3. It is very important that the application'include an accurate and complete description of the -
property proposed for each requested zone.The applicant will not be processed until we receive
the following information about area(s)to be rezoned:
a.Assessor's parcel number(s)from the tax bills or Assessor's Map.
b.Street addresses(if available).
c.Distances and directions to named streets,bodies of water or railroads.
d. Legal description (subdivision lot numbers, fractions of sections or distances and bearings of
perimeter dimensions).

4. California Government Code Section 65300 et seq. requires local zoning ordinances to be
consistent with a jurisdiction's adopted general plan. County approval of a rezoning request

Amendment.
5. The Application for Rezoning is subject to public hearings and approval by both the Planning

Permit and_.Code Enforcement

On January 23 , 1991 , Bettye Kircher and I met with
Supervisor McLaughlin to discuss potent ia-l-amendments--to---Chapter
13 of the Butte County Code pertaining to surface mining and to
Chapter 24 pertaining to zoning.
Regarding surface mining Supervisor McLaughlin appears to
favor, and Bettye does not object, to amendments to Chapter 13 to
shift the permit processing responsibility and enforcement to the
Planning Department. This is logical since, as a practical
matter, the Planning Department is now involved in the processing
of the applications and since the applications are heard by the
Planning Commission. If the shift is made it would be understood

verify compliance with mining permits and reclamation plans. The
filing fees should also be increased. These subjects were
discussed generally by the Board of Supervisors on January 29,
1991. (agenda item 4.06) ; however, the direction to staff was to
work with Supervisor McLaughlin to recommend to the Board any
necessary Butte County Code amendments for two purposes:
1) Make sure code enforcement officers have authority under
Department direction to monitor permit condition compliance and
2) Make sure permit condition violations can be cited as
code violations as an alternative to permit revocation
proceedings.
Supervisor McLaughlin is also interested in a response being
made to Planning Commissioner Lynch' s proposal pertaining to
illegal land use. This issue was not discussed by the Board on
1/29/91 . I will meet with Bettye to discuss it further after she
has returned from an upcoming meeting of Planning Directors.
Alternative ideas include the following:
1) Allow an amnesty period for violators to come in and
apply for all necessary permits, rezones, general plan changes ,
etc. necessary to make an existing use legal.

procedure which would include conditions of approval which would
make the uses .more acceptable in their respective neighborhoods.
The amnesty concept contemplates that people who do not
apply and do not get their use made legitimate will be regarded
as violators against whom action can be taken (even if they have
been in business for a considerable period of time , have
employees , have not been subject to complaints in the
neighborhood, etc. ) . To do otherwise would be to jeopardize our
Code Enforcement System.

PROPOSAL FOR SPECIAL LIMITED USE PERMIT
This is a permit that might be available for those uses that
have developed over the years since zoning was established but
- before the recently passed Zoning Enforcement Ordinance.
A legitimate pre-existing nonconforming use will have legal
documentation relative to its beginnings and its continuing
operations. This documentation will include tax returns, Board
of Equalization documents, appropriate licenses or permits, etc.
For operations that cannot meet the above conditions and are
not of a nature that would be permitted or conditional uses in
their respective zones, this special limited use permit would be
available. It would be a last resort before moving the operation
to an appropriate zone or shutting down.
This Limited Use Permit would require:
1 . All buildings would be required to meet code appropriate to
use. A building permit would be requi.red for existing
buildings, certificates of occupancy would have to be obtained
within the prescribed time limits.
2. Approaches and encorachments onto public roads would be required
to have permits and meet requirements of Public Works.
3. Parking, landscaping, setbacks must be according to plans
approved by Planning.
4. Water and sanitation facilities must meet the requirements
of Environmental Health.
In addition to the above there should be specific limitations
placed on these permits.
A. Permit does not go with the land, but permitee must have
landowner's consent and agreement with conditions.
B. Permit is for original .permitee and cannot be sold, granted
or inherited.
C. Operations allowed under permit cannot be .expanded.
D. Permit expires if. use is abandoned for more than one year.,
orupon change of ownership of property.
If land is rezoned so that use becomes permitted or conditional ,
special limitations may be removed.. ...-
