FIND THAT THIS PROJECT IS EXEMPT FROM ENVIRONMENTAL REVIEW PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER SECTION 15061 (b) 3, WHICH STATES THE ACTIVITY IS COVERED BY THE GENERAL RULE THAT CEQA APPLIES ONLY TO PROJECTS WHICH HAVE THE POTENTIAL FOR CAUSING A SIGNIFICANT EFFECT ON THE ENVIRONMENT. WHERE IT CAN BE SEEN WITH CERTAINTY THAT THERE IS NO POSSIBILITY THAT THE ACTIVITY IN QUESTION MAY HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT, THE ACTIVITY IS NOT SUBJECT TO CEQA. THE OFFICIAL ZONING MAPS AND TEXT CHANGES TO THE- ZONING ORDINANCE WILL NOT CAUSE A CHANGE TO ANY ZONING DISTRICT. The Board will consider a transfer from the Public and/or Mental Health Realignment Trust Funds to the Social Services' Realignment Trust Fund for fiscal year 2002-2003 - action requested - ADOPT AND AUTHORIZE THE CHAIR TO SIGN A RESOLUTION AUTHORIZING A TRANSFER OF $1,220,000 FROM THE PUBLIC HEALTH REALIGNMENT TRUST FUND AND $715, 000 FROM THE BEHAVIORAL HEALTH REALIGNMENT TRUST FUND TO THE SOCIAL SERVICES REALIGNMENT TRUST FUND (BUDGET TRANSFER B-449 [4/5 vote required) ) , AND FINDING THAT THE TRANSFER OF COUNTY REALIGNMENT REVENUES IS BASED ON THE MOST COST-EFFECTIVE USE OF AVAILABLE REVENUES TO MAXIMIZE CLIENT OUTCOMES. . r PAGE 30 MAY 13,2003 Butte County Department of Development Services, (Item determined to be a general rule exemption from environmental review),Zoning Code Amendment to approve 31 new Zoning District Maps and amendments to the text of the Zoning Ordinance to incorporate the new Zoning District Maps. Location is County-wide. (SB) (ZCA 02-01) Mr. Betts gave a brief summary and history of the project. He said the 31 zoning maps cover the entire County. .He said the maps will be on the internet. He exhibited a few samples and showed some slides. He changed the first word under Section 24-25 from "Those" to "The." Chairman Lambert requested that "parcel lines" be added to II B for the recommendation to the Board. Commissioner Evans pointed out that the parcel lines will be changing frequently. Mr. Betts said that parcel lines could be added. Commissioner Leland suggested that "parcel lines" be added under II D as an orientation feature. Commissioner Evans said that by having copies at the office, the maps on CDs, a CD at the copy store in Chico, and the maps on the internet, that this was a good step forward. It was moved by Commissioner Evans,seconded by Commissioner Leland,and unanimously carried to recommend approval to the Board of Supervisors for ZCA 02-01, DDS, to approve 31 new Zoning District Maps and amendments to the text of the Zoning Ordinance to incorporate the new Zoning District Maps County-wide adding "parcel lines" to II D as follows: I. Recommend to the Board of Supervisors that they find that this project is exempt from ' environmental review pursuant to the California Environmental Quality Act(CEQA)under Section 15061 (b) 3 of CEQA, which states the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where'it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The official zoning maps and text changes to the Zoning Ordinance will not cause a change to any zoning district. Additionally,the official zoning maps and the text amendments to the Zoning Code will not cause any physical changes to the environment. The maps and text amendment to the Zoning Code,because of the reasons stated above,will not have the potential for causing environmental impacts. II. Recommend to the Board of Supervisors that they adopt the 31 official zoning district maps, subject to the following findings: A. The maps do not change the boundaries of any existing zoning district. B. The maps accurately reflect the existing zoning districts and overlay zones in the County. C. The maps show orientation features, such as roads, road easements, lakes, parcel. -lines, and waterways that help to identify the location of a parcel. III. Recommend to the Board of Supervisors approval of an Ordinance amending the text of Section 24-25 of the Butte County Code, subject to the following findings: - A. The text amendments are necessary to reflect adoption of the 31 zoning district maps. B. The text amendment allows the director of development services to administratively change the zoning maps to reflect changes in lot lines, roads, road easements, and other orientation features, so as to keep the maps current. ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 24 OF THE BUTTE COUNTY CODE The Board of Supervisors of the County of Butte, State of California,ORDAINS,as follows: SECTION 1. Section 24-25 of the Butte County Code is hereby amended to read as follows: 24-25 Adoption of zoning district map. Those set of maps entitled "Butte County Zoning District Map", together with all legends, symbols, notations, references, zoning district boundaries, map symbols, and other information on the maps, subscribed by the director of development services, on file in the development services department, planning division, together with any amendments previously or hereafter adopted,are hereby adopted as the zoning plan of Butte County and made a part of this chapter. SECTION 2. Section 24-25.05 of the Butte County Code is hereby added in its entirety to read as follows: 24-25.05 Changes to the zoning map. t (a) Changes in the boundaries of the zone districts shall be made by ordinance pursuant to section 24-25.20 of this chapter, and shall be reflected on the official Zoning District Maps. (b). The boundaries of each zoning district as referred to in this chapter are delineated on the zoning district maps by red lines. Within each district so delineated appear symbols consisting of letters and numbers. PROJECT DESCRIPTION: The Department of Development Services has created a set of 31 zoning district maps that ' encompass the complete County. In addition to showing the zoning district boundaries,the maps show overlay zones, parcel lines, roadways, road easements, lakes, rivers, streams, and township and range section lines. Most of the maps cover approximately 36 square miles at a scale of I inch equals 2,000 feet. The zoning maps for the urban areas of Oroville, Paradise, and parts of Chico are at a smaller scale - 1 inch equals 1,000 feet. Portions of the Chico area are further shown at even a smaller scale — 1 inch equals 500 feet— in order to clearly show the parcels and zones in this dense urban area. Each map is numbered and named, and has an index showing .where,that map is located in the County. Each map also contains a legend, north arrow, and a written and graphic scale. The maps are all 34"by 44" in size. The zoning district maps were created using the .Department of Development Service's geographic information system (GIS). Changes to the maps would be accomplished using the GIS,which will allow the maps to be easily kept current. GIS staff would update the digital map files as changes to zoning districts or orientation features occur, and would then print the revised map. Each map has an "Effective Date" which would reflect the date the map was last updated. The text amendments reflect that the zoning districts are defined by a red line, and that the Director of Development Services can administratively modify the maps to reflect changes in lot lines, roads, road easements, and other orientation features. 'Changes to zoning district boundaries on the maps would only be accomplished under approval of an approved zoning ordinance. PLANNING COMMISSON ACTION: On March 27, 2003, the Butte County Planning Commission held a public hearing on the adoption of the proposed maps and proposed changes to the Zoning Ordinance. The Planning Commission was very much in favor of the maps and voted unanimously to recommend approval of the maps and the Zoning Ordinance text changes. There was no public opposition to the maps or the text changes. ANALYSIS: Adoption of the new zoning district maps will greatly help County staff and the public' to determine the zoning of parcels. Currently, the Department of Development Services staff utilizes the GIS to show the zoning districts. The County stopped maintaining official paper maps of the zoning districts in 1994 when the geographical information system started to be utilized. There are currently no up-to-date official paper maps that show the zoning districts in the County. The Planning Division would maintain a paper copy of the official zoning maps, which would be available to the public for review. Due to the time and expense of providing paper copies of the Zoning District Maps to the public, the GIS digital map files would be converted to a PDF format, which can be read by Adobe Acrobat, and placed on a CD. The CD could be purchased by the public. For anyone desiring a paper copy of a map(s), the CD could be taken to a copy business capable of printing large maps. Another possibility would be to provide the CD to several copy businesses, which could then print maps upon request. Additionally; the Planning Division intends to place the official zoning maps on their web page in PDF format. This way, anyone with internet access could view or download the desired map(s). It is anticipated that doing this will allow the public better access to the Zoning Maps and would also save staff time. ZONING CODE TEXT AMENDMENTS: Changes to the Zoning Ordinance would be required to reflect adoption of the proposed 31 official zoning maps. PROJECT DESCRIPTION: The Department of Development Services has created a set of 31 zoning district maps that encompass the complete County. In addition to showing the zoning district boundaries, the maps show overlay zones, parcel lines, roadways, road easements, lakes, rivers, streams, and township and range section lines. Most of the maps cover approximately 36 square miles at a scale of 1 inch equals 2,000 feet. The zoning maps for the urban areas of Oroville, Paradise, and parts of Chico are at a smaller scale - 1 inch equals 1,000 feet. Portions of the Chico area are further shown at even a smaller scale — 1 inch equals 500 feet— in order to clearly show the parcels and zones in this dense urban area. Each map is numbered and named, and has an index showing where that map is located in the County. Each map also contains a legend, north arrow, and a written and graphic scale. The maps are all 34"by 44" in size. The zoning district maps were created using the Department of Development Service's geographic information system (GIS). Changes to the maps would be accomplished using the GIS, which will allow the maps to be easily kept current. GIS staff would update the digital map files as changes to zoning districts or orientation features occur, and would then print the revised' map. Each map has an "Effective Date" which would reflect the last date the map was updated. The text amendments reflect that the zoning districts are defined by a red line, and that the Director of Development Services can administratively modify the maps to reflect changes in lot lines, roads, road easements, and other orientation features. Changes to zoning district boundaries on the maps would only be accomplished under approval of an approved zoning ordinance. ANALYSIS: -Adoption of the new zoning district maps will greatly help County staff and the public to determine the zoning of parcels. Currently, the Department of Development Services staff utilizes the GIS to show the zoning districts. The County stopped maintaining official paper maps of the zoning districts in 1994 when the geographical information system started to be utilized. There are currently no up-to-date official paper maps that show the zoning districts in the County. The Planning Division would maintain a paper copy of the official zoning maps, which would be available to the public for review. Due to the time and expense of providing paper color copies of the Zoning District Maps to the public, the GIS digital map files could be converted to a PDF format, which can be read by Adobe Acrobat, and placed on a CD. The CD could be purchased by the public. For anyone desiring a paper copy of a map(s), the CD could be taken to a copy business capable of printing large maps. Another possibility would be to provide the CD to several copy businesses, which could then print maps upon request. The Planning Division intends to place the official zoning maps on their web page in PDF format upon adoption of the maps. ZONING CODE TEXT AMENDMENTS: Changes to the Zoning Ordinance would be required to reflect adoption of the proposed 31 official zoning maps. You had indicated that the Butte County Zoning ordinance specified that the zoning ` labeling might appear in decimal format rather than in fractional format, which is how I labeled the zoning; e.g. "A-R 2.5"versus current"A-R 2'/z ". After reviewing the ordinance and speaking to Meleka and Larry Painter, it was agreed that the present, labeling system seems to satisfy the ordinance per Article III of the ordinance(III- 1,2,3). 2. ZDM-3. A. You indicated that parcels representing railroads should be labeled "Union Pacific Railroad". However, I had a question as to ownership, i.e. whether these parcels were to be labeled"Southern Pacific Railroad" or"Union Pacific Railroad". After asking Public Works, it was indicated that the railways should be labeled"Union Pacific Railroad". B. Your notation indicates that was some question about parcels located along the Sacramento River as being zoned"A-5". I queried these two zoning areas. The 169 acre stretch along the river was designated"A-5" on 10/07/75 per ordinance 1629..The 6.60 acre parcel further inland was also designated "A-5".on 10/07/75 per ordinance 1629. 3. ZDM-7. 'A. This Zoning District also has a parcel labeled"Union Pacific Railroad". B. This Zoning district also has a 191 acre sliver of land located along the Sacramento River designated"A-5". It was decided that in certain large areas of land the font symbol representing the zoning in these areas would be a size 36 Bold Times New Roman versus the standard 24 Bold Times New Roman. Your notes indicate a concern about the easements representing the powerlines; that reasons for these easements might be misrepresented. Your note on this ZDM indicate that you thought it might be a good idea to indicate where the Oroville Municipal Airport was located. Meleka indicated that all of the Airports in Butte County should be labeled at their locations. No new shapefiles or legend symbols would be needed. 8. ZDM-14D. A. You notes indicate a question as to the"H-C"zoning found on the Mooretown Rancheria. Meleka indicated that Randy should be approached to-ask his opinion:about this zoning designation on trust lands. Your query seems to indicate the question as to why these adjacent areas are not dissolved together into one zoning area. There has been some question (coming from Jim in GIS)as to whether we need to print out a copy of the maps, instead just keeping them on the GIS and printing out a map on demand. I believe that we need to keep an offical paper copy of each map available. You may want to check with Yvonne on this.
