The existing house extends five(5) feet into a ten(10)foot building setback. The addition would extend laterally out from and be even with the existing house,and would not extend further into the side yard setback.The property is located at the southeast corner of Hosler Avenue and Besser Court, at 13154 Hosler Avenue, north of Chico. APN 006-660-006 (SB) (VAR 02-02) Mr. Betts gave a brief summary of the project. The hearing was opened to the public. Ray Bransky stated that he does not want to cut down any trees and that he is adding a new room for his children. Jennifer Bransky said that the house is a fire trap and needs lower windows built in the addition for exit by the children. The hearing was closed. f It was moved by Commissioner Nelson, "seconded by Commissioner Leland, and unanimously carried to approve the Variance for Ray and Jennifer Bransky subj ect to the findings and conditions listed below. I. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically,Section 15305(a)-Minor Alterations in Land Use Limitations,Class 5,of the CEQA Guidelines exempts variances to setbacks not resulting in the creation of any new parcel. II. Approve Variance 02-02 for Ray and Jennifer Bransky subject to the following findings and conditions found in Exhibit A: A. This Variance may be granted because special circumstances applicable to the property exist,including size,location,or surroundings,and the strict application of the setback ordinance would deprive the property owner of privileges enjoyed by other property owners, and would not constitute a grant of special privileges inconsistent with the limitations placed upon other properties in the vicinity and under identical zoning classification, as supported by the following facts: 1. The location of the septic tank and tight line limits where the addition to the house can be located:v 2. The addition would not limit sight distance along Besser Court or Hosler Avenue. 4. The existing house has been located within the side yard building setback for numerous years and had not created'any problems to either the residents of the house or to vehicles on Besser Court. 5. Other landowners in similar situations could apply for a Variance. 6. At the time the house was constructed, the side yard building setback was five feet. SPECIAL CONDITIONS: Planning Division 1. The variance is approved for a 20-foot by 16-foot addition to the existing house to extend five (5) feet into the ten (10)-foot side yard building setback, in accordance with the application and plot plan as submitted. Other Conditions 2. Applicant must also comply with all other applicable State and local statutes,ordinances,and regulations. There are three main reasons we need to add another bedroom to our house. The first is safety. If a fire started in our home the only emergency exit for the entire north end of our home are small windows that set almost four feet off the bedroom floor and close to 6 feet above the ground. Several years ago after a fire burned a neighbor's home with an identical floorplan to ours, the fire chief walked through the burned out structure and informed our neighbor that the floorplan had encouraged the spread of the fire. We were very concerned to hear this since we have two young children en and no easy escape route in the back of the house. Our new floorplan will provide our children with several window escape routes, along with an exit door set between the old bedroom and the new. The second is privacy. Presently our daughter and son share the second bedroom of our two bedroom home. And while they have a good relationship, the time is quickly coming when they will need to have different rooms. The third reason is financial. Simply stated, with the modest income of two teachers, one of which teaches part-time, we presently cannot afford to purchase a new home. In regards to the location of the room addition, we really are limited with our choice. Hemmed in by an existing pool and septic system there are few options as to where we can add existing square footage. Our current design and layout would also maintain the visual integrity. The addition would extend laterally out from and be even with the existing house and would not extend further into the side yard setback. 0 Butte County Department of Development Services 0 Planning Division 0 Page 1 ■ PROJECT SITE DESCRIPTION The property is developed with a two-bedroom, 1,500-square foot single family dwelling with an attached garage, well, septic system, large shed, and a swimming pool. Access onto the site is fxom Hosler Avenue. The property is a comer lot, with Besser Court located along the north property line. The project site is level with no topographic features that would create a hardship for the property. The parcels on the east side of Hosler Avenue are zoned AR-2Y2 and vary in size from 0.54 to 3.4 acres. Most of these parcels are less than 2%z acres in size. Surrounding properties in the AR-2V7, zone are developed primarily with single family dwellings. The parcels on the west side of Hosler Avenue are zoned A-20 and consist of orchards or open fields. The project parcel was created by deed in 1965, which is when the house on the property was constructed. At that time the site was zoned A-2 (General), which allowed a minimum parcel size of 8,125 sq. ft, with side and rear yard building setbacks of five feet. Because the project parcel-met the minimum parcel size requirements at the time it was created, the property is considered to be a legal, nonconforming parcel. The site was rezoned to ARMH-3 in 1975, which required a ten-foot side yard building setback, and then to AR-2%2, the current zoning, in 1998. The 60-foot wide Besser Court road easement was created in 1973 to provide access to a 14.5- acre parcel to the east of the site. All of the road easement lies on the adjoining property to the north of the project site. The 14.5-acre parcel was divided in 1976 and Besser Court now provides access to four parcels. The house on the project parcel was constructed prior to the creation of the road easement, and is located approximately ten feet from the Besser Court roadway. Besser Court is a gravel roadway. Butte Count Sections 10-6 and 10-7 state that building setbacks from a road are only required if Y g Y q the road is dedicated and accepted for public use. Normally, there is a 50 or 55-foot building setback from the centerline of a road accepted for public use. According to the Public Works Department, Besser Court is a private road easement and has not been dedicated to or accepted for public use. Therefore, the only building setbacks that apply are the setbacks found in the AR section of the Zoning Ordinance (Section 24-95.10). ANALYSIS In order to approve a variance, the Planning Commission must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that cause a variance to County code to be necessary. Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. Staff cannot find that there is a hardship with respect to the shape or topography of the parcel. However, the size of the parcel poses a significant hardship because it is a 0.6-acre parcel in a zone that requires a minimum parcel size of 2% acres. If the project site was zoned AR-%Z, which- 0 Butte County Department of Development Services 0 Planning Division 0 Page 2 ■ would be more appropriate given the size of the parcel, a five foot side yard setback would be required and there would be no setback issues with the proposed addition. The addition to the house is consistent with the use of residential property and would not constitute a special privilege not enjoyed by other similar properties. The fact that the zoning of the property has changed over the years imposes a hardship. The house was outside the side yard building setback when it was constructed, but due to zoning changes, which required greater building setbacks, the house is no longer conforming and any additions to the house in a setback would require a variance. The existing house has bedrooms on the west and east sides of the house, which would be the most logical places to add another bedroom to the house. However, placing the addition on to either end of the house would place it in the ten-foot side yard building setback. It appears that the applicant's proposal to construct the addition on the east end of the house is very appropriate because of a hallway that is located at this end of the house. The addition to the house would not result in a reduced sight-distance on Besser Court. The existing house is located 50 feet from Hosler Avenue, and the addition would not encroach into the 20-foot front yard building setback. The project parcel is developed with a house, septic tank and leachfield, and a swimming pool. The location of these improvements and the small size of the parcel limits are contributing factors that limit alternatives for development. Alternatives The proposed addition could be placed on the south side of the house, but doing so would require the removal and relocation of the existing septic tank and tight line. Moving the addition to the west side of the house would still result in the addition being placed in the side yard setback. Another alternative would be to offset the addition five feet from the north outside wall of the house. While this would place the addition outside the building setback, it would result in an unbalanced, non-symmetrical, appearance to the house. This alternative would also reduce the size of the addition from 340 square feet to approximately 214 square feet. The addition could not be placed further to the south unless the existing septic tank was removed and installed- elsewhere on the property. Other Issues The Butte County Building Division, Fire Department/CDF, Public Works Department, Agricultural Commissioner, and the Environmental Health Division did not object to the project or recommend any conditions. ■ Butte County Department of Development Services 0 Planning Division ■ Page 3 ■ Conclusion The special circumstances noted in the previous sections allow for the findings necessary to grant this variance and indicate that the adjustment authorized would not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305(a) - Minor Alterations in Land Use Limitations, Class 5, of the CEQA Guidelines exempts variances to setbacks not resulting in the creation of any new parcel. H. Approve Variance 02-02 for Ray and Jennifer Bransky subject to the following findings and conditions found in Exhibit A: A. This Variance may be granted because special circumstances applicable to the property exist, including size, location, or surroundings, and the strict application of the setback ordinance would deprive the property owner of privileges enjoyed by other property owners, and would not constitute a grant of special privileges inconsistent with the limitations placed upon other properties in the vicinity and under identical zoning classification, as supported by the following facts: 1. The location of the septic tank and tight line limits where the addition to the house can be located. 2. The addition to the house would not extend further into the setback then the existing house already does. 3. The addition would not limit sight distance along Besser Court or Hosler Avenue. 4. The existing house has been located within the side yard building setback for numerous years and had not created any problems to either the residents of the house or to vehicles on Besser Court. 5. There are three main reasons we need to add another bedroom to our house. The first is safety. If a fire started in our home the only emergency exit for the entire north end of our home are small windows that set almost four feet off the bedroom floor and close to 6 feet above the ground. Several years ago after a fire burned a neighbor's home with an identical floorplan to ours, the fire chief walked through the burned out structure and informed our neighbor that the floorplan had encouraged the spread of the fire. We were very concerned to hear this, since we have two young children and no easy escape route in the back of the house. Our new floorplan will provide our children with several window escape routes, along with an exit door set between the old bedroom and the new. The second is privacy. Presently our daughter and son share the second bedroom of our two bedroom home. And while they have a good relationship, the time is quickly coming when they will need to have different rooms. The third reason is financial. Simply stated, with the modest income of two teachers, one of which teaches part-time, we presently cannot afford to purchase a new home. In regards to the location of the room addition, we really are limited with our choice. Hemmed in by an existing pool and septic system there are few options as to where we can add existing square footage. Our current design and layout would also maintain the visual integrity.
