(SB) (VAR99-02) (VIDEO) Mr. Betts gave a brief summary of the project. A video was shown. He said only the corner is within the setback. Commissioner Cage said she was there yesterday and did not see a problem. Vice Chairman Leland said the question is whether or not there is an adverse effect on the neighbor or neighborhood. Commissioner Cage said this house is on a very short street and she had no objections to approving this request. Mr. Parilo said there has to be a physical reason to grant a Variance. He said this problem is due to past circumstances and not physical characteristics. However, staff is recommending approval finding that it occurred prior to the zoning that created the setback. The hearing was opened to-the public. Al Renville said he was there to answer questions. He said he is trying to correct prior mistakes. The hearing was closed. It was moved by Commissioner Nelson, seconded by Commissioner Mooney, and unanimously carried to approve Variance 99-02 for Al Renville, subject to the findings and conditions as follows: FINDINGS Section 1: Environmental Findings. i A. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305(a) -Minor Alterations in Land Use Limitations, Class 5, of the CEQA Guidelines exempts variances to setbacks not resulting in the creation of any new parcel. Section 2: Variance Findings. A. This Variance may be granted because special circumstances applicable to the property exist, including size, shape,topography, location or surroundings, and the strict application of the setback ordinance would deprive the property owner of privileges enjoyed by other property owners, and.would not constitute a grant of special privileges inconsistent with the limitations placed upon other properties in. the vicinity and under identical zoning classification, as supported by the following facts: 1: The guest house was legally constructed in 1951 which at that time did not require any building setbacks from property lines; and ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ DECEMBER 10, 1998 ■ 2. The zoning was changed to A-2 and then to R-1,both of which required a 5-foot side yard setback, causing the existing improvements to become non-conforming; and 3. The expansion of the guest house in 1991 was outside the 5-foot side yard building setback. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, approve Variance 99-02 for expansion of a guest house located2.5 feet into the required 5 foot side yard setback and 4 feet from the main building. Approval shall be subject to the conditions listed in Exhibit SPECIAL CONDITIONS: 1. The variance is approved for the second dwelling unit to encroach 2.5 feet into the south side yard setback-and 4 feet from the main building, in accordance with the application and plot plan as submitted. 2. Prior to issuance of the Variance do one of the following: A. Obtain a Use Permit to convert the guest house into a second dwelling unit; or B. Remove the kitchen facilities in the guest house under a permit from, or special inspection by, the Building Division.' 3. Butte County Code, -Application for APN: 007-073-015 Variance; 24-120.10-R-1 Site Requirements SUMMARY: Staff is recommending approval of a variance with special conditions and findings. PROJECT DESCRIPTION: The applicant requests approval of a variance to allow an existing second dwelling unit to be located 2.5 ft. into the required 5 ft. side yard property line setback. An expansion of the second dwelling unit occurred in 1991 without benefit of building permits. A variance or a use permit would have been required for the expansion. The proper permits were recently issued for the second dwelling unit expansion,but the Building Department will not conduct a final inspection on the second dwelling unit until a variance has been approved. Numerous building code violations have occurred on the property over the years, although it should be noted that with the exception of the setback violation, all violations have been corrected to the satisfaction of the Building Division. It should be noted that the current owner is not the person responsible for the numerous building code violations and he has diligently worked with the Building Division to correct the violations. The property is developed with a 1,400 sq. ft. single family dwelling, a 500 sq. ft. second dwelling unit, and a septic system. The second dwelling unit is a preexisting use. Access to the site is from Lindo Lane. Single family dwellings are located to the west, south, and north (across Lindo Lane) on parcels averaging 16,000 sq. ft. in size. Cohasset Road is located on the east side of the site. CEQA ISSUES: This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305(a) - Minor Alterations in Land Use 0 Butte County Department of Development Services 0 Page 1 0 Limitations, Class 5, of the CEQA Guidelines, exempts variances to setbacks not resulting in the creation of any new parcel. ANALYSIS: In order to approve a variance,the Planning Commission must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that cause a variance to County code to be necessary. Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. Development History The second dwelling unit is non-conforming with respect to the use and to the side yard setback. Numerous building code violations have occurred on the site,mainly resulting from the unapproved conversion of a breezeway attached to the second dwelling unit to living space in 1991 and the construction of a covered patio. All the unapproved work was performed by previous owners. Except for the issue of the second dwelling unit in the side yard setback, all violations have been corrected. According to the County Assessor's Office,the second dwelling unit was constructed in 1951. At that time there was no zoning in the County and multiple dwelling units could be,placed on one parcel. Additionally, no building setbacks were required at that time. The parcel as zoned A-2 when zoning was implemented in the County and a 5-foot side yard building setback was required. The A-2 zoning was changed in 1980 to R-1,which also required a 5-foot side yard building setback. A variance would not normally be required merely because a preexisting structure is located in a setback. For this project,though,a variance is required because the preexisting second dwelling unit was expanded in 1991 without benefit of building permits. A variance or a use permit would have been required at that time due to the expansion of a non-conforming structure. Because of the expansion, a variance is now being required. The fact that these improvements are nonconforming does not, in itself, constitute a special circumstance upon which the Planning Commission can base an approval. The expansion of the second dwelling unit did not occur within the required 5-foot setback. The expansion consisted of converting a covered breezeway into living space. It should be noted that only a small portion of the second dwelling unit is within the 5-foot setback because the house angles away from the side property line. Had a variance or use permit application been submitted for the expansion of the second dwelling unit in 1991, staff would most likely have recommended approval because the expansion would be outside of the 5-foot setback. The Butte County Environmental Health Department, Public Works Department, and the Fire Department/CDF did not object to the proposed variance and did not recommend any conditions. Conclusion The special circumstances noted in the previous sections allow for the findings necessary to grant this variance and indicate that the adjustment authorized will not constitute a grant of special 0 Butte County Department of Development Services 0 Page 2 0 privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. RECOMMENDATION: Staff recommends that the Commission make the findings and take the action listed below to approve Variance 99-02, subject to the special conditions listed in Exhibit"A." FINDINGS Section 1: Environmental Findings. A. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, Section 15305(a) -Minor Alterations in Land .Use Limitations, Class 5, of the CEQA Guidelines exempts variances to setbacks not resulting in the creation of any new parcel. Section 2: Variance Findings. A. This Variance may be granted because special circumstances applicable to the property exist, including size, shape, topography, location or surroundings, and the strict application of the setback ordinance would deprive the property owner of privileges enjoyed by other property owners, and would not constitute a grant of special privileges inconsistent with the limitations placed upon other properties in the vicinity and under identical zoning classification,as supported by the following facts: 1. The second dwelling unit was legally constructed in 1951 which at that time f did not require any building setback from side yard property lines; and I 2. The zoning was changed to A-2 and then to R-1,both of which required a 5- foot setback,causing the existing improvements to become nonconforming. 3. The expansion of the second dwelling unit in 1991 was outside the 5-foot side yard building setback. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, approve Variance 99-02 for Al Renville, for a preexisting second dwelling unit located 2.5 ft. into the required 5 ft. side yard setback.
