Zoning Code Amendment/Rezone - Department Development Services - (Item determined
to be a General Rule Exemption from environmental review) A County wide rezone/code
amendment changing the zoning designation on all parcels currently zoned: ARMH,ARMH-
1,ARMH-2.5,ARMH-3,and ARMH-5 (Agricultural Residential Mobile Home 1,2.5, 3,and
5 acre parcels)to AR,AR-1,AR2.5,AR2.5,and AR-5 (Agricultural Residential,Agricultural
Residential 1, 2.5, and 5 acre parcels)respectively and eliminating Sections 24-100 and 24-
100.10 from the Butte County Code. (CS) (ZCA 98-02)
Mr. Sanders said this is a cleanup ordinance of the ordinance approved in 1997 eliminating pre-
approved HUD mobiles in all zones allowing mobiles. The AR-MH and A-R zones are identical and
redundant. The AR-MH zone is no longer need.
It-was moved by Commissioner Mooney,seconded by Chairman Lambert,and carried to recommend
approval as follows:
FINDINGS:
Section 1: Environmental Findings.
A. Find that the project is not subject to environmental review under CEQA as per the general
rule exemption; and
Section 2: Zoning Ordinance Findings.
A. The proposed changes to the Butte County Code are consistent with the Butte County
General Plan; and
Section 3: Action
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to recommend that
the Board of Supervisors adopt an ordinance rezoning all properties currently zoned AR-MH
to A-R, all properties currently zoned AR-MH-01 to AR-1, all properties currently zoned
AR-MH-2.5 to AR-2.5, all properties currently zoned AR-MH-3 to AR-2.5, and all
properties currently zoned AR-MH-5 to AR-5; and eliminate Sections 24-100 and 24-100.10
from Chapter 24 of the Butte County Code.

AN ORDINANCE AMENDING CHAPTER 24 OF THE BUTTE
COUNTY CODE
The Board of Supervisors of the County of Butte, State of California,

2 under and pursuant to Section 24-25.40 of the Butte County Code of said County,
3 ORDAINS, as follows:
4 SECTION 1. All parcels of land situated in the unincorporated area
5 of Butte County and currently zoned ARMH -Agricultural Residential Mobile Home,
6 shall be rezoned to AR -Agricultural Residential; All parcels of land currently zoned
7
ARMHA -(Agricultural Residential Mobile Home-1 acre minimum), shall be rezoned
8
9 to AR-1 - (Agricultural Residential-1 acre minimum); All parcels of land currently
10 zoned ARMH-2.5 -Agricultural Residential Mobile Home 2.5 acre minimum, shall
11 be rezoned to AR-2.5 (Agricultural Residential-2.5 acre minimum); All parcels of
12 land currently zoned ARMH-3 - (Agricultural Residential Mobile Home-3 acre

County wide rezone/code amendment changing the zoning designation on all
parcels currently zoned: ARMH, ARMH-1, ARMH-2.5, ARMH-3, and ARMH-5
to AR, AR-1,AR-2.5,AR-2.5,and AR-5 respectively and eliminating Sections 24-
100 and 24-100.10 from the Butte County Code.

FOR: Board of Supervisors Meeting of April 14, 1998
SUMMARY: This is a clean-up action to the 1997 code amendment that eliminated the new installation
of non-HUD mobile homes in Butte County. At their February 26, 1998, meeting the Planning
Commission heard this item and recommended that the Board approve this code amendment.
DISCUSSION: On February 1, 1997 the Butte County Board of Supervisors adopted Ordinance Number
3321, eliminating the placement of non-HUD mobile homes in several zoning districts throughout the
County. This had the effect of making five zoning districts identical to other existing zoning districts. In
particular,the uses stipulated in the ARMH zone became identical to the uses stipulated in the AR zone.
The same occurred for the ARMH-1 and AR-1 zones, ARMH-2.5 and AR-2.5, and ARMH-5 and AR-5
zones. The ARMH-3 zone had no identical counterpart with respect to minimum parcel size. The
recommendation is to rezone those parcels to the closest zone, which is AR-2.5. The.uses will remain the
same.
The effect of this action will be to eliminate Section 24-100 and 24-100.10 from the Butte County Code
Attached are copies of both the ARMH zone districts and AR zone districts for comparison.
ENVIRONMENTAL DOCUMENTATION: This project is exempt from CEQA review under section
15061 (3), the general rule exemption, which states:
"CEQA applies only to projects which have the potential for causing a significant effect on the
environment. Where it can be seen with certainty that there is no possibility that the activity in
question may have a significant effect on the environment, the activity is not subject to CEQA."

RECOMMENDATION: Recommend that the Board of Supervisors adopt an ordinance rezoning all
properties in unincorporated Butte County from ARMH to AR; from ARMH-1 to AR-1; from ARMH-

SUMMARY: This is a clean-up action to the 1997 code amendment that eliminated the new installation
of non-HUD mobile homes in Butte County. Staff recommends approval of this request.
DISCUSSION: On February 1, 1997 the Butte County'Board of Supervisors adopted Ordinance Number
3321, eliminating the placement of non-HUD mobile homes in several zoning districts throughout the
County. This had the effect of making five zoning districts identical to other existing zones. In particular,
the uses stipulated in the ARMH zone became identical to the uses stipulated in the AR zone. The same
occurred for the ARMH-1 and AR zones, ARMH-2.5 and AR-2.5, and ARMH-5 and AR-5 zones. The
ARMH-3 zone had no identical counterpart with respect to minimum parcel size. The recommendation
is to rezone those parcels to the closest zone, which is AR-2.5. The uses will remain the same.
The effect of this action will be to eliminate Section 24-100 and 24-100.10 from the Butte County Code
Attached are copies of both the ARMH zone districts and AR zone districts for comparison.
ENVIRONMENTAL DOCUMENTATION: This project is exempt from CEQA review under section
15061 (3), the general rule exemption, which states:
"CEQA applies only to projects which have the potential for causing a significant effect on the
environment. Where it can be seen with certainty that there is no possibility that the activity in
question may have a significant effect on the environment, the activity is not subject to CEQA."

3. Agricultural uses,including the keeping of animals,subject to the animal maintenance requirements of

C. Uses requiring Use Permits: The following uses are permitted subject to a Use Permit:
1. Duplex dwellings,multiple residences,and multiple-family dwellings subject to the density allowed by the
General Plan,and Bed and Breakfast Inns.
2. Golf courses,country clubs,including, but not limited to, accessory uses such as driving range, pro shop,
cocktail bar,restaurant.
3. Public and quasi-public uses.
4. Commercial poultry farming and livestock farming, nurseries and plant gardens.
5. Veterinary clinics, kennels.
6. Sales tract office.
7. : Mobile home parks subject to the density of the General Plan in the ARMH,ARMH-1 zones only.
D. Uses requiring a Minor Use Permit: The following uses may be permitted subject to the requirements of Section
24-41:
1. Large family day care facilities subject to the requirements of Section 24-265.
2. Second dwelling unit subject to the requirements of Section 24-280.
