The North Chico Specific Plan allows a maximum building coverage of 15% of the lot area. The property is zoned SR-1 (Suburban Residential — 1 acre parcels) and is located on the north side of Lindbergh Circle, approximately 1,100 feet north of Guntren Road, Chico area. APN 047- 740-009 (SB) (VAR 03-01) Mr. Betts informed the Commission that Mr. Schuster would like a decision made today. Commissioner Evans said he was absent at the January 9,2003,meeting and asked if the figure for 15% coverage is the lowest coverage area in the NCSP and is it correct that staff is not sure where the figure came from? Mr. Betts said the concern was drainage and aesthetics. He said in the drainage section of the EIR and in the Specific Plan itself, there is no mention of runoff from individual lots. He noted that the Specific Plan references structures and that staff did not include impervious surfaces. Mr. Wannenmacher said in answer to Commissioner Evans question,that on the chart attached to the report, the lowest percentage coverage is 10% in the SR-3. Commissioner Evans said the house and garage are structures that go into the 15% coverage, but pools, tennis courts, etc. don't. Mr. Betts said he believes a covered walkway is considered a structure. Chairman Lambert said she can not make the findings to change the requirement with a Variance. Commissioner Evans agreed that they could not make the findings for special circumstances. Commissioner Marin said 15% coverage is too low a number to impose on the lot and where the neighbors have no objections he was inclined to approve the variance. The hearing was opened to the public. -No one was present to speak on this item. The hearing was closed. Chairman Lambert said the problem is in this case the 15%was specifically applied to this area in a Specific Plan. Commissioner Leland said the County has the rule and this application does not meet the rule and he would vote against approval. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■JANUARY 9, 2003 ■ PAGE 15 ■ M Chairman Lambert noted that the owner can reduce the size of the dwelling, or he can build his home and come back with a proposal to amend the Specific Plan and later build the garage if the restriction is changed. Mr. Wannenmacher read the procedure out of the County Code to amend the Specific Plan. Commissioner Evans did not think the Commission had the authority to change the requirement as set forth in the Specific Plan. It was moved by Commissioner Leland, seconded by Commissioner Evans, and carried to deny the Variance request by Stephen Schuster because it does not comply with the density criteria and can not meet the condition of granting a Variance by the following vote: AYES: Commissioners Nelson, Leland, Evans, and Chairman Lambert NOES: Commissioner Marin ABSENT: No one ABSTAINED: No one j i ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JANUARY 9,2003 ■ PAGE 16 ■ ti � • Stephen J. The North Chico Specific Plan allows a maximum building coverage of 15% of the lot area. The property is zoned SR-1 (Suburban Residential — 1 acre parcels) and is located on the north side of Lindbergh Circle, approximately 1,100 feet north of Guntren Road, Chico area. APN 047- 740-009 (SB) (VAR 03-01) Mr.Betts gave a brief summary of the project. He said it was determined that the pool and barbeque is not considered as part of the coverage area. Mr. Betts did a power point presentation. He corrected the report stating the coverage area would be 2 1.1% instead of the 15% coverage area that is allowed. He said the North Chico Specific Plan(NCSP)has a 15%lot coverage requirement for aesthetics . He said this small increase will not cause an aesthetic problem. Vice Chairman Lambert said the NCSP sets out specific requirements and she did not think there should be any variances allowed. Commissioner Leland said.he could not make the finding that this property was being denied what other property was allowed. He did not see any way to approve a variance. He discussed the possibility of changing the zoning to eliminate the restriction. Vice Chairman Lambert said she would rather amend the NCSP than to grant a variance. Mr. Betts submitted a letter from the neighbors asking that this be approved. The hearing was opened to the public. Bill Brower said that no one can tell him where the 15% figure came from when the NCSP was adopted. He noted that everyone in the neighborhood signed a petition in favor of the variance. He discussed the Specific Plan and the means to make changes with regard to the Specific Plan. Commissioner Leland asked where are the findings needed to grant a variance. He said findings can not be made because of size,shape,or topography of the property and nothing deprives the property of privileges enjoyed by other property in the vicinity. Mr. Brower said that changing the General Plan would not solve Mr. Schuster's problem because of the time it would take to process a General Plan amendment. He said the standard is questionable as to how it was created. Commissioner Leland said the Commission might have discretion to determine the coverage ratio and what that consists of, i.e.,paving,buildings, structures,or just livable space. He said since this is probably an aesthetic issue the Commission is looking at buildings including garages,balconies, patios, etc. Commissioner Marin asked staff what is the purpose of a variance. Mr. Betts said a variance is granted to allow a different standard than what is required. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JANUARY 9,2003 ■ PAGE 10 ■ • Mr. Wannenmacher pointed out that no special circumstances have been identified in order to approve this variance. Commissioner Marin felt the variance could be approved. He said a variance is to help people do what they want to do and where everyone is in agreement, staff, the applicant, the neighbors, he would agree with granting this variance. Vice Chairman Lambert explained the history of the NCSP. She said a lot of thought and hard work went into creating this Plan. She said the SR-1 zone is different within the NCSP and it was hard fought to be established. She said she has difficulty in making findings on a variance today. Mr. Wannenmacher explained what it would take to amend the Specific Plan. Commissioner Marin suggested that this hearing be continued so they can have a full Commission present. Mr. Brower asked Counsel if he had pre-read the recommendation. He suggested that maybe the Director could use her discretion to approve this variance. Commissioner Leland said that staff does not have the discretion to approve this, only the commission. Mr. Brower said that the Director has discretion every day to interpret the standards. Yvonne Christopher,Development Services Director,said she does not have the discretion to act on any item under the Zoning Code, and that all items go to the Commission for public hearings. Commissioner Leland asked Ms. Christopher what would have to be done to a Specific Plan to change the standards. Ms. Christopher said this might seem like a simple change, but the County is in the middle of a County General Plan update and this change could take a long time. She said staff would need to look at the whole NCSP if the Plan is opened up for any kind of discussion. Mr. Brower asked about entering into a Development Agreement to change this requirement in the . Specific Plan. Mr. Alpert, County Counsel, said he was skeptical of entering into a Development Agreement. Mr. Brower said-it might be better to have the Commission deny this item so it can be appealed to the Board. Ms. Christopher pointed out that if the Commission can not make the findings,the Board would not be able to make the findings either. He said he is trying to build a nice home in a nice area. He said he would not want to wait another year to build his house. PROJECT DESCRIPTION The applicant requests approval of a variance to allow building coverage on a parcel to be 24%. The North Chico Specific Plan (NCSP) allows a maximum building coverage of 15% of the lot area. The 15% maximum building coverage is a development standard that is found in the SR-1 zone of the North Chico Specific Plan. The SR-1 zone outside of the North Chico Specific Plan area does not have a maximum building coverage standard. The applicant intends to build a two-story, 6,043 square foot single family dwelling on a 43,389 square foot (0.996-acres) parcel. This equates to 13.9% coverage of the lot. The project site would also be developed with two garages totaling 1,730 square feet (4%), seven porches that ■ Butte County Planning Commission Agenda Report 0 Page 1 ■ total 1,401 square feet (3.2%), an 800 square foot swimming pool (1.8%), and a 300 square foot BBQ area (0.7%). These structures would result in a building coverage of approximately 23.3% of the parcel's surface. The net area of the project parcel is 38,739 square feet , with a gross area of 43,389 square feet. 4,650 square feet of the parcel is within the road easement for Lindberg Circle. The NCSP does not specify whether net or gross acreage is to be used in calculating the building coverage. The percentage of building coverage was calculated based upon the gross area of the parcel. PROJECT SITE DESCRIPTION The property is undeveloped. The project site is level with no topographic features that would create a hardship for the property. Sewage disposal will be handled by a community sewage disposal system and domestic water supplied by an on-site well. The parcel fronts on Lindbergh Circle, with access to Garner Lane via Guntren Road. The project site is located in a new 30-lot subdivision (Pheasant Landing Unit III) that is being gradually developed with large, conventionally-built luxury homes. ANALYSIS The North Chico Specific Plan and the Draft Environmental Impact Report (EIR) for the North Chico Specific Plan were reviewed to determine the reason for the inclusion of the maximum building coverage for parcels in the Plan area. In the Visual Resources element of the NCSP Draft EIR, an impact was identified with respect to visual resources: Implementation of the Specific Plan will alter the existing visual qualities associated with rural characteristics south of Mud Creek. With implementation of Specific Plan elements, this will be a less-than-significant impact. It should be noted that this impact only identifies visual impacts south of Mud Creek. The project site is located well north of Mud Creek. Under Project Elements that Mitigate Impact section (page 8-3) of the Visual Resources element, the following policy is found: Inclusion of development design standards in the Specific Plan that address issues of building size, mass, design, landscaping, and other design components, as well as road standards, can help achieve development scale and appearance that blends with and contributes to the existing rural quality of the area. The NCSP implements the above policy in the Development Regulations and Design Guidelines found on page 7-11 and in Table 7-2 (Summary of Zone District Development Standards), both of which are attached to this report. The development regulations and design guidelines apply to all parcels in the SR-1 zone in the Plan area, not just to parcels located south of Mud Creek. 0 Butte County Planning Commission Agenda Report 0 Page 2 ■ 0 It would appear that the maximum building coverage was designed to help prevent structures from creating significant aesthetic impacts. Larger structures have the potential to cause aesthetic impacts by blocking neighbor's views. The North Chico Specific Plan limits the height of structures in the SR-1 zone to 35 feet, which could limit impacts,but that there is no minimum landscaped open space required in the SR-1 zone. The NCSP does not include a definition of"building coverage." Butte County Code section 24- 305.050 defines a building as "any structure having a permanent foundation and a roof supported by columns, or by walls designed, intended and/or used as shelter for the enclosure of persons, animals, chattels, or for use in commercial, industrial or other enterprises." Additionally, Butte County Code section 24-305.430 defines a structure as "that which is built or constructed, an edifice or building of any kind, or any piece of work, artificially built up or composed of parts joined together in some definite manner." The Director of Development Services determined that building coverage includes patios and swimming pools. Findings for Approval In order to approve a variance, the Planning Commission must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that cause a variance to County code to be necessary (Butte County Code section 24-50.10). Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. The project site does not contain any topographic features that could be considered a special circumstance. The size of the parcel could be considered to be a special circumstance; the parcel is too small to accommodate the size of the dwelling that the property owner wishes to build, given the restrictions regarding maximum lot coverage. Larger homes have become more common over the last ten or so years throughout the Chico area. Larger dwellings, like the house that is proposed to be built on the project site, were most likely not contemplated at the time the North Chico Specific Plan was written. A special circumstance could be that dwellings being constructed in the new subdivisions in the project area are much larger than what the NCSP considered. Some of the structures that are proposed to be placed on the project site, such as the swimming pool, porches, and the BBQ area, would not create significant visual impacts since they would not be large structures that would significantly a neighbor's view. The swimming pool in particular would not create any visual impact since for the most part it would not extend above the surface of the ground. No attempt was made by Planning staff to determine if other parcels in the North Chico Specific Plan area exceeded the 15% building coverage maximum. Some of the parcels in the Plan area may exceed the 15% percent lot coverage due to their size in relation to the larger homes in the area. 0 Butte County Planning Commission Agenda Report 0 Page 3 ■ From staff's review of the NCSP it is difficult to determine why a 15% lot coverage restriction is imposed. From an aesthetics standpoint, the proposed dwelling would be similar in style and design with many of the luxury homes already developed in the project area. Percent lot coverage can also influence drainage characteristics and impacts, but in this case, drainage for the subdivision has been mitigated through on-site retention, which has already been developed. Even with the approval of this variance, fully 76% percent of the lot will be left undeveloped. The Drainage Element of the North Chico Specific Plan Draft EIR did not mention limiting building coverage on a parcel as a means of helping to reduce stonmwater drainage. Alternatives The most logical alternative would be to reduce the size of the proposed dwelling and accessory structures so that the building coverage would be no greater than 15%. However, this would not allow the property owner to build the house and structures he desires. A lot line adjustment with the adjacent parcels to increase the size of the project parcel could not be approved because these parcels are already at the minimum parcel size. A merger with the undeveloped parcels adjacent to the project parcel may not be feasible because of the expense and/or because no one may be willing to sell their parcel. Other Issues The Butte County Building Division, Fire Department/CDF, Public Works Department, and the Environmental Health Division did not object to the project or recommend any conditions. Conclusion The special circumstances noted in the previous sections allow for the findings necessary to grant this variance and indicate that the adjustment authorized would not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305(a) - Minor Alterations in Land Use Limitations, Class 5, of the CEQA Guidelines exempts variances to setbacks not resulting in the creation of any new parcel. II. Approve Variance 03-01 for Stephen J. Schuster subject to the following findings and conditions found in Exhibit A: 0 Butte County Planning Commission Agenda Report ■ Page 4 0 0 • A. The increase in maximum building coverage from 15% to 24% would not create a significant visual impact to the project area. 2. Many of the proposed structures, such as the swimming pool,porches, and BBQ area are not tall structures and would not impact any neighbor's views. 3. 76% of the lot would be undeveloped with structures. 4. Dwellings much larger than have previously been developed in the project area are being constructed on the parcels in newer subdivisions in the project area. 5. The increase in building coverage would not cause a significant increase in stormwater runoff. The additional stormwater runoff caused by the increase in building coverage can be adequately handled by the retention pond serving the subdivision that the project site is located in. 6. The problem and the reason for the request for a variance are a Lot%coverage issue. The property owners,their architect, and my self have worked for almost a year putting together a plan for the Burrington Family. We submitted their plan for plan check back in August and only heard of this coverage requirement, as the plan check was nearly complete. As you can see on the site plan provided the actual living sqft is only 13.8 % with the garages at 4.2%and covered porch areas at 3.2%bringing the total coverage up to 21.2%. If we went with one small garage and no porches to provide needed shade we could make the 15%coverage,but this is not practical. In addition to the home sqft the owners of lot 10 wish to enjoy their back yard by building a pool and a covered BBQ area . which brings the sqft coverage up to 23.7%. I have talked with county staff as to the origin of the 15%rule. No one knows where it came from and as of today this is the only home that has been denied a permit because of it. I have contacted Stephen Honnycutt of Heritage Partners,the designer of the North Chico Specific Plan,as to the reasoning for the 15% coverage rule ori only SR-1 lots. He also does not know and was surprised by the rule. As the Developer of Pheasant Landing subdivision, and other subdivisions in the area, this home design and size fits the character of the development, which consists of other large custom. VISUAL RESOURCES I � EXISTING CONDITIONS The Plan area is located in a setting characterized as being primarily rural in nature. There are several developed residential subdivisions in the study area that are surrounded by open fields with scattered areas of orchards and some row crop production. The transition between open lands and residential development located on generally large lots, the low density nature of existing development, and the presence of open fields, barns, and other agricultural structures help establish a visual quality usually associated withrural settings. Existing narrow roads also contribute to the sense of"rural atmosphere" that is evident in the area. The majority of the Plan area is flat, although.slightly sloping terrain is found in the northern portion of the project area along Keefer Road. There are no significant physical landforms that represent outstanding scenic features or resources. Topography is slightly more varied in the northern portion of the study area along Keefer Slough and Keefer Road, where it becomes more rolling. Tree cover also increases in this area with oak woodlands found north of Keefer Road and riparian habitat associated with Rock Creek. An oak-lined plateau/ridge surrounded by rolling oak grasslands is located outside and immediately adjacent to the project area south of Keefer Road and east of Hicks Lane. Several drainageways traverse the project area, and in conjunction with localized areas of native tree cover and orchards,provide an element of visual relief and interest over otherwise flat and open fields. These creeks are dry most of the year and have little or no tree cover or riparian habitat present adjacent to the banks. Rock Creek at the northern portion of the project area, however, does partially support oak woodland and riparian habitat. Within the project area, two types of views or vistas are prominent, depending on whether the area is undeveloped or developed. In undeveloped portions of the study area, expansive panoramic views of large, open fields are present. In these areas, open grassland, rangeland, and agricultural fields are the primary elements of foreground and midground views from roadways and area residences. The most distinctive visual feature in these areas are long-range views of the foothills to the east, which frame views of the Plan area as seen from State Route 99, Hicks Lane and Keefer Road. The existing residential development in the Plan area is varied,ranging from large,older ranch homes to more modern, smaller residential subdivisions, such as the newer subdivision located east of State Route 99 and north of Sycamore Creek. Within existing developed areas, long- range views of the distant mountains often are obscured. Views are dominated by the immediate development in the neighborhood and associated landscaping and tree cover. In the northern portion of the study area along Keefer Road, lot size and tree cover increases. The oak woodland in this area is the primary visual feature, and also serves to screen development. The existing Songbird Subdivision north of Keefer Road provides a good example of 8-1 Visual Resources Draft Environmental Impact Report • � , North Chico Specific Plan development that has incorporated trees of a former orchard within the site layout and employed design features such as varied building orientation, open fencing, and staggered setbacks, which helps maintain a rural feeling. The scenic quality of a landscape refers to the overall visual impression that generally is influenced by several factors: landform, vegetation, watercourses and other prominent physical features, and type and extent of development, as well as important vistas, view corridors, scenic features, and/or notable landforms. In terms of visual resources, there are no significant visual features in the North Chico Specific Plan area. While there are areas of localized tree cover, drainage courses, and distant views of the adjacent foothills, there are no significant visual or scenic features that create an unusual scenic quality for the area. However, these same physical attributes contribute to the overall rural visual character of the area which also is defined by large expanses of open space with agricultural fields and structures interspersed with residential development. IMPACTS AND MITIGATION MEASURES Standards of Significance: Criteria for determining significant visual impacts include loss of major vistas, blockage of view corridors, alteration of significant landforms, andlor development that is out of scale with the character of the surrounding area. Impact: Implementation of the Specific Plan will alter the existing visual qualities associated with rural characteristics south of Mud Creek. With implementation of Specific Plan elements, this will be a less-than-significant impact. The proposed 1- to 3-acre lot sizes north of Mud Creek are consistent with existing development patterns in that area and future development will be of a similar scale associated with the existing semi-rural character of the area. The area between Mud Creek and Sycamore Creek is the planned location of the higher density "Village Core" area. Development in this area will result in a more urban appearance. The area generally is buffered from the larger-lot areas north of Mud Creek by the existing drainages and planned greenbelt areas. The intensity, siting, scale and design of future development will affect the overall visual quality of the area. Large, massive buildings without visual relief or architectural elements to break up building mass are not incorporated into the overall design. Landscaping, or lack thereof, also can detract from the ambiance of the area if substantial amounts of ornamental species are used, which may not visually blend with native species found in the surrounding area. The Design Guidelines presented in Section 7 of the Specific Plan establish guidelines for development of commercial buildings, roads, and landscaping within the Village Core. The Plan also provides an extensive greenbelt network to break up development and provide buffers. The Burringtons purchased this lot with the intention of building a large Custom Home. Homes built or currently under construction are also large custom luxury homes. The Burringtons have worked with an architect and engineer for over a year at great expense designing their dream home. At no time were they aware that a 15% coverage existed. As far as we know this would be the first time that this 15% coverage rule has ever been enforced or encountered in the North Chico Specific Plan area. Any other SR-1 lot outside of the NCSP area would allow for this home to be built. Lot 10 was purchased by the Burringtons because of its North/South orientation. It was only after their plan was plan checked that this 15%coverage rule arose. We are requesting that this variance be granted because it places and unfair limitation on their rights to use and enjoy their property. I have included a petition signed by every lot owner in Pheasant Landing 3 Subdivision,which says they are in favor of the home being built in their neighborhood. PROJECT DESCRIPTION The applicant requests approval of a variance to allow building coverage on a parcel to be 24%. The North Chico Specific Plan (NCSP) allows a maximum building coverage of 15% of the lot area. The 15% maximum building coverage is a development standard that is found in the SR-1 zone of the North Chico Specific Plan. The SR-1 zone outside of the North Chico Specific Plan area does not have a maximum building coverage standard. The applicant intends to build a two-story, 6,043 square foot single family dwelling on a 43,389 square foot (0.996-acres) parcel. This equates to 13.9% coverage of the lot. The project site would also be developed with two garages totaling 1,730 square feet (4%), seven porches that 0 Butte County Planning Commission Agenda Report 0 Page 1 ■ I total 1,401 square feet (3.2%), an 800 square foot swimming pool (1.8%), and a 300 square foot BB area 0.7% . These structures would result in a building coverage of approximately 23.3% Q ( ) g g pP Y of the parcel's surface. The net area of the project parcel is 38,739 square feet , with a gross area of 43,389 square feet. 4,650 square feet of the parcel is within the road easement for Lindberg Circle. The NCSP does not specify whether net or gross acreage is to be used in calculating the building coverage. The percentage of building coverage was calculated based upon the gross area of the parcel. PROJECT SITE DESCRIPTION The property is undeveloped. The project site is level with no topographic features that would create a hardship for the property. Sewage disposal will be handled by a community sewage disposal system and domestic water supplied by an on-site well. The parcel fronts on Lindbergh Circle, with access to Garner Lane via Guntren Road. The project site is located in a new 30-lot subdivision (Pheasant Landing Unit III) that is being gradually developed with large, conventionally-built luxury homes. ANALYSIS The North Chico Specific Plan and the Draft Environmental Impact Report (EIR) for the North Chico Specific Plan were reviewed to determine the reason for the inclusion of the maximum building coverage for parcels in the Plan area. In the Visual Resources element of the NCSP Draft EIR, an impact was identified with respect to visual resources: Implementation of the Specific Plan will alter the existing visual qualities associated with rural characteristics south of Mud Creek. With implementation of Specific Plan elements, this will be a less-than-significant impact. It should be noted that this impact only identifies visual impacts south of Mud Creek. The project site is located well north of Mud Creek. Under Project Elements that Mitigate Impact section (page 8-3) of the Visual Resources element, the following policy is found: Inclusion of development design standards in the Specific Plan that address issues of building size, mass, design, landscaping, and other design components, as well as road standards, can help achieve development scale and appearance that blends with and contributes to the existing rural quality of the area. The NCSP implements the above policy in the Development Regulations and Design Guidelines found on page 7-11 and in Table 7-2 (Summary of Zone District Development Standards), both of which are attached to this report. The development regulations and design guidelines apply to all parcels in the SR-1 zone in the Plan area, not just to parcels located south of Mud Creek. 0 Butte County Planning Commission Agenda Report ■ Page 2 0 It would appear that the maximum building coverage was designed to help prevent structures from creating significant aesthetic impacts. Larger structures have the potential to cause aesthetic impacts by blocking neighbor's views. The North Chico Specific Plan limits the height of structures in the SR-1 zone to 35 feet,which could limit impacts,but that there is no minimum landscaped open space required in the SR-1 zone. The NCSP does not include a definition of"building coverage." Butte County Code section 24- 305.050 defines a building as "any structure having a permanent foundation and a roof supported by columns, or by walls designed, intended and/or used as shelter for the enclosure of persons, animals, chattels, or for use in commercial, industrial or other enterprises." Additionally, Butte County Code section 24-305.430 defines a structure as "that which is built or constructed, an edifice or building of any kind, or any piece of work, artificially built up or composed of parts joined together in some definite manner." The Director of Development Services determined that building coverage includes patios and swimming pools. i - Findings for Approval In order to approve a variance, the Planning Commission must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that cause a variance to County code to be necessary (Butte County Code section 24-50.10). Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. The project site does not contain any topographic features that could be considered a special circumstance. The size of the parcel could be considered to be a special circumstance; the parcel is too small to accommodate the size of the dwelling that the property owner wishes to build, given the restrictions regarding maximum lot coverage. Larger homes have become more common over the last ten or so years throughout the Chico area. Larger dwellings, like the house that is proposed to be built on the project site, were most likely not contemplated at the time the North Chico Specific Plan was written. A special circumstance could be that dwellings being constructed in the new subdivisions in the project area are much larger than what the NCSP considered. Some of the structures that are proposed to be placed on the project site, such as the swimming pool, porches, and the BBQ area, would not create significant visual impacts since they would not be large structures that would significantly a neighbor's view. The swimming pool in particular would not create any visual impact since for the most part it would not extend above the surface of the ground. No attempt was made by Planning staff to determine if other parcels in the North Chico Specific Plan area exceeded the 15% building coverage maximum. Some of the parcels in the Plan area may exceed the 15% percent lot coverage due to their size in relation to the larger homes in the area. 0 Butte County Planning Commission Agenda Report ■ Page 3 ■ l From staff's review of the NCSP it is difficult to determine why a 15% lot coverage restriction is imposed. From an aesthetics standpoint, the proposed dwelling would be similar in style and design with many of the luxury homes already developed in the project area. Percent lot coverage can also influence drainage characteristics and impacts, but in this case, drainage for the subdivision has been mitigated through on-site retention, which has already been developed. Even with the approval of this variance, fully 76% percent of the lot will be left undeveloped. The Drainage Element of the North Chico Specific Plan Draft EIR did not mention limiting building coverage on a parcel as a means of helping to reduce stormwater drainage. Alternatives The most logical alternative would be to reduce the size of the proposed dwelling and accessory structures so that the building coverage would be no greater than 15%. However, this would not allow the property owner to build the house and structures he desires. A lot line adjustment with the adjacent parcels to increase the size of the project parcel could not be approved because these parcels are already at the minimum parcel size. A merger with the undeveloped parcels adjacent to the project parcel may not be feasible because of the expense and/or because no one may be willing to sell their parcel. Other Issues I� The Butte County Building Division, Fire Department/CDF, Public Works Department, and the Environmental Health Division did not object to the project or recommend any conditions. Conclusion The special circumstances noted in the previous sections allow for the findings necessary to grant this variance and indicate that the adjustment authorized would not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305(a) - Minor Alterations in Land Use Limitations, Class 5, of the CEQA Guidelines exempts variances to setbacks not resulting in the creation of any new parcel. II. Approve Variance 03-01 for Stephen J. Schuster subject to the following findings and conditions found in Exhibit A: ■ Butte County Planning Commission Agenda Report 0 Page 4 ■ ! • A. This Variance may be granted because special circumstances applicable to the property exist, including size, location, or surroundings, and the strict application of the building coverage maximum would deprive the property owner of privileges enjoyed by other property owners, and would not constitute a grant of special privileges inconsistent with the limitations placed upon other properties zoned SR-1 in the North Chico Specific Plan area, as supported by the. following facts: 1. The increase in maximum building coverage from 15% to 24% would not create a significant visual impact to the project area. 2. Many of the proposed structures, such as the swimming pool, porches, and BBQ area are not tall structures and would not impact any neighbor's views. 3. 76% of the lot would be undeveloped with structures. 4. Dwellings much larger than have previously been developed in the project area are being constructed on the parcels in newer subdivisions in the project area. 5. The increase in building coverage would not cause a significant increase in stormwater runoff. The additional stormwater runoff caused by the increase in building coverage can be adequately handled by the retention . pond serving the subdivision that the project site is located in. 6. We submitted their plan for plan check back in August and only heard of this coverage requirement, as the plan check was nearly complete. As you can see on the site plan provided the actual living sqft is only 13.8 % with the garages at 4.2%and covered porch areas at 3.2%bringing the total coverage up to 21.2%. If we went with one small garage and no porches to provide needed shade we could make the 15%coverage, but this is not practical. In addition to the home sqft the owners of lot 10 wish to enjoy their back yard by building a pool and a covered BBQ area which brings the sqft coverage up to 23.7 %. I have talked with county staff as to the origin of the 15%rule. No one knows where it came from and as of today this is the only home that has been denied a permit because of it. I have contacted Stephen Honnycutt of Heritage Partners,the designer of the North Chico Specific Plan, as to the reasoning for the 15%coverage rule on only SR-1 lots. He also does not know and was surprised by the rule. As the Developer of Pheasant Landing subdivision, and other subdivisions in the area, this home design and size fits the character of the development,which consists of other large custom. We are requesting this variance to allow the Burringtons to build their home as designed with a pool and covered BBQ.
