(SL) (95-168) Mr. Lucas said the Cheaper Store is allowable in this zone, but there is a need for a variance to the setback to the rear of the property. There is road frontage on all 3 sides of the property, and the Streets and Pfighways Code requires, a 50 ft. setback. The store had originally asked for a 5 ft. setback from the property line, which was not opposed by the Planning Division since there would be no access along Kennedy Avenue for this use. That would also eliminate any potential dark areas in the back. Public Works has requested a 10 ft. setback, but the applicant would prefer 5 ft., but would accept 10 ft. Access will be off both Hwy. 32 and East Avenue. The intersection was engineered to Caltrans standards. The site development aspects are not in the purview of this Commission. Mr. Hogan said that the Planning Division has worked with the applicant, who has been very co- operative. The Planning Division does not think there is a need for a 10 ft. setback on Kennedy Avenue, i since it does not serve any purpose. The applicant has proposed landscaping in the setback area There are already trees. Mr. Lucas said the applicant is proposing a 6 ft wall directly behind the building and a 6 ft. landscaped chain link fence on the rest of the property. There will be a good barrier between this property and the residential uses on the other side of Kennedy Avenue, which eliminates the need for a setback. Commissioner Lynch said that the 1 ft. no access strip will be within that setback. Mr. Hogan said that normally the 1 ft. no access strip would be adjacent to the right-of-way, at the coterminous line between the setback and the right-of-way. Commissioner Lambert asked if a 6 ft. high concrete block wall should be required rather than a chain link fence? Mr. Lucas said the applicant proposed the block wall. The Planning Division would simply want some type of sight obscuring fence. The applicant would prefer a block wall behind the store and a chain link fence on the two remaining sides. BUTTE COUNTY PLANNING COMMISSION MINUTES — June 22, 1995 Mr. Hogan said that sight obscuring is the main quality desired by the Planning Division. Commissioner Frisman asked why there is not a condition about the 10 ft. setback? Mr. Hogan said there should be something that indicates what the setback should be. The Public Works Dept is trying to hedge their bets in case Kennedy Avenue ever becomes a through street. Mr. Hogan said he cannot see that happening or that the whole corner and the property and that will become aPPe g P PertY beyond commercial. That could be addressed if it ever happens. There is no reason to require another 5 ft.just because a street might go through, but that is the reasoning according to Public Works. Chairman Nelson said he would like some type of landscaping on both sides. Mr. Hagan said that would be appropriate. PIEAMG OPEN TO THE PUBLIC Dwayne Miller, of Anderson, the project engineer, said that they would like to move the building back another 5 ft. beyond what Public Works has asked for in order to have a little more room for driveway access. The 5 ft. behind the store, they will cover with concrete and keep in a maintenance free condition. There is not enough area back there to be useful for anything. They will sign an agreement to provide curbs, gutters and sidewalks at such time as Kennedy Avenue is ever constructed. The existing 60 ft. right-of-way would be more than adequate for any future development so there is no need for the additional 5 ft. The 5 ft. would be more beneficial in front of the store. They submitted the plan for a 10 ft. setback behind the store because of the request from Public Works, but they would prefer a 5 ft. setback. There will be a chain link fence where there is not a block wall in order to save the existing trees. Chairman Nelson said there should be landscaping on the fence in the back. Mr. Muller said they intend to have appropriate landscaping. Commissioner Lynch thought the proposed use for this lot-is appropriate. Chairman Nelson said that although there is a landscaping plan shown on the plat, he would like to have a condition which addresses the landscaping. He would like to have some sort of landscaping such as vines along the chain link fence for the benefit of the residents along Kennedy Avenue. Mr. Hogan said that could be added to Condition A, "with landscaping installed along the fence to soften the visual affect." Condition 44 could say, "fence or wall." Where there is a block wall, some sort of vine to cover the wall could be used to discourage graffiti. It was moved by Commissioner Lambert for approval, seconded by Commissioner Frisman, and carried unanimously, for the variance for Triond, AP 042-080-060, subject to the following findings and BUTTE COUNTY PLANNING COMMISSION MINUTES - June 22, 1995 1 conditions: Section 1, the environmental findings; Section 2,the Zoning Ordinance findings; and Section 3, subject to the findings of Section 1 and 2, and the minor changes note, and the conditions of approval #1 through #4, adding to #4, "provide landscaping along fence line and concrete wall," and approving the variance for the 5 ft. setback. Chairman Nelson said he would like to encourage having trees in the parking lot. Mr. Hogan said the Planning Division can work with the applicant on that, although it is not subject to the variance. The Parking Ordinance requires a certain percentage of the area to be landscaped. Chairman Nelson said that no trees are indicated in the parking area. He would like to see some trees for shade in the parking area Mr. Hogan said that there is no nexus and that landscaping cannot be required by the variance. Commissioner Lambert said that some landscaping goes along with parking. Mr. Hogan said that 5% of the lot is required for landscaping. Mr. Miller said there is a rather extensive landscaping plan with a lot of trees. Section 1: Environmental Findings. A. This project is categorically exempt from the California Environmental Quality Act (CEQA) under Section 15305(a) as a minor alteration to land use limitations that do not result in the creation of any changes in land use or density, including setback variances not resulting in the creation of any new parcel. ; and Section 2: Zoning Ordinance Findings. A. The proposed project is granted a variance to the street setback under Section 24-50 of the Butte County Zoning Ordinance and Government Code Section 65906 because of special circumstances applicable to this property, including size, shape, location or surroundings that deprive the property of privileges enjoyed by other property in the vicinity and under identical zoning classification. Granting of this variance does not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which it is situated; and B. The proposed project is consistent with the C-2 zone and is a Primary Use under the Commercial General Plan designation. Section 3: Action BUTTE COUNTY PLANNING COMMISSION MINUTES - June 22, 1995 A. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: 1. All external lighting along Kennedy Avenue shall be installed in a manner that the lights do not project beyond property boundaries. 2. No access is permitted to the site from Kennedy Avenue except for fire protection purposes. 3. Relinquish abutters'rights or deed a 1 ft. no access strip along Kennedy Avenue to Butte County. 4. Construct and maintain a minimum 6 ft. high, sight obscuring fence or block wall with landscaping, along Kennedy Avenue. Hogan, Planning Manage BY: Stephen Lucas, Planner DATE: May 20, 1995 REQUEST: Variance 495-168 for Triond on APN 042-080-060: A request for a Variance to allow structures within the required 50 ft. setback from the centerline of Kennedy Avenue on property zoned C-2 (General Commercial) located on the north side of SR32 and the east side of East Avenue in the Chico area. RELATED ITEMS: None FOR: Planning Commission Meeting of June 22, 1995 ABSTRACT: This application for a Variance is to allow a portion of a proposed structure to be located within the 50 ft. setback from the centerline of Kennedy Avenue due to special circumstances involving the shape of the property and surrounding uses.The commercial use is consistent with the C-2 zoning and General Plan designation of Commercial. Staff recommends approval of this application. PROJECT CHARACTERISTICS: The applicant is asking for a variance to Chapter 10, Section 10-7(c) of the Streets and Highways Code which establishes a 50 ft.minimum setback from the centerline of all public roads which equates to a 20 ft. setback from the property line. Specifically, a variance to the existing 50 ft. setback from the centerline of Kennedy Avenue, which runs along the easterly boundary of the 1.8 acre triangle shaped parcel, is requested.The applicant had originally requested a 5 ft.setback from the property line, however,the map submitted indicates a 10 ft. setback from the property line along Kennedy Ave, staff would accept either reduction. The property is bordered on the remaining two sides by SR32 on the southwest and East Avenue on the west. The section of Kennedy Avenue in question begins at its intersection with East Avenue and dead ends short of SR 32. The road is in fair to poor condition, provides access to 4 residential parcels and serves no traffic circulation function. The parcel on which the variance is being requested is commercially zoned and will be developed by Triond for a Cheaper Store. The applicant has submitted building plans and has begun some site preparation work. ANALYSIS: The proposed variance to the street setback is an option under Sections 10-13 of the Streets and Highways Code and 24-50.10 of the Zoning Code. The variance can be granted when, because of special circumstances applicable to the property, including size, shape, topography, location or surroundings, the strict application of setbacks deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification. This project is particularly burdened by the shape of the lot and its surroundings. The 1.8 acre triangular lot has three frontages on county roads which is effectively the same as having three front yard setback requirements which results in the loss of approximately 24,000 sq. ft. or 30% of the lot. Other business in the immediate vicinity along the western portion of Kennedy Avenue and along East Avenue do not share the same setback constraints to which this project must conform. The approval of the variance will also allow the design of the project to maximize the use of the lot along East Ilk Avenue and SR32 while removing any activity from along Kennedy Avenue which will further insulate the residential lots from potential noise and light impacts. Impacts to the residential uses along Kennedy Avenue will be further reduced by the erection of a concrete block wall and chain link fence to be built along the property line that will be required by condition.Additionally, the applicant shall relinquish abutters rights or deed a 1 ft. no access strip along Kennedy Avenue. Without approval of the variance, the applicant will be forced to utilize a site design that places truck traffic to the rear of the building and increases the activity along Kennedy Avenue. The Department of Public Works has commented on the project and recommends that a 10 ft. setback from the ■ Butte County Department of Development Services - Planning Division ■ 1 AGENDA ITEM property line be permitted. ENVIRONMENTAL DOCUMENTATION: This application is categorically exempt from the California Environmental Quality Act (CEQA) under Section 15305(a) as a minor alteration to land use limitations which do not result in the creation of any changes in land use or density, including setback variances not resulting in the creation of any new parcel. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing will occur in the Chico Enterprise Record. Public notices will be mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission approve the application for a street setback variance for Triond on APN 042-080-060, subject to the following findings and conditions. FINDINGS OF FACT �. Each zoning classification and larid use has an associated set of development standards which are specified in the Butte County Code. The Code also estab- lishes a procedure to grant variances from these standards where unique . circumstances exist to warrant relief from the strict application of these standards. A variance can be granted only if specific findings are made to indicate that unique circumstances do, in fact, exist. These special circumstances may include factors such as the size, shape, topography, location and surroundings of a piece of property. The courts have clearly indicated that variances are not intended to xewrite the County Code and can only be granted if all the findings listed below are made. Further, the courts have indicated the actual, factual basis for these findings must be stated. RELATED ITEMS: None FOR: Planning Commission Meeting of June 22, 1995 ABSTRACT: This application for a Variance is to allow a portion of a proposed structure to be located within the 50 ft. setback from the centerline of Kennedy Avenue due to special circumstances involving the shape of the property and surrounding uses.The commercial use is consistent with the C-2 zoning and General Plan designation of Commercial. Staff recommends approval of this application. PROJECT CHARACTERISTICS: The applicant is asking for a variance to Chapter 10, Section 10-7(c) of the Streets and Highways Code which establishes a 50 ft. minimum setback from the centerline of all public roads which equates to a 20 ft. setback from the property line. Specifically, a variance to the existing 50 ft. setback from the centerline of Kennedy Avenue, which runs along the easterly boundary of the 1.8 acre triangle shaped parcel, is • requested.The applicant had originally requested a 5 ft.setback from the property line, however,the map submitted indicates a 10 ft. setback from the property line along Kennedy Ave, staff would accept either reduction. The property is bordered on the remaining two sides by SR32 on the southwest and East Avenue on the west. The section of Kennedy Avenue in question begins at its intersection with East Avenue and dead ends short of SR 32. The road is in fair to poor condition, provides access to 4 residential parcels and serves no traffic circulation function. The parcel on which the variance is being requested is commercially zoned and will be developed by Triond for a Cheaper Store. The applicant has submitted building plans and has begun some site preparation work. ANALYSIS: The proposed variance to the street setback is an option under Sections 10-13 of the Streets and Highways Code and 24-50.10 of the Zoning Code. The variance can be granted when, because of special circumstances applicable to the property, including size, shape, topography, location or surroundings, the strict application of setbacks deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification. This project is particularly burdened by the shape of the lot and its surroundings. The 1.8 acre triangular lot has three frontages on county roads which is effectively the same as having three front yard setback requirements which results in the loss of approximately 24,000 sq. ft. or 30% of the lot. Other business in the immediate vicinity along the western portion of Kennedy Avenue and along East Avenue do not share the same setback constraints to which this project must conform. The approval of the variance will also allow the design of the project to maximize the use of the lot along East Avenue and SR32 while removing any activity from along Kennedy Avenue which will further insulate the residential lots from potential noise and light impacts. Impacts to the residential uses along Kennedy Avenue will be further reduced by the erection of a concrete block wall and chain link fence to be built along the property line that will be required by condition.Additionally, the applicant shall relinquish abutters rights or deed a 1 ft. no access strip along Kennedy Avenue. Without approval of the variance, the applicant will be forced to utilize a site design that places truck traffic to the rear of the building and increases the activity along Kennedy Avenue. • The Department of Public Works has commented on the project and recommends that a 10 ft. setback from the ■ Butte County Department of Development Services - Planning Division ■ 1 AGENDA ITEM property line be permitted. ENVIRONMENTAL DOCUMENTATION: This application is categorically exemptfrom the California Environmental Quality Act (CEQA) under Section 15305(a) as a minor alteration to land use limitations which do not result in the creation of any changes in land use or density, including setback variances not resulting in the creation of any new parcel. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing will occur in the Chico Enterprise Record. Public notices will be mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission approve the application for a street setback variance for Triond on APN 042-080-060, subject to the following findings and conditions. RELATED ITEMS: None FOR: Planning Commission Meeting of June 22, 1995 ABSTRACT: This application for a Variance is to allow a portion of.a proposed structure to be located within the 50 ft. setback from the centerline of Kennedy Avenue due to special circumstances involving the shape of the property and surrounding uses.The commercial use is consistent with the C-2 zoning and General Plan designation of Commercial. Staff recommends approval of this application. PROJECT CHARACTERISTICS: The applicant is asking for a variance to Chapter 10, Section 10-7(c) of the Streets and Highways Code which establishes a 50 ft. minimum setback from the centerline of all public roads which equates to a 20 ft. setback from the property line. Specifically, a variance to the existing 50 ft. setback from the centerline of Kennedy Avenue, which runs along the easterly boundary of the 1.8 acre triangle shaped parcel, is requested.The applicant had originally requested a 5 ft.setback from the property line, however,the map submitted indicates a 10 ft. setback from the property line along Kennedy Ave, staff would accept either reduction. The property is bordered on the remaining two sides by SR32 on the southwest and East Avenue on the west. The section of Kennedy Avenue in question begins at its intersection with East Avenue and dead ends short of SR 32. The road is in fair to poor condition, provides access to 4 residential parcels and serves no traffic circulation function. The parcel on which the variance is being requested is commercially zoned and will be developed by Triond for a Cheaper Store. The applicant has submitted building plans and has begun some site preparation work. ANALYSIS: The proposed variance to the street setback is an option under Sections 10-13 of the Streets and Highways Code and 24-50.10 of the Zoning Code. The variance can be granted when, because of special circumstances applicable to the property, including.size, shape, topography, location or surroundings, the strict application of setbacks deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification. This project is particularly burdened by the shape of the lot and its surroundings. The 1.8 acre triangular lot has three frontages on county roads which is effectively the same as having three front yard setback requirements which results in the loss of approximately 24,000 sq. ft. or 30% of the lot. Other business in the immediate vicinity along the western portion of Kennedy Avenue and along East Avenue do not share the same setback constraints to which this project must conform. The approval of the variance will also allow the design of the project to maximize the use of the lot along East Avenue and SR32 while removing any activity from along Kennedy Avenue which will further insulate the residential lots from potential noise and light impacts. Impacts to the residential uses along Kennedy Avenue will be further reduced by the erection of a concrete block wall and chain link fence to be built along the property line that will be required by condition. Additionally, the applicant shall relinquish abutters rights or deed a 1 ft. no access strip along Kennedy Avenue. Without approval of the variance, the applicant will be forced to utilize a site design that places truck traffic to the rear of the building and increases the activity along Kennedy Avenue. The Department of Public Works has commented on the project and recommends that a 10 ft. setback from the ■ Butte County Department of Development Services - Planning Division ■ 1 AGENDA ITEM property line be permitted. ENVIRONMENTAL DOCUMENTATION: This application is categorically exemptfrom the California Environmental Quality Act (CEQA) under Section 15305(a) as a minor alteration to land use limitations which do not result in the creation of any changes in land use or density, including setback variances not resulting in the creation of any new parcel. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing will occur in the Chico Enterprise Record. Public notices will be mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission approve the application for a street setback variance for Triond on APN 042-080-060, subject to the following findings and conditions. Section 1: Environmental Findings. A. This project is categorically exempt from the California Environmental Quality Act (CEQA) under Section 15305(a) as a minor alteration to land use limitations which do not result in the creation of any changes in land use or density, including setback variances not resulting in the creation of any new parcel. ; and Section 2: Zoning Ordinance Findings. A. The proposed project is granted a variance to the street setback under Section 24-50 of the Butte County Zoning Ordinance and Government Code Section 65906 because of special circumstances applicable to this property, including size, shape, location or surroundings that deprives the property of priveleges enjoyed by other property in the vicinity and under identical zoning clasification. Granting of this variance does not constitute a grant of special priveleges inconsistent with the limitations upon other properties in the vicinity and zone in which it is situated; and B. The proposed project is consistent with the C-2 zone and is a Primary Use under the Commercial General Plan designation. Section 3: Action A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the variance for Triond on APN 042-080-060, subject to the following conditions; and B. Minor changes may be approved administratively by the Director of Development Services or designee upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application,fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: 1. All external lighting along Kennedy Avenue shall be installed in a manner that the lights do not project beyond property boundaries. 2. No access is permitted to the site from Kennedy Avenue except for fire protection purposes. 3.
