Staff considers the modification to mean that demolition or relocation of the barn is not required if the applicant provides information showing that the location of the barn in the setback has been officially accepted by the County. As it stands now,the location of the barn in the setback has not been officially accepted by the County. Approval of this variance will provide the necessary verification of acceptance of the barn in the 041°'(� setback and satisfy Condition 20. (gr The staff report for the Blanshei Tentative Parcel Map did not discuss the setback issue. There are two structures on the property that extend into the right-of-way for Parsley Lane, and conditions of the tentative parcel map require either the removal of the structures or the Parsley Lane road (0-1 easement be abandoned. The applicant is currently in the process of abandoning the road easement. V The barn is not located within the Parsley Lane right-of-way. The year the barn was constructed is not known, but a 1997 map of the site drawn by a previous owner indicates the barn is 50 years old or greater. The Butte County Building Division estimates that the barn is approximately 60 years old. Zoning did not exist in Butte County at the time the barn is believed to have been built, and no building setbacks were required. Building permits were not required at that time. The Butte County Assessor's Office does not have any information on file for the barn. There have been two previous recorded parcel maps on the property, one in 1977 and the other in 1983. A project file no longer exists for the 1977 map, but conditions of the 1983 map did not require the barn to be demolished or moved, or for a variance to be obtained. No mention of a setback conflict is made in the project file for the 1983 recorded map. PROJECT SITE DESCRIPTION The property is developed with a single family dwelling and garage, the barn, a covered corral, a large storage building, swimming pool, well, several feed silos, and a septic system. Horses are kept on the project site. Vegetation on the site is mainly grasses,with oak trees and non-native vegetation located around the dwelling. Surrounding properties are developed with single family dwellings on parcels ranging in size from .8 to 1.8 acres. Land uses on surrounding parcels are single family dwellings at rural densities and horse grazing. • 0 Butte County Department of Development Services 0 Page 2 0 The portion of the barn adjacent to the property line is used for storage of farm-related equipment and materials. It has a concrete floor and is separated from the remainder of the barn by a wall. A six-foot tall solid wood fence runs the length of the property line next to the barn. The nearest off- site dwelling unit is located=approximately 70 to 80 feet east of the barn. Numerous pine trees, approximately 20 feet tall, are located between the house on the adjacent parcel and the barn. The project site is located within the North Chico Specific Plan (NCSP) Area. The NCSP requires a five-foot side yard building setback in the SR-1 zone. No provisions of the NCSP apply to this project. The project site is located within the Chico Municipal Airport Area of Influence. Butte County Airport Land Use Commission staff commented that the project site is not within the Overflight Protection Zone and a hearing before the Airport Land Use Commission is not required. ALUC staff recommends that non-reflective roofing material be used on the barnand that an Avigation Easement Agreement be recorded. The barn has a tin roof, which is considered a reflective surface. Because the barn is a pre-existing structure the change to a non-reflective roof is not recommended. A condition of the Blanshei Tentative Parcel Map requires that an Avigation Easement Agreement be recorded prior to recordation of the final map. ANALYSIS It is believed that the barn was constructed approximately 50 to 60 years ago, when there were no building setback requirements in the County. The location of the barn in the setback has not created any impacts to the residential use on the adjacent parcel. Approval of this Variance will not result in the barn being expanded further into the setback. The six-foot tall solid wood fence located on the property line helps to separate the barn from the residential use on the adjacent parcel. The numerous pine trees on the adjacent parcel also help to screen the barn from the view of the residents of that parcel. Normally a fire wall must be installed for an agricultural structure placed within 20 feet of a property line. The Butte County Building Division recommends that a firewall be installed if any new construction occurs to the barn. This is added as a condition of project approval. The Butte County Environmental Health Department, Public Works Department, and the Fire Department/CDF did not object to the proposed variance and did not recommend any conditions. In order to approve a variance,the Planning Commission must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that cause a variance to County code to be necessary. Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. The special circumstances that apply to this project is that the barn was constructed when no building setbacks were required. As such, the barn is a nonconforming structure with regards to the side yard building setback. The only reason that this variance is necessary is because of Condition 20 of the Blanshei Parcel Map. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305(a) -Minor Alterations in Land Use Limitations, Class 5, of the CEQA Guidelines exempts variances to setbacks not resulting in the creation of any new parcel. II. Approve Variance 00-02 for Robert Minton subject to the conditions found in Exhibit A and subject to the following findings: A. The project application, maps and related items have been reviewed by County Agencies in order to determine the completeness of this application. The Planning Division cannot continue to process your application until the following information is provided: 1. The site map does not show the location of the house on parcel 1. While this does not affect the variance project,all structures existing on the site are required to be shown on the site map pursuant to the submittal requirements for a variance application. 2. This variance is for the barn that is located one foot from the property line. However, as stated in the February 6, 1996, letter from the Building Division the covered corrals (pole barn) are also located within five feet of the property line. Condition # 19 of the Blanshei TPM requires the covered corrals to be demolished or set back five feet from the property line. I informed him that the project was incomplete because the site map did not show the.house on parcel 1. He will get us revised maps ASAP. I also discussed the issue that if appears the covered corral (pole barn) is within the five(5) foot side yard building setback, as determined by the Building Division in their 2/6/96 letter. Mr. Rodriguez will look into this matter and get back to me ASAP. I told him that a letter asking to revise the application to include the covered corral will be necessary. I will send out an incomplete letter tomorrow regarding the incomplete application. I also gave Mr. Rodriguez two copies of the comments we have received regarding this project. I am not ' planning on doing an Initial Study, but my supervisor may say otherwise. If I have to do the Initial Study it probably won't be finished until late next week. We'll see. We received comments from all the important departments/agencies and these will be in the mail to you tomorrow. This variance is.for the barn that is located one foot from the property line, but aren't the covered corrals also located within five feet of the property line? The Building Division states that any structure, including agricultural buildings, require a firewall if located less than 20 feet from the property line. Their comment will be in the mail to you tomorrow. Get back to me as soon as you can on this project so we can figure out how to get it going and scheduled for a PC hearing. These two maps were Book 62 Parcel Maps, Page 2 recorded June 29, 1977 and Book 92 Parcel Maps, Page 55 recorded March 30, 1983. According to Darrel Parsley, who recorded the 4-parcel parcel map in March 1983, said barn was there when he purchased the property in 1979. COMMENT#2: Mr. Minton purchased the property with the intent of utilizing all of the buildings on site. The fact that neither of the two parcel maps addressed the location of the barn and that no conditions to remove or relocate the barn were imposed it was Minton's interpretation that the location of the barn was, in each case, accepted as a pre- existing non-conforming use. To deny the variance request would deny Mr. Minton from enjoying the property rights that he, or anyone else, should be entitled to from any pre- existing use. COMMENT #3: During the period from said Parsley map (1983)to the present there has never been a complaint or inquiry into the existing location of the barn or the legality of the barn from any of the neighbors or from the County of Butte, including the County's inspection "to determine encroachment of various structures into easements and setbacks." See attached letter dated February 6, 1996.
