(SB) (95-162) Mr. Hogan said that a variance was previously issued, and the applicant wishes to add on to the building that is already within the setback. The addition will encroach 7 feet into the 20 foot setback. The variance was granted in 1983 for the existing building's encroachment into the setback. The addition will match the existing structure. The requirements for a variance are met and approval is recommended. HEARING OPEN TO THE PUBLIC The applicant agreed with the conditions and the findings.- HEARING CLOSED TO THE PUBLIC It was moved by Commissioner Lynch, seconded by Commissioner Seegert, and carried unanimously, to accept the environmental findings in Section I of Exhibit A, and the Zoning Ordinance findings in Section II of Exhibit A, and take the action in Section III in Exhibit A, including the Condition #1 on Page 4 of Fxhibit A, and grant the variance as requested. EXHIBIT A Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Don Buckman is hereby granted a Variance in accordance with application filed: 5/9/95 to allow a structure`within the required 50 foot setback from the centerline of Estes Road on property zoned M-2, located at 2220 Normal Avenue, Chico. SECTION 1: FNVIRONMIIVTAL FINDINGS: A. This project is categorically exempt from the California Environmental Quality Act (CEQA)under Section 15305(a)as a minor alteration to land use limitations which do not result in the creation of any changes in land use or density, including setback variances not resulting in the creation of any new parcel; and B. the design of the project and improvements will not cause environmental damage to fish. SECIION 2: ZONING ORDINANCE FINDINGS: BUTTE COUNTY PLANNING COMMISSION MINUTES"-- July 13, 1995 Ii i A. Variances from the terms of this chapter shall be granted only when, because of special circumstances applicable to the property, including size, shape, topography, location or surroundings, the strict application of this chapter deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification. B. The proposed project is consistent with the M-2 zone and is a primary use under the Industrial General Plan designation. SECTION 3: ACTION: A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, approve a Variance for Don Buckman to allow a structure within the required 50 foot setback from the centerline of Estes Road, located at 2220 Normal Avenue, identified as AP 039-430-126, Chico, subject to the conditions listed herein. B. Minor changes may be .approved administratively by the Director of Development Services, or designee, upon receipt of a substantiated written request by the applicant. Prior to such approval,verification shall be made by each Department or Division that the modification is consistent with the application,fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a_formal application for amendment. C. Condition of Approval: 1. The proposed addition to the building into the setback must match the existing building in the setback. Hogan, Planning Manager BY: Stephen Betts, Assistant Planner DATE: June 27, 1995 REQUEST: 95-162 - Don Buckman, APN 039-430-126 : A request for a Variance to allow a structure within the required 50 foot setback from the centerline of Estes Road on property zoned M-2 (Heavy Industrial). The site is located at 2220 Normal Ave., approximately 100 feet south of 22nd Street, in the Chico area. This project is located in District 2. RELATED ITEMS: None FOR: Planning Commission Meeting of July 13, 1995 ABSTRACT: This application for a Variance is to allow a portion of a proposed structure to be located within the 50 ft. setback from the centerline of Estes Road. The existing use is consistent with the M-2 zoning and the Butte County General Plan designation of Industrial. Staff recommends approval of this application. PROJECT CHARACTERISTICS: The applicant is asking for a variance to Chapter 10, Section 10-7(c) of the Streets and Highways Code which establishes a 50 ft. minimum setback from the centerline of all public roads which equates to a 20 ft. setback from the property line.This variance will allow an addition to an existing building to encroach into the setback of Estes Road. This addition will encroach 7 feet into the setback. A variance (83- 12) for an adjoining building was'granted in 1983 for an encroachment into the setback. The proposed building addition will match the existing structure that already sits in the setback. The present zoning for the parcel is M-2. The Land Use Plan Map of the Butte County General Plan designates this area as Industrial. The current land use i is the manufacture of agricultural machinery. Surrounding parcels are zoned M-2 and have a General Plan designation of Industrial. ANALYSIS: This project will,allow an encroachment into the Estes Road setback by 7 feet. Estes Road is a dead- end street and sees very little use. The proposed setback will match the existing building structure that already sits in the setback. The applicant states that the addition to the existing building is needed for increased manufacturing capacity. The applicant also states that the shape of the parcel requires the addition to be situated in the setback so as to make the most efficient use of the property due to the existing structures. The proposed variance to the street setback is an option under Sections 10-13 of the Streets and Highways Code and 24-50.10 of the Zoning Code. The variance can be granted when, because of special circumstances applicable to the property, including size, shape, topography, location or surroundings, the strict application of setbacks deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning 1 classification. The Code also estab- lishes a procedure to grant variances from these standards where unique circumstances exist to warrant relief from the strict application of these standards. A variance can be granted only if specific findings. .are made to indicate that unique circumstances do, in fact, exist. These special circumstances may include factors such as the size, shape, topography, -location and surroundings of a piece of property. The courts have clearly indicated that variances are not intended to rewrite the County Code and can only be granted if all the findings listed below are made. Further, the courts have indicated the actual, factual basis for these findings must be stated. Application shall be considered void if not signed by the owner or legal agent. 2. All items on application shall be filled in as completely as possible.
