The project site is located in Supervisorial District 1. RELATED ITEMS: None FOR: Planning Commission Meeting of November 13, 1997 SUMMARY: Staff recommends approval of this application subject to the findings and conditions contained herein. APPLICABLE BUTTE COUNTY REGULATIONS: This use permit application is submitted pursuant to Butte County Code Sections: 24-45 (Use Permits) which requires that an application be submitted and a public hearing be held by the Planning Commission. The Commission may grant a Use Permit when it finds that the proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health or general welfare of the persons residing or working in the neighborhood, or to the general health, safety and welfare of the residents of the County; and 24-95.C.3 (AR Zoning) which states that quasi-public uses require a conditional Use Permit in the AR zone; and 24-305.450 - Definition of a Quasi-Public Use: A use operated by a private non- profit...association or organization, said use having the purpose primarily of serving the general public, and including but not limited to such uses as.churches, private school...community youth and senior citizen recreational facilities... ■ Butte County Department of Development Services ■ Planning Division ■ 1 PROJECT CHARACTERISTICS: This project is a Use Permit request for a quasi-public use to allow a mini-ranch to provide recreational and learning facilities for challenged, abused, and traumatized children. The project site is 5.96 acres in size, and is zoned AR-1 (Agricultural Residential). The Land Use Element Map of the Butte County General Plan designates the project site as Agricultural Residential. The Agricultural Residential Zoning Ordinance requires that a conditional Use Permit be obtained for quasi-public uses. The project site is developed with a dwelling unit, garage, and a small horse corral. One horse is currently kept in the corral. Domestic water service for the project site is supplied by a public water system. Sewage disposal is handled by an on-site'septic system. Most of the project site is open grass land, with scattered oak and willow trees. Extensive amounts of brush and trees are found along a seasonal creek on the east property line. The parcel fronts on Palermo Drive, Plumas Drive, and Pinenut Way, with the primary access being off of Palermo Drive. Surrounding parcels are zoned AR-1, and range in size from 1 to 10 acres. Land use on.the surrounding parcels is rural residential. The proposed use will be a mini-ranch to provide recreational and learning facilities for challenged, abused, and traumatized children. The applicant operates the Miracles Rein Ranch, which is an IRS-certified non-profit organization. Children will come to the ranch to ride horses and participate in various types of arts and crafts classes. The children will only come for the day, and no overnight stays are proposed. There will be a petting zoo to give the children an opportunity to interact with small animals, such as goats, pot belly pigs, and rabbits. The applicant intends to have approximately four to eight horses on the property. The applicant will do most of the work on the ranch herself, but there may be one part-time employee to help care for the horses. Several buildings will be constructed for this project. The largest structure will be a 3,000 to 4,000 sq. ft. barn and craft center. Attached to that structure will be an open, but covered petting zoo. The existing corral is proposed to be enlarged and a riding arena will be constructed. Restrooms will be placed in the barn/craft center structure, and another restroom is proposed to placed near the riding arena. ANALYSIS: The proposed use will change the land use from its current residential use to that of a small ranch that will be open to challenged, abused, and traumatized children. The change in land use will not be significant and will not have a significant impact to the neighborhood because the operating characteristics of the proposed use will have a minimal impact on the neighborhood. Under the current zoning of AR-1, and because the parcel is more than five acres in size, the applicant could place numerous horses on the parcel without the need for a Use Permit. In addition, the applicant is also entitled to have other types of farm animals, such as cows and pigs, on the property without the need for a Use Permit. Noises and odors from the horses and ■ Butte County Department of Development Services ■ Planning Division ■ 2 • other farm animals on the project site may impact the people living on the adjoining parcels. However, the AR-1 zoning allows horses and other animals on the project site without the need of a Use Permit. There are provisions in the Butte County Zoning Ordinance that allows the County to take abatement actions should noises or odors from the animals on the project site become a nuisance to nearby residents. In order to reduce odors, a mitigation of this project requires the applicant to dispose of animal waste so as not to cause excessive odors or pollute water runoff in accordance with Environmental Health Division requirements. The proposed use will allow the applicant to have children come to the property and participate in various types of activities on a regular basis. The ranch will be open to the children 3 to 4 days a week. Approximately two to three children and their families will come to the ranch on those days. No overnight stays are proposed. The applicant intends to only operate during daylight hours. There may be two to three special events each year at which 20 to 30 children and their families will attend. The increase in vehicle traffic generated by these visits will not have a significant impact on vehicle operations in the project area. Only two to three children, and their families, will visit the ranch each day. This will mean an increase of approximately four to six vehicle trips, three to four days a week. The two to three special events that may be held each year on the project site may generate approximately 40 to 60 vehicle trips for each special event. These 40 to 60 vehicle trips will not cause a significant impact to vehicle operations in the project area, although they may result in short-term impacts. Noises from activities on the project site may impact nearby residents. Most outside activities will consist of horse riding on the project site, mostly in the riding arena. No outside playing areas, such as a playground or a ball field, are proposed. No nighttime activities are proposed by the applicant, and a mitigation of this project prohibits activities associated with the proposed use from occurring from 6:00 p.m. to 8:00 a.m. During special events, which will occur two or three times per year, there will be additional noises which may cause an impact to nearby residents. These noises, which will consist of children playing and vehicle noises, will only last during daylight hours, will be intermittent, and should not cause a significant impact to nearby residents. According to the..Butte County General Plan Noise Element, acceptable noise levels in a residential area are 50 to 70 dB CNEL. It is expected that the proposed use will not generate noise levels that exceed the acceptable noise levels. The Butte County Fire Department commented on this project and is requesting that building identification and/or addresses be installed and maintained in conformance with Public Resources Code 4290. Construction, installation or development of structures or facilities on the project site shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. ■ Butte County Department of Development Services ■ Planning Division ■ 3 The Butte County Department of Public Works is requesting that encroachment permits be obtained for all new or existing driveway approaches and constructed to County Improvement Standard. The Department of Public Works is also requesting that a plan for a permanent solution for drainage on the project site be approved prior to issuance of building permits. These have been added as conditions of approval. Restrooms are proposed to be placed in the barn/craft center and another restroom near the proposed riding arena. This may require the installation of a new septic system on the project site. The Butte County Environmental Health Division commented that a new sewage disposal system will have to be installed under permit from their Division. This has been added as a condition of approval. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. An Initial Study has been prepared by County staff. Based upon a review of the Initial Study, staff has determined that the project impacts can be fully mitigated with the addition of mitigation measures added as conditions of approval for the project. RECOMMENDATION: Staff is recommending that a Use Permit be granted to Lisa Kay Ziel for a mini-ranch to serve challenged, abused, and traumatized children on APN 068-130-060 subject to the findings and conditions contained in Exhibit "A," attached. This recommendation is based on the project's ability to meet minimum County and State requirements. These standards demonstrate basic compatibility. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Lisa Kay Ziel is hereby granted a Use Permit in accordance with the application filed: August 18, 1997, to allow a mini-ranch to serve challenged, abused, and traumatized children in an AR-1 (Agricultural-Residential, 1-acre minimum parcel size) zone, identified as APN 068-130-060, at 15 Palermo Drive, Oroville. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. ■ Butte County Department of Development Services ■ Planning Division ■ 5 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. An Initial Study was completed in compliance with the California Environmental Quality Act identifying potentially significant environmental effects that the project may have. Provisions and the design of the project and the conditions added to the project will mitigate such effects to a level of insignificance; and B. The design of the proposed project improvements will not cause environmental damage to fish or wildlife or their habitat; and. C. The Planning Commission has independently reviewed, analyzed and considered the proposed Negative Declaration with mitigation measures prior to making its decision on the project, and the Negative Declaration reflects the independent judgement of the County of Butte; and Section 2: Zoning Ordinance Findings. A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding property or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: 1. The character of the area is agricultural residential and rural residential, and 2. The AR-1 zoning of the property and the size of the property allows agricultural uses, including the keeping of large animals; and 3. The physical characteristics of the site including available parking, access, sewage disposal, and water availability, and will accommodate the proposed use; and 4. The number of vehicle trips generated by the proposed use is consistent with a residential area; and ■ Butte'County Department of Development Services ■ Planning Division ■ 6 5. The operating hours of the proposed mini-ranch are compatible with residential uses; and 6. Conditions have been proposed that will reduce noise, odor, and dust impacts to a less than significant level; and B. The proposed project is conditionally consistent with the AR-1 Zone and is a Secondary Use under the Agricultural-Residential General Plan land use designation; and Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit for Lisa Kay Ziel on APN 068-130-060 to allow a mini- ranch to serve challenged, abused, and traumatized children. Approval shall be subject to the following conditions: B. Conditions of Approval: 1. Limit soil wofk to periods of dry weather between April 15 to November 15. Mulch protect, Hydro-seed, or otherwise stabilize the soil on all areas that have been disturbed or have been cleared of vegetation and are of erodible material. (MM) 2. The access road and all parking areas shall be covered with at least two (2) inches of Class 2 aggregate material and maintained thereafter. (MM) 3. Watering of the project site shall be performed if dust is raised during construction activities. Dust shall also be kept to a minimum on the access road and the parking areas. (MM) 4. Animal waste shall be disposed of so as not to cause excessive odors or pollute water runoff in accordance with Environmental Health Division requirements. (MM) 5. Noise-generating construction activities on the project site shall only occur between the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday. (MM) 6. Activities associated with the proposed use shall be prohibited from the hours of 6:00 p.m. to 8:00 a.m. (MM) 7. All outside lighting fixtures shall utilize "low spillover" design where all direct lighting shall remain on site, allowing only reflective lighting to spillover into those areas off site. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 9. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 10. Prior to the issuance of building permits obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. 11. Prior to the recordation of the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and/or conveyed to the nearest natural or,publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. 12. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. I hereby declare under penalty of perjury that I have read the foregoing conditions, that they are in fact the conditions which were imposed upon the granting of this use permit, and that I agree to abide fully by said conditions. We have held public events at the Paradise Horse Arena during this time with support from a variety of community groups. Among them are the Paradise Horseman's Association, Paradise 4-H Club, Paradise VFW Women's Auxiliary, the Women's Grange Club, California State University of Chico, Walmart Corporation, the Boy Scouts, Paradise Parks and Recreation Department, many local merchants of Paradise and the Paradise Eagles. The Fraternal Order of Eagles adopted this local project to support shortly after its inception. From this Aerie's dedicated support it has grown to state wide support by this community service organization. LAND USE PROPOSAL As Miracles Rein is a non-profit organization our plan is build a mini-ranch here at 15 Palermo Drive in Oroville in the County of Butte, State of California. This ranch will serve the challenged, abused and traumatized children of Butte County, those in this segment of our society who are so often ostracized and ridiculed. Often passed by because they are judged not normal and unable to function in our society, somehow not deserving or being able to appreciate "normal" society. This will be a unique environment where all children with challenges (physical, mental or emotional) can be accepted with no expectations placed upon them to "perform" and no judgements made of their abilities, their families or their friends. A place where love is given unconditionally. We plan on. an riding arena and having horses for the children that are able to .sit astride to ride and a pony cart for those that cannot. There are plans also for a small petting zoo for those children that do not wish, for whatever reason, to ride. We plan an accessible area where the children can participate in "classes" in art and dancing and their efforts can be displayed as they wish. The environment will not only be recreational but educational too. Natural therapeutics will occur without formal therapy. These will be physical, by riding and or moving about, mental and emotionally by being accepted as a person is without expectations. This creates a social enhancement for all as individuals. (SB) (UP98-03) (VIDEO) A video of the site was shown. Mr. Betts gave a brief summary of the project. It was noted that many letters and petitions have been received in opposition to this project. There are a couple of letters in favor of the project. Mr. Betts said there has been concern expressed about Ms. Ziel's non-profit status and a disputed easement on the south property line. He said the permit could be conditioned to not allow any structures within the alleged 18 ft. easement. Mr. Betts said parking is set aside next to the access road. In answer to a concern voiced by Commissioner Cage, Mr. Betts said there are fire hydrants in the area. The hearing was opened to the public. Lisa Ziel said she is the Director of a non-profit organization and has not received her federal number yet. She said she wants to create an atmosphere of safety for the children. This request is to allow therapeutic riding, with a petting zoo (3-4 animals) and a craft center. She said it is her intention to fence the property. She said she is looking at 4 horses. She said there is no right-of-way on her deed for the south property line. She said she has read the petitions and letters opposed to the project and does not agree with their assessment. She stated she has been verbally attacked personally by the neighbors and would like it to stop. She said some of the letters are alarming to her. She said one letter was threatening. She admitted it was a mistake to not invite the neighbors over to discuss this proposal. She said she was concerned with more abuse by neighbors if this permit is approved. She said this is not a care home, but a recreational facility. Commissioner Leland said the Commission should focus on what is relevant. He asked that the speakers not discuss the tax status or easement issue as these issues are not under the control of the Commission. Mr. Betts explained that there is an alleged 18 ft. easement along the southern property line. Michael Douglas said he has a challenged child and is in favor,of this permit. He said he has helped deliver lumber to the property and will be helping with maintenance of animals and stalls. He said he is behind Lisa 100 %. Lisa Dugan submitted three photos of her child riding, showing the safety measures taken while the child rides. She said her child is autistic, and this program has brought incredible results in helping her child. He said a neighbor has 37 ft. of Ms. Ziel's property under fence. He said they had a survey of the property done and doubts there is an easement on the south side. He was in favor of this permit. Ella Mae Brich said she was in favor of the project. She said the activities can be very beneficial to a handicapped child. Maryilyn Franks submitted a letter from Wayne Bell in opposition. She discussed the group home down the road and the heavy traffic that has caused. She said Plumas - Drive is very narrow. She was against this proposal. She said the road can not handle the increase in traffic. She wanted no more than 2 horses be allowed if this is approved. She discussed the noise from a petting zoo. She discussed a fire break• being necessary. She asked if Ms. Ziel was qualified for this type of care giving. Lynn Wicksom, owns parcel directly west of property, said her property is land locked and that is why the need for the easement. He said the applicant's property drains into his property. He did not want a public use in a rural area. He asked if the use permit would terminate if the property was sold. He said there should be a traffic study done on Ward Blvd., Plumas Drive, and Palermo Drive. He said there should be no dormitory or additional home allowed. The right-of-way should be open on the south property line and there should be watering to prevent dust if this is approved. Lola Cecchi said the application says no overnight lodging, but the brochure says there will be a bunkhouse. She did not believe the land was big enough for this type of project. She said if this is approved there should be no overnight accommodations allowed. Linda Haddeman said she is in favor of the project. She said she sold the property to Ms. Ziel. She believed that many of the concerns could be worked out if the applicant and neighbors work together. Charles Vonberg said he was concerned with the dispute over the easement. He discussed adequate fencing for horses. He asked who monitors the conditions for compliance. Mr. Sanders said the neighbors can contact the Planning Division if the conditions are not met. He explained the procedure. Helen Foster said the problem is that the roads are too narrow for this use. She said people want to live in the country where it is quiet. Floyd Scott said he lives on Plumas Drive and is concerned with traffic. Claude Dryden said the people in favor of the project do not live here. Lisa Dugan said her autistic child is involved with a trained therapist and would not be a problem. August Byays, 12 Palermo Drive, Oroville, requested a copy of the minutes from today's meeting. Ms. Ziel said she just wants to provide a safe place where children will be accepted. The hearing was closed. Commissioner Nelson asked why a use permit was required in this case when they are not required for a day care of 6 or under? Mr. Sanders said a Use Permit is required because the use would be opened to the public. Commissioner Cage asked about liability insurance? Mr. Betts said this was not a condition of the permit. My wife and I originally chose this area to move to because it was quiet ,away from the city, and a good place to raise children. The area is perfect for our family and for those that live about us. We have watched our family's growth and continue to watch others grow. Now, it seems that our street is to be used for group homes which allow for buses more people and more congestion. Our roads are small and we like it that way. Already there are large buses driving the length of it. All this to accommodate persons in a home at the end of Plumas Drive. We still do not understand how Butte County with all their codes, allowed that to happen? It seems that there were (are) many code discrepancies that exist now and that were allowed in the beginning. I do not remember any application for a use permit for us to sign! We, Darlene and Myself, are not against group homes. Our concern is for the area. With all the many places that exist, with much more land and away from existing families, why choose an area with small family oriented homes? It does seem reasonable to choose an area more suited to a ranch setting, possible further out with more area. We do not think that our neighborhood should be used as a dumping ground for group therapy. With all due respect for those attempting such an endeavor, I do not think it belongs in our small area. We want to protect our choice of a home environment of Life, Liberty and the pursuit of happiness for as long as we have left to live. I do not want others to ruin our "dream". Ziel APN 068-130-060 Dear Ms. Lambert, Thank you for this opportunity to present my concerns and questions about the above referenced application. I am the owner of and reside at 12 Palermo Drive(APN 068-130-087)which, is located at the southwest corner of Plumas and Palermo drives. My home is immediately across Palermo Drive from the entry to Ms. Ziel's proposed Miracles Rein project. I have reviewed the Staff Report.for the project. I have also read the Eagles Magazine (summer 1997 issue with articles about the project), the first issue of the "Where Miracles Happen" brochure and the November 10 story about the project in the Chico Enterprise Record/Oroville Mercury-Register. The Staff Report cites the quasi-public definition as applicable to the project and that the facilities will be for "challenged, abused and traumatized children." Further, the report states that Ms. Ziel will operate and maintain the facility by herself with, perhaps, one part-time employee. The report also states that only 2 to 3 children will use the facility at any one time and there will be no overnight stays at the ranch. The report is very clear that failure to comply with the conditions which were the basis for the application would constitute a revocation of the permit. I am concerned, based on what I have read, that the project does and will not comply with the conditions on the application. There are noticeable contradictions between what is stated on the application and what is discussed in the other above mentioned documents including the range of handicaps the children will have, the construction of a bunkhouse, the number of horses used in the project and the proposed (but undefined) special events slated to be hosted on the property as well as proposed services for the children's parents/caregivers. My specific concerns regarding these contradictions and the proposed project include: Planning Division N 0 V 1 7 1997 Oroville,California /0C • The apparent plans of the operator to expand the-breadth of the program, including who is served ("physically, emotionally and mentally challenged children" as well as their parents/caregivers). • The ability of one person to successfully and safely manage 2 - 3 children plus 4 - 8 horses, including "a frisky mustang captured in Nevada that will test the limits of any teenager," in an "unstructured environment." • The building of a bunkhouse when the application states that there will be no overnight guests. • The exacerbation of neighborhood traffic problems on the area's narrow roads when undefined "special events" are hosted and people are coming and going from this "unstructured environment." Currently, no traffic mitigations are included for this traffic impact. • The increased potential for the violation through trespassing, vandalism, etc. of neighboring residential properties by the influx of"strangers" in the area through this "unstructured" project. Again, while the report is very clear that failure to comply with the conditions which were the basis for the application would constitute a revocation of the permit, I am concerned that the project does and will not comply with the conditions on the application and have to ask who and how will the project be monitored for compliance? Does this project really qualify as a quasi-public use or is it, in fact, an appointment only facility, with only 2 - 3 children using it at one time? Will any traffic mitigations be included for traffic impacts? At this juncture, I do not believe that a reasonable finding regarding the project can be made since the submitted proposal does not address the above issues and questions. This project will impact the neighborhood and without the inclusion of suitable mitigations and conditions these impacts will adversely effect the quality of life of those of us who have made our homes in this neighborhood. Further, without the inclusion of clearly defined mitigations and conditions the impacts will (based on the information is the referenced written material) only increase. I urge you to deny the application as submitted. As a responsible public servant, I know you will answer my questions and address my concerns. For that, you have my sincere appreciation and gratitude. Butte County Staff has recom- mended approval of this use; I believe this recommendation is in error and does not fully account for the adverse affects this incon- sistent use will have on our neighborhood . Our roads in this neighborhood could be described as, at best , narrow country lanes. There is already too much traffic , traveling too fast , for the current infrustructure to safely accommodate. That there has been relatively few accidents in this area is simply amazing to me. Of course, the neighbors understand the challenges of these narrow roads and have courteously applied caution to their daily drive, but I am extremely troubled at the prospect of having those less familiar with our roads further congest the neighborhood and thereby exacerbate the potential for serious accident . I have two small girls and I can assure you I take this very seriously. Enclosed in the agenda report under the heading of project Characteristics, it states that there will be a petting zoo with goats,potbelly pigs, and rabbits. Additionally it states there will be four to eight horses on the property 5.96 acres in size. We are very concerned about the large number of animals on a property this size. We feel that the noise generated will be excessive. We are also very concerned about the health risks due to large amounts of animal waste. We feel that it is very unrealistic that one person, with possibly a part time helper can adequately remove the waste along with all of the other duties proposed in this project. The increase in traffic is also a great safety concern. These are narrow, poorly developed, country roads without sidewalks. There are many children in the area that have to walk to and from the bus stops and we feel the increase in traffic will greatly jeopardize their safety. Not only are.the children faced with increased risk, but also are the many people that jog and ride their bikes. We have already felt the impact of increased traffic in this area and are strongly opposed to any projects that will cause even greater increases. Also in the project characteristics it states that `no over night stays are proposed', yet upon researching this project, we were told by a fund raiser for the project that dormitories would become a part of the plan as soon as licensing could be obtained. The analysis of the project states that `the proposed use will change the land use from its current residential use...and will not have a significant impact to the neighborhood'. As residents of the neighborhood, we strongly disagree with this statement. It will have a great impact on all of the residents of this neighborhood. Because.in 1995, the commission approved a home for challenged, abused, and traumatized children at 350 Plumas Drive. Our t raf f i c of vehicles has increased ten-f old with work training buses, caretakers an-d home owners and off Plumas Drive. Plumas Drive has been measured'in width: Ward and Plumas Drives - 16 feet, Palermo and Plumas Drives - 14 feet wide, Putnam and Plumas Drive 11 feet wide. This is a very dangerous situation The Drive is not wide enough for school children walking to the bus, joggers and walkers now with all the traffic. The road was tarred in 1967 and 1995. It has never been improved There has already been a terrible accident at the corner of Plumas and Palermo Drive. People drive down the center of the road because it is too narrow. A car crashed right into a truck driving on his correct side. The truck was completely demolished. I hate to think what would have happened if the school children were walking to the bus. Has an Environmental impact Study Report been researched on this road? Was a road counter put on this road in 1995? Has a new study of a road counter been put on Plumas Drive to count the increased traffic? I must emphasize the percent of incrase as subjective to these.findings as judgemental. This parcel drawings are not to scale, they are a quick sketch only. My concerns for this site of 5 acres, 15 Palermo Drive are: 1. That it be stipulated that this is only a day care center, only with 2 - 3 children under 18 ,years of age and Mrs. Zei 1. 2. No overnighters or overnighter caretakers. 3. No more than 2 horses on this parcel of land. 4. That 2 - 3 sMpecial events take place per year,NOT ON HOLIDAYS. / _ 4� 5. That the sanitation on this property be strictly adhered to because this situated parcel will bring flies, mosquitoes and noise and that outhouses are not condusive to our environment in Butte County. 6. As we are neighbors along the west border.we would be subjected to unwanted:. -dust from the proposed arena and riding activities. -drainage from animal waste;bathroom leach fields,stalls,and corrals seeping downhill to our property. -odor's from animal waste. -noise from the public uses proposed - excessive flies from breeding in animal waste. 3. The County Roads are unsuitable for the increased traffic.that will be generated by activities proposed by the use permit. We believe property values will be adversely affected by the granting of quasi-public use of any kind in this neighborhood. Standard construction techniques will be required as part of the construction process of this site. Limiting site construction and soil disturbance to the dry seasons and stabilizing the site prior to the on-set of winter rains will reduce this impact to a less than significant level. Another mitigation will require that the parking spaces and the access road be graveled with at least 2 inches of Class 2 aggregate material. Therefore, significant erosion impacts are not expected to occur. The proposal will require some excavation or grading for driveways and level building sites. Any fill placed on site will have to meet the requirements of Chapter 70 of the Uniform Building Code and will be compacted to accepted engineering standards and will not represent a hazard. Therefore, the project will not create any unstable earth conditions or result in changes to geologic substructures. Once all of the proposed structures are completed, approximately 2%of the project site will be covered by structures, and approximately 2.0 covered by graveled parking areas. Minimal changes in absorption rates and drainage patterns may occur due to impervious coverages from the new structures. The Department of Public Works is requiring a plan for a permanent solution for drainage be submitted prior to issuance of a building permit. The plans will show how drainage waters will be detained on site and/or conveyed to the nearest drainage channel. The plan will provide that there be no increase in the peak flow runoff off the site. In addition,the two mitigations found in Item 3 will reduce erosion impacts to a less than significant level. The proposed use will include the use of four to eight horses and other animals, such as goats,pot belly pigs, and rabbits. Wastes from these animals, if left on the ground, could lead to a significant impact to the quality of surface water runoff from the project site, and potentially pollute downstream surface waters and groundwater. A mitigation in Item 5 requires that the wastes from the animals on the project site be disposed of so as not cause an excessive amount of odor or water pollution. This may require taking animal wastes to the county landfill. Mitigation: None required. 5. AIR QUALITY. Continued disposal of waste from the additional horses and other animals in this manner may create an odor that can be noticed off the project site and could affect the water quality of surface runoff'. In order to prevent these odors, the applicant will be required to properly dispose of waste created by the animals. The AR-1 zoning allows agricultural uses, including the keeping of animals, as a permitted use. The Butte County Code provides for abatement actions if animals on a parcel cause a nuisance, such as excessive noise or odors. If the animals on the project site become a nuisance because of excessive odor, the County can take action to abate the nuisance by requiring animals to be removed from the project site. Mitigation # 3: Watering of the project site shall be accomplished if dust is raised during construction activities. Dust shall also be kept to a minimum on the access road and the parking areas. Mitigation #4: Animal waste shall be disposed of so as not to cause excessive odors or pollute water runoff in accordance with Environmental Health Division requirements. 6. TRANSPORTATION/CIRCULATION. Would the proposal result in: a) Increased vehicle trips or traffic congestion? The Butte County Code provides for abatement actions if animals on a parcel cause a nuisance, such as excessive noise or odors. If the animals on the project site become a nuisance because of excessive noise,the County can take action to abate the nuisance by requiring animals to be removed from the project site. Noise may also be generated by the children participating in activities on the project site. These noises will be short-term in nature, will not exceed accepted noise levels for residential areas and therefore not be significant. Noises from activities on the project site during the night hours could cause a significant impact to the residents on the adjacent parcels. In order to reduce this impact, a mitigation of this project will prohibit any activities associated with the proposed use from occurring between the hours of 6:00 p.m. to 8:00 a.m. Mitigation#5: Noise-generating construction activities on the project site shall only occur between the hours of 8:00 a.m.to 5:00 p.m.,Monday through Friday. Mitigation#6:Activities associated with the proposed use shall be prohibited from the hours of 6:00 p.m.to 8:00 a.m. 11. PUBLIC SERVICES. The Butte County Fire Department is requiring that all new structures meet the requirements the California Fire Safe Regulations (PRC 4290) and that building identification and/or addresses be installed in conformance with PRC 4290. These will be added as a conditions of project approval. Approval of this project should not result in a need for new or altered government services(see comment responses from government agencies).
