(VAR 99-01) (DB) A video of the site was shown. Mr. Breedon summarized the staff report. The hearing was opened to the public. Stephen Smith, representing the applicants, said that the enclosed deck with cement siding would be an improvement in fire safety, and an agreement has been signed with CDF regarding the cement siding. There was a discussion regarding the location of the sliding door access to the deck and the location of the septic tank. The hearing was closed. It was moved by Commissioner Mooney, seconded by Commissioner Cage, and carried unanimously for approval of the Variance for Ray and Margrete Court,VAR 99-01, pursuant to the findings and conditions of the Agenda Report dated November 25, 1998.. FINDINGS Section 1: Environmental Findings. A. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305(a) -Minor Alterations in Land Use Limitations, Class 5, of the CEQA Guidelines exempts variances to set backs not resulting in the creation of any new parcel. Section 2: Variance Findings. A. This Variance may be granted because special circumstances applicable to the property exist, including size,-shape, topography, location or'surroundings, and the strict application of the setback ordinance would deprive the property owner of privileges enjoyed by other property owners, and would not constitute a grant of special privileges inconsistent with the limitations placed'upon other properties in the vicinity and under identical zoning classification, as supported by the following facts: 1: The existing dwelling and attached deck was legally approved at a 5 ft. setback applicable at the time. 2. The corner location,narrow lot design, and the further encumbrance of the property by the radius of La Mirada Ave. combine to eliminate feasible alternatives for the proposal. 4. The dwelling's location within the existing setback, and proximity of the septic system adjacent to the existing deck, eliminate alternative usable areas for development within the rear yard area of the building site. 5. The physical arrangement of improvements on the property took place in accordance with the requirements applicable at the time. This arrangement now limits the acceptable choices for a sun room to the subject proposal, due to findings 3 and 4 above. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve *ti Variance 99-01, for Ray&Margrete Court, for development of the sun room and perimeter foundation on the existing deck 5 ft. into the required 10 ft. side yard setback. Eves of sun room shall be enclosed. - - ■ BUTTE COUNTY PLANNING COMMISSION MINUTES ■NOVEMBER 25, 1998m w There was a discussion regarding the traffic on the Upper Ridge Commissioner Cage thought that projects should be considered on a case by case basis. She noted the entire ridge is a high fire hazard area. Commissioner Leland thought some roads might have greater risks than others. Mr. Parilo said the County is working with the Town of Paradise on a Skyway improvement plan, and most of the immediate concerns are for improvement of the main intersections. Commissioner Nelson said the entire road should be considered rather than one lot at a time. Mr. Parilo said BCAG completed a study on traffic on the Upper Ridge about two years ago which has not been presented to the Town of Paradise or the Board of Supervisors. County and Town staff have been trying to identify projects which could provide some relief. Butte County Code, -Application for Variance. APN: 069-450-028 SUMMARY: Staff is recommending approval of a variance with special conditions and findings. PROJECT DESCRIPTION: The applicant requests approval of a variance to allow for the construction of a sun room, 5 ft. into the required 10 ft. side (southwest) property line setback. The construction of the sun room will involve enclosing an existing 448 sq. ft. deck and installing a new foundation around its perimeter. The sun room enclosure will be 12 ft. 6 inch. high. The proposed sun room will allow for all-weather, handicap accessible use of an existing built-in spa, located on the deck. SETTING: The property is developed with a single family dwelling and septic system. The parcel is 0.41 acres in size, level,with access provided by Short Ave. One single family dwelling is located adjacent to the south. Short Ave. and La Mirada Ave are adjacent to the north and east. A second single family dwelling with swimming pool is developed to the southwest, adjacent to the location of the variance. CEQA ISSUES: This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. ANALYSIS In order to approve a variance, the Planning Commission must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that 0 Butte County Department of Development Services ■ Page 1 ■ cause a variance to County code to be necessary. Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. The size, shape, location and surroundings of the Court property contribute to special circumstances that allow findings to be made to support a variance to County code. The development of a sun room enclosing an existing deck is consistent with the use of residential rear yards, and would not constitute a special privilege not enjoyed by other similar properties. The following sections examine the specific factors allowing for this variance. Development History The dwelling and deck are currently nonconforming to the side setback. The dwelling and deck were approved under appropriate building permits in the 1960's. The zoning at that time allowed for a 5 ft. setback. This zoning was changed in 1984, imposing a 10 ft. setback. The development of improvements on the property took place in accordance with the requirements applicable at the time. The fact that these improvements are nonconforming does not, in itself, constitute a special circumstance upon which the Planning Commission can base an approval. However, the current location of these improvements are contributing factors that limit alternatives for development. Parcel Configuration The Court dwelling is situated on a narrow, corner lot that is further encumbered by the radius of La Mirada Ave.,which makes a 110-degree turn at this location. The property is also developed with a septic system. The location of the septic system, and its replacement area, and the setbacks applicable to both sides of the corner, also limit alternatives for development. The current physical arrangement of the dwelling, deck and the septic system appears to have been chosen due to these factors, and provides the most logical design to allow for a private, rear yard area. . Alternatives The proposed sun room cannot be located any further east from the southwest side property line setback due to the presence of the septic system and dwelling. Development of the sun room on the west side of the dwelling is an alternative,however, this location is already occupied by an attached carport. The side yard setback also presents the same problem at this location, and this site would also require a variance. Development on the dwelling's east side may be feasible,however,this site cannot be characterized as a rear yard given its close proximity to La Mirada Ave. This location may also present a safety hazard, according to the applicant. Conclusion The special circumstances noted in the previous sections allow for the findings necessary to grant this variance and indicate that the adjustment authorized will not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. 0 Butte County Department of Development Services 0 Page 2 0 Conditions ! The Butte County Fire Department indicated that the proposed sun room be improved with fire resistant siding and that the eves be enclosed to increase fire safety. This is a condition of the Variance. RECOMMENDATION: Staff recommends that the Commission make the findings and take'the action listed below to approve Variance 99-01, for Ray & Margrete Court, subject to the special conditions listed in Exhibit "A". I would ask that you and your staff please consider the following additional information in support of our request for an approval of the variance.We feel the following information establishes that special circumstances,with respect to the property and project,are applicable, including size,shape,topography, location and surroundings,and do cause a variance to county code to be an appropriate finding. 1. SIZE: The current Zone,AR-1,was placed on the property in 1984 creating the 10 ft. setback. The former zone was A-2 allowing the 5 ft. setback of the existing permitted deck. A more appropriate zone should have been AR-.5 allowing a 5 ft. setback. This property is only .41 acres and except for a couple other lots, it is surrounded by much larger parcels. If this parcel was larger,say an acre, it would give the owners the flexibility of relocating the proposed structure to a different location. 2. SHAPE- The property is a long narrow lot further restricting any alternative sites for the proposed project. 3. LOCATION: The hot tub and deck,both installed with all appropriate permits, became a non-conforming use due to the rezoning in 1984. The sun room needs to be attached to the house, easily accessible to the living areas. Mr. Court is elderly and handicapped and his medical condition requires daily use of the hot tub. Enclosing it and attaching it to the house is necessary for safe,all weather, handicap accessible, use. Mrs. Court also suffers from arthritis and uses the Jacuzzi daily for relief. The deck or enclosed sun room can't be moved to the east five more feet because it would then encroach on the location of the septic tank and leach field. Detaching it from the house,although not a physically, medically acceptable alternative,depending on location,could interfere witti the 100%leach field reserve area. Changing the location of the sun room/Jacuzzi room to the East side or North side of the house would mean locating it in a very unsafe location fronting a dangerous curve on La Mirada. Just a few weeks ago a young girl lost control of her car in that curve and slammed into 5 large brick pilasters located along the curve on the Courts property causing over$2000.00 in damage to the Courts brick and wood fence. The brick pilasters were put on that curve to stop cars who missed the curve from driving into the house. Based on the above information we find no alternative locations for the proposed project. Approval of the variance will not adversely affect the neighbor to the West. Her property, a similar sized lot, is fully developed with a pool built in her back yard along their common property line. Since a majority of the properties in the area are greater than 1 acre this case is not the norm. Other properties aren't saddled with the same restrictions this property has because, most of the other lots are much larger. We hope this sheds more positive light on this application. The deck was constructed with all appropriate permits. Now the owners wish to put up a perimeter foundation around this existing deck and then enclose it to create a room for the Jacuzzi. The variance is necessitated due to a recent change in the set back requirements. At the time the deck was constructed the set back of 5'from the property line was in force. With the change of the set back to 10', which is the current regulation, the existing deck and any improvements to it, become a nonconforming use. PROJECT DESCRIPTION: The applicant requests approval of a variance to allow for the construction of a sun room, 5 ft. into the required 10 ft. side(southwest)property line setback. The construction of the sun room will involve enclosing an existing 448 sq. ft. deck and installing a new foundation around its perimeter. The sun room enclosure will be 12 ft. 6 inch. high. The proposed sun room will allow for all-weather,handicap accessible use of an existing built-in spa, located on the deck. SETTING: The property is developed with a single family dwelling and septic system. The parcel is 0.41 acres in size,level,with access provided by Short Ave. One single family dwelling is located adjacent to the south. Short Ave. and La Mirada Ave are adjacent to the north and east. A second single family dwelling with swimming pool is developed to the southwest, adjacent to the location of the variance. CEQA ISSUES:This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305(a) - Minor Alterations in Land Use Limitations,,Class 5, of the CEQA Guidelines, exempts variances to setbacks not resulting in the a. creation of any new parcel. ANALYSIS __._.- -- In order to approve a variance,the Planning Commission must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that 0 Butte County Department of Development Services ■ Page I ■ ( cause a variance to County code to be necessary. Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. The size,shape, location and surroundings of the Court property contribute to special circumstances that allow findings to be made to support a variance to County code. The development of a sun room enclosing an existing deck is consistent with the use of residential rear yards, and would not constitute a special privilege not enjoyed by other similar properties. The following sections examine the specific factors allowing for this variance. Development History The dwelling and deck are currently nonconforming to the side setback. The dwelling and deck were approved under appropriate building permits in the 1960's. The zoning at that time allowed for a 5 ft. setback. This zoning was changed in 1484, imposing a 10 ft. -setback. The development of improvements on the property took place in accordance with the requirements applicable at the time. The fact that these improvements are nonconforming does not, in itself, constitute a special circumstance upon which the Planning Commission can base an approval. However, the current location of these improvements are contributing factors that limit alternatives for development. Parcel Configuration The Court dwelling is situated on a narrow, comer lot that is further encumbered by the radius of La Mirada Ave.,which makes a 110-degree turn at this location. The property is also developed with a septic system. The location of the septic system, and its replacement area, and the setbacks applicable to both sides of the corner, also limit alternatives for development. The current physical arrangement of the dwelling, deck and the septic system appears to have been chosen due to these . factors, and provides the most logical design to allow for a private,rear yard area. . Alternatives The proposed sun room cannot be located any further east from the southwest side property line setback due to the presence of the septic system and dwelling. Development of the sun room on the west side of the dwelling is an altemative,however,this location is already occupied by an attached carport. The side yard setback also presents the same problem at this location, and this site would also require a variance. Development on the dwelling's east side may be feasible,however,this site cannot be characterized as a rear yard given its close proximity to La Mirada Ave. This location may also present a safety hazard, according to the applicant. Conclusion The special circumstances noted in the previous sections allow for the findings necessary to grant this variance and indicate that the adjustment authorized will not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. 0 Butte County Department of Development Services 0 Page 2 0 Conditions The Butte County Fire Department indicated that the proposed sun room be improved with fire resistant siding and that the eves be enclosed to increase fire safety. This is a condition of the Variance. RECOMMENDATION: Staff recommends that the Commission make the findings and take'the action listed below to approve Variance 99-01, for Ray & Margrete Court, subject to the special conditions listed in Exhibit "A". FINDINGS Section 1: Environmental Findings. A. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305(a) -Minor Alterations in Land Use Limitations, Class 5, of the CEQA Guidelines exempts variances to set backs not resulting in the creation of any new parcel. Section 2: Variance Findings. A. The existing dwelling and attached deck was legally approved at a 5 ft. setback applicable at the time. 2. The zoning was changed in 1984 which imposed a 10 ft. setback,causing the existing improvements to become non-conforming. 3. The comer location, narrow lot design, and the further encumbrance of the property by the radius of La Mirada Ave. combine to eliminate feasible alternatives for the proposal. 4. The dwelling's location within the existing setback, and proximity of the septic system adjacent to the existing deck, eliminate alternative usable areas for development within the rear yard area of the building site. 5. - The physical arrangement of improvements on the property took place in accordance with the requirements applicable at the time. I would ask that you and your staff please consider the following additional information in support of our request for an approval of the variance.We feel the following Information establishes that special circumstances,with respect to the property and project,are applicable, including size,shape,topography, location and surroundings,and do cause a variance to county code to be an appropriate finding. 1. SIZE: The current Zone,AR-1,was placed on the property in 1984 creating the 10 ft. setback. The former zone was A-2 allowing the 5 ft.setback of the existing permitted deck. A more appropriate zone should have been AR-.5 allowing a 5 ft.setback. This property is only .41 acres and except for a couple other lots, it is surrounded by much larger parcels. If this parcel was larger,say an acre, it would give the owners the flexibility of relocating the proposed structure to a different location. 2. SHAPE: The property is a long narrow lot further restricting any alternative sites for the proposed project. 3. LOCATION: The hot tub and deck,both installed with all appropriate permits, became a non-conforming use due to the rezoning In 1984. The sun room needs to be attached to the house,easily accessible to the living areas. Mr. Court is elderly and handicapped and his medical condition requires daily use of the hot tub. Enclosing it and attaching it to the house Is necessary for safe,all weather, handicap accessible, use. Mrs.Court also suffers from arthritis and uses the Jacuzzi dally for relief. The deck or enclosed sun room can't be moved to the east five more feet because it would then encroach on the location of the septic tank and leach field. Detaching it from the house,although not a physically, medically acceptable alternative,depending on location, could interfere with the 100%leach field reserve area. Changing the location of the sun room I Jacuzzi room to the East side or North side of the house would mean locating it in a very unsafe location fronting a dangerous curve on La Mirada. The existing deck encroaches 5 ft. into the required 10 ft. rear property line setback. The 10 ft. rear setback is applicable in the AR-1 (Agricultural-Residential, 1 acre parcels)Zoning District. In order to approve a variance, staff must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that cause a variance to County code to be necessary. The existing deck is currently non-conforming to the rear setback. It is stated that it was built prior to the setback requirement. The fact that the deck is nonconforming does not constitute a special circumstance upon which the Planning Division can base an approval recommendation to the Planning Commission. It also appears that there is an opportunity to comply with the setback in developing a sun room at a different location. For these reasons staff must inform you that the Planning Division cannot recommend approval of your variance application to the Planning Commission. This does not constitute a denial action, as the Planning Commission has the ultimate discretionary authority in acting upon the variance.
