This item was taken next, since it was non-controversial.

Mr. Sanders said that the small piece of property in an A-20 zone is impacted by the setbacks
of the zone. The request is for a 5 ft. setback from the property line instead of the required 20
- Commissioner Lynch said it is basically a request for an urban setback in an A-20 zone.
HEARING OPEN TO THE PUBLIC
Mr. Spiteri said that he needs a place to park his car out of the rain. His home is in the middle .
of a walnut orchard, and there are no near neighbors. With the 25 ft. setback, he only has room
for a 6 ft. wide garage. The adjacent landowners do not have a problem with his request for a
Variance.
Commissioner Lambert asked if the applicant is aware of the regulations of the 60-640.
Mr. Sanders said that Mr. Spiteri is aware of the regulations of 60-640.
Commissioner Lambert asked if it is being occupied now?
Mr. Spiteri said that it is not occupied now. There is no intention to make it a rental.
Commissioner Lambert asked what happens with units that were intended for seniors?
Mr. Sanders said they can remain, but they need to be occupied by someone 60 years of age or
remain vacant, or be used for storage. There would be the option to make an application under
the Second Dwelling Unit.
Chairman Nelson asked if the mobile is removed, would a Variance be needed?

Mr. Spiteri said it would not be practical because the mobile is on the other side of the house and
he wants a garage he can drive into and walk through the kitchen rather than a bedroom. Also
'the septic-lines are-over there. - -

HEARING CLOSED TO THE PUBLIC
µ Commissioner Lynch said that three years ago a Variance in a similar situation was denied.
There was a small parcel in an A-20 zone and the applicant's request'for a Variance from a 20
ft. setback was denied. Commissioner Lynch voted against the majority's denial on the issue, but
the precedent was set That property was south of Durham on the Midway. The applicant
wanted to build a shop and he was told he could build it in his backyard in order to maintain the
setback. Commissioner Lynch thought that setbacks should be related to the size of the lot rather
than having an arbitrary setback in the zones. There are many non-conforming lots in the
County.
Chairman'Nelson gai&that this-is basically a city size lot in the County: -
Commissioner Lynch-said.he would'not be surprised if the applicant south-of..Durham comes
back in with another request for a Variance. He felt that approval was "opening a can of worms"
although he was not opposed to the request
Commissioner Seegert thought that the applicant should not be penalized for a small lot
Chairman Nelson said that each request should be looked at individually.
Commissioner Lambert said that she does not have concerns about this request for a Variance,
but she is concerned about the 60-640 in this type of situation and whether it can be just left
without another permit That should be decided at some point in time.
Commissioner Cage asked if the Hegan Lane area would be annexed by Chico in the near future?
Commissioner Lambert said she did not see that happening.
It was moved by Commissioner Lynch, seconded by Commissioner Seegert, and carried
unanimously for approval of the variance request for Frank Spiteri.
Section 1: Environmental Findings.
A. The project is categorically exempt from environmental review under a class 5
exemption as described by Section 15035 of the CEQA Guidelines and Butte
County Environmental Review Guidelines; and
Section 2: Zoning Ordinance Findings.
A. Find that there are special circumstances applicable to the property, including size,
shape, topography, location, or surroundings, that the strict application of this
chapter deprives the property of privileges. enjoyed by other property in the
vicinity and under identical zoning classification because the existing parcel is
significantly smaller than the 20 acre minimum required by the A-20 zone and the
required setbacks unreasonably impact the use of the property; and

Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to
approve the Variance for Frank Spiteri on AP#039-080-044 to allow a 20'
encroachment into the side yard setback in an A-20 zone for the construction of
a garage/shop building. Approval shall be subject to the following conditions:
CONDITIONS:
1. Provide proof to the Planning Division that the mobile home on-site is occupied
by persons 60 years of age or older. Sign an affidavit acknowledging the -
occupancy limitations of this dwelling consistent with the 60-640 requirements.
The affidavit shall be submitted to the Planning Division prior to issuance of this
variance.
2, The propose structure may not be closer than 5' from the side property line and
25' from the rear property line.
3. Have both the easterly and northerly property lines located by a licensed land
surveyor or qualified civil engineer. Set appropriate markers to allow building
inspectors to measure the location of the structure.
4. Applicant must also comply with all other applicable State and local statutes,
ordinances and regulations.
Minor changes may be approved administratively by•the Director of Development
Services, or designee, upon receipt of a substantiated written request by the
applicant. Prior to such approval, verification shall be made by each Department
or Division that the modification is consistent with the application, fees paid, and
environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.

PROJECT CHARACTERISTICS: This request is for a Variance to allow the construction of a
garage/shop structure within 5' of a side.property line in an A-20 zone. The parcel is .51 acres in size and
is developed with a 2,400 square foot single family residence, a 400 square foot mobile home that was
legally placed on-site in 1985 as a 60-640 Senior Citizen dwelling, and a 180 square foot shop structure.
The site is extensively landscaped in both the front and rear yards. The parcel was created by combining
two smaller parcels in 1964 and is a legal non-conforming parcel.
The parcel is located in an agricultural area with predominantly larger parcels. A walnut orchard exist to
the east, almonds to the south, a hulling and trucking operation to the west and field crops(sunflowers) to
the north. This is an isolated residence. No other homes exist within the immediate area.
ANALYSIS: The Butte County Zoning Ordinance and State law allow for variances to site development
standards such as setbacks when, due to size, shape, topography, location, or surroundings of the property
in question, the strict application of those standards deprives the property of privileges enjoyed by other
properties in the vicinity and under the same zoning classification.
The property is developed for residential use even though it is in an agricultural zone. The main house on-
site was constructed in the 1960's and the garage was converted to living space in 1981. A mobile home
was placed on the property in 1985 as a 60-640 Senior Dwelling unit. The current owner did not place this

mobile home and may not be aware of the restrictions on its occupancy. This dwelling is exclusively
intended as a living unit for persons over the age of 60. Verification of occupancy should be required
before this variance becomes effective.
The applicant wishes to construct an attached garage and shop/storage structure as accessory structures
to the residential use. The proposed location of the garage is currently paved and used for parking. The
area covered by the proposed shop is occupied by a small garden and existing 12' x 15'.storage building.
The shop is approximately 5' from the easterly property line, encroaching about 20' into the setback. This
structure must be removed to accommodate the proposed building.
This parcel was created by deeds prior to the requirements of the Subdivision Map Act. Based on the site
visit,the exact location of the property lines is not apparent. A wire fence runs crookedly down both the
side and rear lines. These property lines should be positively located and corners identified as a condition
of this variance.
There are few alternatives for constructing the proposed structures. The back yard is landscaped with a
moderately sized lawn, a deck, and a hot tub. The septic tanks and leachfields are also located in the rear.
There is room to construct a two car garage in the front of the house, attached to the easterly side of the
home. The house is setback from the edge of the right-of-way approximately 52'. Once the 20' front yard
setback is taken into account, a 32'deep garage could be built. Constructing in this location would require
removal of two mature trees and landscaping in a portion of the front yard, and will require a portion of the
roof on the existing house to be reconstructed. A second alternative would be to construct a garage and
shop building in the rear of the parcel, attached or detached to the existing home. This would require the
relocation of the existing well located near the rear of the house or significant modification to the shape of
the garage and/or to the rear yard improvements.
The property in question is a .51 acre (22,350 square feet) parcel in an A-20 zone. The setback
requirements of the zone are 25' for the side and rear yards and 20' from the ultimate right-of-way of the
road. Strictly imposing these setbacks on a parcel of this size reduces the useable building space to 7,400
square feet, a 67% reduction. The adoption of a 25' setback for the A-20 zone was based on the
assumption of large parcels and does not take into account smaller, non-conforming parcels. Based on this,
findings for a hardship due to the size of the property can be made.
ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the
California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. This
project meets the requirements of a Class 5 categorical exemption and is, therefore, not subject to
environmental review.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and
held. Advertisement of the public hearing was published in a local newspaper and were mailed to all

property owners within a 300 foot radius of the subject property. As of the date of this report we have
received no public comment.
RECOMAMNDATION: Staff recommends that the Planning Commission approve Variance No. 96-01
subject to the findings and attached conditions contained in exhibit A.

INSTRUCTIONS TO VARIANCE APPLICANTS
1. If applicant is not the owner, written authorization by the owner or other proof of agency must be sub-
mitted in order for the applicant to legally sign the application. Application shall be considered void if
not signed by the owner or legal agent.
2. All items on application shall be filled in as completely as possible. If an item is not applicable, please
indicate by the term "NA".
3. It is important that the applicant supply an accurate description of the location of the proposed project,
including the following:
a. Assessor's parcel number(s) (from the tax bills or Assessor's Maps).
b. Street addresses (if available).
C. Distances and directions to named streets,bodies of water or railroads.
4. Twenty (20) copies of a detailed plot plan of adequate scale to clearly show proposed buildings and
improvements, folded to 8'/2 x 11 inches, shall accompany and be made part of the"Application for Vari-
ance".The plot plan shall include the following information:
a. A scaled drawing of the parcel(s) boundaries.
b. Location and dimensions of all existing and proposed improvements on the property,includ-
ing buildings,driveways,parking areas,wells,septic tanks and leach fields.
C. Location and name of bordering streets, access roads, nearby crossroads, streams, bodies of
water and railroads.
d. North arrow and scale of drawing.
5. The "Application for Variance" is subject to public hearings and approval by the Planning Commission.
Any special conditions of approval shall be made a part of the approved "Variance" and shall be binding
on the applicant. The procedures for County action on variance applications are stated in Chapter 24
of the Butte County Code.
6. VARIANCES from the terms of the zoning ordinance shall be granted only when, because of special
circumstances applicable to the property, including size, shape, topography, location or surroundings, the
strict application of the zoning ordinance deprives such property of privileges enjoyed by other property
in the vicinity and under identical zoning classification.
Any variance granted shall be subject to such conditions as will assure that the adjustment thereby auth-
orized shall not constitute a grant of special privileges inconsistent with the limitations upon other pro-
perties in the vicinity and zone in which such property is situated. Any such condition imposed upon
issuance of a variance must be related to the use of the property for which the variance is requested.
A variance shall not be granted for a parcel of property which authorizes a use or activity which is not
' otherwise expressly authorized by.the zone regulation governing the parcel of property.

FINDINGS OF FACT
Each zoning classification and land use has an associated set of development
standards which are specified in the Butte County Code. The Code also estab-
lishes a procedure to grant variances from these standards where unique
circumstances exist to warrant relief from the strict application of these
standards.
A variance can be granted only if specific findings are made to indicate that
unique circumstances do, in fact, exist. These special circumstances may
include factors such as the size, shape, topography, location and surroundings
of a piece of property.
The courts have clearly indicated that variances are not intended to rewrite
the County Code and can only be granted if all the findings listed below are
made. Further, the courts have indicated the actual, factual basis for these
findings must be stated.
NOTE TO APPLICANT
Please do NOT apply for a variance unless you can provide the necessary factual
basis to grant the requested variance. All necessary application fees are non-
refundable.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the findings
and .conditions set forth below: Frank Spiteri is hereby granted a Variance in accordance
with application filed: 7/5/95 to the side yard setback to allow a structure 5 feet from the
property line on property zoned A-20 located at 2908 Hegan Lane, Chico.
FINDINGS:
Section 1: Environmental Findings.
A. The project is categorically exempt from environmental review under a class 5
exemption as described by Section 15035 of the CEQA Guidelines and Butte
County Environmental Review Guidelines; and
Section 2: Zoning Ordinance Findings.
A. Find that there are special circumstances applicable to the property, including
size, shape, topography, location, or surroundings, that the strict application of
this chapter deprives the property of privileges enjoyed by other property in
the vicinity and under identical zoning classification because the existing
parcel is significantly smaller than the 20 acre minimum required by the A-20
zone and the required setbacks unreasonably impact the use of the property;
and
Section 3: Action.
A, Subject to the findings indicated in Sections 1 and 2 of this report, move to
approve the Variance for Frank Spiteri on AP# 039-080-044 to allow a 20'
encroachment into the side yard setback in an A-20 zone for the construction
of a garage/shop building. Approval shall be subject to the following
conditions:
CONDITIONS:
1. Provide proof to the Planning Division that the mobile home on-site is
occupied by persons 60 years of age or older. Sign an affidavit
acknowledging the occupancy limitations of this dwelling consistent with the
60=640 requirements. The affidavit shall be submitted to the Planning Division
prior to issuance of this variance.
2, The propose structure may not be closer than 5' from the side property line
and 25' from the rear property line.
3. Have both the easterly, and northerly property lines located by a licensed land
surveyor or qualified civil engineer. Set appropriate markers to allow building
inspectors to measure the location of the structure.
4. Applicant must also comply with all other applicable State and local statutes,
ordinances and regulations.
Minor changes may be approved administratively by the Director of
Development Services, or designee, upon receipt of a substantiated written
request by the applicant. Prior to such approval, verification shall be made by
each Department or Division that the modification is consistent with the
application, fees paid, and environmental determination as conditionally.

Dear Mr. Spiteri:
At the regular meeting of the Butte County Planning Commission held September 14,
1995, your request for a Variance to the side yard setback to allow a structure within 5
feet of the property line located at 2908 Hegan Lane, Chico, was approved subject to the
conditions listed in the attached Use Permit. Both copies must be signed and returned
to this department within 30 days from the expiration of the 10 day appeal period.
Should you desire to appeal any of the conditions imposed by the Planning Commission,
you must do' so in writing with the appeal fee of $250.00, to the Clerk of the Board of
Supervisors, 25 County Center Drive, Oroville, California, prior to 5:00 p.m., Monday,
September 25, 1995. If you do not appeal and if there are no other appeal within the 10-
day appeal period, your use permit will be issued after September 25, 1995.
Please be aware that failure to return the signed copies within 30 days will result in the
use permit becoming invalid. Re-application to this department would then be necessary
to proceed with the project.
The Use Permit is deemed granted when this permit has been signed by the applicant,
with the counter signature of the Chairman of the Planning Commission, and said permit
is received by the applicant by registered mail.
