Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below, James Marshall is hereby granted a Variance to reduce the front
setback to 10 feet and the rear setback to 13 feet.
I. SPECIAL CONDITIONS:

1. Applicant shall comply with requirements of the Building Division and Department of
Public Works.
2. Applicant shall also comply with all other applicable state and local statutes, ordinances
and regulations.
3. Prior to the issuance of the Variance, applicant shall pay any outstanding project-related
processing fees.

4. Connection to the City of Chico Sewer System is required.
County Counsel
5. If this entire matter or any finding, action or condition of this matter is appealed to the
Board of Supervisors, the applicant or any other developer/operator other than the
applicant agrees to indemnify the County of Butte from liability or loss related to the
approval of this project and agrees to sign an indemnification agreement in a form
approved by County Counsel before the Board's appeal hearing. If the application is not
appealed, this condition is deemed satisfied.

EXECUTIVE SUMMARY
The applicant is requesting a variance to the front and rear setback to build a single-family
dwelling. The applicant is asking for a 10-foot front setback, where normally the required front
setback would be consistent with the average of the existing front yard of adjoining parcels, but
in no case less than fifteen feet (15) feet nor greater than thirty (30) feet, and a 13-foot rear
setback, where 15-feet is the required standard setback.
Staff Recommendation: Approve the attached resolution that finds the project Categorically
Exempt under Section 15303(a) of the California Environmental Quality Act (CEQA) Guidelines
and approving the Variance 09-0010 with findings and conditions.
PROJECT DESCRIPTION/SITE CHARACTERISTICS
• The applicant requests a variance to reduce the front setback from 20-feet to 10-feet and the
rear setback from 15-feet to 13-feet.

• The project site is located on the west side of Boucher Street in the Chapman Neighborhood
of Chico. The size of the subject property is approximately 2,700 square feet (45' x 60').
• The site is undeveloped and generally flat.

• The following improvements are proposed:
- A three-bedroom, 1,363 square foot, two-story single family dwelling;
- An attached 264 square foot garage;
- A 151 square foot front porch; and
- Connection to public water and city sewer.
• Surrounding parcels to the north, south and east are zoned R-1/CM (Residential/Chapman-
Mulberry Combining) and to the west are within the City of Chico. Parcels range in size
from 0.05 to 4.22 acres, with an average parcel size of 0.21 acres.. Land uses on surrounding
and nearby parcels are single-family dwellings.
• Access onto the site is from Boucher Street, a publicly-maintained road. The property is an
interior lot.
• The project parcel was created by deed on January 20, 1930.
ANALYSIS
• The zoning is R-1/CM (Residential/Chapman-Mulberry Combining) which requires the front
setback to be consistent with the average of the existing front yard of adjoining parcels, but
in no case less than fifteen feet (15) feet nor greater than thirty (30) feet.
• The rear setback in the R-1/CM zone is 15 feet.
• The adjacent parcels, APN 005-408-002 fronts on 12th Street and APN 005-408-004 fronts
on 15t Street:' Their front setbacks are approximately 10 feet. Their setbacks along
Boucher Street are approximately 10 feet and 20 feet, respectively. .
• The proposed house would be 10 feet from the front property line and 13 feet from the rear
property line.
• The proposed front setback for the house would be consistent with front yard setbacks of the
adjacent parcels.

• This application was filed in response to the Department of Development Services review of
a building permit(B09-0330).
• APN 005-408-004, located to south of the project site, was granted a use permit in 1986 to
replace a damaged home that did not meet the required setbacks.
• The proposed dwelling is consistent with the design standards of the Chapman/Mulberry
Combining Zone:
1. The front entries is oriented toward the street;
2. The garage is located 10 feet from the front of the dwelling; and
3. The dwelling is designed with a functional front porch.
REQUIRED FINDINGS
• Variances shall be granted only when, because of special circumstances applicable to the
property, including size, shape, topography, location or surroundings, the strict application of
Chapter 24 deprives such property of privileges enjoyed by other property in the.vicinity and
under identical zoning classification. Additionally, the variance must not constitute a grant of
special privilege inconsistent with the limitations placed upon other properties in the vicinity
and zone in which the property is situated.
- Special circumstances applicable to the property, including size, shape, topography,
location or surroundings exist on the subject property that make a variance to County
code necessary.
1. The parcel is a shallower lot (60 feet) compared to the majority of lots in the R-
1/Chapman-Mulberry zone. Other than handful of lots, the majority of lots in the R-
1/CM zone have a depth of at least 85 feet.
2. The parcel size is significantly smaller (0.06 acres) than the mean (0.21 acres) of the
surrounding parcels.
- The required setbacks on the subject parcel deprives the property of privileges enjoyed by
other properties in the vicinity and in the identical zone district. Granting, the variance
would not constitute a grant of special privilege inconsistent with the limitations placed
upon other properties in the vicinity and zone in which the property is situated.
- Adequate room does not exist to place a residential dwelling that could meet the front and
rear setbacks.
LOCAL AGENCY REVIEW
• The Butte County Public Works Department had no comments. They did review the creation
deed and determined the parcel is buildable.
• Butte County Environmental Health required a condition of approval that requires the
dwelling be served by sewer(City of Chico).

• Staff did not receive any public comments prior to completion of the agenda report.
ENVIRONMENTAL REVIEW
Staff made a determination that the project is Categorically Exempt under Section 15305(a) of
the CEQA Guidelines (Class 3 exemption). Class 3 consists of'construction and location of
limited numbers of new, small facilities or structures, including up to three single- family
residences in urbanized areas.

Analysis
The zoning is R-1/CM (Residential/Chapman-Mulberry
Combining) which requires the front setback to be
consistent with the average of the existing front yard of
adjoining parcels, but in no case less than fifteen feet '
(15) feet nor greater than thirty (30) feet.
The rear setback in the R-1/CM zone is15 feet.
• The adjacent parcels, APN 005-408-002 fronts on 12th
Street and APN 005-408-004 fronts on 15th Street.
Their front setbacks are approximately 10 feet. Their
setbacks along Boucher Street are approximately 10
feet and 20 feet, respectively.
The proposed house would be 10 feet from the front
property line and 13 feet from the rear property line.
The proposed front setback for the house would be
consistent with front yard setbacks of the adjacent
parcels.

Analysis
• This application was filed in response to the Department
of Development Services review of a building permit
(B09-0330).
APN 005-408-004, located to south of the project site,
was granted a use permit in 1986 to replace a damaged
home that did not meet the required setbacks.
• The proposed dwelling is consistent with the design
standards of the Chapman/Mulberry Combining Zone:
-. The front entries is oriented toward the street;
- The garage is located 10 feet from the front of the
dwelling; and
- The dwelling is designed with a functional front
porch.

Required Findings
• Variances shall be granted only when, because of special circumstances
applicable to the property, including size, shape,topography, location or
surroundings,the strict application of Chapter 24 deprives such property of
privile es enjoyed by other property in the vicinity and under identical zoning
classification.Additionally,the variance must not constitute a grant of
special privilege inconsistent with the limitations placed upon other
properties in the vicinity and zone in which the property is situated.
- Special circumstances applicable to the property, including size, shape,
topography, location or surroundings exist on the subject property that
make a variance to County code necessary.
1. The parcel is a shallower lot(60 feet)compared to the majority of lots
in the R-1/Chapman-Mulberry zone. Other than handful of lots,the
majority of lots in the R-1/CM zone have a depth of at least 85 feet.
2. Theparcel size is significantly smaller(0.06 acres)than the mean
(0.21 acres) of the surrounding parcels.
The required setb°acks on the subject parcel deprives the property of
privileges enjoyed by other properties in the vicinity and in the identical
zone district. Granting,the variance would not constitute a grant of
special privilege inconsistent with the limitations placed upon other
properties in the vicinity and zone in which the property is situated.
Adequate room does,not exist to place a residential dwelling that could
meet the front and rear setbacks.
