Variance Clarification—Ken Reimers. Mr. Sanders gave a brief summary of the clarification that was requested. He stated that when the Variance previously came before the Commission, there was not any information in the packet sent to the Commission which indicated that that the proposed garage was a two story building. Commissioner Marin asked, how does this variance conform with the surrounding parcels? Mr. Sanders said that there are single story garages to the west and south. Commissioner Lambert said the height was not included in the information before the Commission. She said that there was no discussion as to the height of the garage. She said that she did not know at the time this would be a two-story garage. She was not sure she would have voted to allow a two- story garage, which can be obtrusive and overbearing. She said that her intent, when making the motion, was for a one-story garage. Chairman Mooney felt that the neighbors had a right to know the subject garage was going to be a two-story garage. Commissioner Lambert stated again that her intent was for a one-story garage. Chairman Mooney said that he also understood it to be a one-story garage. Mr. Reimers said that he had the plan drawn and submitted to the Building Division and was told he needed a variance. He said that he did not change the plans that were submitted for the building permit when he applied for the Variance. He said that it was not his fault the Commission did not receive the plans for the garage at the time of the hearing. He argued that the Building Division and Planning Division are in the same department. Commissioner Lambert said that what Mr. Reimers indicated would change the fact that the Commission did not have the plans at the time of the hearing and she was not sure she would have .approved a two-story garage variance at five feet from the property line. Mr. Reimers said a two-story garage will not impact the line of sight for traffic. Chairman Mooney said he did not have a problem with a two-story garage. Mr. Reimers affirmed that he had no plans to have living quarters above the garage, that it was just for storage. ` ^�T �. �7BTUTTEOUNTY PLANNING COMMISSION MINUTES MARCH 28,2002 PAGE 19 Commissioner Lambert again attested that it was her intention at the time she made the motion for a one-story garage with no height listed. Chairman Mooney pointed out that a 16-foot building without a floor is considered a one-story building. He said that by adding a floor it makes the building a two-story building. Mr. Sanders asked the Commission if adding the floor makes a difference in their decision? Mr. Reimers asserted that it was not his fault the Commission did not know the height of the building at the hearing. Chairman Mooney said that staff is asking for clarification and he has no problem with the two-story garage. Commissioner Lambert said that the original structure was encroaching 5 feet into the setback. It was her understanding that this would be a normal size garage. She said it was her intent to allow a variance for a single-story building. She was not sure she would have approved the variance had she known it was for a two-story building. Chairman Mooney said that the Commission approved a variance for a structure in the setback with no discussion related to the height. Commissioner Marin agreed with Chairman Mooney that the Commission approved a structure that encroached into the setback. The property is located at the northwest corner of West Lindo Avenue and Sequoyah Avenue, at 127 W. Lindo Avenue, Chico. APN 003-593-004(CBS) (VAR 02-01) Mr. Sanders gave a brief summary of the reason that this project was continued. He submitted findings in support of approving this project. It was moved by Commissioner Lambert, seconded by Commissioner Nelson, and carried to approve the Variance for Ken Reimers subject to the findings and conditions below: I. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305 Class 5(a) - Minor Alterations in Land Use Limitations, Class 5(a), of the CEQA Guidelines exempts variances to setbacks not resulting in the creation of any new parcel. II. Approve Variance VAR 02-01 for Ken Reimers, subject to the conditions found in Exhibit "A" and subject to the following findings: A. This Variance may be.granted because special circumstances applicable to the property exist, including size, shape, topography, location or surroundings, and the strict application of the setback ordinance would deprive the property owner of privileges enjoyed by other property owners, and would not constitute a grant of special privileges inconsistent with the limitations placed upon other properties in the vicinity and under identical zoning classification, as supported by the following facts: 1. The applicant's parcel and surrounding lots were created in 1904, prior to County setback requirements. 2. Many of the surrounding properties are developed with structures in both the rear-yard and street setbacks prior to the County adopting setback requirements and these property owners enjoy the use of their property in a manner that others do not. 3. The existing improvements on-site including the placement of the septic tank and leachfield area, limits the location for accessory structures on the subject ' property. t Approval of a variance to allow the construction of a residential garage would not be considered to be granting a special privilege because a garage is considered a normal accessory use to a residence and the proposed location is consistent with the location of other accessory structures in the area and character of the neighborhood. APN 003-593-004(CBS) (VAR 02-01) Mr. Sanders gave a summary of the project and the findings that were required to approve a variance. The hearing was opened to the public. Chairman Nelson asked if staff was concerned with the widening of Sequoyah Avenue. Mr. Sanders stated that Sequoyah is currently:a very narrow street. r Ken Reimers handed out pictures of Sequoyah Avenue showing 16 feet of pavement on the road. He was concerned with his Chinese pistachio trees along his south border which are 4 or 5 feet from the right-of-way line. He said that he was preparing the paper work to abandon 10 feet of the right- of-way to protect the trees. He did not think anyone would be cutting down these trees to widen Sequoyah Avenue. He discussed a carport on the north side of his house. He explained that he did not believe he had room to build a garage where the carport is located because of a large elm tree. He passed out pictures showing how close the neighbor's house is to the existing fence. He also discussed the size of the trees on his property. He commented on the transitional nature of the area. He stated that there have been variances granted in his neighborhood. He requested that this Variance be approved. Commissioner Mooney asked about putting in a drive-through garage? Mr. Reimers said a drive-through would cut across his leachfields and septic tank. He said he wanted to come out forward on Sequoyah. D. C. Jones, 833 Mt. Ida Road, said there should be something that says precisely where the property line is and not use an assumption. He discussed a possible survey to ascertain where the property line is. The hearing was closed. 'F . Chairman Nelson assured Mr. Jones that the Commission is trying to be reasonable by looking at all elements. He did not want to set a precedent factor. i Commissioner Mooney said he agreed with the City of Chico and the Department of Public Works and would recommend denial. This property is in the City of Chico's sphere of influence. 0 BC PLANNING COMMISSION 0 MINUTES,DECEMBER 13,2001 ■PAGE 14 0 Commissioner Lambert thought with all the variances that exist in the subject neighborhood, she did not see a problem approving this request. Commissioner Marin said the applicant should be allowed to do what he is proposing to do as long as the property line is measured properly. Mr. Sanders did not deny that there are a significant percentage of properties in the neighborhood that have some type of structure that does not conform, but the County did not grant variances for those structures; the structures were either pre-existing nonconforming or illegal. Commissioner Lambert noted that there were at lease a couple of variances that the Commission had approved in this area. Chairman Nelson talked about establishing a new standard for this area. He said the Commission needs to decide if this variance does or does not make a difference. He asked Mr. Buford for his input. Mr. Buford agreed with Mr. Sander's report that this Variance would be a special privilege if granted. He asserted that the Commission could condition the Variance regarding the property lines being clearly identified. He said the Commission should make appropriate findings phrased in language consistent with the ordinance, indicate their intention, and direct staff to schedule this item for the next Planning Commission meeting. There was a brief discussion on having staff prepare a motion once the property line is established and come back with findings at the next meeting.• It was moved by Commissioner Lambert, seconded by Commissioner Marin, and carried to do a Motion of Intent to approve the Variance for Ken Reimers subject to locating the property line with findings of surrounding variances granted and bring this item back at the next Planning Commission meeting,by the following vote: AYES: Commissioner Marin, Lambert, and Chairman Nelson NOES: Commissioner Mooney ABSENT: Commissioner Leland ABSTAINED: No one 4 Chairman Nelson re-opened the meeting to allow a final comment from Mr. Reimers. Mr. Reimers voiced his objections to submitting 35 maps with the application. Please note that acceptance of your application is not an indication of approval. A. SPECIFIC INFORMATION The following specific information'and material shall accompany a Uniform Application at the time of submittal. Applications will not be considered complete nor will they be acted upon until all submittal requirements have been met. All items, maps and exhibits submitted in support of this application shall become the property of Butte County. The following items are required to be submitted at the time of application: 1. A completed, signed, Uniform Application and Environmental Information form. If the application is signed by an agent for the property owner, an agent authorization form must be submitted along with the Uniform Application. The application shall not be accepted unless signed by the owner or authorized agent. 2. Payment of the currently required Application Fee. 3. Thirty-five (35) copies of plans which shall include a detailed site plan drawn to scale. All plans shall be drawn on uniform size sheets no greater than 24" X 36".The finished plans shall be folded to 8 1/2" x 11". The detailed site plan must include: Name and address of Applicant, Engineer, Architect, and/or person who prepared the plan Property lines and lot dimensions _ Assessor Parcel Number(s) and the street address. Dimensioned locations of existing and proposed improvements on the property (including, but not limited to, buildings, driveways, parking areas, wells, septic tanks and leach fields). PUBLIC HEARING REQUIREMENTS A variance is subject to a public hearing by the Planning Commission. All parcels within a 300' radius of the application boundaries, but not less than 10 parcels, will be notified of the application by the Planning Division prior to the public hearing. C. NECESSARY FINDINGS OF FACT Each zoning classification and land use has an associated set of development standards which are specified in the Butte County Zoning Code. The'California Government Code Section 65906 and 65906.5 and the Butte County Zoning Code establish findings which must be made in order to grant variances from these standards where unique circumstances exist to warrant relief from the strict application of these standards. Variances from the terms of the Zoning Code may be granted only when, because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the Zoning Code deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification. Any Variance granted may be subject to conditions that will assure that the deviation shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated. Variances can not be granted for reductions in lot size, increases in residential density, increase in lot coverage, or for uses not permitted in a zone. The courts have clearly indicated that variances are not intended to rewrite the County Code and can only be granted if all the findings listed below are made. Further, the courts have indicated the actual, factual basis for these findings must be stated. PROJECT DESCRIPTION The applicant requests approval of a variance to allow a 396 square foot (18 feet x 22 feet) garage to be located ten (10) feet into the fifteen (15)foot rear yard building setback and fifteen (15) feet into the twenty(20). This will leave a five(5)foot distance between the garage and the rear property line and five (5) feet between the garage and the right-of-way.along Sequoyah Avenue. . PROJECT SITE DESCRIPTION The property is developed with a 3,000 square foot single family dwelling as well as a carport and attached garden shed. A gravel driveway extends from West Lindo Avenue to the existing carport. The project site is nearly level with no topographic features that would create a hardship for the property. The project site is located in an older established subdivision that was created in 1904, prior to any zoning, building or subdivision regulations in the County. Almost all of the existing lots meet the 0 Butte County Department of Development Services ■ Page 1 0 current zoning size and lot width minimums. The minimum lot size for a corner lot in the R-1 zone is 8,125 square feet, when sewer is not available. The subject parcel exceeds this minimum by approximately 4,225 square feet. Surrounding properties are generally about 9,400 square feet and are developed primarily with single family dwellings. All existing structures on the subject property conform to the required building setbacks. ANALYSIS In order to approve a variance, the Planning Commission must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that cause a variance to County code to be necessary. Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. Staff cannot find that there is a hardship with respect to the size, shape, topography, or location of the parcel. The parcel is larger than most surrounding parcels. The parcel shape is not irregular. As previously mentioned, the site is completely level and has no limiting topographic features. The site is a corner lot and is subject to 20-foot street setbacks on two property lines, but the parcel is large enough that this does not create a hardship. In considering the surroundings of the subject property, Staff has found that two variances have been approved nearby. Both variances are for lots on Sequoyah Avenue and both were granted to allow structures near to the road setback. In both instances the lots are 65-foot wide corner lots that have a 40-foot wide building envelope once setbacks are taken into consideration. It should be noted that both of the parcels are in an SR zone rather than an R-1 zone. There are also several parcels in the immediate vicinity with structures that are nonconforming with respect to setback requirements. Some of these nonconforming structures were built prior to zoning and building setbacks. In other instances, structures may have been built up to 5 feet from rear property lines between 1955 and 1988, as 5 feet was the rear yard setback for the entire area during this time period. The development of a garage is a consistent use in the zone and the granting of a variance would not allow a use that other residences may not have nor would having a garage be considered a special privilege, however, the property already has a carport which could be converted or reconstructed into a garage structure. Other Issues The Butte County Building Division,the Environmental Health Division, and Butte County Fire Department/CDF do not object to the project and did not recommend any conditions. The City of Chico commented on this project stating that it does not appear that the findings required to approve the project can be made and that the encroachment into the street setback may obstruct the view of drivers backing into Sequoyah Avenue from the driveway immediately to the west. City Planning staff recommends denial if the garage cannot be placed 20 feet from Sequoyah Avenue. 0 Butte County Department of Development Services 0 Page 2 0 County Department of Public Works staff also commented on the reduced sight-distance and the potential traffic hazard created by placing a structure 5 feet from the right-of way. A site visit revealed that the sight-distance for drivers backing out of the driveway in question is already impaired by a 6-foot, solid, wood fence that comes to within 5 feet of the right-of way. It is not known if the applicant constructed this fence or the neighbor. Conclusion The special circumstances noted in the previous sections are not present on the applicant's property' to allow for the findings necessary to grant this variance. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. Deny Variance 02-01 for Ken Reimers finding that: A. Special circumstances applicable to the property, including size, shape,topography, location and surroundings do not exist on the subject property that would cause a variance to County code to be necessary. B. The application of County setback requirements on the subject parcel does not deprive the property of privileges enjoyed by other properties in the vicinity and in the identical zone district. Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. C.
