Changes are proposed adjusting the Attachments: fees in accordance with the Engineering A. Location: This amendment would be applicable to the area encompassed by the North Chico Specific Plan EXECUTIVE SUMMARY: This is a proposed amendment to Butte County Code Section 3-164 and Section 3-165 concerning development impact fees in the North Chico Specific Plan area. Butte County Code Section 3-165 allows for an adjustment of the development impact fees for the North Chico Specific Plan. 2. It is required that this adjustment correspond to an amount equaling the net percentage increase or decrease in the Engineering News Record Construction Cost Index for San Francisco (ENR CCI). 3. The Department of Public Works has applied this index to the current fees. 4. The Department of Public Works has established that increases to all of the impact fees shown in the North Chico Specific Plan Development Impact Fee Table are warranted. 5. The previous table and the corrected table are shown in the attached amended ordinance. 6. The language in Section 3-165 has been amended to be consistent with the current adjustment language used in other fee ordinances. 7. The Department of Public Works notes that actual material costs for road and bridge construction show an increase of about 12 percent, significantly greater than the ENR CCI increase of 6.6 percent. 8. Public Works recommends that the Development Impact Fees for road and bridges be adjusted in the future to reflect current construction costs. 9. At this time, the new ordinance only reflects the ENR CCI increase. ACTIONS FOR CONSIDERATION: Staff recommends that the Board of Supervisors take the following actions: I. Amendment to Section 3-164 of Article XVII of the Butte County Code. Section 3-164 of the Butte County Code is amended as follows: Section 3-164 Amount of fees. From time to time,the Director of Development Services may submit documentation substantiating that there has been an increase in the cost of the acquisition and development of public trail, road and bridge, storm drainage, fire station, and park facilities within the North Chico Specific Plan, and requesting an increase in said fees assessed and levied pursuant to the provisions of this article. The board of supervisors may increase such fees, in an amount proportional to the increase in such costs. The determination of whether there has been an increase in the cost of acquiring and/or developing such facilities as stated above and the amount of the increase in the aforementioned impact fees which is proportional to the increase in such costs shall be made by the board of supervisors based on the following: The net percentage increase in the Engineering News Record Construction Cost Index for San Francisco (using the CCI Column of the "ENR City Cost Index-San Francisco")(based on 1913 U.S. average=100)as last published in the Engineering News Record McGraw Hill Construction Weekly (or on the Internet) between the date of such increase and the effective date of this section or any prior increase in the above-mentioned fees made pursuant to the provisions I of this section. The formula for adjusting the fees is: (New index amount/amount of index at time of existing fee) x existing fee = new fee. SECTION 3. Severability If any provision of this Ordinance or the application thereof to any person or circumstances is for any reason held to be invalid by a court of competent jurisdiction, such provision shall be deemed severable, and the invalidity thereof shall not affect the remaining provisions or other applications of the Ordinance which can be given effect without the invalid provision or application thereof. Section 4. Effective Date and Publication. This Ordinance shall take effect sixty(60)days after date of its passage. The Clerk J of the Board of Supervisors is authorized and directed to publish this ordinance before the expiration of fifteen (15) days after its passage. OF DEVELOPMENT SERVICES FROM: STUART EDELL,MANAGER,LAND DEVELOPMENT DIVISION S� PUBLIC WORKS SUBJECT: NORTH CHICO SPECIFIC PLAN IMPACT FEES, CCI ADJUSTMENT DATE: OCTOBER 28, 2004 The North Chico Specific Plan Impact Fees as defined in Butte County Code (BCC) §3-164 are anticipated to be adjusted by changes in the Engineering News Record (ENR) Construction Cost Index (CCI) as noted in BCC §3-165. The.CCI for march 2002, when these fees were originally adopted was 7683.68. The CCI for October 2004 is 8194.52. The fee adjustment formula is 8194.52/7683.68 X existing fee=new fee or 1.066484 X existing fee=new fee (approximately a 6.6% increase over the existing fee). In the review and updating of these fees the Department of Public Works has reviewed the construction cost estimates for road and bridge construction and determined that there were significant changes in the unit prices for construction materials including: steel, concrete, asphalt concrete, aggregate base, oil products and drainage facilities. These increases in unit prices averaged about 12%, significantly greater than the CCI increase calculated above. Our construction cost estimates were revised to reflect current construction prices and adjust costs for facilities already constructed. The construction cost estimates include: • New bridges on Kitty Hawk at Mud Creek and Hicks Lane at Keefer Slough; • New traffic signals at Highway 99 and Keefer Road and Highway 99 and Kitty Hawk; Kitty Hawk between Highway 99 and Hicks Lane; • Hicks Lane from the City airport property to Keefer Road and • Garner Lane areas that have not been reconstructed by subdivisions. It is recommended that the proposed impact fees for Road and Bridges be adjusted in the future to reflect, as a minimum the current construction cost. The Department of Public Works has applied this index to the current fees. 4. The Department of Public Works has established that increases to all of the impact fees shown in the North Chico Specific Plan Development Impact Fee Table are warranted. 5. The previous table and the corrected table are shown in the attached amended ordinance. 6. The language in Section 3-165 has been amended to be consistent with the current adjustment language used in other fee ordinances. 7. The Department of Public Works notes that actual material costs for road and bridge construction show an increase of about 12 percent, significantly greater than the ENR CCI increase of 6.6 percent. 8. Public Works recommends that the Development Impact Fees for road and bridges be adjusted in the future to reflect current construction costs. 9. The CCI for march 2002, when these fees were originally adopted was 7683.68. The CCI for October 2004 is 8194.52. The fee adjustment formula is 8194.52/7683.68 X existing fee=new fee or 1.066484 X existing fee=new fee (approximately a 6.6% increase over the existing fee). In the review and updating of these fees the Department of Public Works has reviewed the construction cost estimates for road and bridge construction and determined that there were significant changes in the unit prices for construction materials including: steel, concrete, asphalt concrete, aggregate base, oil products and drainage facilities. These increases in unit prices averaged about 12%, significantly greater than the CCI increase calculated above. Our construction cost estimates were revised to reflect current construction prices and adjust costs for facilities already constructed. The construction cost estimates include: • New bridges on Kitty Hawk at Mud Creek and Hicks Lane at Keefer Slough; • New traffic signals at Highway 99 and Keefer Road and Highway 99 and Kitty Hawk; Kitty Hawk between Highway 99 and Hicks Lane; • Hicks Lane from the City airport property to Keefer Road and • Garner Lane areas that have not been reconstructed by subdivisions. It is recommended that the proposed impact fees for Road and Bridges be adjusted in the future to reflect, as a minimum the current construction cost. The board of supervisors may increase such fees, in an amount proportional to the increase in such costs. Severability If any provision of this Ordinance or the application thereof to any person or circumstances is for any reason held to be invalid by a court of competent jurisdiction, such provision shall be deemed severable, and-the invalidity thereof shall not affect the remaining provisions or other applications of the Ordinance which can be given effect without the invalid provision or application thereof. Section 4. Effective Date and Publication. This Ordinance shall take effect sixty(60)days after date of its passage. OF DEVELOPMENT SERVICES FROM: STUART EDELL, MANAGER,LAND DEVELOPMENT DIVISION S� PUBLIC WORKS SUBJECT: NORTH CHICO SPECIFIC PLAN IMPACT FEES, CCI ADJUSTMENT DATE: OCTOBER 28, 2004 The North Chico Specific Plan Impact Fees as defined in Butte County Code (BCC) §3-164 are anticipated to be adjusted by changes in the Engineering News Record (ENR) Construction Cost Index (CCI) as noted in BCC §3-165. The CCI for march 2002, when these fees were originally adopted was 7683.68. The CCI for October 2004 is 8194.52. The fee adjustment formula is 8194.52/7683.68 X existing fee=new fee or 1.066484 X existing fee=new fee (approximately a 6.6% increase over the existing fee). In the review and updating of these fees the Department of Public Works has reviewed the construction cost estimates for road and bridge construction and determined that there were significant changes in the unit prices for construction materials including: steel, concrete, asphalt concrete, aggregate base, oil products and drainage facilities. These increases in unit prices averaged about 12%, significantly greater than the CCI increase calculated above. Our construction cost estimates were revised to reflect current construction prices and adjust costs for facilities already constructed. The construction cost estimates include: • New bridges on Kitty Hawk at Mud Creek and Hicks Lane at Keefer Slough; • New traffic signals at Highway 99 and Keefer Road and Highway 99 and Kitty Hawk; Kitty Hawk between Highway 99 and Hicks Lane; • Hicks Lane from the City airport property to Keefer Road and • Garner Lane areas that have not been reconstructed by subdivisions. It is recommended that the proposed impact fees for Road and Bridges be adjusted in the future to reflect, as a minimum the current construction cost.
